CITY OF GROVER BEACH
POLICIES AND PROCEDURES FOR CONDUCT AND DECORUM AT COUNCIL MEETINGS (Pursuant to Resolution No. 07-44, adopted 04-16-07, revised 02-18-2020) The City Council and staff welcomes and encourages civic participation and debate on issues. The Council values the public’s opinion and in every Council meeting invite and encourages the public to address the Council on any matter of interest. The Council adopted these policies and procedures for appropriate conduct and decorum at Council meetings and establish guidance for public participation during Council meetings.
These policies will foster and provide greater clarity to preserve the intent of open government and maintain a positive environment for public input and City Council decision-making.
1.0 DECORUM AND ORDER – IN GENERAL
1.1 The presiding officer is responsible for the maintenance of order and decorum at all times.
1.2 The presiding officer shall determine all points of order subject to the right of any Council member to appeal to the City Council by majority vote. If any appeal is taken, the question shall be “Shall the decision of the presiding officer be sustained” in which event a majority vote of the Council shall govern and conclusively determine such question of order.
1.3 All Council members, staff members and members of the public should speak respectfully and avoid the use of profanity, vulgarity and slanderous comments. Recognizing that the First Amendment precludes the City Council form prohibiting speakers from speaking based upon the content of their speech, the presiding officer shall use their best efforts, short of enforcement action, to remind and encourage all participating in the meeting to keep their speech respectful towards others and within bounds appropriate for children and persons of sensitivity toward course language as a courtesy to others present or otherwise viewing Council meetings.
2.0 DECORUM AND ORDER – COUNCIL MEMBERS
2.1 Manner of Speaking.
Any Council member desiring to speak shall first address the presiding officer. Upon recognition by the presiding officer, the Council member shall speak only to the question under debate.
U2.1(a) Questioning Staff.
A Council member desiring to question the staff should address his question to the City Manager, or, in appropriate cases, the City Clerk or City Attorney, who shall be entitled either to answer the inquiry or to designate some staff member for that purpose. Such a designation may be made at the time of any staff presentation or on the agenda listing for the item.
U2.1(b) Interruptions.
Once recognized, a Council member shall not be interrupted while speaking unless called to order by the presiding officer; unless a point of order is raised by another Council member, or unless the speaker chooses to yield to questions from another Council member.
3.0 DECORUM AND ORDER – STAFF
3.1 City Manager Responsibilities
The City Manager is responsible for ensuring that members of the administrative staff observe the rules of decorum and order set forth in this Policy.
3.2 AAddressing the City Council
Any administrative staff member desiring to address the City Council or members of the public shall first be recognized by the presiding officer. All remarks shall be addressed to the presiding officer and not to any individual Council Member or member of the public. Administrative staff members shall accord the utmost courtesy to the City Council, other administrative staff members and the public.
4.0 DECORUM AND ORDER – MEMBERS OF THE PUBLIC
4.1 AAddressing the City Council
Any member of the public desiring to address the City Council or members of the public shall first be recognized by the presiding officer at the appropriate place on the agenda. All remarks shall be addressed to the presiding officer and not to any individual Council Member, City Manager, City Attorney or member of the administrative staff or member of the public.
4.2 Time Limitation for Addressing the City Council
Public comment when addressing the City Council shall be generally limited to three (3) minutes per speaker. Depending on the extent of the agenda and the number of persons desiring to speak on an issue, the presiding officer may, at the beginning of the hearing, set a different time limit for each speaker. Any person may speak for a longer period of time upon approval from the presiding officer, when deemed necessary, for instance when a person is speaking on behalf of a group or has a graphic or slide presentation requiring more time.
4.3 Failure to Yield, Disruptions
Any person who refuses to relinquish the floor after their allotted time or while attending the City Council meeting engages in conduct or speech which disrupts the business of the meeting shall be brought to order and/or removed from the room if the sergeant-at-arms is so directed by the presiding officer.
Disruptive remarks from the audience, stamping of feet, clapping, whistles, yells and similar demonstrations shall not be permitted by the presiding officer who may direct the sergeant-at-arms to remove such offenders from the room.
4.4 Prosecution
Aggravated cases shall be prosecuted on appropriate complaint signed by the presiding officer.
5.0 ENFORCEMENT OF DECORUM
5.1 The Chief of Police or his designee shall be the ex-officio sergeant-at-arms of the City Council. The sergeant-at-arms shall carry out all legal and valid orders and instructions given by the presiding officer for the purpose of maintaining order and decorum in the Council Chamber. Upon instructions from the presiding officer, it shall be the duty of the sergeant-at-arms to remove any disorderly person from the Council Chambers or place the disorderly person under arrest or both.
