Policy Context

Major Changes in our Ocean
Stressors are more frequent and more extreme
NOAA- NMFS State of the California Ocean 2024
● Climate Change
● Land based inputs
● Fishing pressure
● Habitat destruction
● Resilience not likely to be
sustained
● Changes are happening
against backdrop of rapid &
accelerating climate change.
● “New normals" likely replace
historic expectations.

MPAs as a solution
What did DMR tell us?
● Bigger, more abundant fish &
invertebrates.
● Larger MPAs perform better.
● NO Take SMRs perform the best.
● Responses to MPA protection greatest in
South, where more fishing occurs.
● Detecting ecological benefits for some
species & habitats will take more time.
● Biodiversity responses of ecological
communities varied across habitats and
bioregions
CA MPAs are significantly smaller & farther apart
than science guidelines
California MPA science guidelines recommended 25 years for full benefits to accrue > 90 % smaller ~70 % farther apart- less connected

Red- Less connected
Green- Connected
Analysis conducted Eriksen 2025 using GIS layers
Red- Smaller, Further apart

Proposed Point
Sal MPA
Guadalupe City Council
March 11, 2025
Petition 2023-28MPA
Petitioner: NRDC
Northern boundary: Mussel
Point
Southern boundary: end of
Brown’s Beach
Area: 14.22 sq miles
Shore-adjacent distance: 3.2
miles

Location Rationale
● Point Sal would increase representation and replication of nearly all habitat types along the Central Coast (e.g., intertidal, subtidal, kelp forests, deep and shallow rocky bottom, and deep and shallow rocky plains)
● Point Sal would protect a larval retention zone for commercially important fish and invert species
● Point Sal meets the minimum spacing guidelines for an interconnected network
● Point Sal would protect an important transitional zone for many species Lion Rock, an important haul-out zone for many pinnipeds and roosting site for seabirds.

Tribal Co-Management and Access
● Point Sal holds significant cultural and historical ties to the Chumash people as well as continued importance today
● The petition did not specify Tribal co-management or access language.

Instead it calls on the FGC to consult with federally recognized and non recognized Tribes in the area to determine the Tribal co-management and access regulations
● We are ammending our petition to be open to shore-based recreational fishing to account for subsistence activities and non-federally recognized Tribal members who fish the area

Proposed
Mishopshno MPA
Guadalupe City Council
March 11, 2025
Petition 2023-29MPA
Petitioners: EDC,

NRDC, SYBCI
Northern boundary: north of
Loon Point
Southern boundary:
northern end of Carpinteria
State Beach
Area: 26.2 sq miles
Shore-adjacent distance:

6.06 miles
Location Rationale
● Mishopshno is ecologically rich and includes many habitat types (e.g., rocky reef, rocky intertidal, sandy habitats, sandy beaches, kelp forests, surfgrass beds)
○ Mishopshno would expand the representation of rocky intertidal and rocky reef habitat in the southern region
○ Mishopshno would protect juvenile white shark aggregation habitat ● Mishopshno would fill a spacing gap between existing coastal MPAs and promote network connectivity
○ MPA design guidance: MPAs should be placed within 31-62 miles of each other ■ Distance between Campus Point and Point Dume: 64 miles ○ Research shows the mainland MPAs are unlikely to be well connected to the Channel Island MPAs
Tribal Co-Management and Access
● The MPA is named after an important historical Chumash village– Mishopshno. The area still continues to be of great importance for Chumash people today
● The petition includes suggested regulations to allow access to the shoreline and marine resources for traditional, ceremonial, cultural, and subsistence purposes for the federally recognized Tribe of the Santa Ynez Band of Chumash Indians.
● However, expanding access to non-federally recognized Chumash Tribes is also one of our priorities, which is one of the reasons we are amending our petition to allow for recreational fishing from the shore and from nonmotorized water crafts ● Additionally, the SYBCI’s co-management strategy is in the early stages of planning

Agenda Item No. 8E

REPORT TO THE CITY COUNCIL OF THE CITY OF GUADALUPE
Agenda of March 11, 2025
__________________________________ _____________________________ Prepared by: Approved by:

Jeff van den Eikhof, City Engineer Todd Bodem, City Administrator SUBJECT: Amendment No. 3 to the agreement for services between the City of Guadalupe and Michael K. Nunley and Associates (MKN) for Engineering Services during Construction of the Highway 1 Lift Station.

