CITY OF GROVER BEACH

POLICIES AND PROCEDURES FOR CONDUCT AND DECORUM AT COUNCIL MEETINGS (Pursuant to Resolution No. 07-44, adopted 04-16-07, revised 02-18-2020) The City Council and staff welcomes and encourages civic participation and debate on issues. The Council values the public’s opinion and in every Council meeting invite and encourages the public to address the Council on any matter of interest. The Council adopted these policies and procedures for appropriate conduct and decorum at Council meetings and establish guidance for public participation during Council meetings.

These policies will foster and provide greater clarity to preserve the intent of open government and maintain a positive environment for public input and City Council decision-making.

1.0 DECORUM AND ORDER – IN GENERAL

1.1 The presiding officer is responsible for the maintenance of order and decorum at all times.

1.2 The presiding officer shall determine all points of order subject to the right of any Council member to appeal to the City Council by majority vote. If any appeal is taken, the question shall be “Shall the decision of the presiding officer be sustained” in which event a majority vote of the Council shall govern and conclusively determine such question of order.

1.3 All Council members, staff members and members of the public should speak respectfully and avoid the use of profanity, vulgarity and slanderous comments. Recognizing that the First Amendment precludes the City Council form prohibiting speakers from speaking based upon the content of their speech, the presiding officer shall use their best efforts, short of enforcement action, to remind and encourage all participating in the meeting to keep their speech respectful towards others and within bounds appropriate for children and persons of sensitivity toward course language as a courtesy to others present or otherwise viewing Council meetings.

2.0 DECORUM AND ORDER – COUNCIL MEMBERS

2.1 Manner of Speaking.

Any Council member desiring to speak shall first address the presiding officer. Upon recognition by the presiding officer, the Council member shall speak only to the question under debate.

U2.1(a) Questioning Staff.

A Council member desiring to question the staff should address his question to the City Manager, or, in appropriate cases, the City Clerk or City Attorney, who shall be entitled either to answer the inquiry or to designate some staff member for that purpose. Such a designation may be made at the time of any staff presentation or on the agenda listing for the item.

U2.1(b) Interruptions.

Once recognized, a Council member shall not be interrupted while speaking unless called to order by the presiding officer; unless a point of order is raised by another Council member, or unless the speaker chooses to yield to questions from another Council member.

3.0 DECORUM AND ORDER – STAFF

3.1 City Manager Responsibilities
The City Manager is responsible for ensuring that members of the administrative staff observe the rules of decorum and order set forth in this Policy.

3.2 AAddressing the City Council
Any administrative staff member desiring to address the City Council or members of the public shall first be recognized by the presiding officer. All remarks shall be addressed to the presiding officer and not to any individual Council Member or member of the public. Administrative staff members shall accord the utmost courtesy to the City Council, other administrative staff members and the public.

4.0 DECORUM AND ORDER – MEMBERS OF THE PUBLIC

4.1 AAddressing the City Council
Any member of the public desiring to address the City Council or members of the public shall first be recognized by the presiding officer at the appropriate place on the agenda. All remarks shall be addressed to the presiding officer and not to any individual Council Member, City Manager, City Attorney or member of the administrative staff or member of the public.

4.2 Time Limitation for Addressing the City Council
Public comment when addressing the City Council shall be generally limited to three (3) minutes per speaker. Depending on the extent of the agenda and the number of persons desiring to speak on an issue, the presiding officer may, at the beginning of the hearing, set a different time limit for each speaker. Any person may speak for a longer period of time upon approval from the presiding officer, when deemed necessary, for instance when a person is speaking on behalf of a group or has a graphic or slide presentation requiring more time.

4.3 Failure to Yield, Disruptions
Any person who refuses to relinquish the floor after their allotted time or while attending the City Council meeting engages in conduct or speech which disrupts the business of the meeting shall be brought to order and/or removed from the room if the sergeant-at-arms is so directed by the presiding officer.

Disruptive remarks from the audience, stamping of feet, clapping, whistles, yells and similar demonstrations shall not be permitted by the presiding officer who may direct the sergeant-at-arms to remove such offenders from the room.

