CITY OF GROVER BEACH
POLICIES AND PROCEDURES FOR CONDUCT AND DECORUM AT COUNCIL MEETINGS (Pursuant to Resolution No. 07-44, adopted 04-16-07, revised 02-18-2020) The City Council and staff welcomes and encourages civic participation and debate on issues. The Council values the public’s opinion and in every Council meeting invite and encourages the public to address the Council on any matter of interest. The Council adopted these policies and procedures for appropriate conduct and decorum at Council meetings and establish guidance for public participation during Council meetings.
These policies will foster and provide greater clarity to preserve the intent of open government and maintain a positive environment for public input and City Council decision-making.
1.0 DECORUM AND ORDER – IN GENERAL
1.1 The presiding officer is responsible for the maintenance of order and decorum at all times.
1.2 The presiding officer shall determine all points of order subject to the right of any Council member to appeal to the City Council by majority vote. If any appeal is taken, the question shall be “Shall the decision of the presiding officer be sustained” in which event a majority vote of the Council shall govern and conclusively determine such question of order.
1.3 All Council members, staff members and members of the public should speak respectfully and avoid the use of profanity, vulgarity and slanderous comments. Recognizing that the First Amendment precludes the City Council form prohibiting speakers from speaking based upon the content of their speech, the presiding officer shall use their best efforts, short of enforcement action, to remind and encourage all participating in the meeting to keep their speech respectful towards others and within bounds appropriate for children and persons of sensitivity toward course language as a courtesy to others present or otherwise viewing Council meetings.
2.0 DECORUM AND ORDER – COUNCIL MEMBERS
2.1 Manner of Speaking.
Any Council member desiring to speak shall first address the presiding officer. Upon recognition by the presiding officer, the Council member shall speak only to the question under debate.
2.1(a) Questioning Staff.
A Council member desiring to question the staff should address his question to the City Manager, or, in appropriate cases, the City Clerk or City Attorney, who shall be entitled either to answer the inquiry or to designate some staff member for that purpose. Such a designation may be made at the time of any staff presentation or on the agenda listing for the item.
2.1(b) Interruptions.
Once recognized, a Council member shall not be interrupted while speaking unless called to order by the presiding officer; unless a point of order is raised by another Council member, or unless the speaker chooses to yield to questions from another Council member.
3.0 DECORUM AND ORDER – STAFF
3.1 City Manager Responsibilities
The City Manager is responsible for ensuring that members of the administrative staff observe the rules of decorum and order set forth in this Policy.
3.2 Addressing the City Council
Any administrative staff member desiring to address the City Council or members of the public shall first be recognized by the presiding officer. All remarks shall be addressed to the presiding officer and not to any individual Council Member or member of the public. Administrative staff members shall accord the utmost courtesy to the City Council, other administrative staff members and the public.
4.0 DECORUM AND ORDER – MEMBERS OF THE PUBLIC
4.1 Addressing the City Council
Any member of the public desiring to address the City Council or members of the public shall first be recognized by the presiding officer at the appropriate place on the agenda. All remarks shall be addressed to the presiding officer and not to any individual Council Member, City Manager, City Attorney or member of the administrative staff or member of the public.
4.2 Time Limitation for Addressing the City Council
Public comment when addressing the City Council shall be generally limited to three (3) minutes per speaker. Depending on the extent of the agenda and the number of persons desiring to speak on an issue, the presiding officer may, at the beginning of the hearing, set a different time limit for each speaker. Any person may speak for a longer period of time upon approval from the presiding officer, when deemed necessary, for instance when a person is speaking on behalf of a group or has a graphic or slide presentation requiring more time.
4.3 Failure to Yield, Disruptions
Any person who refuses to relinquish the floor after their allotted time or while attending the City Council meeting engages in conduct or speech which disrupts the business of the meeting shall be brought to order and/or removed from the room if the sergeant-at-arms is so directed by the presiding officer.
Disruptive remarks from the audience, stamping of feet, clapping, whistles, yells and similar demonstrations shall not be permitted by the presiding officer who may direct the sergeant-at-arms to remove such offenders from the room.
