MINUTES
City of Guadalupe
Regular Meeting of the Guadalupe City Council
Tuesday, March 12, 2024, at 6:00 pm
City Hall, 918 Obispo Street, Council Chambers

1. ROLL CALL:

Council Member Christina Hernandez
Council Member Gilbert Robles
Council Member Vacant
Mayor Pro Tempore Eugene Costa Jr.

Mayor Ariston Julian
Mayor Julian called the meeting to order at 6:00 p.m. All members were present. (Note: The abbreviation, “CM”, will be used for “Council Member” in these minutes.)

2. PLEDGE OF ALLEGIANCE

3. MOMENT OF THANKS, APPRECIATION OR CONDOLENCES.

CM Robles mentioned the passing of Shadi Escobedo. Condolences were given to her family who are long-time Guadalupe residents.

Chief Cash said, “The Public Safety Department has a voting group when they want to acknowledge some of our employees or our citizens who do great work. The Mayor and the Council know for sure that we got a heavy hitter here in the City. That even though we make her leave, she keeps coming back and filling in as a major designated hitter. So, this is something that I stay out of, but the staff thought this was important.

So, I have Norma who is our office manager, and Lt. Limon who would like to present to our City Clerk, our City HR Manager times three, and all-around librarian historian…and she’s my lawyer. I think the Mayor and Council can honestly say we really rely on her and the staff, and we utilize her knowledge and skill. She is an outstanding asset to the City of Guadalupe. We just tremendously love and care for how she took care of us…not just Public Safety but every department in the City.

She sweats, bleeds, cries Guadalupe and is an absolute treasure for our City. So, we’d like to present your shadow box.”
Ms. Villegas made a few comments. She said, “This took me by surprise. I have no words. You’re going to ruin my rep. This is so sweet. I’m still here…I’m still Interim HR Manager. This shadow box is so cool. Thank you very much. I’m not going to do a ‘farewell’ because I’m still going to be here.

It’s been an odd pleasure being back. I love HR…I absolutely enjoy it. I have 200 years of experience. I am a Guadalupian, although I lived away for 30 years. It’s been a pleasure, it really Agenda Item No. 8C
March 12, 2024 City of Guadalupe Council Meeting Minutes Page 2 of 11 has. I work closely with this guy (Chief Cash), and those people (Norma Bribiesca and Lt. Limon) over there, too. He says I keep him straight; Norma keeps me straight. We work very closely together, and I’m pleased that you’re pleased. So, I’m done.”

4. AGENDA REVIEW
CM Hernandez requested that Item #12. “Mid-Year Budget Review for Fisal Year 2023-2024” be moved before Item #11. “Grants Administrator Job Description”.

5. COMMUNITY PARTICIPATION FORUM
Belinda Popovich, President of the Guadalupe Business Association (GBA), gave an update and said that GBA is making great strides:

There have been two (2) Farmers’ Markets held with much success. The third one is scheduled for Saturday, March 30th. They are meeting regularly, fundraising. There is a bank account separate from GBA. Capital campaign to raise $10,000 for signage and hiring a part-time manager. Route One has been helpful. They’re hoping that it can be sustainable weekly. Location is Le Roy Park.

6. CONSENT CALENDAR (A-F)
The following items are presented for City Council approval without discussion as a single agenda item in order to expedite the meeting. Should a Council Member wish to discuss or disapprove an item, it must be dropped from the blanket motion of approval and considered as a separate item.

A. Waive the reading in full of all Ordinances and Resolutions. Ordinances on the Consent Calendar will be adopted by the same vote cast as the first meeting unless City Council indicates otherwise.

REGULAR BUSINESS

10. Council Seat Vacancy.

Written report: Philip F. Sinco, City Attorney
Recommendation: That the City Council:

1. Interview all interested city residents and appoint one (1) candidate to serve the remainder of the vacant Council seat (expiring on December 10, 2024), effective immediately; and

2. Swearing in of newly appointed official.
• City Clerk will administer the oath of office.

City Attorney Sinco gave a brief update explaining that Ms. Lizalde has resigned her seat on the City Council meeting on February 9, 2024. He brought an item to the City Council meeting on February 27, 2024 recommending that the Council make an appointment from the list of persons who had applied in November 2022. However, at the meeting on February 27th, the City Council directed staff to allow new applications for the current vacancy and not limit the applicants to those who had previously applied.

March 12, 2024 City of Guadalupe Council Meeting Minutes Page 5 of 11 There were three (3) new applications and one (1) from the last time. The individual who had applied previously was unable to attend the meeting tonight. The three (3) individuals here tonight will be interviewed and could appoint tonight or later. The mayor had City Attorney Sinco to explain the term of the vacancy. City Attorney Sinco said, “The appointment is to finish the current term of prior CM Antonio Ramirez, which expires on 12/20/24. The individual selected would need to run again at the upcoming election.

Mayor Julian then said, “Seven (7) questions for tonight had been handed out to the applicants.

Courtney Cazanave was not able to attend tonight.” Each applicant was asked how their background on their skills and experience would benefit the community and other such questions on each applicant’s knowledge of city government, how to deal with controversial issues, what are the City’s major projects, etc.

