Agenda Item No. 5

CITY COUNCIL STAFF REPORT
TO: Honorable Mayor and City Council DATE: February 26, 2024 FROM: Matthew Bronson, City Manager

PREPARED BY: Megan Martin, Community Development Director SUBJECT: Conduct a Public Hearing and Second Reading, by title only, and Adopt Ordinance No. 24-02 to Amend Municipal Code Article IX (Development Code); and Adopt Revisions to the City’s Short-Term Rental Ordinance; and Adopt a Resolution to Approve a Local Coastal Program Amendment

RECOMMENDATION
1) Conduct a public hearing and second reading, by title only, and adopt Ordinance No. 24- 02 to amend Article IX (Development Code) of the Grover Beach Municipal Code; and Adopt Revisions to the City’s Short-Term Rental Ordinance; and 2) Adopt the Resolution approving a Local Coastal Program Amendment.

BACKGROUND
On February 13, 2024, City Council introduced and conducted a first reading, by title only, of Ordinance No. 24-02 amending Article IX of the Grover Beach Municipal Code to regulate ShortTerm Rentals (STRs). The amendment to Article IX requires the Council adopt a resolution to approve a corresponding Local Coastal Program (LCP) Amendment. The California Coastal Commission (Coastal Commission) will consider the LCP Amendment following local adoption.

Staff is requesting that Council conduct a second reading of the Ordinance, by title only, and adopt the Resolution to approve the LCP Amendment.

Overview of STR Regulations
On June 17, 2019, the City Council (Council) adopted a Short-Term Rental (STR) ordinance (Ordinance No. 19-04) that permits owner-occupied and non-owner occupied STRs in the City1 .

Following adoption, staff developed “Administrative Rules” to inform applicants of the requirements to apply for and operate an STR. A “Good Neighbor Brochure” was also prepared by the City for operators to communicate to their visitors on how to be considerate and responsible neighbors. After implementation, City staff committed to regular reviews of the program to ensure its ongoing success and to identify deficiencies and areas for policy improvement or refinement.

On September 27, 2021, the Council received a presentation on the implementation of the STR Program. The Council provided policy direction at that time to modify the current Administrative Rules limiting multi-family development to one STR permit, establish a minimum stay requirement (12 nights per year) for non-owner occupied STRs, and create a waitlist for non-owner-occupied 1 June 17, 2019 City Council Staff Report - https://www.grover.org/DocumentCenter/View/8652/Item-7_ShortTerm-Rentals?bidId= Staff Report: Short-Term Rental Ordinance Revisions Page 2 February 26, 2024
permits. On August 28, 2023, the Council received another presentation on the status and implementation of the STR regulatory program2
. Staff recommended areas in the ordinance for
refinement and the Council provided subsequent policy direction to consider changes in the City’s administration of its waitlist procedures, local contacts, STRs within Accessory Dwelling Units (ADUs), required annual minimum stays, and number of non-owner-occupied permits.

To date, the City has issued 113 STR permits which include 20 owner-occupied permits and the remaining non-owner occupied permits. There are two pending applications within the Coastal Zone and five pending applications outside the Coastal Zone. Of the permitted operators, 97% have listed their rentals on advertising platforms such as VRBO, Airbnb, and Booking while the remaining 3% utilize referrals to rent to select guests throughout the year.

The City has collected approximately $1.77 million in Transient Occupancy Tax (TOT) revenue since the program’s inception in 2019. STR permit holders are also responsible for paying the City’s TOT (12%) and the San Luis Obispo County’s Tourism Management District (TDM) tax (1.5%) each quarter for an effective tax rate of 13.5%. In terms of revenue, STRs account for approximately 50% of the total TOT revenue collected by the City. Below is a table showing the TOT revenue generated annually:

Fiscal Year (FY) TOT Revenue % Increase
2019-20 $103,540.90 --
2020-21 $298,915.02 +189%
2021-22 $508,362.22 +70%
2022-23 $458,567.07 -10%
2024 to date $409,773.12 --
Taxes are remitted monthly by permittees via Host Compliance, the City’s third-party vendor for registration, monitoring, and tax remittance. Host Compliance also provides compliance and enforcement assistance. The City has one Code Compliance Officer who responds to all compliance issues associated with STRs, in addition to their other responsibilities. Since 2019, there have been a total of 75 compliance cases for permitted and unpermitted STRs (10 and 65, respectively). These cases range from noise, parking, and waste, to illegal STRs.

Short-Term Rental Survey
Staff prepared and distributed a survey to gauge community and STR permit holders’ opinions of the STR Program3
. Questions included basic demographics, impact of STRs on the neighborhood, overall satisfaction with the current STR regulations, and suggestions for change.

The City received 121 responses and the survey indicates that 75% of respondents are satisfied with the City’s STR Program and 86% find STRs to have a positive impact on neighborhoods. 2% percent of operators reported challenges in complying with the City’s regulations, whereas part of the same question, when asked to specify those challenges, 17% responded with feedback, indicating more respondents provided feedback than reported challenges. Attachment 5 includes a summary of this survey data,