4.4 Prosecution
Aggravated cases shall be prosecuted on appropriate complaint signed by the presiding officer.
5.0 ENFORCEMENT OF DECORUM
5.1 The Chief of Police or his designee shall be the ex-officio sergeant-at-arms of the City Council. The sergeant-at-arms shall carry out all legal and valid orders and instructions given by the presiding officer for the purpose of maintaining order and decorum in the Council Chamber. Upon instructions from the presiding officer, it shall be the duty of the sergeant-at-arms to remove any disorderly person from the Council Chambers or place the disorderly person under arrest or both.
5.2 As set forth in Government Code Section 54957.9, in the event that any meeting is willfully interrupted by a person or group of persons so as to render the orderly conduct of such meeting unfeasible or impedes the ability of the Council to hold the meeting, and order cannot be restored by the removal of individuals who are willfully interrupting the meeting, the presiding officer may order the meeting room cleared and continue in session. Only matters appearing on the agenda may be considered in such a session. Duly accredited representatives of the press or other news media, except those participating in the disturbance, shall be allowed to attend any session held pursuant to this Section. Nothing in this Section shall prohibit the City Council from establishing a procedure for readmitting an individual or individuals not responsible for willfully disturbing the orderly conduct of the meeting.

Businesses
Labor Shortages
Inflation
Cash Flow
Three Surveys have been conducted during the last 5
months.
Top 3 concerns for Grover Beach Businesses
Labor Shortages – Worse in certain sectors like restaurants and entry level positions in general
Inflation – Soaring cost of goods continues to cut into the bottom line. Especially hard hit is the restaurant sector Cash Flow – With a reduced profit margin in the 4th quarter due to inflation. Reserves are low for many businesses. First quarter tends normally trend low in Business to Consumer businesses creating a more stress on these businesses. Again, Restaurants appear to be the most vulnerable right now
In the restaurant sector we are aware of
several restaurant closing in surrounding
communities.
Dr. Bernstein's Ice Cream stores abruptly
closing
Coco’s in Pismo Closed
We are working closely with restaurants
in Grover Beach to monitor their progress
Expect prices consumers pay for goods
and services to continue to rise
Expect staff shortages to continue to
lead to reduced hours of operation in
the Business to Consumer sectors.
TRENDS
In the retail sector we see similar vulnerabilities and signs of concern
Recent announcement of retail closures
Bed, Bath, and Beyond in Arroyo Grande
TRENDS
OPPORTUNITIES
As doors close – those looking to hire can tag and share that they are looking to hire those recently laid off
Chamber will be hosting a Resource Fair in late May/early June to connect businesses with job seekers, posting sites, and HR resources related to recruitment and retention
Chamber will resume industry specific roundtables and continue to monitor successes and pinch points within specific industries.
VISIT GROVER BEACH
Contract for Visit Grover Beach
expired in July and was on a monthby-month basis until a review of goals and expectations was conducted.
In October, the month to month and
contract with Lovely Day was put on
pause and the decision was made to
bring Visit Grover Beach social media
and website in house.
Due to the success of social media coming in
house, the Chamber has agreed to continue
to maintain Visit Grover Beach as part of our
contract with the city for Economic
Development.
Website updates will start in March as we
continue to support business growth and
economic vitality in the tourism sector as well
as all other sectors of business in Grover
Beach
VISIT GROVER BEACH
This data shows us that there wasn’t a plan in
place to use hashtags, key words, partners,
or algorithms to reach outside of our region
to promote Grover Beach as a destination to
major CA markets such as Los Angeles,
Bakersfield and San Francisco.
This will be a key component of our
marketing strategy now that Visit Grover
Beach has been brought in house.
This combined with our success in adding
content, number or followers and
engagement will take us to the next level in
our tourism marketing strategies.

Agenda Item No. 6
CITY COUNCIL STAFF REPORT
TO: Honorable Mayor and City Council DATE: February 27, 2023 FROM: Matthew Bronson, City Manager
PREPARED BY: Matthew Bronson, City Manager
SUBJECT: Fire and Emergency Medical Services Review
RECOMMENDATION
Receive a presentation on a review conducted by Baker Tilly to assess current and future needs for fire and emergency medical services provided by the Five Cities Fire Authority in Grover Beach and Arroyo Grande and provide input to staff.