After the questions were asked of each applicant, the Council had additional questions:

Whitney Furness: CM Costa, Jr. asked, “If you were or not selected, would you run again?” She said, “I can’t say I’d run again if I was elected. This would be a great time for me for nine (9) months. I can’t say I’d run if not appointed. I’m not sure. Would have to think about it. I do plan to attend more meetings.”
CM Robles asked, “Are you active…do you volunteer in the community?” She said, “Before COVID, I was involved in the Planning Commission in Santa Maria. This vacancy and time in my life…this is the next step.”
Mayor Julian asked, “If selected today would you be ready to sit now?” She said, “Yes.” Judy Wilson: Mayor Julia asked, “Would you run again if selected or not?” She said, “Yes, I would.

I’m very involved in the community. I’d want to continue, if elected. I’m volunteering with GBA and have done other things with the community.”
Richard Akowuah: Mayor Julian asked, “Would you run again?” He said, “Yes, and would be more prepared by demonstrating enthusiasm for the community. I’d keep it authentic.” The mayor then asked if he did other volunteering besides youth football. Mr. Akowuah said, “No.” At this point, the mayor asked Mr. Bodem if Ms. Cazanave had provided any answers in writing.

Mr. Bodem said, “No, there were no answers.” Mayor Julian then asked for comments from the Council.
• CM Costa, Jr.: To all three of you, thank you for participating. This is a difficult decision. I recommend Judy Wilson.
• CM Hernandez: Thank you to everyone. This is difficult. But I recommend Whitney…some things stood out.
• CM Robles: This is a tough one. All wholeheartedly did well. I recommend Whitney.

March 12, 2024 City of Guadalupe Council Meeting Minutes Page 6 of 11 • Mayor Julian: This is a 9-month position. Here’s some of what’s before us in the next 2-3 years: Hwy 1/166, new bridge, Black Road signalization. We need to bring businesses in here. There’s the 18 acres of commercial land at Pasadera which needs to be built up.

There’s a lot of work for the City Council. I recommend Whitney. • CM Robles: There’s a lot on the table. We got the “rock at the top of the hill”. We have a lot to accomplish. There’s not a lot of glamour being on the City Council. There’s a lot of work but it’s where your heart is at. Decisions are not always welcomed but have to be made. • Mayor Julian said, “There are three (3) positive choices. Does someone want to make a motion?”
Motion was made by Council Member Hernandez and seconded by Council Member Robles to select Whitney Furness to fill the City Council Member vacancy. Roll Call: Ayes: 4 4-0 Motion passed.

At this point, the City Clerk administered the Oath of Office to Ms. Furness.

At 7:00 p.m., the mayor suggested a brief break.

11. Grants Administrator Job Description.

Written report: Amelia M. Villegas, Interim Human Resources Recommendation: That the City Council adopt Resolution No. 2024-20 approving the position description for Grants Administrator and authorizing the recruitment process.

Ms. Villegas stated that over the past 4-5 years, the City has applied for and received various grants, ranging in dollar amounts from $5M to $170K. Public Safety has applied for twenty-five grants, receiving fifteen, for a total of approximately $350,000 in grant funding.

There continues to be an opportunity for the City to apply for more grants. There currently is approximately $30M in grant procurement. Without a Grants Administrator, the City hasn’t applied for some grant opportunities due to the lack of time on the part of City staff and the burdens of ongoing administration. Potential grants could be lost without this position.

She further stated that this new position is under the SEIU union. The new job description was reviewed by them with no issues. After such review, City Attorney Sinco brought to Ms. Villegas’ attention that because this program will also be administering the Cannabis Program, SEIU needed to be apprised as that was not stated in the job description. Ms. Villegas did let SEIU know of the additional responsibility of the Cannabis Program, and they stated having no concerns.

At this point, Mr. Bodem added comments stressing the importance of this new position. He said, “This position would require someone who is very organized and financially minded. The Cannabis Program was an afterthought but could easily fit into this position. They would work in a centralized position, ensuring reimbursements are made. It won’t be a general fund position but we have to show it in the budget as an expenditure, but the revenue from the grant will offset that March 12, 2024 City of Guadalupe Council Meeting Minutes Page 7 of 11 expenditure. There will be aspects of each department working on grants and doing reimbursements. But this position will work in a centralized capacity communicating with each department head and employee to ensure that reimbursements are being made. I feel we can easily afford this position with the number of grants that we have and could potentially receive.” CM Costa, Jr. asked, “What is the pay scale for this position?” Ms. Villegas said, “The minimum hourly rate of $30.00 to a maximum of $40.206.” CM Costa, Jr. then asked, “If no grants, there’ll be no job?” Mr. Bodem said, “Even with the grants that we have now, there’s about five (5) years of grants to administer.”
Motion was made by Council Member Costa, Jr. and seconded by Council Member Hernandez to approve Resolution No. 2024-20 approving the Grants Administrator job description and begin recruitment. Roll Call: Ayes: 5 5-0 Motion passed.

12. Mid-Year Budget Review for Fiscal Year 2023-2024.

Written report: Janice Davis, Finance Director
Recommendation: That the City Council adopt Resolution No. 2024-21 approving budget amendments to the FY2023-2024 budget and making changes to the allocation of ARPA funds.