5.2 As set forth in Government Code Section 54957.9, in the event that any meeting is willfully interrupted by a person or group of persons so as to render the orderly conduct of such meeting unfeasible or impedes the ability of the Council to hold the meeting, and order cannot be restored by the removal of individuals who are willfully interrupting the meeting, the presiding officer may order the meeting room cleared and continue in session. Only matters appearing on the agenda may be considered in such a session. Duly accredited representatives of the press or other news media, except those participating in the disturbance, shall be allowed to attend any session held pursuant to this Section. Nothing in this Section shall prohibit the City Council from establishing a procedure for readmitting an individual or individuals not responsible for willfully disturbing the orderly conduct of the meeting.

Agenda Item No. 5
CITY COUNCIL STAFF REPORT
TO: Honorable Mayor and City Council DATE: December 9, 2024 FROM: Matthew Bronson, City Manager
PREPARED BY: Greg Ray, Public Works Director/City Engineer Erin Wiggin, Capital Improvement Project Manager
SUBJECT: Authorization to Purchase Ramona Garden Park Restroom Building
RECOMMENDATION
Authorize a purchase order in the amount of $229,377 to StructureCast for the restroom building associated with the Ramona Garden Park Rehabilitation Project, Phases 1 and 2 (CIP 1259).
BACKGROUND
On April 10, 2023, the City Council provided direction for the design of the new restrooms to be located near the sidewalk along North 10th Street and near the new playground. The Council selected a three-person restroom building with a shed style roof and wood cladding that will complement the bandshell. Construction of Phases 1 and 2 of the Ramona Garden Park Rehabilitation Project is expected to begin in spring 2025. Due to the long lead time to construct and deliver the restroom structure, staff is recommending the City purchase the equipment directly at this time, rather than incorporating the purchase into the bid process which is anticipated to start in mid-December with an award date anticipated in mid-February.
The City’s Purchasing Policy requires staff to obtain proposals from three vendors. Staff solicited proposals from StructureCast, the Public Restroom Company and Romtec. The scope of work includes furnishing and installing the restroom structure. The proposed designs are based on Council’s selection from a sample design provided by the Public Restroom Company; however, they proposed the highest cost of the three vendors. Romtec can provide a style and finish that is similar to Council’s selection, however their proposal indicated a price range instead of a fixed price for the structure and a higher price for installation of the structure. StructureCast is a custom precast supplier that can create a product that aligns with Council’s selection at a lower cost, so staff is recommending purchasing the restroom from StructureCast.
FISCAL IMPACT
The cost of this purchase is $229,377. Given the timing, General Fund reserves will be used to fund this purchase which will be offset with the $3.3M CDBG grant awarded to the Ramona Garden Park Rehabilitation Project, Phases 1 and 2 (CIP 1259). The City anticipates being able to receive and expend these grant funds within the next few months.
Staff Report: Authorization to Purchase Ramona Garden Park Restroom Building Page 2 December 9, 2024
ALTERNATIVES
The Council has the following alternatives to consider:
1. Authorize a purchase order to StructureCast in the amount of $229,377 for the restroom associated with the Ramona Garden Park Rehabilitation Project, Phases 1 and 2 (CIP 1259); or
2. Do not authorize a purchase order and provide alternative direction to staff.
PUBLIC NOTIFICATION
The agenda was posted in accordance with the Brown Act.

Owner/General Contractor verification of site access to allow Building Delivery:
1. You certify to PRC that suitable delivery access to the proposed building site is available. Suitable access is defined as 14’ minimum width, 16’ minimum height, and sufficient turning radius for a crane and 70’ tractor-trailer.
2. Our cost is based upon the crane we provide being able to get within 35’ from the building center and for the delivery truck to be no more than 35’ from the crane center picking point.
3. If the path to the building site traverses curbs, underground utilities, landscaping, sidewalks, or other obstacles that could be damaged, it is the Owner/General Contractor ‘s responsibility for repair and all costs, if damage occurs.

improved site, Owner should stop site watering several days before delivery to minimize the impact on the soils for the heavy equipment needed for installation.
Caution: If site is not ready for our field crew to perform their delivery and if no notice of delay in readiness from Owner/General Contractor is received, PRC will provide a change order for remobilization on a daily basis until the site is ready for us. Ready means that the site pad is completed, the corner required survey stakes are in place, the slab elevation stakes are in place, the location of the front of the building is confirmed on site, and access to the site is available from an improved roadway. Owner/General Contractor shall sign the change order before we will continue delivery.

