CITY OF GROVER BEACH

POLICIES AND PROCEDURES FOR CONDUCT AND DECORUM AT COUNCIL MEETINGS (Pursuant to Resolution No. 07-44, adopted 04-16-07, revised 02-18-2020) The City Council and staff welcomes and encourages civic participation and debate on issues. The Council values the public’s opinion and in every Council meeting invite and encourages the public to address the Council on any matter of interest. The Council adopted these policies and procedures for appropriate conduct and decorum at Council meetings and establish guidance for public participation during Council meetings.

These policies will foster and provide greater clarity to preserve the intent of open government and maintain a positive environment for public input and City Council decision-making.

1.0 DECORUM AND ORDER – IN GENERAL

1.1 The presiding officer is responsible for the maintenance of order and decorum at all times.

1.2 The presiding officer shall determine all points of order subject to the right of any Council member to appeal to the City Council by majority vote. If any appeal is taken, the question shall be “Shall the decision of the presiding officer be sustained” in which event a majority vote of the Council shall govern and conclusively determine such question of order.

1.3 All Council members, staff members and members of the public should speak respectfully and avoid the use of profanity, vulgarity and slanderous comments. Recognizing that the First Amendment precludes the City Council form prohibiting speakers from speaking based upon the content of their speech, the presiding officer shall use their best efforts, short of enforcement action, to remind and encourage all participating in the meeting to keep their speech respectful towards others and within bounds appropriate for children and persons of sensitivity toward course language as a courtesy to others present or otherwise viewing Council meetings.

2.0 DECORUM AND ORDER – COUNCIL MEMBERS

2.1 Manner of Speaking.

Any Council member desiring to speak shall first address the presiding officer. Upon recognition by the presiding officer, the Council member shall speak only to the question under debate.

2.1(a) Questioning Staff.

A Council member desiring to question the staff should address his question to the City Manager, or, in appropriate cases, the City Clerk or City Attorney, who shall be entitled either to answer the inquiry or to designate some staff member for that purpose. Such a designation may be made at the time of any staff presentation or on the agenda listing for the item.

2.1(b) Interruptions.

Once recognized, a Council member shall not be interrupted while speaking unless called to order by the presiding officer; unless a point of order is raised by another Council member, or unless the speaker chooses to yield to questions from another Council member.

3.0 DECORUM AND ORDER – STAFF

3.1 City Manager Responsibilities
The City Manager is responsible for ensuring that members of the administrative staff observe the rules of decorum and order set forth in this Policy.

3.2 Addressing the City Council
Any administrative staff member desiring to address the City Council or members of the public shall first be recognized by the presiding officer. All remarks shall be addressed to the presiding officer and not to any individual Council Member or member of the public. Administrative staff members shall accord the utmost courtesy to the City Council, other administrative staff members and the public.

4.0 DECORUM AND ORDER – MEMBERS OF THE PUBLIC

4.1 Addressing the City Council
Any member of the public desiring to address the City Council or members of the public shall first be recognized by the presiding officer at the appropriate place on the agenda. All remarks shall be addressed to the presiding officer and not to any individual Council Member, City Manager, City Attorney or member of the administrative staff or member of the public.

4.2 Time Limitation for Addressing the City Council
Public comment when addressing the City Council shall be generally limited to three (3) minutes per speaker. Depending on the extent of the agenda and the number of persons desiring to speak on an issue, the presiding officer may, at the beginning of the hearing, set a different time limit for each speaker. Any person may speak for a longer period of time upon approval from the presiding officer, when deemed necessary, for instance when a person is speaking on behalf of a group or has a graphic or slide presentation requiring more time.

4.3 Failure to Yield, Disruptions
Any person who refuses to relinquish the floor after their allotted time or while attending the City Council meeting engages in conduct or speech which disrupts the business of the meeting shall be brought to order and/or removed from the room if the sergeant-at-arms is so directed by the presiding officer.

Disruptive remarks from the audience, stamping of feet, clapping, whistles, yells and similar demonstrations shall not be permitted by the presiding officer who may direct the sergeant-at-arms to remove such offenders from the room.

4.4 Prosecution
Aggravated cases shall be prosecuted on appropriate complaint signed by the presiding officer.

5.0 ENFORCEMENT OF DECORUM

5.1 The Chief of Police or his designee shall be the ex-officio sergeant-at-arms of the City Council. The sergeant-at-arms shall carry out all legal and valid orders and instructions given by the presiding officer for the purpose of maintaining order and decorum in the Council Chamber. Upon instructions from the presiding officer, it shall be the duty of the sergeant-at-arms to remove any disorderly person from the Council Chambers or place the disorderly person under arrest or both.