RECOMMENDATION:

It is recommended that the City Council adopt Resolution No. 2025-17 approving Amendment No. 3 to the agreement with MKN to provide ongoing engineering services during the construction of the Highway 1 lift station.

BACKGROUND:

In 2014, the Wastewater Master Plan identified the need to replace over 3,000 feet of sewer trunk main, the Highway 1 Lift Station, and the Pioneer Lift Station.

In 2016, the City entered an agreement with Michael K. Nunley and Associates (MKN) to design the three projects. Construction of the sewer trunk main project is complete, and the Highway 1 Lift Station Project and Pioneer Lift Station Project have been designed, and construction contracts awarded.

Due to the complexity and long duration of the projects, the City Council has approved two amendments to MKN’s agreement. The most recent amendment, approved on November 22, 2022, approved engineering services during the construction of the Highway 1 and Pioneer Lift Station.

DISCUSSION:

Due to continued supply chain issues caused by the pandemic, the Highway 1 Lift Station Project is in its thirteenth month of procuring equipment. MKN’s contract includes engineering services during construction, including reviewing submittals, responding to Requests for Information (RFIs), and assisting with design-related issues. Multiple revisions have been necessary due to the lack of parts and inventory. Additionally, the previously secured Caltrans encroachment permit expired due to the lack of construction.

Jeff van den Eikhof
Amendment No. 3 will allow MKN to continue providing engineering services during construction (ESCD) of the Highway 1 Lift Station Project. It will also extend the agreement expiration date to account for the procurement delays and construction.

FISCAL IMPACT:

The cost of $22,571 will be covered by the CDBG funds received for the construction of the Highway 1 Lift Station.

Re: Highway 1 Lift Station Replacement Project Engineering Services During Construction - Scope Amendment #1
Dear Dayanira,
MKN and Associates, Inc., (MKN) is currently providing Engineering Services During Construction (ESDC) for the Highway 1 Lift Station Replacement Project. Services include office engineering tasks such as submittal reviews, requests for information (RFI) responses, field observation as needed, lift station startup support, and record drawings.

The contract budget was prepared in November 2022 and was based on various assumptions, including number of hours for submittal reviews, the number of RFI responses, and an estimated construction duration. Per the contract, invoicing and payment is based on time and materials expended. As of our last invoice (December 2024), MKN had less than approximately $3,500 remaining in the project budget. Work performed this last month has fully exhausted our contracted budget amount. Additional budget authorization is required to continue to provide services through the end of the project construction.

Since the December 2024 invoice, MKN was requested to provide an updated planset to address Caltrans Encroachment Permit review comments. The final plans had been previously approved by Caltrans, however, since the project has been delayed the original issued Caltrans Encroachment Permit had expired and required a new permit application and review. Revised plans and a response letter was provided to the City on January 9th, 2025 to obtain the new permit. This out-of-scope effort resulted in additional charges of approximately $5,400. Caltrans has recently requested additional information to be provided on the plans. MKN has included budget to respond to this request and has included additional hours to respond to any additional requests if needed.

Dayanira Cruz | 2
In addition, MKN and IRJ (Electrical Design Consultant) have expended a greater number of hours reviewing submittals than originally estimated. This has been due to several submittals requiring resubmittal and review and the additional review and conversations regarding the lift station MCC and control panel. MKN and IRJ have been required to spend additional hours reviewing proposed revisions to the lift station electrical and controls arrangement at the request of the Contractor. These request stem from issues with supply delivery dates and Contractor coordination issues between various component suppliers. MKN and IRJ anticipate the need for additional submittal review and re-reviews as not all required project submittals have been received. MKN is requesting an additional 20 hours to continue to review project submittals.

It is also requested that budgets for scope items not yet provided or completed be replenished with this scope amendment. These tasks include:
• Responses to RFIs
• Responses to Requests for Change Orders
• Engineer’s Observation of Work In Progress
• Lift Station Startup Support
• Record Drawings
Estimated budget to provide these services is based on the original anticipated number of hours.

Budget
The current authorized budget for the project is $32,510. This scope amendment (SA#1) includes additional budget required to continue to provide ESDC. Budgets for this scope amendment have been updated to MKN’s 2025 rates (see attached 2025 Rate Sheet). The total requested amount for this scope amendment is $22,571. The revised total contract amount will be $55,081. Work will be invoiced on a time and materials basis.