Special Conditions, Permits, and Inspection Fees:
Follow any published specifications governing local building procedures for applicable building permit fees, health department fees, all inspection fees, site concrete testing fees, and compaction tests, if required by Owner. PRC is responsible for all required State inspections and final State insignia certification of the building, if applicable.
Jurisdiction for Off-site Work:
Jurisdiction, for permitting and inspection of this building shall be either the State agency who manages prefabricated building compliance in the state or the local CBO (when the State does not provide certification.) If the responsibility for building inspection is the local CBO, we will provide a certified plan set, calculations, and a third-party engineer inspection report for any and all closed work the local official cannot see.
PUBLIC RESTROOM COMPANY SCOPE OF WORK:
Our In Plant/Off-Site Construction Scheduling System:
PRC has several off-site manufacturing centers in the United States, strategically located, with the proper equipment and trained staff to fabricate our custom buildings to our high-quality fit and finish standards. PRC manages quality control in our off-site production facility to comply with the approved drawings and provides an inspection certification and photos as required. When proprietary materials, which we have designed and fabricated, are part of the project, PRC supplies the manufacturing centers Ramona Garden Park – Grover Beach, CA | 10.11.2024| Reference # 11558 2587 Business Parkway | Minden, NV 89423 | www.PublicRestroomCompany.com | p: 888-888-2060 | f: 888-888-1448 4 of 9
with these proprietary PRC components. We then schedule the in-plant construction process to coordinate with your delivery date through our Operations Division field staff. We guaranty on time at cost delivery weather permitting.
Special Payment and Progress Billing Terms:
Invoicing begins on the 30th of the month following an order and/or the acceptance of the proposal/contract.
The first progress billing invoice will be issued for the commencement of design and engineering of architectural plans. This will be 10% of the contracted amount. Once construction begins invoicing will commence monthly based on plant percentage of completion, supported by photographs.
In the event of project stoppage, additional fees may be assessed for re-mobilization, storage, crane costs, etc. Our discounted project costs are based upon timely payments. Delays in payment could change delivery schedules and project costs.
Delivery and Installation Supervision:
Site Inspection:
PRC staff, upon site arrival, will verify the required dimensions of the building pad and the corner locations/elevation. We will also verify the delivery path from an accessible road or street and install the underground utilities to the point of connection nominally 6’ from the exterior of the building.
Testing of Water, Sewer, and Electrical in Plant and Final Site Utility Connection:
Before the building leaves the manufacturing center, PRC certifies a pressure water piping test, DWV, and the electrical connections for compliance with code. While the building is fully tested for leaks at the plant before shipment, road vibration may loosen some plumbing slip fittings and require tightening once the building services (water) is completed. Owner/General Contractor is responsible for minor fitting tightening to handle small slip fitting leaks caused by transportation.
Time of Completion:
PRC estimates a 240 calendar day schedule to complete our scope of work from receipt of written notice to proceed together with signed approved architectural submittals from all authorities required to approve them.
Exclusions/Exceptions:
1. Access issues for delivery of the building by a clear unobstructed path of travel from an improved roadway to the final installation pad or foundation may cause site delays and extra cost at each site. This exclusion covers sites whose access is limited by trees, inaccessible roadways, overhead power lines at location where crane will lift building, grade changes disallowing our delivery trailers with only 4” of clearance to grade, berms, or uneven site grades, or when the path of travel is over improvements such as sidewalks, all of which are not within the scope of work by PRC. On some sites without on-site storage availability for buildings that cannot be set, relocation to a proximal crane yard and later relocated to the site for installation, will incur additional fees at rates that vary Ramona Garden Park – Grover Beach, CA | 10.11.2024| Reference # 11558 2587 Business Parkway | Minden, NV 89423 | www.PublicRestroomCompany.com | p: 888-888-2060 | f: 888-888-1448 5 of 9
depending on local rates. PRC will provide written costs for this additional work by change order.
2. If weather on site causes site delivery issues, the delivery may have to be diverted to an off-site location and the additional costs will be a change order to the bid. Our staff works with the Owner/General Contractor in advance to make sure sound decisions for delivery are made to avoid this issue. But sometimes Owner/General Contractor take risks for weather, but this risk is clearly at the Owner/General Contractor risk, not PRC.
3. Sidewalks outside the building footprint.
4. Trench plates or matting needed for protection of site soils, sidewalks, hardscaping, or site utilities shall be the responsibility of the Owner/General Contractor. Any site soils damage or other site improvements if damaged during installation shall be the responsibility of the Owner/General Contractor.