5.2 As set forth in Government Code Section 54957.9, in the event that any meeting is willfully interrupted by a person or group of persons so as to render the orderly conduct of such meeting unfeasible or impedes the ability of the Council to hold the meeting, and order cannot be restored by the removal of individuals who are willfully interrupting the meeting, the presiding officer may order the meeting room cleared and continue in session. Only matters appearing on the agenda may be considered in such a session. Duly accredited representatives of the press or other news media, except those participating in the disturbance, shall be allowed to attend any session held pursuant to this Section. Nothing in this Section shall prohibit the City Council from establishing a procedure for readmitting an individual or individuals not responsible for willfully disturbing the orderly conduct of the meeting.

CITY COUNCIL STAFF REPORT
TO: Honorable Mayor and City Council DATE: May 22, 2023 FROM: Matthew Bronson, City Manager
PREPARED BY: John Peters, Chief of Police
Karla Mattocks, Management Analyst / Human Resources
SUBJECT: Amendments to the Police Officer Trainee Compensation Plan and the Police Officer Hiring Incentive Program

RECOMMENDATION
Adopt the Resolution amending the Compensation Plan for the Police Officer Trainee Position and amending the Police Officer Hiring Incentive Program.

BACKGROUND
On November 2, 2015, City Council adopted Resolution 15-65 establishing the Police Officer Trainee position to attract qualified candidates to become Police Officers. Since that time, the City has successfully sponsored five candidates through the Police Academy. On June 6, 2016, City Council adopted Resolution 16-46 establishing a Police Officer Hiring Incentive Program. The program offered a $5,000 incremental hiring incentive to attract lateral and academy graduate police officers to City employment since the Police Department was still experiencing multiple vacancies. This resulted in hiring five qualified candidates for Police Officer over the following two years but did not fill all police officer vacancies during that time.

In June 2018, the Police Department was experiencing a 20% vacancy rate in the Police Officer rank due to retirements, disability retirements and normal attrition. On June 19, 2018, City Council adopted Resolution 18-53 increasing the Police Officer Trainee compensation to a competitive rate in line with other local police departments. The Resolution also enhanced the Police Officer Hiring Incentive Program from an incremental $5,000 to an incremental $10,000 with an additional $1,000 for prior honorable military service. This resulted in the hiring of six new police officers.

On August 19, 2019, City Council adopted Resolution 19-43 which lowered the Lateral Police Officer probationary period from an extended 18 months to the police department standard of 12 months.

Since 2020, police departments across the nation have had difficulty in recruiting and retaining police officers. Locally, that same difficulty is being felt by all law enforcement agencies in San Luis Obispo and Santa Barbara Counties. Since 2021, the Grover Beach Police Department has experienced 7 retirements, 1 termination and 1 resignation of sworn officers. Currently the Police Department has 5 Police Officer vacancies and is preparing for a 6th vacancy due to an impending disability retirement. The Police Department also has two officers out on long term injury and unpaid leave status. This amounts to a 25% vacancy rate for sworn staff.

Staff Report: Amendments to Police Trainee and Hiring Incentive Programs May 22, 2023

Page 2 ends

Staff, in consultation with other local agencies, has determined that police officers are not laterally transferring to other departments as readily as they have in the past. There are many factors involved, but for the San Luis Obispo County area it has to do with the high cost of living and in particular, the cost of housing. Staff has been concentrating recent recruitments on Police Officer Trainees that are either in the police academy or qualified candidates that we can send to the police academy. In recent recruitment trips to various police academies, staff has found interested candidates but has also received questions regarding the cost of relocating and finding housing in or near the city.

To maintain competitiveness in our recruiting efforts, staff is proposing an amendment to the salary rate for Police Officer Trainee from the current $5,544 per month to $6,691 per month, which is the starting step for Police Officer (Exhibit A). Police Officer Trainees would stay at this salary rate for their entire time in the police academy and for at least the first six months of employment as a Police Officer. The Police Officer Trainee classification would maintain the same salary as the starting step police officer for future compensation adjustments.

Staff also recommends amending the Police Officer Hiring Incentive Program to include a relocation incentive of up to $5,000 for Police Officer Trainee and all sworn positions in the police department. The proposed Relocation Incentive language to be added to the Police Officer Hiring Incentive Program is shown below along with a proposed addition of an incentive for prior certifications:

Relocation Incentive
Police Officer Trainee
Appointed Police Officer Trainees who reside 100 miles or more away from Grover Beach, may be eligible for a Relocation Incentive after graduation from a California POST Basic Police Academy and appointment to the position of Police Officer with the City. To be eligible for a Relocation Incentive, the Police Officer Trainee must relocate to within a 30-minute response time to the City of Grover Beach. This response time is generally consistent with the distance between Atascadero and Orcutt. The Relocation Incentive provides up to $5,000 for reimbursement of relocation expenses approved by the City Manager. Relocation expenses may include, but are not limited to, first and last month’s rent, security deposit, pet deposit, moving vehicle rentals, packaging supplies, moving company temporary storage containers, storage facility rental, and hotel expenses. Receipts for all reimbursable expenses must be submitted to the City Manager for consideration and approval.

