RECOMMENDATION
Receive and file the annual Military Equipment Report pursuant to state law requirements under AB 481; and adopt the Resolution authorizing the continuation of Ordinance No. 22-01 and the purchase of specified equipment in 2025.
BACKGROUND
On September 30, 2021, Assembly Bill 481 (AB 481) was codified in Government Code sections 7070 through 7075 requiring the governing body of a law enforcement agency to adopt a “military equipment use” policy no later than May 1, 2022. The Police Department complied with AB 481 in policy development, holding a community meeting and making the policy documents available on the City’s website prior to Council adoption of Ordinance 22-01 on March 14, 2022.
AB 481 also requires law enforcement agencies to present an annual report to their governing body on the use of the equipment, any complaint(s) or concern(s) regarding the use of the equipment, results of any internal audits on the use of the equipment, the annual costs for the equipment, the quantity possessed (in parenthesis) by the agency and the intention to purchase additional equipment in the following year.
Staff reviewed department records and determined there were no complaints or concerns raised regarding the use of the equipment in 2024. Staff’s internal audit of the equipment use determined there were no violations of the Grover Beach Police Department (GBPD) Policy #707 or any other departmental policy. The bullet points below highlight the use of the equipment, and the costs associated with the use of the equipment.
