REPORT TO THE CITY COUNCIL OF THE CITY OF GUADALUPE
Agenda of June 24, 2025
________________________________
Prepared by:

Todd Bodem, City Administrator
SUBJECT: Recommendation to Appoint Board Members to the Guadalupe Community Action Coalition (GCAC)
RECOMMENDATION:

The Guadalupe Community Action Coalition (GCAC) recommends that the City Council approve the appointment of the following individuals to serve on the GCAC Board of Directors effective June 24, 2025:
• Deborah Sykes – Term Ending June 24, 2027
• Robert Diaz – Term Ending June 24, 2027
BACKGROUND:

The GCAC is a nonprofit organization that works in partnership with the city to accept capital campaign monies, seek grants, and to enhance community and economic development for the City of Guadalupe.

The organization’s bylaws require that board appointments be confirmed or made by the City Council.

The new appointments are not vacancies, but rather an expansion of the board from 5 to 7 members as authorized in the bylaws. New appointments are desired to ensure expanded and continued governance.

DISCUSSION:

The GCAC issued a call for applications to join the board and conducted a review of potential candidates.

Based on qualifications, community involvement, and relevant experience, the following individuals are recommended:
• Deborah Sykes, Resident of Guadalupe
• Robert Diaz, Resident of Guadalupe
The appointments align with the City’s goal of promoting community representation and ensuring qualified oversight of organizations receiving support.

Agenda Item No. 9

REPORT TO THE CITY COUNCIL OF THE CITY OF GUADALUPE
Agenda of June 24, 2025

________________________________ __________________________________ Prepared by: Approved by:

Jeff van den Eikhof, City Engineer Todd Bodem, City Administrator SUBJECT: Caltrans Utility Agreement (UA) and Landscape Maintenance Agreement (MA) RECOMMENDATION:

It is recommended that the City Council adopt

1. Resolution No. 2025-35, approving a Utility Agreement (UA) with Caltrans, which allows the City to request and receive reimbursement for costs related to moving and adjusting water meters and a fire hydrant due to the construction of the Caltrans project on Guadalupe Street, and authorizing the Public Works Director to sign the agreement on behalf of the City.

2. Resolution No. 2025-36, approving a Landscape Maintenance Agreement (MA) with Caltrans, which memorializes the City’s and Caltrans’ maintenance responsibilities within the State right-ofway and authorizing the Mayor to sign the agreement on behalf of the City.

DISCUSSION:

Caltrans is working on plans to construct several projects within the City limits. The City owns utilities within the State right-of-way. The City Council previously approved a Cover Agreement with Caltrans on July 23, 2024, which authorizes Caltrans to adjust city-owned lids and covers for utilities. There is no cost to the City for this work. However, as part of Caltrans’ construction of the new bridge on Highway 1 and the ADA improvement project, the existing curb and gutter north of 12th Street must be moved about one foot to the west. This necessitates the relocation of water meters and a fire hydrant behind the new curb.

New driveway approaches on Highway 1 are also being constructed to new standards, necessitating the relocation of some water meters. Caltrans will not relocate these facilities so the City needs to perform this work. The City has submitted a claim to Caltrans, which, if approved, will provide reimbursement for the utility relocation. The Utility Agreement (UA) formalizes this agreement and allows the City to seek reimbursement after the City’s contractor performs the work.

During the development of the Caltrans projects throughout Guadalupe, the Caltrans Maintenance Division discovered that no Landscape Maintenance Agreement (MA) existed between Caltrans and the City. The MA specifies the City’s and Caltrans’ responsibilities within the Caltrans right-of-way.

The City Attorney, City Engineer, and Public Works Director have reviewed the documents.

Jeff van den Eikhof

Page 2 of 2 ends

FISCAL IMPACT:

The approval of the Utility Agreement allows the City to seek reimbursement for relocating utilities in the state right-of-way. If not approved by the City Council, the City can make no claims for reimbursement and will be responsible for the full cost of relocating the utilities.

The Landscape Maintenance Agreement (MA) costs to the City are currently unknown. The City currently maintains most of the items contained within the agreement. Not approving the MA would jeopardize the projects within the City limits from moving forward.

No work under said deviation shall commence prior to written execution by the OWNER of the Revised Notice to Owner. Changes in the scope of the work will require an amendment to this Agreement in addition to the revised Notice to Owner.

II. LIABILITY FOR WORK
Existing facilities are located in their present position pursuant to rights superior to those of the STATE and will be relocated at STATE expense.

III. PERFORMANCE OF WORK
OWNER agrees to perform the herein described work with its own forces or to cause the herein described work to be performed by the OWNER’s contractor, employed by written contract on a continuing basis to perform work of this type, and to provide and furnish all necessary labor, materials, tools, and equipment required therefore, and to prosecute said work diligently to completion.

Work performed by OWNER’s contractor is a public work under the definition of Labor Code Section 1720(a) and is therefore subject to prevailing wage requirements.

Work performed directly by Owner’s employees falls within the exception of Labor Code Section 1720(a)(1) and does not constitute a public work under Section 1720(a)(2) and is not subject to prevailing wages. OWNER shall verify compliance with this requirement in the administration of its contracts referenced above.