Sworn Employee
New employees appointed to Sworn positions with the Grover Beach Police Department and reside 100 miles or more away from Grover Beach may be eligible for a Relocation Incentive after appointment. To be eligible for a Relocation Incentive, the Sworn Employee must relocate to within a 30-minute response time to Grover Beach. This response time is generally consistent with the area between Atascadero and Orcutt. The Relocation Incentive is up to $5,000 for reimbursement of relocation expenses post-approved by the City Manager.

Staff Report: Amendments to Police Trainee and Hiring Incentive Programs May 22, 2023

Page 3 ends

Lateral Police Officer candidates who are certified and hold a valid Instructor Certification in an approved California Peace Officer Standards and Training course and who are appointed to a Police Officer or Police Sergeant position with the Grover Beach Police Department, will, upon completion of the Field Training Program, be eligible for an Instructor Certificate cash incentive of $500 for each valid certification. The approved courses are:
• Academy Instructor Active Shooter
• Arrest and Control Baton/Impact Weapons
• Chemical Agent Defensive Tactics
• Driver Training Firearms (Pistol/Rifle/Shotgun)
• First Aid/CPR/AED IDI-Leadership/Mentoring
• Instructor Development Less Lethal (Taser/Kinetic)

FISCAL IMPACT
The estimated cost will vary based on the actual usage of these incentives. There would be no overall fiscal impact as these programs would be funded in the City’s operating budget through salary savings from vacant positions. The incentives would only be used as vacancies were available.

ALTERNATIVES
The City Council has the following alternatives to consider:

1. Adopt the Resolution amending the Compensation Plan for the Police Officer Trainee Position and amending the Police Officer Hiring Incentive Program; or

2. Provide staff with alternative direction.

Agenda Item No. 7

CITY COUNCIL STAFF REPORT
TO: Honorable Mayor and City Council DATE: May 22, 2023 FROM: Matthew Bronson, City Manager
PREPARED BY: Lorena Zarate, Finance Manager
SUBJECT: Resolution to Approve the Agreement for Contract Administrative Services with the Central Coast Blue Regional Recycled Water Authority

RECOMMENDATION
Adopt a Resolution approving the agreement for contract administrative services between the Central Coast Blue Regional Recycled Water Authority and the City of Grover Beach to appoint a Treasurer/Controller, and provide certain accounting, financial and information technology services.

BACKGROUND
The Joint Exercise of Power Agreement (“Agreement”) created by the City Councils of the Cities of Arroyo Grande, Grover Beach, and Pismo Beach established the Central Coast Blue Regional Recycled Water Authority (“Authority”) and provided specific provisions for appointment of a Treasurer/Controller for the Authority to enter agreements and secure services necessary for Authority business. The Authority has a need for certain accounting, financial, and information technology services. The JPA Agreement provides that such services may be provided by a Member Agency pursuant to a written agreement.

On April 17th, 2023, the Board of Directors for the Authority held a special meeting, in which the Board appointed a Treasurer/Controller and approved the proposed agreement with City of Grover Beach for administrative services. The appointed Treasurer/Controller is the Finance Manager for the City of Grover Beach and the services to be provided by the City are included in the scope of services of the proposed agreement (See Exhibit A of Attachment 2). The proposed agreement is modeled after a similar agreement between the City of Arroyo Grande and the Five Cities Fire Authority. The City of Arroyo Grande currently provides personnel, finance, accounting, and information technology services for the Five Cities Fire Authority.

FISCAL IMPACT
The Authority shall compensate the City of Grover Beach for the administrative services provided in an amount equal to the direct costs incurred by the City of Grover Beach in providing the services. Direct costs shall consist of salary and benefit costs for time dedicated exclusively by employees in performing services for the JPA. No overhead costs shall be charged. This compensation would reduce the City’s proportionate share of the JPA’s operating expenses.

CITY COUNCIL STAFF REPORT
TO: Honorable Mayor and City Council DATE: May 22, 2023 FROM: Matthew Bronson, City Manager
PREPARED BY: Greg Ray, Public Works Director/City Engineer Gabriel Munoz-Morris, Senior Engineer
SUBJECT: Second Reading, and Adoption of an Ordinance Repealing and Replacing Chapter 1 (Sanitary Sewer System) of Article VII (Public Works) of the Grover Beach Municipal Code

RECOMMENDATION
Conduct a second reading, by title only, conduct a public hearing, and adopt an Ordinance repealing and replacing Chapter 1 (Sanitary Sewer System) of Article VII (Public Works) of the Grover Beach Municipal Code to update the City’s Sewer Ordinance.

BACKGROUND
The City’s current Sewer Ordinance was originally adopted in 1965 in conjunction with the establishment of the City’s original Sewer Assessment District No. 1 that constructed the majority of the City’s sewer system. The District did not include any land south of Farroll Road as most of that land was privately owned at that time and had not yet been subdivided and developed.