DISCUSSION
On December 5, 2022, the Council received an update from staff on the implementation of the “wind down” period related to the Oceano Community Services District (OCSD) withdrawal from the Five Cities Fire Authority (FCFA) along with a fire services review carried out in conjunction with the City of Arroyo Grande. This update followed a previous update to the Council on July 25, 2022 reporting the failure of Oceano Measure A-22 which would have assessed a parcel tax on Oceano properties to generate additional funding for fire and emergency medical services in Oceano. Failure of this measure triggered a 12-month wind down process defined in the Third Amendment to the Joint Exercise of Powers Agreement (shown in Attachment 1) culminating in the OCSD withdrawal of membership in the FCFA effective July 1, 2023. The tasks defined in this wind down process including distribution of assets and liabilities such as pension costs are underway and scheduled to be completed by the July 1, 2023 deadline.
OCSD has also submitted an application to the Local Area Formation Commission (LAFCo) to divest itself of its fire and emergency service powers effective June 30, 2023. Through the LAFCo process, OCSD is requesting that the County of San Luis Obispo (County) take over fire and emergency service responsibilities to Oceano, which will require an agreement between the OCSD and the County. Due to the short amount of time before OCSD is required to leave the FCFA, it is possible that FCFA may be approached to continue to provide services to Oceano during the completion of the LAFCo process. However, a Fourth Amendment to the Joint Exercise of Powers Agreement or a new agreement would be needed to either extend the current structure of the JPA or establish a new two-city structure that in turn could contract with OCSD to provide service to Oceano. Absent this new amendment or agreement, FCFA would be unable to supply fire services to Oceano after June 30, 2023.
In addition to this wind down process, there has been a separate process underway between the remaining FCFA member agencies (cities of Grover Beach and Arroyo Grande) at the staff level about the desired level of fire and emergency medical services and funding needs in the respective communities. These discussions are being led by the City Managers of the two cities and initially involved work sessions with FCFA staff and treasurer about current and projected FCFA call volume along with staffing and equipment needs. The FCFA budget has not changed since FY 2019-20 given the Third Amendment which locked in member contributions in June 2020 Staff Report: Fire and Emergency Medical Services Review Page 2 February 27, 2023
at the beginning of the COVID-19 pandemic and was also predicated on Oceano’s future tax measure in 2022 which ultimately failed. The member contributions under the Third Amendment are $2,580,955 for Arroyo Grande, $2,015,115 for Grover Beach, and $1,138,148 for Oceano.
Though the City previously increased its funding to transition part-time reserve firefighters to fulltime positions, the FCFA budget has become constrained as both costs and service needs have increased. This is particularly challenging when multiple calls are received in the FCFA service area. Mutual aid from other agencies can assist when available but such resources cannot be relied upon to respond to all calls. In addition, firefighter workload has increased significantly which impacts not only service response but also employee health and retention. This fire services review is an important effort to ensure responsive and effective fire and emergency medical services in the future and determine the budgetary implication to this work to inform the Council’s development of FY 2023-25 Council Goals and resulting two-year budget.
Given the significance of this issue and potential costs involved, the Arroyo Grande and Grover Beach City Managers engaged an outside consultant (Baker Tilly) in October 2022 to conduct an analysis of fire services for the two cities and provide service and funding recommendations. The Baker Tilly team working on this project has extensive experience in fire services and was led by Rick Haydon, former City Manager in Santa Maria. Mr. Haydon is familiar with the local area and previously led a review of the City’s police services in 2018 and also led an organizational assessment of other City services that will be presented to the Council following this agenda item.
There were several other members of the Baker Tilly team including Larry Waterhouse, a former fire chief in several cities in Southern California. Baker Tilly was chosen given their work with service reviews elsewhere within the Central Coast and their ability to complete this study by early 2023 to inform decisions by the two cities.