4.4 Prosecution
Aggravated cases shall be prosecuted on appropriate complaint signed by the presiding officer.

5.0 ENFORCEMENT OF DECORUM

5.1 The Chief of Police or his designee shall be the ex-officio sergeant-at-arms of the City Council. The sergeant-at-arms shall carry out all legal and valid orders and instructions given by the presiding officer for the purpose of maintaining order and decorum in the Council Chamber. Upon instructions from the presiding officer, it shall be the duty of the sergeant-at-arms to remove any disorderly person from the Council Chambers or place the disorderly person under arrest or both.

5.2 As set forth in Government Code Section 54957.9, in the event that any meeting is willfully interrupted by a person or group of persons so as to render the orderly conduct of such meeting unfeasible or impedes the ability of the Council to hold the meeting, and order cannot be restored by the removal of individuals who are willfully interrupting the meeting, the presiding officer may order the meeting room cleared and continue in session. Only matters appearing on the agenda may be considered in such a session. Duly accredited representatives of the press or other news media, except those participating in the disturbance, shall be allowed to attend any session held pursuant to this Section. Nothing in this Section shall prohibit the City Council from establishing a procedure for readmitting an individual or individuals not responsible for willfully disturbing the orderly conduct of the meeting.

Agenda Item No. 5

CITY COUNCIL STAFF REPORT
TO: Honorable Mayor and City Council DATE: July 25, 2022 FROM: Matthew Bronson, City Manager
PREPARED BY: Karla Mattocks, Human Resources / Management Analyst John Peters, Chief of Police
SUBJECT: Police Department Conversion of Full-Time Records/Property Technician Position to One Full-Time and One Part-Time Community Services Technician I Positions

RECOMMENDATION
Adopt the Resolution authorizing the Police Department to convert one Full-Time Records/Property Technician position into one Full-Time and one Part-Time Community Services Technician I positions.

BACKGROUND
On September 21, 2020, the Council authorized the creation of the Community Services Technician I/II (CST) position within the Police Department. The CST position is a non-sworn position that handles non-emergency calls for service in the city. Typical non-emergency calls for service that a non-sworn Community Services Technician handles include:

Parking Violations Abandoned Vehicles / 72 Hour Violations Lost/Found Property Graffiti Reports
Minor Vandalism Reports Petty Theft Reports
Fingerprinting Vacation / Extra Patrol Checks
Code Compliance Investigations Sex Offender Registrations Homeless Outreach Administrative Tasks
The September 21, 2020, staff report estimated that the CST position could handle approximately 1,200 calls for service for patrol officers. However, in 2021, the CST handled 1,669 calls for service for the Patrol Division, which was much more than anticipated and allowed patrol officers to concentrate on crime calls for service and proactive police patrols. The success of the CST program to date led to the belief that additional success could be achieved by adding more CSTs to the Police Department.

The FY 2022-23 Police Department staffing allocation includes three Records/Property Technician positions and one CST II position. In August 2022, one of the Records/Property Technician positions will become vacant due to a planned employee resignation. Staff reviewed the Records/Property program workload and determined the duties could be comfortably handled with two Records/Property Technicians. Staff further reviewed the possibility of adding one parttime CST to assist the weekend Patrol Bureau and one full-time CST to assist the weekday Detective Bureau. Staff determined it would be beneficial to convert the Records/Property Technician position into one full-time and one part-time CST within the cost of the Staff Report: Conversion of Records/Property Technician to Community Services Technicians Page 2 July 25, 2022
Records/Property Technician position. This action would bring the total allocation of CST positions in the Police Department from 1 to 2.5 positions.

Staff has met and conferred with the Grover Beach Police Officers’ Association (GBPOA) who is the recognized bargaining unit that represents Records/Property Technicians and they agreed to the re-allocation of positions as proposed. The funding for the CST positions will come from the existing funding for the third Records/Property Technician position.

FISCAL IMPACT
The converting of one Records/Property Technician position to one Full-Time and one Part-Time Community Services Technician I positions will be absorbed in the current FY 2022-23 Police Department budget.