Assessment District No. 1, along with Ordinance 72, sought to standardize requirements for sewer collection in the City and established a timeline for properties to connect to the City’s sewer collection system. Ordinance 72 also established regulations on the character of waste that could be discharged to the sewer collection system and were generally consistent with regulations adopted by the South San Luis Obispo County Sanitation District (SSLOCSD) that operates the sewage treatment plant where sewer from Grover Beach is treated.

Beginning in 2009, the City made significant investments to construct sewer mains in the industrial areas south of Farroll Road and constructed additional sewer mains in 2020. Collectively, these projects have constructed 7,100 linear feet of new sewer main and cost $1.8 million. These investments were made at the Council’s direction to modernize and expand the City’s sewer infrastructure and reduce the risk of groundwater contamination from septic systems. However, few properties in this area have connected to the new sewer system and most remain on septic tank systems. For the most part, the condition of these private systems is unknown and the potential for groundwater contamination is significant. Since its adoption in 1965, Ordinance 72 has been amended several times as needed to ensure the City’s compliance with new regulations and requirements from SSLOCSD, and to regulate new additions and extensions of the City’s sewer collection system.

This proposed update to the City’s sewer regulations would replace Ordinance 72 and incorporate the language from several other related ordinances and amendments into a single new ordinance.

The City’s Master Fee Schedule would be included by reference instead of having fees included directly in the ordinance and the SSLOCSD regulations regarding character of waste would be adopted by reference. These changes allow fees and sewer discharge regulations to be updated Staff Report: Second Reading and Adoption of Ordinance to Update Sewer Ordinance Page 3 May 22, 2023
without requiring updates to the sewer ordinance. The only regulatory change proposed with this new ordinance is to establish a citywide requirement for connection to the City sewer system and to remove all references to Sewer Assessment District No. 1. Requiring this connection is consistent with previous direction expressed by the Council most recently on July 6, 2020 when the Council approved the Highland Way sewer project.

The new ordinance would establish a one-year time period for all properties in Grover Beach to connect to City sewer when a property is located within 200 feet of a City sewer line. It is estimated that there are currently 115 properties which are on septic that would ultimately be required to connect to City sewer as a result of this new ordinance. Of those, there are only 20 properties that do not have a City sewer line within 200-feet and would not have to connect within one year of adoption of the new Ordinance, but would be required to connect to City sewer within one year of construction of a City sewer within 200 feet of their property.

A sewer main extension planned as part of Capital Improvement Program project 5002, which will begin construction in Fall 2023, will extend a City sewer main to within 200 feet of seven of these 20 remaining properties leaving only 13 properties without a City sewer main within 200 feet. Staff is working to identify projects in which to include additional sewer main extensions in order to provide the remaining 13 properties with a City sewer main within 200 feet of their property. The one-year grace period and distance to sewer requirements of the new ordinance are consistent with the original requirement in Ordinance 72 which helps ensure continuity between current and past development requirements. The proposed ordinance also retains the ability for the Council to grant time extensions where special circumstances exist such as an extreme hardship documented to the City.

Once adopted, staff will work to contact all properties that currently have City sewer available and request that they connect to City sewer within one year of adoption. In the future if additional sewer main projects are planned, staff would contact affected property owners and advise them of the proposed project and connection requirements. Staff anticipates that the majority of these requests will be sent to properties in the industrial area which is defined as the area bounded by South 4th Street to the west, Farroll Road to the north, South 13th Street to the east, and the City’s southern jurisdictional boundary to the south. Property owners connecting to the City sewer would be required to pay sewer impact fees and the cost to construct their connection and abandon their septic tank system. Currently the estimated average cost for this work is approximately $15,000 which includes approximately $3,000 in City Sewer Impact fees and approximately $6,000 in SSLOCSD Sewer Impact fees along with construction costs. The actual fees and construction cost varies depending on the size of their water meter, the distance to the City sewer main and the property use.

On May 8, 2023, the Council introduced and conducted a first reading, by title only, of an Ordinance replacing Chapter 1 (Sanitary Sewer System) of Article VII (Public Works) of the Grover Beach Municipal Code. Since then, staff has sent letters to all properties currently on septic within the City to notify them of this item and its potential impact to their property. Pending Council adoption of the Ordinance and following the effective date of June 23, staff will immediately notify properties within 200 feet of an existing sewer line of the requirement to connect to City sewer.

FISCAL IMPACT
There is no City fiscal impact associated with this action, but once a property establishes connection to the City sewer the City would receive its portion of the Sewer Impact fee and monthly sewer use payments as established by the Master Fee Schedule.

