5.2 As set forth in Government Code Section 54957.9, in the event that any meeting is willfully interrupted by a person or group of persons so as to render the orderly conduct of such meeting unfeasible or impedes the ability of the Council to hold the meeting, and order cannot be restored by the removal of individuals who are willfully interrupting the meeting, the presiding officer may order the meeting room cleared and continue in session. Only matters appearing on the agenda may be considered in such a session. Duly accredited representatives of the press or other news media, except those participating in the disturbance, shall be allowed to attend any session held pursuant to this Section. CITY COUNCIL STAFF REPORT
TO: Honorable Mayor and City Council DATE: September 12, 2022 FROM: Matthew Bronson, City Manager
PREPARED BY:
SUBJECT:
Wendi Sims, City Clerk
David P. Hale, City Attorney
Biennial Review of Conflict of Interest Code
RECOMMENDATION
Adopt the Resolution amending the City’s Conflict of Interest Code.
BACKGROUND
The Political Reform Act of 1974 as amended requires every local government agency to review its Conflict of Interest Code by October 1st of even-numbered years and determine whether it is up-to-date or in need of revision. The Conflict-of-Interest Code sets out those job classifications within the City that are decision-making positions, but are not among those positions mandated by state law to file Statements of Economic Interests (Form 700) pursuant to Government Code Section 87200. The positions mandated by state law to file Statements of Economic Interests are City Council, City Manager, City Attorney, City Treasurer, and Planning Commissioner. These public officials file their Form 700s electronically utilizing the Fair Political Practices Commission’s (FPPC’s) online filing option.
The City Council determines, with input from staff, what other job classifications entail the making or participation in the making of governmental decisions which may foreseeably have a material effect on any financial interest (Government Code Section 82019). Such designated positions would then be included in the City's Conflict of Interest Code. Individuals identified as holding those positions would be required to file Statements of Economic Interests directly with the City Clerk. There is no electronic online filing option for these designated positions.
The City’s Conflict of Interest Code was last updated in August 2018 as staff was not able to complete this review in 2020 and some positions have been added since 2018. Individuals in newly created positions that make or participate in making governmental decisions have been required to file a Statement of Economic Interest with the City Clerk (FPPC Regulation 18734) until the formal update of the City’s Conflict of Interest Code.
In order to ensure the City’s Conflict of Interest Code is current, the following changes are necessary for the list of designated employees and advisory bodies by positions:
City Employees / Advisory Bodies:
Revise: Explanation:
• Assistant Administrative Services Director Job class revised in 2022 to “Finance Manager”

Agenda Item No. 6
CITY COUNCIL STAFF REPORT
TO: Honorable Mayor and City Council DATE: September 12, 2022 FROM: Matthew Bronson, City Manager
PREPARED BY: Karla Mattocks, Management Analyst/Human Resources SUBJECT: Amendments to Classification and Compensation Plan and Setting the Salary Schedule for the City of Grover Beach for Employee Recruitment and Retention Needs
RECOMMENDATION
Adopt the Resolution amending the Classification and Compensation Plan and setting the Salary Schedule for the City of Grover Beach to assist with employee recruitment and retention needs.
BACKGROUND
The City of Grover Beach strives to continually provide the community with quality services which requires maintaining a professional, well-qualified staff. In the increasingly competitive job market, one of the necessary components to recruit and retain qualified candidates is to provide fair and equitable pay to employees. Recently, the City completed a compensation review based on average total compensation among other cities in San Luis Obispo County and six regional cities of similar size (Carpinteria, Goleta, Greenfield, King City, Pacific Grove, and Port Hueneme) to assess the current compensation market and identify potential adjustments. This evaluation revealed that adopted labor agreements in several cities have included significant cost of living adjustments and specific targeted equity adjustments which have placed the City of Grover Beach’s wages below the median level of comparable cities.
Below are examples of cost-of-living increases among comparable cities:
City Increase
Paso Robles 3% to 4%
Arroyo Grande 3.50%
Atascadero 3.75 to 5%
Morro Bay 6%
Pismo Beach 4% to 6%
For reference, the current cost of living increase in FY 2022-23 for all employee groups in the City is 3%. However, in the City’s interest to maintain market competitiveness and assist employees with rapidly increasing costs, staff is recommending a supplemental cost of living adjustment of 1.5% to the base salary for all employees effective October 3, 2022. This would represent a total cost of living increase of 4.5% increase for City employees for FY 2022-23 with a subsequent increase of 3% approved in FY 2023-24.
Staff Report: Amendments to Classification and Compensation for Recruitment and Retention Page 2 September 12, 2022
In addition to this adjustment for all employees, staff is recommending targeted equity adjustments in compensation given significant deviations from comparable cities which affects recruitment and retention efforts. Given an impending recruitment in the Finance Manager position due to an upcoming retirement and the ongoing difficulties recruiting for public safety positions, staff determined that additional equity adjustments are necessary for these positions to remain competitive in recruiting and retaining well-qualified employees. Staff recommends equity adjustments to the base salary of the following positions which have fallen well below the median compensation level:
Position
Proposed
Increase
Police Sergeant 3%
Police Officer 7%
Police Trainee 15%
Finance Manager 15%
The adjustments to these classifications will become effective January 1, 2023 and will bring the positions closer to market with other agencies, which will enhance the City’s ability to compete for well qualified candidates for these difficult recruitments. The City will continue to review compensation as needed for other job classifications to ensure competitiveness.
Salary adjustments to job classifications falling under the Service Employee’s International Union group have been shared with SEIU Representatives and a side letter will be drafted prior to implementation on October 3, 2022.
FISCAL IMPACT
These recommended compensation adjustments are projected to cost the General Fund approximately $200,000 for the remainder of FY 2022-23 which can be funded through the City’s projected surplus in this year’s operating budget. The ongoing annual cost beginning in FY 2023- 24 is approximately $300,000 which will be incorporated into the two-year FY 2023-25 budget.
ALTERNATIVES
The Council has the following alternatives to consider:
1. Adopt the Resolution amending the Classification and Compensation Plan and setting the Salary Schedule for the City of Grover Beach to assist with employee recruitment and retention needs; or
2. Do not adopt Resolution; or
3. Provide alternate direction to staff.
PUBLIC NOTIFICATION
The agenda was posted in accordance with the Brown Act.