5. Not responsible for removing any soil, sand, or other debris as a result of trenching or installation.
6. Survey, location of building corners, finish floor elevation, excavation, and construction of subgrade building pad and footings (if required) per PRC plans.
7. Soil conditions not suitable for bearing a minimum of 1500 PSF with compaction to 90% maximum dry density shall require Owner/General Contractor correction before building placement. If no soils testing report is available before bid, Owner/General Contractor must verify site supporting soils at a minimum of 1500 PSF because that is the least we can place our structures on or Owner/General Contractor or engineer of record must design a foundation system to meet the imposed loads of site placement.
8. Improper water pressure, an undersized meter, or improper water volume flow to the building may necessitate a change order for installation of a building internal diaphragm tank to provide the minimum flow rate and static pressure of up to 60 PSI and a minimum of 40 PSI to properly flush the fixtures. Building water service chlorination, post installation, shall be by Owner/General Contractor.
9. Our bid included crane costs are based on a maximum 35’ radius from the center pin of the crane (10’ back from the rear of the crane) to the building center point of the furthest building module roof. If additional distance requires a larger crane, additional costs will be assessed by change order to the Owner/General Contractor.
10. Bonds, building permits, a site survey, special inspection fees, minor trash removal (nominally one pickup truck of shipping materials), final utility connections to the on-site water, sewer and electrical are by the Owner/General Contractor. Since the building is fully inspected and tested in plant, minor plumbing leaks (if water is not available when building site work installation is completed) is by the Owner/ General Contractor.
11. Site Traffic Control, if applicable, shall be by Owner/ General Contractor, not PRC.
12. Any equipment installation, site work or special inspections other than described within this proposal, shall be by Owner/General Contractor.
13. Backflow certification if applicable by Owner/ General Contractor.

PRC shall comply with the required insurance requirements, wage reports, and safety requirements for the project, including OSHA regulations.
Special Insurance to protect the Building before acceptance:
As PRC requires payment for each month of off-site construction, and since the building is not on owner property where their insurance will cover the building, we maintain a special policy that insures the property even when paid for off-site until the building is finally accepted by the owner. This special policy protects the Owner’s custom ordered materials to be used in the fabrication of the building during this period. PRC provides this Stock Throughput Policy to cover the building materials from supplier to manufacturer, while it is being built off-site, while in transit to the job site, during and after it is installed on-site until final acceptance. This special policy has a $1,000,000 coverage limit. This exceeds the cost of any single building we have offered for sale herein.
Errors and Omissions Insurance:
Our firm employs licensed architects, engineers, and drafting staff to provide design of our buildings.
Since these buildings are required to meet accessibility standards and building codes on site, and since we are the designer, we carry Errors and Omissions Insurance (E & O) to protect our clients from any errors. The policy covers a limit of up to $2,000,000 per occurrence and is more clearly explained in the insurance certificates we provide after receipt of a purchase order.
WARRANTY
All work performed by PUBLIC RESTROOM COMPANY (called “Company”) shall be warranted to the Owner to be of good quality, free of faults and defects in material, workmanship, and title for 5 years from last date of installation if building is installed by Company or 1 year if building is installed by Owner or Owner’s agent without on-site supervision by Company. Company warranty on building shell including exterior walls, concrete 8” slab/foundation, and roof system is warranted for 20 years structurally. The Company will repair or replace at their sole option any defects in work upon proper notice to the below stated address below.
Our Company extended warranties shall be Company only and shall have no effect on any required Performance, Payment, or Warranty Bonds where Surety shall assume no liability to the Company, the Owner, or any third parties should the Company fail for any reason to deliver acceptable maintenance warranties beyond the one year period. The warranty extension is solely between the owner and PRC and not the general contractor, bonding company, or architect/engineer of record.
This warranty applies only if all work performed by Company has been fully paid for, including change orders if applicable. Company has no responsibility for any neglect, abuse, or improper handling of building product.
The warranties expressed herein are exclusive, and are in lieu of all other warranties expressed or implied, including those of merchantability and fitness.

There are no warranties which extend beyond those described on the face of this Warranty. The foregoing shall constitute the full liability of the Company and be the sole remedy to the Owner.
Owner/General Contractor selected parts and materials that are not PRC approved will not be covered under PRC’s 5 year component warranty. These selections will be covered only by any available manufacturer warranty.