Where a public sewer is located within a distance of two hundred (200) feet (measured along streets, alleys, avenues, or public Right-ofWays upon which the property abuts), or where in the opinion of the City Engineer a public sewer is available, and except as otherwise provided in this Chapter, every building now or hereafter situated within the City of Grover Beach in which plumbing fixtures are now or hereafter installed shall be separately and independently connected to the city sewerage system by the property owner within one year of adoption of this Ordinance by the City Council. Said property owners shall make application for the sewer connection pursuant to Section 7157. All buildings within the City of Grover Beach which are required by this section to be connected to the city sewerage collection system shall be subject to monthly sewer fees commencing on the date of connection to the sewerage collection system. Upon completion of the required connection to the city sewerage system, any existing septic tank or well shall be abandoned and removed or filled, according to the direction of and to the satisfaction of the City Engineer. Upon written application by the property owner, and on a showing of good cause therefor, the City Council may grant an extension of time to connect a building to the city sewerage collection system of up to one year.

Such extension of time may be granted only upon condition that the applicant make monthly payments to the City equivalent to the sewer fees in effect which would apply to the property for which the extension is granted. Failure to comply with any of the provisions of this section shall be deemed to be a misdemeanor.

Sec. 7141.1. Public Nuisance. Notwithstanding any other provisions of the City of Grover Beach Municipal Code, noncompliance with either Section 7140 or 7141 or the further maintenance or use of cesspools, septic tanks, or other means of sewage disposal in the City of Grover Beach Ordinance No. 23-__ Page 6
inconsistent with the requirements of this Chapter, by any person, except as permitted pursuant to this Chapter, is a public nuisance. The occupancy of any building from which sewage is discharged in violation of this Chapter is a public nuisance, and an action may be brought to enjoin any person from occupying any such building.

grant such relief or modification as it finds necessary. The Council, on its own motion and without an application, may, when special circumstances make the application of this chapter a hardship or unjust or inequitable, modify or suspend such portion of this chapter for the period during which the special circumstances exist. An application for relief under this section shall be in writing and shall be accompanied by a filing fee as set forth in the Master Fee Schedule and amended from time to time.

(B) Where necessary, in the opinion of the City Engineer, the owner shall provide, at their expense, such preliminary treatment as may be necessary to reduce the nature and constituents of the discharge to comply with Section 7172 or control the quantities and rates of discharge of such waters or wastes.
(C) Plans, specifications, and any other pertinent information relating to proposed preliminary treatment facilities shall be submitted for the approval of the City Engineer and of the Regional Water Quality Control Board of the State of California, and no construction of such facilities shall be commenced until said approvals are obtained in writing.

Ordinance No. 23-__ Page 9
Sec. 7175. Preliminary Treatment Facilities. Where preliminary treatment facilities are provided for any waters or wastes, they shall be maintained continuously in satisfactory and effective operation, by the owner, at their expense.

Sec. 7176. Installation of Control Manholes. When required by the City Engineer, the owner of any property served by a building sewer carrying industrial wastes shall install a suitable control manhole in the building sewer to facilitate observation, sampling and measurements of the wastes.

Sec. 7178. Special Agreements with Industrial Concerns. No statement contained in this chapter shall be construed as preventing any special agreement or arrangement between the City and any industrial concern whereby an industrial waste of unusual strength or character may be accepted by the City for treatment, subject to payment therefor by the industrial concern.

PART 7 - SEWER SERVICE CHARGES
Sec. 7180. Sewer Rental Charge. Every person whose premises in the City are served by a connection to the sewerage collection system of the City, whereby the sewerage or industrial wastes, or both, are disposed of by the City to the South San Luis Obispo County Sanitation District sewerage treatment plant, or otherwise, shall pay a sewer rental charge as set forth in the Master Fee Schedule as amended from time to time.

Sec. 7185. Penalties. Any person failing to pay the sewer service charge when due, and if the water service has been disconnected, shall pay the sum as set forth in the Master Fee Schedule and amended from time to time.

Sec. 7186. Application of Revenue. PART 8 -- SEWER FACILITY FEES
Sec. 7190. Facility Fees. Facility fees shall be charged as set forth in the Master Fee Schedule and amended from time to time.

Sec. 7191. Payment for Connection. The permit for water and sewer connections shall be made at such time as any building permit is issued.

PART 2. If any section, subsection, subdivision, paragraph, sentence, clause, or phrase of this Ordinance or any part thereof is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portion of this Ordinance or any part thereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause, or phrase thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, paragraphs, sentences, clauses, or phrases be declared unconstitutional.

PART 3. CITY COUNCIL STAFF REPORT
TO: Honorable Mayor and City Council DATE: May 22, 2023 FROM: Matthew Bronson, City Manager
PREPARED BY: Megan Martin, Community Development Director SUBJECT: Development Application 23-14 - Request for a Two-year Time Extension for Development Application 10-03 for the Grover Beach Lodge Project Located at 55 West Grand Avenue

RECOMMENDATION
Adopt a Resolution to approve Development Application 23-14 granting a two-year time extension for Development Application 10-03 (Grover Beach Lodge project) with a previously adopted Final Environmental Impact Report (SCH# 2010051002).