Ms. Davis gave a brief background on the budget then went into explanations on any changes relating to the General Fund revenues and expenditures, Enterprise Fund, CIP (Capital Improvement Projects) improvements and American Rescue Plan Act (ARPA) modification.

Background: The proposed budget for Fiscal Year 2023/2024 (FY23/24) which was approved by the City Council on July 25, 2023, was recently reviewed by City staff. Staff recommendations postreview with current and projected information are as follows:

General Fund Revenues: FY23-24 approved budget revenue estimates were set at $7,282,819.

Recommendation is to reduce revenues by $60,000 for a school resource officer; revenues not expected in FY23-24, resetting the revenue budget at $7,222,819.

General Fund Expenditures: At the City Council meeting on January 23, 2024, $10,000 was approved as startup funding for the approved City non-profit corporation. City staff recommended that monies from expenditure savings in Administration-Professional Services be used for this specific expenditure. Mayor Julian asked to explain more on that expenditure. Ms. Davis said, “For the City to receive historical tax credit, the City is funding $10,000 for creating a non-profit.” The mayor added that this non-profit would also be for any other entity besides the Royal Theatre.

Year-end projected expenditures reflect an increase in expenditures by +$50,000 for a replacement vehicle for the Police Department. (Ms. Davis said an accident totaled a police vehicle and wasn’t sure what the insurance would pay.) Overall expenditures which were approved at $7,248,616 would now total $7,298.616.

March 12, 2024 City of Guadalupe Council Meeting Minutes Page 8 of 11 Enterprise Fund: Year-end projected revenues would reflect an increase in revenues from grants for the Wastewater Fund by +$1,734,908 and the Transit Fund by +$1,004,000.

CIP Modifications: Under category of Wastewater, a grant for Highway 1 lift station for CDBG was approved in the amount of $3,534,908. The original budget had $1,800,000 from the Wastewater Fund to cover this project, which the City staff has now recommended allocating that $1,800,000 to fund much needed improvements of the ponds and dredging at the wastewater treatment plant.

For Transit: A Clean Air Grant was approved in the amount of $1,004,000 for the Amtrak Train Station Rehab (design)/Transit Hub Rehab project.

ARPA Modifications: These funds were also part of the mid-year budget review process. The recommended changes involve redirecting funds from certain CIP projects that are not likely to be pursued to other CIP projects that are either underway or contemplated during the second half of the year.

Ms. Davis said that what remains in that fund is $1,023,672. There is a total of $602,607 dedicated for City Hall roof and wall repairs. Mayor Julian asked, “Why allocate monies to that?” Mr. Bodem said “There are five (5) locations in the roof that lead. Chief Cash’s ceiling partially fell. ARPA funds to be spent by July – emergency. The City Engineer, Jeff van den Eikhof, will help put together a bid document, not an RFP (Request for Proposal). There will be sealed bids brought in. Anybody would bid on it on an equal bidding field. We need to preserve City Hall, maintain its historic look. Protect the ‘bones’, start with the roof. Walls have to be fixed before the roof. It’s all justified – protect what we have and keep the building for the long term.”
Mayor Julian said, “In the past, the plan was to have City Hall built at Pasadera. Instead of building a new one there, there’s a commitment by Pasadera to allocate so much money per house that sold for this building, approximately $3M to renovate City Hall and the Fire station.” Mr. Bodem said, “Chief asked for renovation and repair of the Police Department. We also have need to look at all the windows here.”
Fiscal Impact: The result of the recommended mid-year budget review changes are -$120,000 (-$10,000 for non-profit start-up costs and -$110,000 from Public Safety revenue and expenses changes) in the General Fund. In the Enterprise Fund, +$2,545,908 in other government grants revenue in the Wastewater and Transit Funds.

Note: For a complete detailed listing of recommended changed to the FY 23-24 budget can be viewed on the City’s website at www.cityofguadalupe.org under City Administration “CC Agenda – 3-12-2024”.

Mayor Julian asked, “I saw something about our reserves. Where is that?” Ms. Davis said, “In the February report…based off of the Fund Balance, currently, +$2,098,080. It’s not audited.” Mr.

Bodem asked, “Isn’t the goal to be 15% of the General Fund?” Ms. Davis said, “The required amount of reserves was $1,087,000. We’re exceeding that by $1,010,788.” March 12, 2024 City of Guadalupe Council Meeting Minutes Page 9 of 11 Mayor Julian said, “Historically, the Grand Jury said, which most people know, that we should disincorporate. You can’t transfer monies from the Enterprise Funds unless all the necessary documents are in place with the intent to pay back with interest, which is what we’re doing now.

We were in the negative. Then we had +$27,000 in reserves. If anything happened to City Hall, we’d have to be in a tent. So, this is good.”
Ms. Davis then said, “In 2017, we were in the negative. In 2018, were still in the negative at $167K but progressing. In 2019, we were +$15,000. Then in 2020, it was +$485K. We got into the millions last year. That is very good news!”
Motion was made by Council Member Costa, Jr. and seconded by Council Member Robles to approve Resolution 2024-21 adopting budget amendments to the FY 2923-23 budget and making changes to the allocation of ARPA funds. Roll Call: Ayes: 5 5-0 Motion passed.

