CITY OF GROVER BEACH
CITY COUNCIL STAFF REPORT
Agenda Item No. 3
Placement: Consent
Meeting Date: June 8, 2026
TO: Honorable Mayor and City Council
FROM: Matthew Bronson, City Manager
PREPARED BY: Wendi Sims, City Clerk
SUBJECT: Resolutions for the 2026 General Municipal Election
RECOMMENDATION
1) Adopt the Resolution calling and giving notice of a General Municipal Election to be held on November 3, 2026 for the election of certain officers of the City; 2) Adopt the Resolution requesting the County Board of Supervisors to consolidate the City’s General Municipal Election with the Statewide General Election; 3) Adopt the Resolution adopting regulations for candidates governing submittal of a Candidate’s Statement; and 4) Receive and file the City Attorney’s Impartial Analysis of the elected City Clerk ballot measure.
BACKGROUND
State law establishes the dates when general law cities conduct municipal elections for the purpose of electing members of the City Council. Grover Beach Municipal Code (GBMC) Section 2350 requires the General Municipal Election to be held on the same day as, and consolidated with, the Statewide General Election. With adoption of the Resolutions described in this staff report, the City will be requesting the County Board of Supervisors to consolidate the General Municipal Election with the Statewide General Election. The request must be submitted to the Board of Supervisors by no later than August 7, 2026.
As a first step in the election process, certain Resolutions must be adopted by the Council. On March 28, 2022, the City Council adopted Ordinance No. 22-02 which changed the City's "atlarge" election system to a "district-based" system in which each Council Member seat is elected by the voters in the district in which the candidate resides. Attachment 4 shows the district maps for electing Council Members. The office of Council Member is a four-year term, with terms expiring at staggered intervals. For the November 2026 election, Council seats in Districts 1 and 2 will be up for election. The office of Mayor remains directly elected "at-large" for a two-year term and will be up for election in the November 2026 election, as well. The required Resolutions for the November 2026 election for the purpose of electing a Mayor and two (2) members of the City Council, from District 1 and District 2, are presented to the Council for its consideration (see Attachments 1, 2, and 3).
Nomination Process for Candidates for Elective Office
The nomination period for candidates running for the offices of Mayor and Council Member is Monday, July 13 through Friday, August 7, 2026. If an incumbent does not file nomination papers Staff Report: Resolutions for 2026 General Municipal Election Page 2 June 8, 2026
and qualify by the close of the nomination period, the filing period extends (for non-incumbents only) for five (5) days pursuant to state law.
Citizen Initiative to Require the City Clerk to be an Elected Position On March 14, 2024, a citizen initiative was proposed to make the City of Grover Beach City Clerk an elected position for a four-year term of office. The initiative petition gathered sufficient signatures for placement on the ballot and was certified by the Deputy City Clerk of the City of San Luis Obispo given the conflict of interest with the currently appointed City Clerk validating signatures for this initiative. State law requires all cities to have a City Clerk, and the position may be elected or appointed. Since the City’s incorporation in 1959, the City Clerk has been an appointed position similar to other cities in San Luis Obispo County and approximately 70% of cities in California. This approach enables cities to openly recruit individuals for this appointed role based on technical qualifications and skills necessary for the role.
On October 15, 2024, the Council adopted a resolution to place this initiative on the November 2026 ballot and directed the City Attorney to prepare an impartial analysis of the initiative shown in Attachment 4. This measure will be Measure A-26 on the ballot and invites Grover Beach’s electorate to weigh the benefits of electing a City Clerk against the tradition and current practice of appointment. Approval of the measure would require the City to hold a special election within 90 days to fill the office of City Clerk, at an estimated cost to the City of over $330,000, until the next succeeding general municipal election where the position would be elected for a four-year term.
FISCAL IMPACT
The City’s total estimated costs for the November 2026 General Municipal Election are $47,000 and are included in the proposed FY 2026-27 budget. This does not include the cost of placing the citizen initiative on development standards on the ballot but the cost for adding this initiative is not expected to exceed $5,000. By consolidating the election with other jurisdictions in the County, the City's costs are significantly reduced. A majority of election costs are not reimbursable; however, full cost recovery is authorized for Candidate Statements. If a candidate chooses to have a Candidate's Statement printed in the County’s sample ballot booklet, the City requires an initial deposit at the time a candidate submits his/her Nomination Papers. Candidates are then invoiced (or sent a refund) after the County calculates the share of costs for printing/mailing of the sample ballots for each agency and candidate.