BACKGROUND
Pacifica Companies (Applicant) submitted a request to the City of Grover Beach for a two-year time extension on April 3, 2023, to allow for additional time to obtain building permits and begin construction of the Grover Beach Lodge project (Attachment 2). The approved project consists of a 144-room hotel, a restaurant, and 4,000 square-feet of meeting space totaling approximately 121,000 square-feet located at 55 West Grand Avenue at the end of West Grand Avenue on State property at Pismo State Park.

In April 2014, the Council approved Development Application 10-03 for a Coastal Development Permit and Use Permit. The project was appealed to the Coastal Commission which determined in June 2014 that the appeals raised no substantial issue. The project was amended in January 2017 to add a roof deck and in July 2018 to eliminate the standalone conference center and reconfigure the on-site parking lots and on-site sanitary dump station. These approved amendments are available on the City’s website at:
https://www.groverbeach.org/DocumentCenter/View/13801/Combined-Resolutions-Grover-BeachLodge On May 2, 2023, the Planning Commission unanimously recommended the time extension for your approval. The Council has approved previous time extensions for the project given the complex permitting and development process related to this project. The project is unique because the lead permitting agencies are State Parks and the State Fire Marshal given the location on State property rather than the City. The project also requires permits from Caltrans, State Department of Fish and Wildlife, Union Pacific Railroad, and four utility companies. Review by four State permitting agencies along with the railroad and utility companies requires considerably more time and coordination to receive all required project permits.

In an effort to continue to make progress on the approved permit, the applicant submitted building plans to State Parks and the State Fire Marshal in December 2022. The applicant is requesting Staff Report: Time Extension for the Grover Beach Lodge (Development Application 23-14) Page 2 May 22, 2023
additional time to make corrections to the building documents to satisfy the State agencies’ comments, corrections, and commence construction.

Time extension requests may be approved consistent with Development Code Section 6.30.060.B if the applicant can demonstrate that delays were beyond their control. Based on the financial challenges that resulted from COVID-19 in addition to the complexity of review by several permitting agencies, staff has determined that Pacifica Companies’ request for the extension is reasonable and will allow additional time to respond and complete the plan review comments and have permits issued. Staff has reviewed the project and any applicable Development Code amendments since the project approval and has determined there have been no Code changes that would require revisions to the project at this time. Therefore, staff is recommending that the Council approve the time extension request.

FISCAL IMPACT
There is no fiscal impact associated with this action.

ALTERNATIVES
The Council has the following alternatives to consider:

1. Adopt a Resolution to approve Development Application 23-14 for a two-year time extension for Development Application 10-03 (Grover Beach Lodge project); or

2. Provide alternative direction to staff.

PUBLIC NOTIFICATION
On April 20, 2023, a public hearing notice for the Planning Commission and City Council meeting was mailed to all property owners located within 300 feet of the property, all occupants within 100 feet of the property, all residences in Le Sage Mobile Home Park, and posted as required by City code. On May 11, 2023, a public hearing notice for the City Council meeting was published in the New Times. The agenda was posted in accordance with the Brown Act.

RESOLUTION NO. 23-__

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GROVER BEACH, CALIFORNIA APPROVING DEVELOPMENT APPLICATION 23-14 FOR A TWO-YEAR TIME EXTENSION TO DEVELOPMENT APPLICATION 10-03

FOR THE GROVER BEACH LODGE PROJECT
WHEREAS, Development Application 23-14 has been received from Grover Beach Lodge L.P. (Applicant) requesting a two-year time extension of Development Application 10-03 for the Grover Beach Lodge project located at 55 West Grand Avenue; and WHEREAS, on March 5, 2012, the City Council certified the Environmental Impact Report prepared for the project in compliance with the California Environmental Quality Act (CEQA); and WHEREAS, on April 7, 2014, the City Council conducted a public hearing and adopted Resolution No. 14-19 approving Development Permit 10-03 consisting of a Coastal Development Permit and Site and Architectural Plans; and
WHEREAS, on May 2, 2016, the City Council conducted a public hearing and adopted Resolution No. 16-30 approving a one-year time extension; and WHEREAS, on January 9, 2017, the City Council conducted a public hearing and adopted Resolution No. 17-04 approving an amendment to Development Application 10-03 to allow a roof deck and other minor project revisions; and
WHEREAS, on June 5, 2017, the City Council conducted a public hearing and adopted Resolution No. 17-28 approving a one-year time extension; and WHEREAS, on July 23, 2018, the City Council conducted a public hearing and adopted Resolution No. 18-77 approving an amendment to Development Application 10-03 for minor project revisions and Resolution No. 18-78 approving a one-year time extension; and WHEREAS, on September 3, 2019, the City Council conducted a public hearing and adopted Resolution 19-49 approving a two-year time extension; and WHEREAS, on July 26, 2021, the City Council conducted a public hearing and adopted Resolution 21-26 approving a two-year time extension.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Grover Beach HEREBY makes the following findings and determinations with respect to the time extension for Development Application 23-14:

SECTION 1. Findings for a Time Extension. The City Council finds as follows:

1. There have been no changes in the conditions or circumstances of the site or development since the project approval. The site is unchanged since the project was approved and there have been no Development Code amendments that apply to the project. In addition, the Final Environmental Impact Report (EIR) prepared for the project is still valid because there have been no changes to the site, project scope, or surrounding area that would cause reevaluation of the Final EIR.