ALTERNATIVES
The Council has the following alternatives to consider:

1. Adopt the Resolution authorizing the Police Department to convert one Records/Property Technician position to one Full-Time and one Part-Time Community Services Technician I positions; or

2. Provide alternative direction to staff.

PUBLIC NOTIFICATION
The agenda was posted in accordance with the Brown Act. A courtesy copy of this staff report and the meeting agenda were provided to the Grover Beach Police Officers’ Association.

Agenda Item No. 6

CITY COUNCIL STAFF REPORT
TO: Honorable Mayor and City Council DATE: July 25, 2022 FROM: Matthew Bronson, City Manager
PREPARED BY: John Peters, Chief of Police
SUBJECT: Federal Equitable Sharing Agreement

RECOMMENDATION
Adopt the Resolution authorizing the Mayor and the Chief of Police to sign a Federal Equitable Sharing Agreement that will allow the City to receive federally forfeited assets from adjudicated cases, pursuant to the Federal Equitable Sharing Program.

BACKGROUND
The City of Grover Beach is a participating agency in the San Luis Obispo County Special Operations Unit (SOU), a multi-agency narcotics task force coordinated by the Sheriff’s Office of San Luis Obispo County. As a result of our participation, the City has the opportunity to receive federally forfeited funds including equipment purchased with such funds from the SOU. However, in order to receive such assets, the City needs to have the Federal Equitable Sharing Agreement on file with the Department of Justice and the Department of the Treasury. Typically, any forfeited assets have been and will continue to be maintained and used by the County’s SOU as determined by the Sheriff’s Office.

In addition to being a participating agency with the SOU, the Police Department also conducts street-level narcotics investigations. Some of the investigations conducted by SOU and GBPD may result in the seizure of assets (cash and/or property) that could be determined to be the proceeds of illegal drug transactions or used in the furtherance of such transactions. These drug assets may be seized under state or federal law. If the assets are proved to be drug-related, they are subject to forfeiture by a court of law. Once deemed legally forfeited, the assets may be available to be shared with agencies that were involved in the original investigation.

There are strict guidelines under both state and federal law governing the use of forfeited assets by cities and counties. These assets must be used for law enforcement purposes to supplement the regular budget “above and beyond” items that are normally or already budgeted for and there are strict prohibitions against supplanting General Fund allocations with forfeited funds. The use of forfeited assets is a cost-effective way to further the City’s public safety goals without impacting the General Fund.

If a drug asset is forfeited under federal law, the responsible federal agency is not able to transfer that asset to local law enforcement agencies involved in the case without a signed Federal Equitable Sharing Agreement on file with both the Department of Justice and the Department of the Treasury. This agreement states that the City will comply with the following conditions upon receipt of a federally forfeited asset:

Staff Report: Federal Equitable Sharing Agreement Page 2 July 25, 2022

1. The forfeited funds will not be commingled with funds from other sources and will be accounted for using a separate revenue account or accounting code.

2. Interest earned on federally forfeited assets must be accounted for in the same account as the forfeited assets.

3. The forfeited funds will be subject to all standard accounting requirements as well as to specific requirements for federally forfeited funds.

4. The City (via the Police Department) will submit annual Certification Reports to the Department of Justice and the Department of the Treasury accounting for the shared federal funds.

The Police Department will be responsible for ensuring the City’s compliance with the agreement, including the annual reporting. Staff will work with the Administrative Services Department regarding the accounting aspects of the agreement to ensure the forfeited funds and earned interest are tracked separately from other funds and utilized in accordance with federal law. The Federal Equitable Sharing Agreement each year requires the signatures of both the head of the Governing Body for the City and the Chief of Police.

FISCAL IMPACT
The City generally does not receive federally forfeited funds, however, approval of the recommended agreement is necessary if such funds are shared with the Police Department. If this occurs, the funds will benefit the City for one-time allocations such as equipment purchases or training. There will be a minimum amount of staff time needed within the Police Department to ensure proper accounting of the funds and compliance with the sharing agreement.

ALTERNATIVES
The Council has the following alternatives to consider:

1. Adopt the Resolution authorizing the Mayor and the Chief of Police to sign a Federal Equitable Sharing Agreement that will allow the City to receive federally forfeited assets from adjudicated narcotics cases, pursuant to the Federal Equitable Sharing Program.