13. Compensation increases for City Officials and stipend for Recreation and Parks Commissioners.

Written report: Philip F. Sinco, City Attorney
Recommendation: That the City Council introduce on the first reading, and continue to its meeting of March 26, 2024, for second reading and adoption, Ordinance No. 2024-516, increasing Council members’ salaries and providing for additional compensation for the Mayor, and adopt Resolution No. 2024-22 providing a per meeting stipend to Recreation and Parks Commissioners.

City Attorney Sinco gave a brief background: At the City Council meeting on February 27, 2024, the City Council received a staff report concerning SB329, a bill that became effective on January 1, 2024. This bill stated that the maximum salary for elected officials in cities with less than 35,000 in population could increase from $300 to $950 per month. City council compensation had not kept pace with inflation (as it had not been raised since 1984). This increase in city council compensation was long overdue and could potentially allow for city councils to become more diverse.

The City Council supported a monthly salary of $500 for all of the City’s elected officials (i.e., Councilmembers, City Clerk and City Treasurer), and an additional $250 per month for the Mayor’s office (for a monthly salary totaling $750), in light of the additional duties and obligations of this office. In addition, the Council supported a stipend for the Recreations & Parks Commissioners in the amount of $100 per meeting.

City Attorney Sinco said, “The fiscal impact with the proposed monthly increase for the five (5) Councilmembers, City Clerk, and City Treasurer of $350 ($150 to $500), and the additional $250 proposed monthly increase for the Mayor equals a $2,700 per month increase…takes effect January 1, 2025.” For the Recreation & Parks Commissioners, City Attorney Sinco said that the fiscal impact for their stipends would be $6,000 per year, assuming there are five (5) commissioners.

March 12, 2024 City of Guadalupe Council Meeting Minutes Page 10 of 11 City Attorney Sinco then explained the approval process for an ordinance. He said, “This is the first reading of the ordinance. After the second reading of the ordinance, it takes effect 30 days after.

For the Recreation & Parks Commissioner proposed stipend, that would take effect immediately at the next meeting.”
Motion was made by Council Member Costa, Jr. and seconded by Council Member Hernandez to approve the first reading of Ordinance No. 2024-516. Roll Call: Ayes: 5 5-0 Motion passed.

Motion was made by Council Member Costa, Jr. and seconded by Council Member Robles to approve Resolution 2024-22 with a change to the proposed monthly stipend amount from $50 to $100 per meeting. Roll Call: Ayes: 5-5-0 Motion passed

WHEREAS, the City Council wants to ensure that individuals who serve on the City Council are recognized for their public service by providing them a reasonable amount of compensation for this service and believes that $500 per month for City Council members is appropriate, and that the Mayor should receive an additional $250 per month (for a total monthly salary of $750) in light of the additional obligations and duties of this office.

Agenda Item No. 8F

REPORT TO THE CITY COUNCIL OF THE CITY OF GUADALUPE
Agenda of March 26, 20234
_______________________________
Prepared by:

Todd Bodem, City Administrator
SUBJECT: Resolution terminating the existence of a local state of emergency RECOMMENDATION:

That the City Council adopt Resolution No. 2024-24 terminating the local state of emergency ratified and declared by the City Council at its meeting on February 13, 2024.

BACKGROUND:

Governor Newsom declared a state of emergency in California on February 4, 2024, for Los Angeles, Orange, Riverside, San Bernardino, San Diego, San Luis Obispo, Santa Barbara, and Ventura counties. On that same date, the County of Santa Barbara also proclaimed the existence of a local state of emergency.

Both of these proclamations were made due to the February 2024 storm which began on January 31, 2024. This powerful, slow moving, atmospheric river storm system struck many places in California including Santa Barbara County. The February 2024 Storm series posed serious risks of rock falls, flooding, landslides, debris flows, severe winds, and coastal flooding throughout the County.

In light of the County of Santa Barbara’s proclamation of a local public health emergency, as well as the Governor’s proclamation, City Administrator/Director of Emergency Services, Todd Bodem, on February 7, 2024, issued a “Proclamation of Existence of a Local Emergency by the City Administrator/Director of Emergency Services of the City of Guadalupe” as a result of February 2024 storm, and the continuing impacts from this severe weather.

Government Code section 8630 and Guadalupe Municipal Code section 2.32.050 authorized the City Administration/Director of Emergency Services to proclaim the existence of a local emergency when the City Council is not in session, provided the City Council ratifies the decision within seven (7) days. The City Council so ratified the proclamation of local emergency at its meeting on February 13, 2024, when it adopted Resolution No. 2024-14.

DISCUSSION:

Government Code section 8630(c) requires the Council to review the need for continuing the local emergency at least once every 60 days until it decides to terminate the local emergency.

Page 2 of 2 ends

Since the heavy rains that occurred on and before February 4, 2024, there have not been any significant rains, and none are anticipated. Staff does not believe that there is a threat to public health, safety, or welfare from rains or floods at this time, and recommends that the City Council should terminate the local emergency.

FISCAL IMPACT:

None.