Term of Offer to Sell and Owner/General Contractor Acceptance:
This offer is valid for acceptance within 30 days, or when a part of a public bid for the applicable duration imposed within the Owner’s bid documents. Acceptance is by approving our post bid preliminary notice to begin drawings subject to final Owner/General Contractor approval of our submittals and receipt of a contract or a purchase order/contract.
Special Notice of Possible Project Cost Increases as a Result of Late Payments:
In the event of delayed or late payment, PRC shall have the right to remedies including late charges, overall project total cost increases, and other damages as allowed by applicable law. The contract price quoted herein is a discounted price based upon our receipt of progress payments as invoiced on the agreed billing schedule of PRC. In the event of non-payment, PRC will provide a 5 day written notice to cure and if payment is still not received, the discounted price for the payment due may increase, to an undetermined amount, to cover work stoppage, remobilization, cancellation of materials and subsequent restocking charges, resale of the contracted building to another party, storage fees, additional crane fees, travel and per diem costs for field crews, and any other cost applicable to the project, as allowed by law. Interest if applicable to non-payment will be assessed at the maximum amount allowed by law or 18% whichever is greater.
Termination
Upon Termination for any reason, Owner/General Contractor shall be liable for the cost of all work performed up to the date of termination. Additionally, Owner/General Contractor shall pay for off-site demolition and disposal of the partially or fully fabricated building as well as any non-returnable materials which were custom-ordered to complete fabrication in PRC’s factory location. Any returned materials are subject to return and restocking fees at the Owner/General Contractor expense.
Venue for Contract Jurisdiction:
Public Restroom Company requires all contracts accepted by our firm to hold that the venue for legal jurisdiction for this contract offer and acceptance shall be Douglas County, Nevada. In the event of your default, PRC shall be entitled to the full amount due including reasonable attorney fees, costs, storage, expenses of physical recovery, and statutory interest, as allowed by law.

Erin,
Please see the attached Budgetary Proposal for the Ramona Garden Park Restroom.
As discussed, I have provided a proposal for the Design & Supply of the building package purchased directly from Romtec utilizing Sourcewell and to be installed by a local contractor.
Installation can be performed by any contractor licensed by the state of California, Romtec structures are made with conventional construction material and methods. Typically, installation is 1-1.5 times the cost of building package when performed by a local or bidding contractor.
Romtec Design & Supply - $125,000 +/-
Installation- ~$125,000- ~$175,000
Total cost ~$250,000 - ~$300,000
As pervious stated Romtec has industry best lead times at 4-6 months from purchase order to delivery on site, if purchased in November delivery could be March or April.
Please feel free to reach out with any questions.

Subject: RE: CIP 1259 Ramona: Romtec - Site-built options Erin,
Thank you again for meeting with me today to discuss your project.
As discussed, Romtec will be providing an “alternative” or equal structure that is a packaged building kit with delivery to the site to be installed by a local contractor through the public bid process.
We do not require our buildings to be installed by Romtec, and therefore will be proposing the “Design & Supply ONLY” as our best value for your project. We design and supply our buildings across the county to be installed by a local contractor and provide technical support through our construction manager during installation to ensure a smooth and successful project. This is our best value option that is utilized by 80% of our customers.
Romtec will provide you with a preliminary design proposal and estimates for the “Design & Supply ONLY” of the proposed Romtec alternate restroom building for your project that satisfies the architectural style of the building you shared.
I appreciate the opportunity and look forward to sharing our proposal and quote with you when ready later next week.
Best Regards,
Matt Cugley

CITY COUNCIL STAFF REPORT
TO: Honorable Mayor and City Council DATE: December 9, 2024 FROM: Matthew Bronson, City Manager
PREPARED BY: Matthew Bronson, City Manager
Kristin Eriksson, Assistant City Manager
SUBJECT: Ramona Garden Park Rehabilitation Project Update and Community Donation Program
RECOMMENDATION
Receive an update on the Ramona Garden Park Rehabilitation Project and Community Donation Program and adopt a resolution to approve the Ramona Garden Park Community Donation Policy.
BACKGROUND
Ramona Garden Park Rehabilitation Project
Ramona Garden Park (“Park”) is a multi-use park, bounded by North 9th and North 10th Streets on the west and east, and Ramona Avenue and Brighton Avenue on the south and north, respectively. The Park is the focal point for activities in Grover Beach and the South County, in general. Many public and private functions are held at the park such as the Stone Soup Music Festival and Street Fair and the City’s Summer Concert Series.