CITY COUNCIL STAFF REPORT
TO: Honorable Mayor and City Council DATE: September 12, 2022 FROM: Matthew Bronson, City Manager
PREPARED BY: Annette Munoz, Finance Manager
SUBJECT: FY 2022-23 Annual Master Fee Schedule Update
RECOMMENDATION
Adopt a Resolution updating the Citywide Master Fee Schedule to reflect minor changes to the Parks & Recreation and Police sections and to incorporate the updated Solid Waste Rates approved by Council on June 13, 2022.
BACKGROUND
The Citywide Master Fee Schedule summarizes all fees the City charges for various services and permits, such as building permits and recreational classes. The FY 2022-23 schedule was approved by Council on April 11, 2022 and became effective on July 1, 2022. Since this approval, the Council approved updated Solid Waste Rates on June 13, 2022 requiring a corresponding update to the Master Fee Schedule. Additionally, the Parks & Recreation section has been updated to increase cleaning fees for facility rentals to reflect the current cost to the City as well as to add a Santa’s Workshop special event fee and a vendor participation fee for Summer Concerts. Finally, a card table fee inadvertently removed has been re-added to the Police section.
FISCAL IMPACT
The fiscal impact to the General Fund is estimated to be between $1,000 - $3,000 depending upon the level of activity for the related services during FY 2022-23. The Solid Waste Fees are a pass-through fee which will not result in a fiscal impact to the City.
ALTERNATIVES
The Council has the following alternatives to consider:
1. Adopt a Resolution updating the fees added to the Master Fee Schedule; or
2. Do not adopt the Resolution and provide alternative direction to staff.
PUBLIC NOTIFICATION
The agenda was posted in accordance with the Brown Act.

Agenda Item No. 8
CITY COUNCIL STAFF REPORT
TO: Honorable Mayor and City Council DATE: September 12, 2022 FROM: Matthew Bronson, City Manager
PREPARED BY: Greg Ray, Public Works Director/City Engineer Gabriel Munoz-Morris, Senior Engineer
SUBJECT: Citywide Stop Sign Replacement Project Change Order Approval
RECOMMENDATION
Authorize the City Manager to approve change order for the Stop Sign Replacement Project.
BACKGROUND
The Public Works Department recently contracted with Golden State Sealing and Striping to replace every stop sign in the city with a new Manual for Uniform Traffic Control Devices (MUTCD) compliant stop sign. The project scope also included the replacement of all existing square wood stop sign posts with new square metal poles, per City standard. Some of these wood posts were originally placed in unimproved frontages that have since had concrete curb, gutter, and sidewalk installed.
Due to lower than anticipated project costs, staff was able to request proposals for additional work that was originally expected to exceed the project budget of $61,550. Staff requested a change order proposal from Golden State to relocate stop signs on new square metal poles to adjacent concrete sidewalk areas to make the signs more visible to drivers. Staff also requested a change order proposal from Golden State for the replacement of every speed limit sign in the city with new MUTCD-compliant speed limit signs. Several current speed limit signs are faded and no longer meet reflectivity standards. Lastly, staff requested a change order proposal from Golden State for turn lane arrows to be striped at the intersection of Farroll Road and South 13th Street to improve traffic flow at that intersection. Golden State also provides striping services and staff was able to negotiate a low cost for this additional work due to the fact that Golden State was already working in the City for the signage work.
The total change order cost for this work is $18,951, which will result in a total project cost of $80,501. The City’s purchasing policy authorizes the City Manager to sign contracts up to $75,000 but requires City Council approval for contracts that exceed that amount. Staff requests authorization for the City Manager to approve this change order for the Stop Sign Replacement Project with no further change orders anticipated for this project.
FISCAL IMPACT
There is an increased cost of $18,951 for this project associated with authorization for the City Manager to approve this change order. There is sufficient project funding for this additional cost.
Staff Report: Stop Sign Replacement Project Change Order Authorization Page 2 September 12, 2022
ALTERNATIVES
The Council has the following alternatives to consider:
1. Authorize the City Manager to approve Change Order for the Stop Sign Replacement Project; or
2. Provide staff with alternate direction.
PUBLIC NOTIFICATION
The agenda was posted in accordance with the Brown Act.