WHEREAS, Section 2.32.050 of the Guadalupe Municipal Code declares that the City Administrator shall be the Director of Emergency Services and may request that “the City Council to proclaim the existence or threatened existence of an emergency or a disaster and the termination thereof, if the City Council is in session, or to issue such proclamation if the City Council is not in session, subject to confirmation by the City Council at the earliest possible time;” and
WHEREAS, Section 2.32.060 of the Guadalupe Municipal Code provides that the City Administrator/Director of Emergency Services may “[m]ake and issue rules and regulations on matters reasonably related to the protection of life and property, as affected by such disaster; provided, however, such rules and regulations must be confirmed at the earliest practical possible time by the City Council” and
WHEREAS, Governor Newsom declared a state of emergency in California on February 4, 2024, for Los Angeles, Orange, Riverside, San Bernardino, San Diego, San Luis Obispo, Santa Barbara, and Ventura counties; and

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GUADALUPE AS FOLLOWS:

SECTION 1. The City Council of the City of Guadalupe hereby adopts all of the findings made in Resolution No. 2024-14, adopted on February 13, 2024, concerning the existing of facts and circumstances justifying a declaration of a local emergency.

SECTION 2. Pursuant to Government Code section 8360, the City Council reviewed whether the local emergency should continue at its meeting on March 26, 2024, and found that the local emergency declaration could be terminated without negatively affecting the health, safety, and welfare of the public.

Agenda Item No. 8G

REPORT TO THE CITY COUNCIL OF THE CITY OF GUADALUPE
Agenda of March 26, 2024
_______________________________ _________________________________ Prepared by: Approved by:

Philip F. Sinco, City Attorney Todd Bodem, City Administrator SUBJECT: Second Amended and Restated Joint Powers Agreement for the Santa Barbara County Association of Governments
RECOMMENDATION:

That the City Council adopt Resolution No. 2024-25 approving the Second Amended and Restated Joint Powers Agreement for the Santa Barbara County Association of Governments to add the role of coordination of broadband activities.

BACKGROUND:

During 2020, at the outset of the COVID-19 pandemic and increased stay at home activities, access to affordable, reliable, high-speed internet was exposed as needing much improvement. As such, legislative actions occurred at both the State and Federal levels. In June 2020, California Senate Bill 1462 was approved establishing the California Broadband Council to promote broadband deployment in unserved and underserved areas as defined by the California Public Utilities Commission (CPUC). In August 2020, Governor Newsom signed Executive Order N-73-20 which required the development of a Broadband Action Plan for California. Furthermore, in July 2021, California Senate Bill 156 authorized Joint Powers Authorities (JPAs) to issue revenue bonds for broadband infrastructure implementation under the Broadband Loan Loss Reserve Fund.

Building upon this momentum at a local level, in October 2021, the Broadband Alliance (Alliance) for Santa Barbara County was formed. The Alliance was comprised of membership for all member agencies of SBCAG and also included the Santa Ynez Band of Chumash Indians, the Broadband Consortium of the Pacific Coast, and regional economic development organizations. Contributions were made from American Rescue Plan Act (ARPA) funding to develop a countywide Broadband Strategic Plan (BSP). Work on the BSP began in late 2021, and in December 2022, the SBCAG Board approved the BSP as a framework plan for which to initiate broadband implementation in the County. Prior to adoption of the BSP, SBCAG received approvals from member agencies.

DISCUSSION:

The BSP included several recommendations, one of which was member agencies approved forming a Joint Power Authority (JPA) for administering regional broadband to improve the broadband alignment among efforts by member agencies. To further explore options on development of the regional Philip F. Sinco

Page 2 of 2 ends

broadband, SBCAG and the County of Santa Barbara received grant funding from the California Public Utilities Commission (CPUC) under the Local Agency Technical Assistance (LATA) program. Under the grant, SBCAG initiated work on JPA options with an initial presentation to its board in October 2023. The SBCAG board approved an option to amend SBCAG’s JPA agreement to include broadband activities, rather than form a new JPA. Members of SBCAG supported this as the simplest approach, and also maintained local control for broadband implementation and permitting. Following the approval of the JPA amendment language by the SBCAG board, SBCAG counsel was directed to commence seeking input from the member agencies. That process has been completed and now the final language is ready for approval by each of the member agencies.

FISCAL IMPACT:

Minimal impact to the general fund (related only to time spent by City staff on work related to broadband activities).

Agenda Item No. 12

REPORT TO THE CITY COUNCIL OF THE CITY OF GUADALUPE
Agenda of March 26, 2024
_______________________________ _________________________________ Prepared by: Approved by:

Larry Appel, Contract Planning Director Todd Bodem, City Administrator SUBJECT: Public Hearing, Introduction and First Reading of Ordinance No. 2024-517 to amend the subdivision ordinance title 17, Section 17.32.030.

EXECUTIVE SUMMARY:

The City’s General Plan was updated in November 2022 and shortly thereafter, the zoning ordinance was amended to ensure that all zoning designations were consistent with the new land use designations. Another component of the General Plan update was in allowing a higher density in all three residential zone districts. This has caused an inconsistency now with Title 17, the city’s subdivision ordinance. The current ordinance requires a minimum lot size of 6,000 square feet and a minimum lot width of 60 feet. With the new single-family densities, a lot can be as small as 3,630 square feet. Along with the reduced lot size, staff is also recommending a reduction in lot width from 60 feet to 45 feet. It is necessary to amend Title 17 to reflect these changes. Later in the year, staff will be taking a more comprehensive look at amending Title 17, but for now, this amendment is necessary for a current application to be processed and recorded.