Summary of Ordinance Changes
The Planning Commission (Commission), at a regular meeting on February 6, 2024, reviewed recommended changes to the STR Ordinance, and, following public comment and Commission deliberation, recommended the Council adopt Ordinance No. 24-02 amending the City’s ShortTerm Rental Ordinance (Ordinance No. 19-04) and approve a Local Coastal Program Amendment. The recommended changes included minor revisions to the following areas:
• Administration of STR waitlist procedures. A review of the waitlist administration process revealed that some participants, upon the availability of permits, would repeatedly choose to “pass,” causing significant delays in issuance. Council directed staff to revise the rules, limiting participants to a single “pass” to streamline the process and establish a more efficient issuance methodology. These changes are now reflected in the updated Administrative Rules and Regulations.
• Local contact requirements. The STR Ordinance established a local contact requirement to ensure a responsible person was available and able to be physically present at the STR within 30 minutes of receiving a complaint. Council directed staff to expand to a 45-minute radius which effectively would allow a local contact to live within San Luis Obispo County and northern Santa Barbara County (approximately San Miguel to Buellton). This does not affect or change the Administrative Rule that a local contact must respond to a complaint within 30 minutes of receiving a complaint.
• STRs within Accessory Dwelling Units (ADUs). State law (California Government Code §65852.2.e.4) requires ADUs to be rented for at least 30 days. The City’s current ordinance states that any ADU that was existing, under construction, or in building plan review prior to September 11, 2020, could be used as an STR. However, State law supersedes this use and does not allow any ADUs to be used as STRs. The ordinance has been modified to comply with State law. To implement and administer this change, any renewal application received will be rejected and the ADU ineligible to further participate in the program.

Minimum night stay requirement. Upon direction from Council to consider increasing this requirement, staff analyzed increasing the current 12-night minimum per fiscal year to 24- and 50-night minimums. In reviewing the non-owner occupied STRs for the last fiscal year (2022-23), only 15 of the 100 permitted STRs reported fewer than 25 stays per year, and 30 STRs reported fewer than 50 stays per year. Based on an estimated average TOT tax revenue of $41 per night, increasing the minimum night stay to 24 would yield approximately $6,000 in additional revenue annually under the program and eliminate 13% of non-owner-occupied permit holders. Increasing the minimum stays to 50 would yield approximately $28,800 in additional TOT revenue annually and eliminate 33% of non-owner-occupied permit holders.

While increasing the requirement may result in more turnover in the waitlist, the additional stays may result in increased fiscal impacts in responding to complaints and costs associated with enforcement. Furthermore, increasing the minimum number of stays could be considered inconsistent with the intent of the SLO County Regional Compact Policy R6: “Encourage rental units be prioritized for long-term residents rather than short term users or vacation rentals”, which is further supported by the City’s Housing Element (Chapter 2 – Regional Visions for Housing). Therefore, the revised STR Ordinance does Staff Report: Short-Term Rental Ordinance Revisions Page 4 February 26, 2024
not increase the minimum stay requirement though Council could modify the ordinance to increase this requirement.

During the Commission meeting, public comment was received requesting the City not increase the minimum stay requirement and continue allowing permittees to only rent up to 12 nights per year. The Commission did not recommend changes to this requirement but recommended the STR Ordinance m the definition of the term ‘stay’ to be consistent to an ‘overnight accommodation’ rather than the length of the stay (see Attachment 4 – Glossary). This change was recommended to provide clarification to non-owner occupied STRs regarding the minimum stay requirement. Proceeding the introduction of the changes to the STR Ordinance, staff will continue to work to improve upon the Rules and Regulations to provide greater clarification, internal consistency, and improve readability. • Additional Clean-up Items. In addition to those items directed by Council for consideration and clean-up, as well as those suggested by the Commission, staff identified necessary items throughout the ordinance including minor changes and clarifications to Definitions and Permit Revocation. These changes provide for consistency throughout the ordinance as well as compliance with State law.

A track-changes version of the ordinance has been included to allow the public and Council to review the modifications (Attachment 3). The ordinance amendments also prompted minor revisions to the Administrative Rules and Regulations to eliminate inconsistencies and ensure clarity and compliance with the adopted regulations (Attachment 4).

Ordinance Effective Date
Amendments to the STR Ordinance would result in changes to Chapters 4 and 9 of the Development Code (Article IX of the Municipal Code) that constitute the ordinances for implementation of the City’s Local Coastal Program (LCP). Therefore, this amendment requires an LCP Amendment in compliance with the California Coastal Act, which requires the Coastal Commission’s approval prior to the ordinance taking effect in the Coastal Zone. Following the adoption of the ordinance, staff will forward the LCP amendment to the Coastal Commission for review with the amended ordinance becoming effective the day after Coastal Commission action.

ENVIRONMENTAL REVIEW
This action is not a project within the meaning of the California Environmental Quality Act (California Public Resources Code §§ 21000, et seq., “CEQA”) and CEQA Guidelines (Title 14 California Code of Regulations §§ 15000, et seq.) Section 15378(b)(5). The revisions to the Shortterm Rental Ordinance are administrative and will not result in direct or indirect physical changes in the environment and are therefore exempt from CEQA.

ALTERNATIVES
The City Council has the following alternatives:

1. Conduct a public hearing and second reading, by title only, and adopt Ordinance No. 24- 02 to amend Article IX (Development Code) of the Grover Beach Municipal Code; and Adopt the Resolution approving a Local Coastal Program Amendment; or

2. Provide alternative direction to staff.

Staff Report: Short-Term Rental Ordinance Revisions Page 5 February 26, 2024

FISCAL IMPACT
The adoption of these amendments to the City’s Short-Term Rental Ordinance would not have a significant fiscal impact. The cost associated with issuance and renewal of permits and regulation of STRs is recouped as part of the annual permitting fee.

PUBLIC NOTIFICATION
On February 15, 2024, a one-eighth page public hearing notice was published in New Times and sent to all current STR operators. A courtesy notice was also sent to all individuals currently on the STR waitlist. The agenda was posted in accordance with the Brown Act.