ALTERNATIVES
The City Council has the following alternatives to consider:
1. Adopt the Resolutions as submitted; or
2. Amend the Resolutions, provided all requirements of the Elections Code are met, and adopt the Resolutions as amended; or
3. Do not adopt the Resolutions and provide alternative direction to staff.
PUBLIC NOTIFICATION
The agenda was posted in accordance with the Brown Act.

INITIATIVE MEASURE A-26
CITY ATTORNEY’S IMPARTIAL ANALYSIS
Initiative Measure A-26 asks the voters whether the City of Grover Beach City Clerk shall be an elected position for a four-year term of office.
Proposed Initiative Measure. On March 14, 2024, a citizen’s ballot initiative was proposed to make the City of Grover Beach City Clerk an elected position for a four-year term of office. The initiative petition gathered sufficient signatures for placement on the ballot and was certified by the Deputy City Clerk of the City of San Luis Obispo given the conflict of interest with the currently appointed City Clerk validating signatures for this initiative.
Background. State law requires all cities to have a City Clerk and the position may be elected or appointed. Since the City’s incorporation in 1959, the City Clerk has been an appointed position similar to other cities in San Luis Obispo County and approximately 70% of cities in California.
This approach enables cities to openly recruit individuals for this appointed role based on technical qualifications and skills necessary for the role.
Effect of Measure.
A “yes” vote on this measure means the City Clerk position will become an elected position with a four-year term. A “no” vote on this measure means the City Clerk position will remain an appointed position.
The City Clerk’s responsibilities include keeping accurate records of City Council proceedings; recording, publishing, and certifying City ordinances and resolutions; keeping custody of the City seal; and administering oaths of office. The City Clerk also serves as the City’s elections official; collects and maintains all candidate campaign finance forms; coordinates, records, and retains City officials’ and City staff’s statements of economic interests; and helps ensure compliance with the state’s open meeting laws. An elected City Clerk may appoint deputies to assist in performing the functions and responsibilities of the City Clerk.
This measure invites Grover Beach’s electorate to weigh the benefits of electing a City Clerk against the tradition and current practice of appointment. Approval of the measure would require the City to hold a special election within 90 days to fill the office of City Clerk until the next succeeding General Municipal Election where the position would be elected for a four-year term.
THE ABOVE STATEMENT IS AN IMPARTIAL ANALYSIS OF INITIATIVE MEASURE A26. IF YOU DESIRE A COPY OF THE FULL TEXT OF THE MEASURE, PLEASE CALL THE CITY CLERK, WENDI SIMS, AT 805-473-4568 OR EMAIL AT [email protected] AND A COPY WILL BE MADE AVAILABLE TO YOU AT NO COST.

Sec. 2304. Term Limits. A member of the City Council may only serve two consecutive terms in that position. If the City has an elected mayor, an elected mayor may only serve two consecutive terms in that position. The two positions (Council Member and elected mayor) are separate and an individual can serve two consecutive terms in one position and then two consecutive terms in the other. If a person is elected to the office of City Council and because of a vacancy in the office of an elected mayor, such person is appointed to fill the unexpired term of an elected mayor, such Council Member shall be deemed to be serving just the term of a City Council Member. However, if a person should be elected to the office of City Council and part way through his or her term as a member of the City Council, such person is elected mayor, then such person shall be deemed to have served his or her full term as a City Council Member upon acceptance of the office of elected mayor.
Even if a person has already served two consecutive terms in one position, such person may serve another two consecutive terms if at least twenty-three months have passed since such person last served in that same position. (Approved by electorate on November 5, 1996, pursuant to Resolution No. 96-46; Am. Ord. No. 08-05.)
Sec. 2350. Date of General Municipal Election. The City's General Municipal Election shall be held on the same day as, and consolidated with, the Statewide General Election on the first Tuesday after the first Monday of November in each even-numbered year. (Ord. No. 83-6) Attachment 4
§ 30.050 DATE OF GENERAL ELECTION.
The city’s general municipal election shall be held on the same day as, and consolidated with, the statewide general election on the first Tuesday after the first Monday of November in each even-numbered year. (Prior Code, § 2350) (Ord. 83-6, passed 11-7-1983)