RECOMMENDATION:

It is recommended that the City Council:
1) Receive a presentation from staff; and
2) Conduct a public hearing and introduce by title only and waive the first reading of Ordinance No. 2024-517 (Attachment 1) amending Section 17.32.030 of the Guadalupe Municipal Code; and
3) Continue to April 9, 2024, for second reading and adoption.

FISCAL IMPACT:

There would be no fiscal impact as a result of this proposed text amendment.

Ord. No. 2024-517 Page 2 of 2 March 26, 2024
DISCUSSION:

Title 17 was adopted by the city over fifty years ago. It was enacted about six years before the city adopted its zoning ordinance. Both of these ordinances are in need of updating. At this time, the only change to Title 17 will be limited to the lot size and width. Section 17.32.030.A reads as follows:

A. The minimum area of lots shall be 6,000 3,630 square feet, with a minimum width of 60 45 feet, except in cases of R-1-M and planned unit developments.

The reduction in lot size and width is consistent with the many changes that have been required by state legislators over the last few years where they are requiring increased housing stock in all jurisdictions.

ENVIRONMENTAL REVIEW:

This ordinance has been reviewed for compliance with the California Environmental Quality Act (CEQA), and the CEQA Guidelines, and has been found to be exempt pursuant to Section 15306 of the CEQA Guidelines (information collection) because it does not have the potential to create a physical environmental effect.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GUADALUPE, CALIFORNIA, TO AMEND THE SUBDIVISION ORDINANCE (SECTION 17.32.030.A OF THE GUADALUPE MUNICIPAL CODE) The City Council of the City of Guadalupe, State of California, does ordain as follows:

WHEREAS, the City Council recognizes that the City’s subdivision ordinance was adopted over 50 years ago in 1974, and that many sections of the ordinance are outdated, and do not reflect mandatory State regulations that have been enacted over the years; and WHEREAS, the state of California has made a number of changes to housing law in order to increase housing stock in all jurisdictions; and
WHEREAS, staff is systematically reviewing and amending the subdivision ordinance to ensure that the final version reflects the desire of City Council to provide the most accurate document to describe and regulate development within the City; and WHEREAS, public notice pursuant to Government Code section 65090 was posted on or about March 15, 2024.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GUADALUPE DOES ORDAIN AS FOLLOWS:

SECTION 1. Section 17.32.030.A of the Guadalupe Municipal Code is hereby amended as follows:

SECTION 2. This Ordinance has been reviewed for compliance with the California Environmental Quality Act (CEQA), and the CEQA guidelines, and has been found to be exempt pursuant to §15306 of the CEQA Guidelines (Information Collection) because it does not have the potential to create a physical environmental effect.

SECTION 3. The City Council declares that each section, subsection, paragraph, subparagraph, sentence, clause, and phrase of this Ordinance is severable and independent of every other section, subsection, paragraph, subparagraph, sentence, clause, and phrase of this Ordinance. If any section, subsection, paragraph, subparagraph, sentence, clause, or phrase of this Ordinance is held invalid, the City Council declares it would have adopted the remaining provisions of this Ordinance irrespective of the portion held invalid, and further declares its express intent that ATTACHMENT 1

REPORT TO THE GUADALUPE CITY COUNCIL
Agenda of March 26, 2024
__________________________________
Prepared by:

Todd Bodem, City Administrator
SUBJECT: Approving Hiring of Bond Financing Team for the Guadalupe Royal Theater Renovation Project.

RECOMMENDATION:

It is recommended that the City Council adopt Resolution No. 2024-26 approving the hiring of a bond financing team (Jones Hall, A Professional Law Corporation as bond counsel and Wulff, Hansen & Co. as municipal advisor) to assist with bond financing for the Guadalupe Royal Theater Renovation Project.

BACKGROUND:

Constructed in 1939, the Royal Theater operated as an active movie theater until closed in 1989.

Following its closure, the building was intermittently used for a variety of purposes including a performing arts theater and public meeting space until 2011. In 2011 it was red tagged due to a minor interior electrical fire. The former Redevelopment Agency of the City of Guadalupe (RDA) purchased the property in 2001, and with the dissolution of the RDA ownership, transferred to the Successor Agency (SA) in 2012. In accordance with state law, the SA adopted a Long-Range Property Management Plan (LRPMP) to guide the disposition of the property. The LRPMP stipulates that the theater should be transferred to the City and ultimately the theater should be renovated as some form of Public Performing Arts Center.

The Royal Theater is located within the former Japanese enclave at the south end of City’s historic commercial business district. The Royal Theater Renovation Project is being undertaken by the City to (1) reconstruct, rehabilitate, and renovate, to historic standards, Royal Theater and (2) construct an additional, connected 3-story performing arts center, amphitheater, and community plaza. The Royal Theater Renovation Project is an essential project of public infrastructure for the City as it is part of the basic, underlying features of the City’s physical landscape, community identity and organization.