Agenda Item No. 13

REPORT TO THE CITY COUNCIL OF THE CITY OF GUADALUPE
Agenda of March 11, 2025
________________________________ __________________________________ Prepared by: Approved by:

Bill Scott, Contract City Planner Todd Bodem, City Administrator SUBJECT: Review of a conceptual site plan (2025-003-PA) proposing to establish four (4) short-term rental cabins and a brewery in addition to an existing single-family house on a 14,480 square-foot property at the northwest corner of Ninth Street and Olivera Street (4575 Ninth Street) APN 115-720-009.

RECOMMENDATION:

It is recommended that the City Council:
a. Receive a presentation from staff;
b. Accept public comments, including: 1) an opportunity for the applicant to present the proposed project; and
c. Provide staff with general non-binding comments on the proposed project.

BACKGROUND:

The applicant, Mr. Victor Early, is presenting a conceptual site plan to solicit feedback from the City Council for his proposal to create a phased mixed-use project on the northeast corner of Ninth Street and Olivera Street (Attachment 1 – Aerial Vicinity Map). As shown, the project would consist of an existing single-family home, four short-term rental cabins and a 2,500 square-foot brewery/restaurant (Attachment 2 - Applicant’s Site Plan).

The property is currently zoned under the R-3 (High Density) residential zoning district. To allow all of the envisioned of uses, it would be necessary to change the General Plan land use designation and zoning on the property. A change from the High-Density Residential designations to the Downtown Mixed-Use land use and zoning designations would be the most plausible to accommodate the three uses. The property is bounded by commercial uses on two sides. The MIX zone is currently applied on the northwest side of the property. Other commercial uses are located directly across Ninth Street southwesterly.

Project Description:

As shown on the Site Plan, a vintage single-family home faces Olivera Street on the southeasterly side of the property. The house was recently restored and is intended to remain for use as a single-family residence. As the first Phase, four (4) small rental cabins would be located behind an existing shed in the northernmost corner of the property. The applicant has indicated the cabins would likely include the Bill Scott

Page 2 of 5 ends

sleeping area, a bathroom and a kitchenette. A driveway would be extended from Olivera street to provide access to the four cabins. As a potential second phase, the 2,500 square-foot brewery is proposed to be located on the southwesterly side of the property. The entrance of the brewery would be oriented to face Ninth Street. As shown, no off-street parking is being proposed by the project. Since the plan is preliminary, no building floor plans, or any other project details have yet been provided by the applicant.

Surrounding Land Uses:

The property is on the northerly corner of Ninth Street and Olivera Street (Attachment 1 - Aerial Vicinity Map). Immediately on the northwest side of the property are rear portions of the various commercial businesses (e.g., El Tapatio Restaurant and Root One dispensary) that have their frontages on Guadalupe street in Downtown Guadalupe. To the south, across Olivera Street are various single-family homes and multi-family dwellings. Southwesterly, across Ninth Street is a car wash and vacant lands are further southwesterly beyond the carwash. Northeasterly, along both sides of Olivera Street the area is typified by single-family homes. A few lots developed with multi-family dwellings are distributed among the single-family residences.

DISCUSSION:

The primary issues associated with the proposal are: 1) neighborhood compatibility; 2) suitability of the property to accommodate the three uses; and 3) consideration of a change in the land use and zoning designations at this location.

Compatibility with the Neighborhood:

The compatibility of the proposal with the neighborhood is evaluated by considering each of the three uses separately, followed by an assessment of how well the property might accommodate the three uses in combination.

Single-Family Home: As noted, a recently restored vintage single-family home is facing Olivera Street.

The applicant has stated that the home would remain for use as a single-family residence. If the rental cabins were approved, a small portion of the home could be used as a management office. The home is already an integral part of the neighborhood and by its very nature, continuation of the home would result in no neighborhood compatibility issues.

Rental Cabins: The applicant has indicated that, the cabins would function like small motel rooms. In addition to a sleeping area, each would contain a bathroom and a small kitchenette.

As shown on the conceptual site plan, the cabins would be placed ten feet away from the closest residential property on the northeast side of the site. Each of the four rental cabins is roughly 150 square feet in size. For this type of lodging facility, the Municipal Code requires one conveniently located parking space for each guestroom (cabin).

In terms of land use compatibility, it is noted that the Zoning Ordinance already permits a “lodging facility” in the R-3 zone. Depending on the type of facility, a transient lodging facility may be permitted through a conditional use permit, a design review permit or an administrative use permit. Since the owner is requesting multiple lodging facilities in newly constructed buildings, a Design Review Permit would be the appropriate permit to accommodate the use.

