RECOMMENDATION
Adopt a Resolution updating the Citywide Master Fee Schedule approving cost increases based on the Consumer Price Index and other changes to become effective July 1, 2024.
BACKGROUND
The Citywide Master Fee Schedule (“Schedule”) summarizes all fees the City charges for various services and permits, such as building permits and recreational classes. This schedule ensures transparency and consistency in the fees charged for services to provide cost-recovery to the General Fund. Most fees are developed based on the cost to the City to provide the service or on the impact the activity has on the City or its property.
Adjusting the fees in accordance with the Consumer Price Index (CPI) ensures sufficient costrecovery for the City. The adjustment requested for the Schedule is based on the CPI for Los Angeles-Long Beach-Anaheim, CA which had an increase of 3.475% for the year ending on December 31, 2023. Staff would note that the City has some fees which are pass-thru fees from other agencies and are only updated when the pass-thru agencies change their fees. One such agency is the South San Luis Obispo County Sanitation District which provides wastewater treatment to Grover Beach residents and businesses. Another such agency is Waste Connections which provides garbage service to residents. As of January 19, 2024, Waste Connections has increased their fees for service to customers.
Below is a description of proposed changes to the City’s Master Fee Schedule beyond the CPI adjustments shown by department.
Community Development Department Deposits, Fees, and Fines Staff are proposing adjustments to the deposit amounts for the Administrative Development Permit, Administrative Coastal Development Permit, Coastal Development Permit, and Use Permits for Proposed Cannabis activities, and Subdivision Maps to reflect updated estimates of time for staff to complete/review these permits. Staff have also removed the Administrative Use Permit deposit as this permit type was eliminated with the most recent Development Code Update in 2022. Adjustments have also been made to Building Permit fees related to the Residential and Commercial Solar Photovoltaic permits. These changes reflect the limit on solar permit costs pursuant to State Law (AB 1132).
In addition, staff is proposing to remove the Administrative Citations for Misdemeanors within the Penalties & Fines section of the Community Development Department schedule. Misdemeanor Staff Report: Annual Master Fee Schedule Update Page 2

citations are criminal in nature and must be issued by the Grover Beach Police Department (GBPD) and not through Code Compliance. In addition to the removal from this section of the fee schedule, staff are proposing to modify the title of the “Administrative Citations for Misdemeanors – Short-Term Rentals” to read “Administrative Citations – Short-Term Rentals”. Any Short-Term Rental violations considered misdemeanors will be cited by the GBPD as outlined in the Penalties & Fines section of the fee schedule.
Community Services Fees
Staff are proposing the removal of all class fees from the Schedule, as Instructors are Independent Contractors and set their own fees for classes. The City receives a flat percentage per class listed in the Master Fee Schedule. Additionally, updates are recommended to lower Special Event/Outdoor Assembly pre-application review fees to encourage more special events. Staff is also proposing a marginal increase to the cleaning fee for Ramona Garden Park and the Community Center which will now reflect actual costs plus a 10% administrative cost. Ramona Garden Park and Community Center deposits for high and low impact events have become a flat fee for any event held at these facilities.
Fees for recreational services (pages 18-19 of Attachment 1) for non-residential and residential customers have also been combined into one category as fees for recreational services have not differed in the implementation for both non-residential and residential customers.
Utility Rate Fees
The updated Master Fee Schedule includes utility rate increases as approved by the Council in December 2023 (see pages 9-11 of the Master Fee Schedule included in Attachment 1). Staff is reviewing the utility rate structure in light of cost increases for the Central Coast Blue project and will present options to the Council for review at the April 22nd meeting.
FISCAL IMPACT
The fiscal impact is estimated to be an increase between $20,000 and $25,000 in General Fund revenue depending upon the level of activity for the related services during FY 2024-25.
ALTERNATIVES
The Council has the following alternatives to consider:
1. Adopt a Resolution updating the fee increases to the Master Fee Schedule; or
2. Do not adopt the Resolution with fees remaining unadjusted for inflation.

RESOLUTION NO. 24-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GROVER BEACH,
CALIFORNIA, AMENDING THE MASTER FEE SCHEDULE
WHEREAS, California state law authorizes local governments to charge fees for public services based on the estimated reasonable cost of providing the service for which the fees are charged; and
WHEREAS, the City Council has the authority to increase certain fees annually, based on an appropriate measure within the nationally published Consumer Price Index, or by reevaluation and assignment of actual municipal costs to cover the estimated cost of providing the services for which such fees are levied; and
WHEREAS, Staff recommends adjustments to certain current fees based on CPI of 3.475% for Los Angeles-Long Beach-Anaheim, CA as of year ended December 31, 2023 and other cost changes in certain areas to achieve full cost recovery for City services; and WHEREAS, the City Council has held a public hearing at a Regular Meeting concerning the adoption of said fees and has made available to the public, at least 10 days before the hearing, data on the amount of costs or estimated costs required to provide the services for which the fees are levied and the revenue sources anticipated to provide the services; and WHEREAS, the City Council of the City of Grover Beach determines that the proposed annual adjustments to the Master Fee Schedule are necessary to cover the estimated costs of providing the services.
NOW, THERFORE, BE IT RESOLVED that the City Council of the City of Grover Beach, California, does hereby:
1. The Council finds the updated fees propose a reasonable relationship between the fees and services, and the time for payment set forth in this resolution are proper and necessary and the information upon which the fees are based is correct and accurate; and
2. Council hereby adopts and approves the Master Fee Schedule as amended and set forth in Exhibit “A” attached to this Resolution; and
3. The updated fees listed in Exhibit “A” of this resolution shall become effective beginning July 1, 2024; and
4. The provisions of this resolution are severable, and the validity of any part thereof including any fee shall not affect the validity or effectiveness of the remainder of the resolution.

Late Fees are imposed for residential customers over 30 days delinquent and commercial customers over 30 days delinquent. The fee is 1.5% per month of the outstanding charge, with a minimum fee of $5.00. No prior notice is required, as this late fee policy is stated at the bottom of every bill.