After extensive community outreach beginning in 2019, the Council adopted the Ramona Garden Park Master Plan (“Master Plan”) in November 2020, which provides a vision or “road map” for the City to guide future park improvements over a multi-year period along with implementation and construction of these improvements. These improvements have long been envisioned at Ramona Park including a playground facility. The Master Plan has been further refined with a consultant-led effort on the design and construction phasing of this project (see Attachment 1).
The Master Plan is divided into four phases, to assist in identifying and obtaining funding as shown in the Phasing Plan in Attachment 2. Phase 1 of the project encompasses the playground and restroom while Phase 2 features the amphitheater and bandshell with renderings of these elements shown in Attachments 3-5. The project bidding process will begin this month with a construction award anticipated in February 2025 and construction beginning in April/May 2025.
The Ramona Garden Park Rehabilitation Project represents a pivotal step forward in enriching the Grover Beach community and enhancing its regional appeal and brings transformative benefits to the community, residents, and visitors. The improvements will create an inviting, functional, and inclusive environment for a multitude of users. Revitalization of the park will support a wide range of community events and activities which fosters a strong sense of connection and engagement among residents. Upgraded park facilities will provide residents with improved recreational opportunities, and this phased approach ensures a fiscally responsible development process, allowing thoughtful improvements that align with the City’s long-term vision for the park.
Staff Report: Ramona Garden Park Project Update and Community Donation Program Page 2 December 9, 2024
Community Development Block Grant Funding
Funding for the Ramona Garden Park Rehabilitation Project was not identified in prior Capital Improvement Programs (CIPs). However, in 2023, staff identified a significant opportunity to secure funding through the Community Development Block Grant (CDBG) program through the California Department of Housing and Community Development (HCD) to accelerate the implementation of Phases 1 and 2 of the project. On February 13, 2024, the Council conducted a public hearing to review the Notice of Funding Availability (NOFA) for the 2023 Community Development Block Grant (CDBG) Funds and approved an Over-the-Counter (OTC) application for $3.3 million in funding for the Ramona Garden Park Rehabilitation Project, Phases 1 and 2.
Subsequently, on March 21, 2024, HCD recommended the City’s application for approval, and on May 24, 2024, HCD provided notice of conditional approval.
The CDBG funding award will cover nearly 90% of the total $3.7 million project cost leaving a gap of approximately $400,000 to fully fund project construction. In the short term, the funding gap will be covered by General Fund reserves to allow staff to begin necessary purchases of equipment, including equipment referenced in an accompanying item on this agenda, and to enter into construction and construction management agreements for the project. However, as discussed with the Council at the August 26, 2024 meeting, staff recommends seeking community support to help offset this funding gap as described below.
Community Donations Program and Policy
Staff is proposing to begin a Ramona Garden Park Community Donation Program to help close the funding gap for the project and to allow the public to support these improvements to Grover Beach’s “Central Park.” Community donations efforts are common for park and open space projects where the public can use and enjoy the facilities and there are tangible items for naming opportunities.
Staff had been working with the Grover Beach Community Foundation, a non-profit community organization dedicated to providing funding for community needs, to implement this program. The Community Foundation has agreed to manage community donations for the project and will collect donation funding and transfer these funds to the City which will be held in a special account to ensure the donations are applied only to the Ramona Garden Park Rehabilitation Project.
Donation opportunities will include pavers to be installed near the playground ($250/$500 based on size), benches ($5,000), tables ($7,000), and other items under consideration such as bike racks and drinking fountains. Attachment 7 shows examples of these donation opportunities with the Community Foundation also talking with prospective donors regarding naming rights for the amphitheater bandshell. The Community Donation Program will start in mid-December and run through April prior to the beginning of construction.
Staff has also developed a Ramona Garden Park Community Donation Policy for the Council’s consideration, as shown in Attachment 6. The policy governs the process for making donations; the requirements and rules for purchasing recognition items, such as park benches, tables and a bike rack, as well as language that may be used on recognition items. The policy also guides the possible naming of the amphitheater bandshell for a period of up to 25 years for a substantial donation. Staff recommends the Council adopt a resolution to approve this policy to guide staff and the public in the donation process.
Staff Report: Ramona Garden Park Project Update and Community Donation Program Page 3 December 9, 2024
FISCAL IMPACT
The City has secured a $3.3 million award through the CDBG program for the Ramona Garden Park Rehabilitation Project Phases 1 and 2 with a total projected cost of $3.7 million. Upon receipt of the grant funding, the project will have an estimated funding shortfall of approximately $400,000.
The proposed community giving effort described above is intended to help close this gap with General Fund reserves proposed to be used initially to ensure necessary funding upfront for the project to begin.