Page 3 of 5 ends

For this type of use, the Municipal Code does not permit temporary buildings. The cabins would have to be constructed on permanent foundations. Through the Design Review permit approval process the building details, operational parameters and associated facilities would be established to ensure compatibility with the immediate neighborhood.

Brewery: As a wholly commercial use, a change in the General Plan land use and zoning designations would be required to permit the brewery use. The brewery would be appropriately placed with the entrance adjacent to Ninth Street on the southwest side of the property. As noted, directly across Ninth Street is a car wash and Downtown commercial uses. Downtown commercial uses are also located on the northwest side of the site. Thus, at this location the brewery should be a fully compatible with the land uses on the northwesterly and southwesterly sides of the property. It is also noted that the 2002 General Plan and zoning map had previously designated the area for commercial use. Therefore, the potential to introduce a commercial use in the area would be consistent with the prior General Plan land use designation.

On the northeasterly and southeasterly sides of the property are residential areas. As shown, the rear of the brewery would be roughly 60 feet from the closest residential property to the northeast. Thus far, no detailed description of the brewery has been provided. Potential impacts on the nearby residential areas could vary greatly depending on the seating capacity and the range of activities that are envisioned.

For example, if outdoor seating or amplified sound is envisioned, potential noise impacts could be greater. If entertainment or special promotional events are held, potential traffic and parking impacts could be greater. The project would need be conditioned such that outdoor events are limited to daytime uses without amplification.

Parking: For uses such as restaurants, cafes, nightclubs, bars and cocktail lounges with seats or tables, a minimum of one parking space for each 65 square feet of floor area used for tables and chairs, plus one space for each 260 square feet of remaining gross-floor areas is required. Assuming 1,500 square feet of floor area is used for tables and chairs, it is estimated twenty-seven (27) parking spaces would be needed to accommodate the parking needs for the brewery. A more detailed discussion of the parking needs for all of the uses on the property is provided in the Site Suitability discussion below.

Site Suitability
The current Site Plan would include the three separate land uses on the 14,480 square-foot property.

The main consideration is providing enough parking to accommodate the three uses.

Total Parking Requirement:

GMC Section 18.60.070 specifies: If more than one use is located on a site or within a building, the number of parking spaces provided shall be equal to the sum of the parking spaces required for each use. Based on this code requirement, the off-street parking requirement for the three proposed uses is as follows:

Parking Required:

Single-family home = Two (2) covered spaces.*
Four Rental Cabins: One (1) space per cabin = 4 spaces.* 2,500 Square-Foot Microbrewery = Twenty-five (27) spaces.* Total Required Parking Spaces = 33 Spaces
Total Off-Street Parking Provided = None
*Parking calculations are estimates based on the current project description and could vary when more details are provided.

Page 4 of 5 ends

As shown on the preliminary site plan, there is not enough room to accommodate 30+ parking spaces on the property. As an alternative, the applicant has proposed on-street parking to meet most of the parking needs of the project. The Zoning Ordinance contains a provision that allows on-street parking in Downtown Guadalupe in limited circumstances and if certain findings can be made.

Planning staff has noted that there is approximately 670 linear feet of street frontage extending along the front of the property on Olivera Street and on both sides of Ninth Street. This would equate to approximately twenty-seven (27) on street parking spaces. Thus, it may be possible that most of the parking needs of the project could be met by on-street parking. Again, findings would have to be made that on-street parking would be suitable for this location.

Driveways/Vehicle Circulation:

The Municipal Code also establishes minimum standards for onsite vehicle circulation. With all three uses, there would be limited space to accommodate adequate vehicle turnaround movements. The Fire Department has previously stated that all fire access requirements would have to be met during the Design Review stage. The applicant would likely need to make some adjustments to the site plan (e.g., possibly removal of an existing storage structure) to ensure adequate driveway widths and vehicle turnaround space is provided, particularly in proximity to the lodging cabins.

Appropriateness of a Change in Land Use:

As noted, the property is currently zoned for the R-3 (High Density Residential) use. As a first step, if the City Council chose to conceptually support the project, the City’s General Plan land use map would need to be amended as well as the Official Zoning Map to establish the following land use and zoning designations on the property:

General Plan - Downtown Mixed-Use: The Downtown Mixed-Use General Plan land use designation is primarily a commercial designation. Additionally, residential uses in limited forms may be permitted.