2. Do not adopt the Resolution; or

3. Provide alternative direction to staff.

PUBLIC NOTIFICATION
The agenda was posted in accordance with the Brown Act.

CITY COUNCIL STAFF REPORT
TO: Honorable Mayor and City Council DATE: July 25, 2022 FROM: Matthew Bronson, City Manager
PREPARED BY: Kristin Eriksson, Deputy City Manager
SUBJECT: Economic Development Services Semi-Annual Report

RECOMMENDATION
Receive an update from the South County Chambers of Commerce on the economic development services provided to the City and provide input and direction to staff.

BACKGROUND
On December 2, 2019, the Council approved an agreement with the South County Chambers of Commerce (Chamber) to assist the City with economic development services. The agreement with the Chamber included specific actions related to business attraction, business retention, development of an economic asset website, and creation of a cowork space including an incubation program in partnership with the Cal Poly Center for Innovation and Entrepreneurship.

The agreement included a cost of $120,000 over an 18-month period from January 1, 2020 through June 30, 2021 funded by one-time SB 1090 Diablo Canyon settlement funds for economic development activities. In 2021, the agreement was extended through June 30, 2023 for a total cost of $170,000 funded by American Rescue Plan Act (ARPA) funds (see Attachment 3). These funds are paid through a monthly retainer along with one-time payments for specific activities and with semi-annual reports provided to the Council. This work is done in support of the Economic Development Major City Goal with the FY 2022-23 work program shown in Attachment 2.

The first quarter report from the Chamber was provided to the Council on May 18, 2020 to highlight the Chamber’s work to support the business community in the initial wake of COVID-19 and share the results of an initial survey of businesses to better understand key issues facing businesses.

The Council provided direction to implement a business assistance microgrant program to help local businesses weather the financial impacts from COVID-19 which ultimately provided approximately $700,000 in four rounds of business assistance grants to 92 local businesses from July 2020 to January 2021. Semi-annual reports were provided to the Council on September 21, 2020, February 22, 2021, and October 25, 2021 highlighting key economic activities including the development of a business attraction strategy to continue achieving a resilient and diverse economy in Grover Beach. The Chamber and City identified four specific sectors to focus business attraction activities:
• Construction including engineering and architecture
• Technology companies and businesses that require a broadband fiber network • Cannabis and ancillary businesses
• Tourism-related businesses
As part of this process, the Chamber and City held industry cluster roundtable virtual meetings with specific industry segments to hear from businesses about what the City and Chamber could Staff Report: Economic Development Services Semi-Annual Report Page 2 July 25, 2022
do to help meet their needs. These segments included manufacturing, construction, and cannabis businesses with this outreach designed to assist in development of a Business Attraction Strategy.

The Chamber also provided assistance to 166 businesses for retention and expansion, launching and administering a “Buy Local” gift card program to encourage customer spending at local businesses in 2021 and 2022, developed a new tourism marketing initiative “Visit Grover Beach”, and developed a workforce retention and resiliency initiative in collaboration with SLO Partners.

Attachment 1 is the Chamber’s latest semi-annual report which highlights activities carried out since February 2022. Key activities included:
• Completing the “Buy Local” program which generated a total of $131,624 in funding for local businesses from February through April 2022 with nearly $2.80 in customer spending generated for every $1 in public funds invested
• Launching a new cowork space, called The Launchpad, located on Front Street providing private offices and open workspaces and hosting an aerospace incubator program in cooperation with the Cal Poly Center for Innovation and Entrepreneurship • Hosting roundtable meetings with various industry groups, including cannabis and hospitality and restaurant groups
• Holding local business ribbon cuttings to introduce new businesses such as Sherwin Williams Paint Store, Empower Yoga Studio and Community Boutique, The Launchpad, Beyond/Hello Cannabis Dispensary, and Pono Pacific Kitchen Restaurant • Continuing promotion of the Visit Grover Beach tourism marketing initiative with social media and website platforms. The Visit Grover Beach tourism site was a finalist the Visit California Poppy Award for Best Overall Destination Brand Identity (under $1 Million). • Coordinating childcare grants on behalf of the City, providing nearly $50,000 in grants to local at-home childcare providers and Grover Beach families to support childcare needs in the city.