ALTERNATIVES
The Council has the following alternatives to consider:
1) Receive an update on the Ramona Garden Park Rehabilitation Project and Community Donation Program and adopt a resolution to approve the Ramona Garden Park Community Donation Policy; or
2) Provide alternative direction to staff.
PUBLIC NOTIFICATION
The agenda was posted in accordance with the Brown Act.

TO: Honorable Mayor and City Council DATE: December 9, 2024 FROM: Matthew Bronson, City Manager
PREPARED BY: Wendi Sims, City Clerk
SUBJECT: Resolution Declaring the Results of the November 5, 2024 Municipal Election
RECOMMENDATION
Adopt the Resolution declaring the results of the General Municipal Election held on November 5, 2024.
BACKGROUND
On Tuesday, November 5, 2024, a General Municipal Election was held in the City of Grover Beach for the purpose of electing a Mayor At-Large and two City Council Members including one Council Member in District 3 and one Council Member in District 4. The City’s election was consolidated with the Statewide General Election conducted by the San Luis Obispo County Clerk-Recorder’s Office. The County Clerk-Recorder was therefore responsible for conducting the canvass of all votes cast and certifying the election results.
On November 5, 2024, there were three candidates seeking to be elected to the office of Mayor, two candidates seeking to be elected to the office of Council Member for District 3 and one candidate seeking to be elected to the office of Council Member for District 4. On the ballot for the City was also a recall of District 2 Council Member Daniel Rushing and a citizen initiative Measure G-24 which would repeal the water and wastewater rate structure adopted in 2023.
There are 7,953 registered voters in Grover Beach with a total voter turnout of 6,428 or 80.82% of registered voters. There were 621 voters at the polls on Election Day and 5,807 voting by mail.

The vote requirement for the question to pass was a majority (50% + 1) of the votes cast for the voters of District 2.
The question passed with a vote of 55.38%.
Citizen Initiative Measure G-24
The vote requirement for the measure to pass was a majority (50% + 1) of the votes cast for the entire City.
The measure passed with a vote of 64.62%.
Council Reorganization
Once the City Council adopts the Resolution, a presentation from the City will be made to outgoing Mayor Karen Bright, who has served a two-year term as the directly elected Mayor, along with outgoing Council Members Daniel Rushing and Zach Zimmerman. The outgoing members of the Council will then be respectfully requested to step down from the dais and will be invited to be seated in the audience. The three candidates who were successfully elected to office (Kassi Dee, Kathy McCorry, and Clint Weirick) will be called forward to have the City Clerk administer the Oaths of Office before receiving Certificates of Election and being seated at the dais as part of the City Council reorganization.
Following the Council reorganization, subsequent agenda items on this meeting agenda include comments from newly elected officials, selection of a Mayor Pro Tem by the incoming Mayor, approval of the 2025 Council meeting schedule, and policy direction on filling the Council seat vacated by the recall of District 2 Council Member Daniel Rushing. The public is then invited to remain in the Council Chamber to join the Council and staff for a brief reception.
FISCAL IMPACT
There is no fiscal impact associated with adoption of the resolution. The San Luis Obispo CountyClerk Recorder’s Office will invoice the City for our share of election costs for conducting a consolidated election. The County’s estimated cost and other election-related expenses were included in the FY 2024-25 budget.
ALTERNATIVES
No alternatives are recommended.

CITY COUNCIL STAFF REPORT
TO: Honorable Mayor and City Council DATE: December 9, 2024 FROM: Matthew Bronson, City Manager
PREPARED BY: Matthew Bronson, City Manager
SUBJECT: Adoption of the City Council Meeting Schedule for Calendar Year 2025
RECOMMENDATION
Adopt the proposed City Council meeting schedule for calendar year 2025.
BACKGROUND
Regular City Council meetings are held on the second and fourth Mondays of each month at 6:00 p.m. If that day falls on a holiday, the meeting is held on the next succeeding day which is not a holiday (GBMC Article II, Section 2301). The Council has the ability to adjust and/or add other meeting dates as deemed necessary and can change the regular meeting schedule by resolution.
Adjustments to the regular Council meeting schedule for 2025 are proposed to provide the Council and City staff with an opportunity to make advance planning arrangements for time off during the summer and winter holiday season. These proposed adjustments are listed below:
1) Cancelling the first meetings in July and August:
- conducting one meeting only during the months of July and August to allow the Council and City staff the opportunity to schedule vacation time off during the summer; and 2) Cancelling the second meetings in November and December:
- conducting one meeting only during the months of November and December in the beginning of the month given the extent of holiday activities and to allow Council and City staff the opportunity to schedule vacation time off during the winter holidays.
