Agenda Item No. 7

CITY COUNCIL STAFF REPORT
TO: Honorable Mayor and City Council DATE: March 25, 2024 FROM: Matthew Bronson, City Manager
PREPARED BY: Gabriel Munoz-Morris, Senior Engineer
SUBJECT: Acceptance of Offer of Dedication from Final Parcel Map GB 00-028 for Street Purposes and a Drainage Easement

RECOMMENDATION
Accept the offers of dedication on Final Parcel Map GB 00-028 for street purposes and a drainage easement and authorize the City Clerk to record the acceptance.

BACKGROUND
On May 15, 2000, the City Council accepted Final Parcel Map GB 00-028 for a two (2) parcel subdivision of a property bounded by the Union Pacific Railroad tracks to the west, Newport Avenue to the north, Front Street to the east, and West Grand Avenue to the south. At the time the map was recorded, the City accepted the dedications for water and sewer easements but rejected the dedications for street purposes and drainage easement without prejudice as the associated improvements were not constructed at that time. Per Section 8.80.020 of the City’s Development Code, and in compliance with California Government Code Section 66477.2 and Code of Civil Procedure Section 771.010, the City may, at a later date, accept dedications once appropriate as the dedications must remain open once offered.

The street and drainage improvements associated with the subdivision have since been constructed per the improvement plans. The proposed resolution would formally accept the 30- foot dedication on Front Street for street purposes, the 35-foot dedication on Ramona Avenue for street purposes, the 50-foot dedication on West Grand Avenue for street purposes, and the 10- foot dedication for a public drainage easement between the intersection of Ramona Avenue and Front Street and the Union Pacific Railroad Right-of-Way. The subject sections of Front Street, Ramona Avenue, and West Grand Avenue are all being used by the public as public streets.

The need for this action was discovered by staff during a review of an upcoming development project at one of the parcels created by Parcel Map GB 00-028 (197 West Grand Avenue).

Acceptance of the dedications would confirm the public interest in the improvements previously dedicated, which is required for existing uses of the site and proposed uses after this new development project is entitled. Staff will also confirm that other similar dedications from past developments throughout the City have been accepted formally and return to Council with resolutions for acceptance if any were not previously formally accepted.

FISCAL IMPACT
There is no fiscal impact associated with this action. The City has been maintaining the subject streets and drainage infrastructure and formal acceptance of the dedications at this time will not create unexpected maintenance costs going forward.

ALTERNATIVES
The Council has the following alternatives to consider:

1. Accept the offers of dedication on Final Parcel Map GB 00-028 for street purposes and a drainage easement and authorize the City Clerk to record the acceptance; or

2. Do not accept the offers of dedication; or

2. Provide alternative direction to staff.

PUBLIC NOTIFICATION
The agenda was posted in accordance with the Brown Act. The property owners of the two parcels created by Final Map GB 00-028 were notified of this proposed action by the Council.
