Agenda Item No. 8

CITY COUNCIL STAFF REPORT
TO: Honorable Mayor and City Council DATE: June 24, 2024 FROM: Matthew Bronson, City Manager
PREPARED BY: John Peters, Chief of Police
SUBJECT: Resolution to Accept the California Highway Patrol’s Cannabis Tax Fund Grant Program Award.

RECOMMENDATION
Adopt a Resolution approving the acceptance of California Highway Patrol’s Cannabis Tax Fund Grant Program funds in the amount of $116,133.64 for FY 2024-25.

BACKGROUND
With the passage of Proposition 64 (the Control, Regulate, and Tax Adult Use of Marijuana Act or AUMA), California voters mandated the State set aside funding for the California Highway Patrol (CHP) to award grants to local governments and qualified nonprofit organizations with the goal of reducing impaired driving crashes, increasing public awareness surrounding the dangers of impaired driving, and making roadways safer to travel. In February 2024, the Police Department applied to the California Highway Patrol Cannabis Tax Fund Grant Program (CTFGP) for a $116,133.64 grant and received notice on June 7, 2024, that the City was selected to receive the requested grant funding.

The grant will allow the Police Department to purchase Preliminary Alcohol Sensors (PAS), have officers dedicated to impaired driving saturation patrols, host impaired driving booths at community events for public education, and provide training to improve officers' ability to detect impaired driving. Officers will receive training in the form of Standardized Field Sobriety Tests (SFST), Advanced Roadside Impairment Enforcement (ARIDE) and Drug Recognition Expert (DRE) training. With this advanced training, officers will staff impaired driving saturation patrol details where extra officers will be assigned to a focused patrol during times of increased impaired driving incidents. While investigating DUI incidents officers will utilize PAS devices. The grant will allow officers to focus public education and Traffic / DUI enforcement efforts to reduce the number of impaired driving incidents and DUI-Related traffic collisions within Grover Beach.

The goals of the proposed program are to reduce DUI driving and DUI related collisions during the grant period. To achieve these goals, the Police Department will conduct the following:
 Conduct eight impaired driving saturation patrols.
 Host an Impaired Driving Prevention Booth at the Grover Beach Summer Concerts and Stone Soup Festival.
 Train five officers on Standardized Field Sobriety Tests, 10 officers on Advanced Roadside Impairment and Enforcement Training, and one officer on Drug Recognition Expert.  Purchase six handheld Preliminary Alcohol Screening devices.

If approved by the Council, the CHP CTFGP grant requires the signature of the Chief of Police to Staff Report: California Highway Patrol Grant Award Acceptance June 24, 2024

enter into a contract for acceptance of the funds. The funds approved by the grant must be utilized during FY 2024-25 and must not be used to supplant previously approved expenditures or the General Fund. The City does not have a matching funds requirement for this grant; however, the funds for the grant are paid back to the City on a reimbursement basis. If accepted, the City will be reimbursed by the State on a quarterly basis for operational expenses related to this program.

The funding for this grant had been included in the proposed FY 2024-25 budget.

FISCAL IMPACT
The grant requires the City to expend the approved grant amount of $116,133.64 for these Police Department operations with full reimbursement being provided by the California Highway Patrol during FY 2024-25.

ALTERNATIVES
The Council has the following alternatives to consider:

1. Adopt a Resolution approving the acceptance of California Highway Patrol’s Cannabis Tax Fund Grant Program funds in the amount of $116,133.64 for FY 2024-25; or