DISCUSSION:

Over the past 5 years, the City has diligently worked to raise the vast majority of funding needed for the Royal Theater Renovation Project. In total, the City has secured or is in the process of securing more than $10 million in grants and other financing. These consist of the following anticipated sources/amounts:
• Economic Development Administration (EDA) grant ($4.8 million) • California Arts Council – State Legislative Passthrough Funding ($5.0 million) • Historic Tax Credit (HTC) investments (approximately $0.8 – 0.9 million) Final cost estimates are not yet available, but the City believes an additional approximately $3.0 million (and potentially up to $5.0 million) is required to ensure the project can be completed as designed. The timeline for obtaining funding is running short, as the $4.8 million EDA grant will expire if construction is not started by March 2024.

After exhaustively exploring all options, the City believes placing a bond measure on the November 2024 ballot now represents the best option to ensure the funding for the project is in place in a timely manner. To put a bond measure on the November 2024, specialized consultants are required. Jones Hall, A Professional Law Corporation would serve as bond counsel to the City, drafting resolutions and other required legal documents, with review by the City attorney. Wulff, Hansen & Co. would serve as municipal advisor to the City, analyzing tax rates, bond interest rates and related matters. These firms have provided the following fee proposals to the City: Jones Hall ($10,000) and Wulff Hansen & Co. ($5,000). In addition to these consultants, the Santa Barbara County elections department would charge the City an additional fee to place the measure on the November 2024 ballot; final details are to be confirmed, but the City believes the cost would not exceed $5,000.

Once the financing team is hired, they can work with City staff to further analyze a potential bond measure and bring back to the City Council additional action items. The professional services agreements for these consultants will be submitted to the City Council for approval at a future Council meeting. These additional actions are anticipated to occur in June and July, in order to meet state-wide deadlines for the November 2024 election.

FISCAL IMPACT:

The current total cost of hiring the financing team and placing the measure on the November 2024 is estimated at $20,000. These funds would initially be paid from the City’s Fiscal Year 24/25 budget. If the measure fails, these costs would be borne by the General Fund. If the measure passes, the City could consider reimbursing the General Fund from bond proceeds.

Royal Theater Revitalization Project
Financing Options
March 26, 2024
ATTACHMENT 2
1 Royal Theatre Revitalization Project
The Historic Guadalupe Royal Theater Revitalization Project will include the following:
 Renovation of the 5,000 square foot 230 seat historic theater  Construction of a state-of-the-art, three-story, multi-purpose performing arts center for hosting live stage productions, live musical events, community events, and educational and cultural programs for the children of Guadalupe.
 A green room, classrooms, meeting spaces and an industrial kitchen, as well as a plaza, outdoor amphitheater and parking lot on the south side of the building.
2 Project Cost and Funding Sources
 The estimated total cost of the Project is $12 million to $14 million.  To date, the City has obtained approximately $10 million of grant funds from the following sources:
 The United States Economic Development Administration (EDA) awarded $4.8 million in American Rescue Plan funds to the Project,
 The State of California Arts Council awarded $5.0 million to the Project, and
 The Project has qualified for approximately $800,000 of Historic Tax Credits.
 Approximately $2 million to $5 million of additional funding is required to cover the remaining costs of the Project.
3 Tax-exempt bonds are frequently used by local governments such as the City of Guadalupe to finance large capital improvement projects.

The advantages of tax-exempt bonds include the following:
 Tax-exempt bonds have relatively low interest rates because interest on the bonds is tax-exempt,
 The interest rate on tax exempt bonds is also relatively low because bonds issued by local governments are generally considered highly creditworthy (e.g. less risky), and
 Tax-exempt bonds typically have long repayment terms of 25 to 30 years, depending on the useful life of the project being financed, which lowers the annual cost of debt repayment.

Tax-Exempt Bonds
4 There are many types of tax-exempt bonds. Some examples include:
 General Obligation Bonds
 Special Tax Bonds
 Parcel Tax Bonds
 Sales Tax Bonds
 Lease Revenue Bonds or Certificates of Participation
Given the size of the City and its financial resources, and the size and nature of the Project and its funding needs, the financing team recommends the issuance of Tax-Exempt General Obligation Bonds to cover the remaining Project costs.

Types of Tax-Exempt Bonds
5 Estimated Annual Cost of Debt Repayment
If the City finances the remaining Project costs by issuing Tax-Exempt General Obligation Bonds, the total annual cost of debt repayment will be between $125,000 and $300,000 per year for 30-years.

General Obligation Bonds are payable from ‘ad valorem’ property taxes, meaning all owners of taxable real property in the City will pay a share of the annual cost of debt repayment through their annual property taxes.

In California, ad valorem property taxes are levied based on ‘assessed value’ not ‘market value’. The total assessed value of taxable property in the City is approximately $700 million. Therefore, the annual cost of debt repayment will be between $18 and $43 per $100,000 of assessed value.

For a typical single-family home with an assessed value of $300,000 the annual cost of debt repayment will be between $54 and $129 per year. 6 In order to issue General Obligation Bonds, the City must place a measure on the November Election Ballot, which must be approved by 2/3rds of voters casting ballots. Many communities form a Citizens Committee to rally support for such a measure.