Baker Tilly’s scope included a service level analysis, staffing deployment options, fiscal analysis, and review of alternative service models and governance structure. This work included reviewing the financial impacts of OCSD’s departure from FCFA including their current funding contribution and whether it would be beneficial for FCFA to provide fire service to Oceano under a contractual fee-for-service arrangement. Baker Tilly interviewed numerous individuals including former FCFA Board members, City Managers/OCSD General Manager, FCFA command staff, FCFA firefighters union representatives, and others. The consulting team also reviewed numerous documents including the Joint Powers Authority Agreement, FCFA strategic planning materials, budgets and CalPERS information, service call data, and other documents.
During this agenda item, Baker Tilly will present their observations, findings, and recommendations for sustainable and responsive fire and emergency medical services along with associated costs for both Grover Beach and Arroyo Grande. Baker Tilly will provide a similar presentation to the Arroyo Grande City Council on February 28. The recommendations are intended to be implemented beginning in FY 2023-24 to coincide with the withdrawal of Oceano Community Services District from the FCFA. Staff is seeking questions and comments from the Council to inform the next steps in this work effort along with the upcoming Council goal-setting discussion on March 6. Following the presentation, Baker Tilly will prepare a written report that will be available for consideration as part of the negotiations of a future agreement for fire and emergency medical services between Grover Beach and Arroyo Grande. Staff from Grover Beach and Arroyo Grande will work on mutually agreeable fire service levels and related governance and contractual documents that would be brought to the respective Councils for review this spring, prior to proposed implementation beginning on July 1.

CITY COUNCIL STAFF REPORT
TO: Honorable Mayor and City Council DATE: February 27, 2023 FROM: Matthew Bronson, City Manager
PREPARED BY: Kristin Eriksson, Deputy City Manager
SUBJECT: Organizational Assessment Overview
RECOMMENDATION
Receive a presentation on an assessment conducted by Baker Tilly to assess the City’s organizational structure, City services and future needs.
DISCUSSION
In July 2022, the City contracted with Baker Tilly to conduct an organizational assessment of the City’s structure, staffing, services and future needs. To inform the assessment, Baker Tilly conducted staff interviews, an employee survey, site visits, and interviews with members of the Council and public. Additionally, Baker Tilly studied prior assessments commissioned by the City and data from comparison cities. Because prior assessments focused on operations in the City Manager’s Office, the Community Development Department and the Police Department, this assessment had particular focus on the Public Works, Parks and Recreation and Administrative Services departments.
During this agenda item, Baker Tilly will present their observations, findings, and recommendations for how the City can continue to improve service delivery to the community.
The assessment indicated that the City has many strengths including capable and qualified staff, positive employee morale, customer service focus, and strong financial position. The assessment also identified a total of 57 recommendations for improvement with a particular emphasis on the following six priority recommendations:
1) Improve management and leadership in the Public Works Operations Maintenance Division through the addition of a new division manager; 2) Analyze parks recreation program costs and related fee recovery plans, increase the volunteer program and explore regional cooperation with other agencies; 3) Develop Key Performance Indicators and Standard Operating Procedures organizationwide; 4) Develop an Equipment Replacement Policy and identify a funding structure for future equipment replacement needs;
5) Add additional contract project management services if the Capital Improvement Plan continues to expand;
6) Develop and implement a financial plan for renovated Corporation Yard and Police vehicle yard.
Staff has already begun work on many of the recommendations, including development of Performance Measures (Key Performance Indicators) for the FY 2023-25 budget and planning for improvements to the Corporation Yard. Staff will consider the recommendations, along with Staff Report: Organization Assessment Overview Page 2
February 27, 2023
Council identification of updated City Council Goals, in developing the FY 2023-25 budget. Staff would also note that related reviews and assessments will also inform the goal-setting and budget process including the fire and emergency medical services review presented during this meeting and a facility condition needs assessment to presented to the Council this spring.
FISCAL IMPACT
There is no fiscal impact associated with receiving this presentation. Subsequent policy decisions will have identified fiscal impacts.
ALTERNATIVES
The Council has the following alternatives to consider:
1) Receive a presentation on an assessment conducted by Baker Tilly to assess the City’s organizational structure, City services and future needs; or 2) Provide alternative direction to staff.