In addition to the regularly scheduled meetings, the Council may call for special meetings as needed throughout the year.
FISCAL IMPACT
There is no fiscal impact from this action.
ALTERNATIVES
The City Council has the following alternatives to consider:
1. Adopt the proposed City Council meeting schedule for calendar year 2025; or
2. Amend the proposed City Council meeting schedule, and adopt the amended meeting schedule for 2025; or

CITY COUNCIL STAFF REPORT
TO: Honorable Mayor and City Council DATE: December 9, 2024 FROM: Matthew Bronson, City Manager
PREPARED BY: Robert Lomeli, City Attorney
SUBJECT: Procedure to Fill Vacant Council Seat
RECOMMENDATION
Provide direction to fill the Council seat vacated by the recall of Council Member Daniel Rushing.
BACKGROUND
The City Council has received certification of the recall election results for Council Member Dan Rushing, District 2, on December 9, 2024. Pursuant to Elections Code section 11328, the Council has a ministerial duty to declare the results of the recall election. Pursuant to Elections Code section 11382, there is not an automatic election for a successor in the recall of a local officer.
Instead, upon certification that a majority of votes were in favor of recall, the officer is removed and the seat becomes vacant.
Government Code Section 36512(b) establishes that when a vacancy occurs in an elective office, the Council must within 60 days from the commencement of the vacancy either call a special election or fill the vacancy by appointment. If the Council opts to hold a special election, it must be scheduled for the next regularly established election date that is no less than 114 days from when the special election is called. The next regularly established election date in March 2025 would not meet the statutory timeline requirements as it falls within the 114-day proscription period from when a special election could be called. Therefore, Council would need to establish an alternative date for holding the special election. This would not only result in an extended vacancy on the Council but would also incur significant costs to the City, estimated at approximately $300,000. The individual elected would then hold office for the unexpired period of Council Member Rushing’s term through December 2026.
If the Council chooses to fill the vacancy by appointment, pursuant to Section 36512(b)(2)(B), the appointed individual will hold office for the unexpired term of Council Member Rushing’s seat. The Council has historically used the appointment process for filling vacancies, most recently with the appointments of Council Member Weirick in January 2023 and Council Member Zimmerman in April 2023. While there are no statutory requirements dictating a specific appointment process, as this remains a policy decision of the Council, previous appointments have been conducted through various methods, including Council Member nominations, public applications with open session interviews, and selection from previous applicant pools. Notably, the Council has predominantly chosen to fill vacancies by accepting applications and conducting interviews during open session meetings.
Typically, when filling Council vacancies through appointment, the City will implement an application process. The City Clerk's Office will generally accept applications for a designated period from interested residents who can demonstrate their eligibility, which includes being at Staff Report: Procedure to Fill Vacant Council Seat Page 2 December 9, 2024
least 18 years of age, residing within the city limits (District 2 for this seat), and being a registered voter in the city. Once the application period closes, the City Clerk's Office reviews all submissions for completeness and eligibility requirements. Qualified applicants are then invited to participate in public interviews conducted during a special or regular City Council meeting, as required by the Brown Act. During the interviews, each candidate is typically allotted a specified time, usually 5-10 minutes, to present their qualifications and respond to a standardized set of questions from the Council. Following the interviews, Council Members engage in public deliberation and select an appointee through a majority vote. The selected individual is then sworn in at either the same meeting or the next regular Council meeting depending on the Council's direction.
Following the December 9, 2024 commencement of the vacancy by certification of election results, the Council must take action by February 7, 2024, either making an appointment or calling for a special election in accordance with Government Code Section 36512(b). If the Council choses to fill the vacancy by appointment through an application process, staff would recommend accepting applications through January 3 with the Council conducting interviews and making an appointment at the January 13, 2025 meeting. This timing would allow the new Council Member to begin shortly after the new year begins and enable them to attend the Cal Cities New Mayor and Council Member Academy in late January.
FISCAL IMPACT
Should the Council choose to hold a special election to fill the vacant Council seat, it is estimated the process will cost the City’s General Fund approximately $300,000. As this would not be a budgeted expense, the funding would have to come from General Fund reserves. There is no fiscal impact associated with filling the vacant seat by appointment.
ALTERNATIVES
The Council has the following alternatives to consider:
1. Provide direction to fill the Council seat vacated by the recall of Council Member Daniel Rushing; or
2. Provide alternative direction to staff.