Citizens committees are typically comprised of local residents, local business leaders, members of civic organizations, members of the local and regional arts community, etc. Citizens committee activities often include:
• Writing letters to local newspapers
• Posting lawn signs around neighborhoods
• Handing-out flyers at local commercial establishments • Paid advertising (if funds are available)
• Giving interviews on local radio programs and speeches at local events • Giving the Project visibility and notoriety
Public Outreach Effort
7 Proposed Schedule
March 26, 2024: Informational item; authorization to proceed June, 2024: City Council approves Resolution of Necessity to Issue Bonds July, 2024: Council approves Reso. Calling for Election to Approve Bonds August 9, 2024: Deadline to submit election materials to County November 5, 2024: Election Day
January, 2025: City Council approves issuance of bonds February, 2025: Issuance of Bonds
8 Estimated Costs
Pre-Election, Non-Contingent Costs (reimbursable from bond proceeds)  Legal Counsel: $10,000
 Municipal Advisor: $5,000
 County Board of Elections: Approximately $3,000 to $5,000 Post-Election, Contingent Costs (payable from bond proceeds)  Bond & Disclosure Counsel, Underwriter, Municipal Advisor, Bond Insurer, Rating Agency, Trustee, etc.
 Approximately $160,000 contingent upon the issuance of the bonds Agenda Item No. 14

REPORT TO THE CITY COUNCIL OF THE CITY OF GUADALUPE
Agenda of March 26, 2024
__________________________________ ___________________________________ Prepared by: Approved by:

Annis Barajas, Recreation Services Manager Todd Bodem, City Administrator SUBJECT: Renaming of Central Park
RECOMMENDATION:

The Recreation and Parks Commission recommends that the City Council adopt Resolution No. 2024-27 renaming of Central Park to Las Mujeres Park, and review the proposed process for selecting a recipient of the Las Mujeres Park Woman of the Year award and inscribing her name on a perpetual memorial plaque in the park.

BACKGROUND:

Discussions by the Recreation and Parks Commission regarding the renaming of Central Park began last year. Around the time that the names of streets in the Pasadera community were going to be named after local Guadalupe veterans, the idea of renaming Central Park came up. Over the course of multiple Recreation and Parks Commission meetings, the Commission began to develop the idea of recommending the renaming of Central Park to be named after something significant to Guadalupe.

During the March meeting last year, Commissioner Emily Dreiling mentioned that March is Women’s History month and recommended to the Commission that Central Park be renamed after a Guadalupe female of significance. Over the course of the next few meetings, the commission discussed rather than naming it after one female to rename it Las Mujeres Park to recognize women as a whole. In order to still recognize an individual female, the Commission recommended having a woman of the year nominated by the community to be recognized each year.

DISCUSSION:

Changing the name from Central Park to Las Mujeres Park would not only allow for a new name along with the renovation of the park itself, but also recognize the women of Guadalupe who have made a positive impact on the community and its members.

The process to rename the park would begin with the City Council renaming the park as Las Mujeres Park. Thereafter, the Recreation and Parks Commission recommends that the next step would be to open a nomination period beginning on August 26 and ending in mid-October to accept nominations of Annis Barajas
women in Guadalupe who would be eligible to be named as the “Las Mujeres Park Woman of the Year.” August 26th is Women’s Equality Day and commemorates the 1920 adoption of the 19th Amendment to the United States Constitution, which prohibited the states and the federal government from denying the right to vote to citizens on the basis of sex. The special observance was first celebrated in 1971 and designated by congress in 1973.

Proposed nomination process:

The Recreation and Parks Commission also recommends the following process for determining who will receive the Las Mujeres Park Woman of the Year award:

After receiving the final submissions in the middle of the month of October, the Recreation Services Manager would submit a staff report to the Recreation & Parks Commission containing all of the nominations. The criteria for nominations along with what information should be submitted to the Recreation Department about the nominee will be determined at a later date should the renaming of Central Park be approved by the City Council. The Recreation Manager would allot two Recreation and Parks Commission meetings to allow the Commission time to narrow down the nominations to three candidates.

During the month of January, the Recreation Services Manager would submit a staff report to the City Council with the top three Recreation and Parks Commission recommended nominees. After the January meeting, following the final decision of the City Council the Recreation Services Manager would inform the selected individual that they will be awarded the Las Mujeres Park Woman of the Year.

The Recreation Services Manager would then procure a perpetual memorial plaque. Each year upon being selected a new honoree would be added to the plaque. The Recreation Department in conjunction with the Recreation and Parks Commission would hold a ceremony celebrating the honoree annually on March 8th which is recognized as International Women’s Day. International Women's Day is a global day celebrating the social, economic, cultural, and political achievements of women. The day also marks a call to action for accelerating women's equality. In addition to the plaque, a QR code containing the biography of the honoree would be located at the bottom of the plaque. The QR code would direct the public to a city recreation page designated for the honorees.

FISCAL IMPACT:

Hopefully, impact on the general fund will be limited to City staff time. If the City Council approves the renaming of the park and the process for selecting a recipient of the annual award, the Recreation Department will solicit local organizations to volunteer their time and resources to raise funds to cover the cost of the plaque, installation, and ongoing maintenance.