As part of this update, staff is pleased to introduce the new Chamber President/CEO Kathy McCorry who began with the Chamber in June. Ms. McCorry will present this report and will highlight upcoming Chamber activities, including amplification of Grover Beach branding and tourism marketing, continued local business education and support, as well as continuation of roundtable discussions with local businesses.

CITY COUNCIL STAFF REPORT
TO: Honorable Mayor and City Council DATE: July 25, 2022 FROM: Matthew Bronson, City Manager
PREPARED BY: Matthew Bronson, City Manager
SUBJECT: Five Cities Fire Authority Update

RECOMMENDATION
Receive an update on the results of the Oceano Fire Tax Measure A-22 on the June 2022 election and the process for a wind down period as defined by the Third Amendment to the Five Cities Fire Authority Joint Exercise of Powers Agreement.

BACKGROUND
On June 22, 2020, the Council approved a Third Amendment to the Five Cities Fire Authority (FCFA) Joint Exercise of Powers Agreement given the narrow failure of the Oceano Community Services District (OCSD) Fire Tax Measure A-20 in March 2020. Measure A-20 would have assessed a parcel tax on Oceano properties to generate an additional $422,000 annually for fire and emergency medical services in Oceano. The measure needed 2/3 vote and received 66.6% approval only failing by 10 votes. As a result, the Third Amendment continued the funding formulas set forth in a prior amendment with a commitment from OCSD to seek a new tax measure in 2022. This Third Amendment locked in member contributions at FY 2019-20 levels for a three-year period to provide stability in fire service costs in light of economic challenges at the time related to COVID-19. The amendment also specified a 12-month “wind down” process if the future Oceano tax measure failed which would result in OCSD no longer being a member of the FCFA Joint Powers Authority (JPA).

Measure A-22 was subsequently placed on the ballot in Oceano by OCSD in June 2022 as stipulated under the Third Amendment. The election results certified on July 7, 2022 showed the measure failed to gain a 2/3 majority similar to 2020 with a lower approval percentage of 58%.

With the failure of Measure A-22, the “wind down” process goes into effect and OCSD will cease to be a member of the JPA effective June 30, 2023. Below is a summary of the major work program tasks during this wind down period as defined in the Third Amendment:
• Establish distribution of assets of the JPA
• Establish obligations of the JPA including:
o Lease payments on equipment and apparatus
o Unfunded PERS liabilities for disassociating or withdrawing member agency o Other employment-related liabilities
• Post and determine reconciliation of assets and liabilities with any party owing funds to the other(s) paying such funds to the appropriate agencies A summary of this wind down process was shared on July 15, 2022 with the FCFA Board and separately with the FCFA Managers Group comprised of the City/General Managers of the three member agencies. The FCFA staff report is shown as Attachment 1 and includes the list of work Staff Report: Five Cities Fire Authority Update Page 2

program tasks, flow chart of decision-making, and the Third Amendment document. Staff would defer to the Council’s representative on the FCFA Board (Mayor Lee) to provide further information from the Board perspective. The Managers Group will meet regularly during the fiscal year to oversee the implementation of the wind down process and the expected dates of completion for each work program task. FCFA staff has completed much of the required inventory identification and equipment valuation and has engaged an actuary to carry out the necessary analysis on pension liabilities. Fire Chief Lieberman will be at the July 25th meeting and can provide information on this work done by FCFA staff.

In addition, there will be a separate process between the remaining FCFA member agencies (cities of Grover Beach and Arroyo Grande) about the desired level of fire and emergency medical services and funding needs in the respective communities. The discussions, led by the City Managers of the two cities, will also include negotiations regarding modification or dissolution of the JPA and potential contract service delivery. This work will incorporate the information about potential fire services options presented to the Council on October 12, 2021. This process is anticipated for completion in early 2023 with Council action that will inform the development of FY 2023-25 Council Goals and two-year budget and ensure continuous service beginning July 1, 2023. Staff will share regular updates with the Council and will bring an agenda item on the status of this process to the Council this fall for input and direction.

FISCAL IMPACT
There is no fiscal impact to this agenda item.