Agenda Item No. 9
CITY COUNCIL STAFF REPORT
TO: Honorable Mayor and City Council DATE: September 12, 2022 FROM: Matthew Bronson, City Manager
PREPARED BY: Deanne Purcell, Administrative Services Director SUBJECT: FY 2021-22 Year-End Financial Review
RECOMMENDATION
Receive a report on the FY 2021-22 Year-End Financial Review
BACKGROUND
On June 27, 2022, the Council adopted the Revised FY 2022-23 budget which included estimates for the fiscal year ending June 30, 2022. Staff is currently working with the City’s outside auditors to complete the FY 2021-22 annual audit which is anticipated to be completed in December 2022 and brought to the Council for approval in January 2023. In preparation for the outside auditors’ review in October, staff has conducted an initial review of the year-end financial results of FY 2021-22 to provide a summary to the Council prior to the completion of the audit. The following summary represents this initial review subject to change with the upcoming audit process.
General Fund
The General Fund is the City’s primary fund and includes general City services such as police, fire, and parks and recreation, and general administration. The General Fund is also where property tax, sales tax, and other general revenues are collected. Table 1 below shows the yearend estimates for FY 2021-22 provided to the Council in June 2022 compared to the FY 2021-22 unaudited actuals:
Table 1
FY 2021-22 actual revenues are lower than estimated as part of the FY 2022-23 budget process mainly due to the deferral of American Rescue Plan Act (ARPA) revenue that was not expended in the amount of $476,983. This amount will be deferred and expended in future fiscal years.

Beginning Reserves $ 5,073,745 $ 5,073,745 $ -

Expenditures/Transfers Out 18,199,946 17,719,266 (480,680) Annual Surplus $ 633,181 $ 622,622 $ (10,559)
Ending Reserves $ 5,706,926 $ 5,696,367 $ (10,559)
% of Operating Expenditures 39.0% 40.0% 0.9%
Staff Report: FY 2021-22 Year End Financial Review Page 2 September 12, 2022
Expenditures shown in Table 1 are also lower than originally estimated mainly due to capital items that were budgeted in FY 2021-22 but not completed or purchased during the year and include:
• Computer aided dispatch system/records management system - $241,000 • Public Works maintenance boom lift - $75,000
• Back up computer storage/servers - $39,000
• Asset management system - $28,000
As shown in Table 1, the FY 2021-22 General Fund estimated unaudited actual surplus is $622,622 which is nearly identical to the surplus of $633,181 originally projected by staff. This estimated surplus produces ending reserves of $5.7 million or a level equal to 40% of the City’s operating budget which provides sufficient reserves for emergencies and unforeseen needs and demonstrates the City’s strong financial position. Staff would note that this surplus amount does reflect carryover funds of $1.44M that include the capital items above and approximately $1.06M in capital projects not completed in FY 2021-22 that will be reallocated this year.
Given these circumstances, staff would recommend refraining from use of the FY 2021-22 unaudited surplus at this time as staff will return to the Council with additional information about the City’s financial condition in November 2022 and in February 2023 as part of the FY 2022-23 first quarter and mid-year review respectively.
Water Fund
The Water Fund is responsible for the maintenance and operation of City’s water system. This includes water lines, tanks, and wells. The Water Fund is estimated to end FY 2021-22 with $97,000 less than the year-end estimates for FY 2021-22 provided to the Council in June 2022 compared to the FY 2021-22 unaudited actuals as shown in Table 2:
Table 2
Water revenues are lower than estimated by approximately $60,000. This was mainly due to lower water usage due to water conservation efforts. Expenditures are higher than anticipated by almost $37,000 mainly due to operating expenditures where there were supply chain issues and inflation costs that had to be absorbed by the City.

Wastewater Fund
The Wastewater Fund is responsible for the City’s maintenance and operation of wastewater lines within the City and bills for and forwards funds collected to the South San Luis Obispo County Sanitation District. The Wastewater Fund is projected to end FY 2021-22 with $315,000 more than the year-end estimates for FY 2021-22 provided to the Council in June 2022 compared to the FY 2021-22 unaudited actuals as shown in Table 3:
Table 3
Wastewater revenues are higher than estimated by approximately $144,000. This was mainly due to the use of ARPA funding to help cover project costs including a sewer system upgrade of $81,000 and sewer video services of $88,000. Expenditures are lower than anticipated mainly due higher estimates than actual costs of projects that were not completed in FY 2021-22.
FISCAL IMPACT
There is no fiscal impact from receiving this report.
ALTERNATIVES
The Council has the following alternatives to consider:
1. Receive information on the FY 2021-22 Year-End Financial Review and provide direction to staff; or
2. Provide alternative direction to staff
PUBLIC NOTIFICATION
The agenda was posted in accordance with the Brown Act.