Zoning District - MIX (Mixed-Use): The MIX (Mixed-Use) zoning district is the corresponding zoning to the Downtown Mixed-Use General Plan land use designation. Similarly, the MIX (Mixed-Use) zoning district is primarily a commercial zoning that also allow limited forms of residential use.

The General Plan land use and zone change would have the effect of expanding Downtown Guadalupe onto the Ninth/Olivera Street corner property. As discussed above, the entire north side of Olivera Street was previously designated General Commercial under the 2002 General Plan land use and official Zoning Map. Therefore, applying the Downtown Mixed-Use designations on the property would not be unprecedented.

General Plan Policy Considerations:

Residential Land Use Goal LU-3: To separate incompatible land uses for functional efficiency, reduction of nuisance, and improvement of health and safety.
• Careful consideration must be given to the protection established homes in this “Original City” neighborhood. Through the Design Permit review permit process, it may be possible to establish the mixed-use project to be a suitable fit with the with the residences in the area.

Commercial Land Use Policy LU-1.13: The City will encourage commercial uses that serve the entire community and/or region to locate in the Downtown Guadalupe.

Page 5 of 5 ends

• The project includes uses to serve both the residents of the immediate community as well as to serve the visitors from the broader region.

Economic Development Goal ED-7: Expand allowed retail, food, and drink sales in Commercial-Industrial Zones to attract more restaurants, wineries, breweries, distillers, and specialty manufacturers to do business in Guadalupe.

Economic Development Policy ED-1.5: The City will encourage new types of commercial and industrial uses in order to diversify the City’s economic base.
• Both the rental cabins and the microbrewery could support the City’s economic development objectives by providing new lodging facilities for visitors and increasing the variety of social and entertainment opportunities for both City residents and visitors.

Conclusion:

In summary, the addition of lodging facilities and a brewery would have great potential to promote General Plan economic objectives to support tourism and increase the variety of entertainment opportunities in the City’s Downtown. To accommodate the mixed-use project a General Plan amendment and a zone change would be required to apply the Downtown Mix Use designations on the property. Staff believes all of the uses could be conditioned to fit the property. However, some conditioning (e.g., placing limitation on hours, or amplified sound) may possibly constrain the uses and activities envisioned by the applicant for the brewery. Furthermore, findings would have to be made that on-street parking would be fitting for this location. Overall, staff believes the uses proposed by the mixed-use project could potentially be a notable asset for the City.

Agenda Item No. 14

REPORT TO THE CITY COUNCIL OF THE CITY OF GUADALUPE
Agenda of March 11, 2025

________________________________ __________________________________ Prepared by: Approved by:

Michael Cash, Director of Public Safety Todd Bodem, City Administrator SUBJECT: Informational report from Public Safety staff on the feasibility of amending Guadalupe Municipal Code 6.04.210 – Prohibition of fowl, livestock, and wild animals.

EXECUTIVE SUMMARY:

The Guadalupe Municipal Code (GMC) section6.04.210 Prohibition of fowl, livestock, and wild animals, states: “No person shall keep, harbor, maintain upon his or her premises within the City any fowl, livestock, or wild animals. If a person has any fowl, livestock, or wild animals on the effective date hereof, the person shall have 90 days from the effective date hereof to come into compliance with this section.

Some community members have voiced concerns in continued support of this ordinance to guard against rodent infestation, noise pollution, and public health concerns. Some residents have voiced support to change the current ordinance to allow the keeping of fowl (but no male fowl and or roosters) to help with pest control, fight inflation (i.e., the rising cost of eggs), and increase access to healthy food alternatives.

RECOMMENDATION:

It is recommended that the City Council:
1) Receive presentation from staff; and
2) Accept public testimony; and
3) Close public comment; and
4) Deliberate and file the report; or
5) Direct staff to prepare an ordinance; or
6) Direct staff to return to Council when a draft ordinance is ready for consideration; or 7) Continue to another Council meeting for further discussion and deliberation BACKGROUND:

Public Safety staff had received verbal and written concerns from residents in support of keeping the current ordinance as is and from community members to amend the ordinance to allow fowl in residential areas.