Resolution No. 23-__ - Grover Beach Lodge Time Extension Page 2

2. The delay in the project has not been caused by the applicant’s actions or failure to use due diligence in pursuing the required permits necessary to move forward with construction of the project. The applicant has submitted plans to the State (lead agency) and is awaiting comments to move forward. The complexity of needing permitting from multiple State agencies and entities has resulted in delays outside of the applicant’s control.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Grover Beach DOES HEREBY APPROVE Development Application 23-14 for a two-year time extension to Development Application 10-03 consisting of a Coastal Development Permit and Use Permit subject to the condition below.

CONDITIONS OF APPROVAL:

1. This approval authorizes a two-year time extension for Development Application 10-03 for the construction and operation of the approved project. The project shall comply with the adopted City Council Resolution Nos. 14-19, 17-04 and 18-77 and all applicable mitigation measures contained in Resolution No. 12-14 certifying the Final Environmental Impact Report.

Subject: Grover Beach Lodge Project
Project Update and Time Extension Request
Dear Mr. Bronson and Ms. Martin,
As you are aware, we requested a 2-year time extension of our Coasta l Development Permit (CDP), on June, 3 2021, due to the delays caused by the COVID 19 pandemic and subsequent business impacts.

That Development Application 10-03, for a 2-year extension was approved by the Grover Beach City Council on July 26, 2021.

As promised at that time, we authorized our design consultant team to immediately proceed with all the Design, Engineering, and Permit Processing functions, hoping to receive approvals from the JPA which would enable us to begin construction in 2022. Unfortunately, the Fire Marshall required that we update plans to the latest building code, so we had to sta rt over and update all architectural, MEP, and structural drawings to new building codes.

Updated plans, including relocation of meeting facil ities into the ma in Hotel building, were submitted to the State Fire Marshall, City of Grover Beach, and to State Parks in December of 2022. We and our · consultants are currently awaiting official plan-check comments, so we can make any required corrections, obtain Perm its, and start the Construction Bid Process.

We are anxious to start construction of this facil ity, but need additional time to final ize the construction documents, to the satisfaction of the JPA. By means of this letter and Application, we are respectfully requesting approval for a 2-year extension of the approved Coastal Development Permit.

Sincerely,

CITY COUNCIL STAFF REPORT
TO: Honorable Mayor and City Council DATE: May 22, 2023 FROM: Matthew Bronson City Manager
PREPARED BY: Kristin Eriksson, Deputy City Manager
SUBJECT: Award of FY 2023-24 Community Grants

RECOMMENDATION
Approve the recommended FY 2023-24 Community Grants to provide $50,000 in American Rescue Plan Act (ARPA) funding to community-based organizations to provide services or programs for Grover Beach residents.

BACKGROUND:

In 2021, the City was allocated $3.2 million in one-time ARPA funding over a two-year period. As part of the FY 2022-23 revised budget adoption on June 27, 2022, Council provided direction to staff to use $50,000 of that funding for nonprofit assistance grants for agencies serving Grover Beach. On February 15, 2022 the Council approved a Community Grants policy (see Attachment 1) to provide guidance on the award of City discretionary money to be awarded by the City Council in any budget year. The policy establishes eligibility criteria for agencies or organizations and allowable services or programs for community grant funding. The policy also establishes scoring criteria for applications for community grant funding.

Staff used this approved framework to bring these recommendations to the Council to approve the appropriation of funding to eligible nonprofit agencies for the FY 2023-24 program year. The City accepted applications for grants up to $5,000 per organization between March 13 and April 14, 2023. The City received 20 timely applications from various organizations with a total of $102,500 of requested funding. Staff convened a review panel, including the City Manager, Deputy City Manager and two community stakeholders to score the applications. Based on the review panel’s combined scores, staff recommends the Council award a total amount of $50,000 in ARPA funding to 11 organizations, as shown in the chart below:

Community Grants Program Policy
Policy Statement
Grover Beach recognizes that nonprofit organizations can and will perform beneficial services through the granting of local funds. The City Council sets legislative financial management policies, as recommended by staff and advisory committees. Historically, the City Council has awarded community grants, when possible within budgetary constraints, to contribute toward the funding of programs conducted by non-profit organizations that actively enhance the quality of life for Grover Beach residents. This Community Grants Program Policy is designed to establish guidelines to allow for such funding, furthering City Council Goals.

Policy

1. Non-profit organizations must file a City application for the community grants funding program in accordance with the City’s timeline for grant applications, which may vary from year to year. Notification of the open grant period will be provided on the City’s website.

Applications must be submitted to the City Manager’s Office and forms are available on the City’s website or at City Hall. The application format and requested information is provided as Attachment 1.

2. Public funds shall be made available only when the funds are to be expended for a community program or service that will benefit the community and residents of Grover Beach.

3. Funds will not be allocated to the following organizations and activities (so as to maintain local government impartiality towards political campaigns, religious activities and fundraising endeavors):
a. Political action committees, political candidates, political campaigns, or programs engaged in partisan political activity;
b. Any organization conducting, promoting or denigrating religious activity wherein the funds would be used for sectarian purposes;
c. To support an organization’s fundraising event or activity;

4. Funds requested from membership-based adult organizations will not be considered if the funds requested are to be used to directly benefit its members and not the community of Grover Beach at large.

5. Requests for funding will be considered for award by the City Council only during the periods determined in this Council Policy and if submitted on the appropriate City application form.

6. Funding of a program will not constitute a precedent for contributions in subsequent years. 2 Eligibility
To be eligible for award of a community grant, agencies must:

1. Submit a separate, completed application form for each project or program (see Attachment 1).

2. Be incorporated as a tax-exempt nonprofit corporation (IRS 501-C) and/or exist as another government entity.

3. Operate in or provide direct services to the community of Grover Beach.

4. Demonstrate the managerial and financial capability to receive and expend grant funds.

5. Assure compliance with all applicable local, state, and federal laws including but not limited to non-discrimination requirements.

In the review panel’s sole discretion, an otherwise qualified applicant (who is unable, pursuant to an articulated justification consistent with promotion of City’s needs, to reasonably meet application requirements) may be granted an exception by the panel from one or more application requirements.

Programs for which funding is requested must qualify under one of the categories below:

1. Community and Social Services: Funding for programs and services that address identified community needs or problems (as stated in the City’s General Plan, Major City Goals, or other policies). These may include, but are not limited to, the following:
a. Crisis Intervention and/or Centers
b. Health and Safety
c. Youth-Serving Agencies
d. Social service agencies and programs.
e. Bilingual service agencies
f. Low-income service agencies
g. Homelessness

2. Project: Funding for one-time projects designed to address a significant community need or problem. City funding shall be limited to a specific timeframe, usually not more than one year.

Funding Request
All applications must submit a completed City application (Attachment 1) and the following attachments unless already on file with the City:

1. Names/addresses of current Board of Directors

2. Board approved current operating budget
3 Evaluation/Scoring Criteria
All applications will be submitted to the Office of the City Manager, C/O of the Deputy City Manager, for consideration. The Deputy City Manager will forward all qualifying applications to a review panel comprised of City staff and community stakeholders for review and consideration.

The review panel will score each qualifying application up to a possible total of 100 points, using the following criteria:

Criteria Total Possible Points
Degree to which the program or services
focus on the City of Grover Beach and its

After review, the scored applications will be presented to the City Council for their consideration.

At the time of consideration and evaluation, staff will advise Council of available funding amount to be awarded. The Council will determine which applications will receive available funding and will direct staff to include that funding in the draft proposed budget.

Post Funding Application Requirements

This report must include a complete financial statement detailing all 4 expenditures of City monies for the program(s) covered under the grant and a narrative report on the project or program and its significance. The financial and narrative report should compare actual expenditures and accomplishments with the budget and objectives cited in the original proposal.

Failure to comply with the reporting requirements by the stipulated dates may lead to termination of the grant agreement and funds being returned to the discretion of the City Council. Failure to comply with reporting requirements will also automatically exclude an agency from eligibility to receive community grant funding from the City for the following two fiscal years

6. Funded applicants must return to the City any unexpended funds at the end of the oneyear period, or agreed upon project or program timeframe, or whenever the City reasonably determines that the applicant has not performed in accordance with the approved program proposal.

7. Any funds returned in accordance with this policy shall be returned to the fund from which they were allocated from.

8. City moneys shall be used only for the purpose and program(s) duly authorized and in accordance with the approved budget. Any deviation from the approved program proposal may be made only with the City’s prior written approval which requires Council authority.

BACKGROUND
Historically, the City displays the United States Flag, the State of California Flag, and the City of Grover Beach Flag at City Hall and other City facilities in accordance with Federal and State law.

Additionally, since 2020, the City has displayed the Pride Flag during Pride Month in June to recognize and celebrate the members of the Lesbian, Gay, Bisexual, Transgender, and Queer (LGBTQ) community in Grover Beach.

On May 8, 2023, the City Council adopted a resolution to establish a formal policy for displaying flags at City Hall and other City facilities. Following this adoption, the Council directed staff to return with a resolution to authorize flying the Pride Flag as a symbol of support for the LGBTQ community during the month of June consistent with the adopted flag policy.

FISCAL IMPACT
There is no direct fiscal impact to this action.

ALTERNATIVES

1. Adopt a resolution to authorize the flying of the Pride flag at City Hall during the month of June 2023; or