DISCUSSION:

Michael Cash

2. Complaint filed and investigation regarding illegal housing of chickens in a residential neighborhood.

To the City of Guadalupe,
We, the residents of Guadalupe, respectfully request that the town amend its zoning and animal ordinance to allow chickens to be kept as pets in residential areas. Keeping chickens has numerous benefits, both for individual households and the community as a whole. We believe that allowing chickens as pets will contribute positively to the quality of life in our town. **The Benefits of Keeping Chickens:**

1. **Fresh, Local Eggs:** Chickens provide a sustainable source of fresh, nutritious eggs. Homeraised eggs are often more flavorful and healthier than store-bought options, with higher levels of omega-3 fatty acids and vitamins.

2. **Pest Control:** Chickens are natural foragers and help control insects and pests, such as ticks, beetles, and mosquitoes, reducing the need for chemical pesticides. This promotes a healthier and more eco-friendly environment.

3. **Composting and Waste Reduction:** Chickens produce rich, nitrogen-rich manure that can be used as compost to enrich soil in gardens and lawns. This helps reduce household waste, as kitchen scraps can be fed to the chickens, contributing to a sustainable lifestyle.

4. **Educational Value:** Raising chickens provides valuable opportunities for children and adults to learn about responsibility, animal care, and sustainable farming practices. Chickens offer hands-on learning experiences that promote a connection with nature.

5. **Quiet and Low-Maintenance:** Contrary to common misconceptions, chickens are quiet animals that make minimal noise. They do not pose a disturbance to neighbors, and their care requires relatively little time and effort. Most chickens are content with a small outdoor space and simple shelter.

6. **Improved Mental Health and Well-being:** Studies have shown that interacting with animals, including chickens, can reduce stress, improve mood, and provide emotional benefits.

Having chickens can enhance residents' quality of life and foster a deeper connection to the land.

7. **Supporting Local Agriculture:** By allowing chickens, the town can encourage local food production and self-sufficiency, supporting a culture of sustainable living in the community. **Proposed Guidelines for Chicken Keeping:**
To ensure the safety, cleanliness, and well-being of both the chickens and the community, we propose the following reasonable guidelines for residential chicken keeping:

ATTACHMENT 1
- A limit of S chickens per household to prevent overcrowding. - Chickens must be kept in a well-maintained, enclosed coop to prevent wandering and ensure hygiene.
- No roosters to minimize noise disturbances.
- Proper waste disposal and management to ensure cleanliness and prevent odors. - Adequate space for chickens, with a fenced area or run to provide them with room to roam.

We believe these guidelines will address any concerns while allowing families to enjoy the benefits of having chickens as pets.

We ask that the council consider this petition and the positive impact chickens can have on our community. Allowing chickens as pets in residential areas will not only promote sustainability and self-sufficiency but also enrich the lives of our residents.

Thank you for your consideration.

Sincerely,
Copado Family

I have completed my investigation into your Code Compliance Service Request regarding 154 Santa Barbara Street, "Chickens in the yard and rat infestation".

On Monday, November 4, 2024, a Guadalupe poJice officer made an unannounced visit to 154 Santa Barbara Street in reference to the service request. The officer spoke with the female resident and advised her he was there in reference to a code compliance service request regarding chickens on the property and possible rat infestation.

The home resident invited the officer to inspect their rear yard. The officer found ten (10) chickens in the rear yard area. A further inspection found the area to be clean with very few chicken droppings and no foul smell or foul odor coming from the area. No rodent droppings were noticed throughout the yard during the inspection. The police body camera was activated to record the inspection.

On Tuesday, November 5, 2024, I made an unannounced visit to 154 Santa Barbara Street to confirm the officers findings. I met the home resident and introduced myself to her as the city Code Compliance Officer. I advised her I was there in response to a code compliance service request regarding chickens on the property and possible rodent infestation. She invited me in and allowed me to inspect the rear yard. While in the rear yard, I noticed several chickens in the area.

There were minimal chicken droppings on the ground and no foul odor was detected. I also did not observe any rodents or rodent droppings in the yard area.

I advised the resident that she was in violation of Guadalupe City Ordinance:

6.04.210Prohibition of fowl. livestock, and wild animals.

No person shall keep, harbor, maintain upon his or her premises within the City any fowl, livestock, or wild animals. If a person has any fowl, livestock, or wild animals on the effective date hereof, the person shall have 90 days from the effective date hereof to come into compliance with this section.
(Ord. 2006-375 §1)
The resident was advised to remove the fowl within the time limit of the ordinance. She stated she would comply with the order.

This office will continue to monitor the situation until the situation has been corrected.