Use of personnel requiring lodging and meal “per diem” expenses shall not exceed the per diem expense amounts allowed under the California Department of Human Resources travel expense guidelines. Accounting Form FA-1301 is to be completed and submitted for all non-State personnel travel per diem. Owner shall also include an explanation why local employee or contract labor is not considered adequate for the relocation work proposed.

IV. PAYMENT FOR WORK
The STATE shall pay its share of the actual and necessary cost of the herein described work within 45 days after receipt of OWNER’s itemized bill, signed by a responsible official of OWNER’s organization and prepared on OWNER’s letterhead, compiled on the basis of the actual and necessary cost and expense. The OWNER shall maintain records of the actual costs incurred and charged or allocated to the project in accordance with recognized accounting principles.

It is understood and agreed that the STATE will not pay for any betterment or increase in capacity of OWNER’s facilities in the new location and that OWNER shall give credit to the STATE for the accrued depreciation of the replaced facilities and for the salvage value of any material or parts salvaged and retained or sold by OWNER.

Not more frequently than once a month, but at least quarterly, OWNER will prepare and submit itemized progress bills for costs incurred not to exceed OWNER’s recorded costs as of the billing date less estimated credits applicable to completed work. Payment of progress bills not to exceed the amount of this Agreement may be made under the terms of this Agreement. Payment of progress bills which exceed the amount of this Agreement may be made after receipt and approval by STATE of documentation supporting the cost increase and after an Amendment to this Agreement has been executed by the parties to this Agreement.

The OWNER shall submit a final bill to the STATE within 360 days after the completion of the work described in Section I above. If the STATE has not received a final bill within 360 days after notification of completion of OWNER’s work described in Section I of this Agreement, and STATE has delivered to OWNER fully executed Director’s Deeds, Consents to Common Use or Joint Use Agreements, if required for OWNER’s facilities, STATE will provide written notification to OWNER of its intent to close its file within 30 days and OWNER hereby acknowledges, to the extent allowed by law, that all remaining costs will be deemed to have been abandoned. If the STATE processes a final bill for payment more than 360 days after notification of completion of OWNER’s work, payment of the late bill may be subject to allocation and/or approval by the California Transportation Commission.

The final billing shall be in the form of an itemized statement of the total costs charged to the project, less the credits provided for in this Agreement, and less any amounts covered by progress billings. However, the STATE shall not pay final bills which exceed the estimated cost of this Agreement without documentation of the reason for the increase of said cost from the OWNER and approval of documentation by STATE. Except, if the final bill exceeds the OWNER’s estimated costs solely as the result of a revised Notice to Owner as provided for in Section I, a copy of said revised Notice to Owner shall suffice as documentation. In either case, payment of the amount over the estimated cost of this Agreement may be subject to allocation and/or approval by the California Transportation Commission.

In any event if the final bill exceeds 125% of the estimated cost of this Agreement, an Amended Agreement shall be executed by the parties to this Agreement prior to the payment of the OWNER’S final bill. Any and all increases in costs that are the direct result of deviations from the work described in Section I of this Agreement shall have the prior concurrence of STATE.

Detailed records from which the billing is compiled shall be retained by the OWNER for a period of three years from the date of the final payment and will be available for audit by State and/or Federal auditors. In performing work under this Agreement, OWNER agrees to comply with the Uniform System of Accounts for Public Utilities found at 18 CFR, Parts 101, 201, et al., to the extent they are applicable to OWNER doing work on the project that is the subject of this agreement, the contract cost principles and procedures as set forth in 48 CFR, Chapter 1, Part 31, et seq., 23 CFR, Chapter 1, Part 645 and 2 CFR, Part 200, et al. If a subsequent State and/or Federal audit determines payments to be unallowable, OWNER agrees to reimburse AGENCY upon receipt of AGENCY billing. If OWNER is subject to repayment due to failure by State/Local Public Agency (LPA) to comply with applicable laws, regulations, and ordinances, then State/LPA will ensure that OWNER is compensated for actual cost in performing work under this agreement.

V. GENERAL CONDITIONS
All costs accrued by OWNER as a result of STATE’s request of November 4, 2024 to review, study and/or prepare relocation plans and estimates for the project associated with this Agreement may be billed pursuant to the terms and conditions of this Agreement.

If STATE's Project which precipitated this Agreement is canceled or modified so as to eliminate the necessity of work by OWNER, STATE will notify OWNER in writing and STATE reserves the right to terminate this Agreement by Amendment. The Amendment shall provide mutually acceptable terms and conditions for terminating the Agreement. The Amendment shall provide payment by the STATE of any cost actually incurred by OWNER in connection with the performance element(s) of OWNER's Work (including preparation of OWNER's Plan).

All obligations of STATE under the terms of this Agreement are subject to the passage of the annual Budget Act by the State Legislature, and the allocation of those funds by the California Transportation Commission.

OWNER shall submit a Notice of Completion to the STATE within 30 days of the completion of the work described herein.

It is understood that said highway is a Federal aid highway and accordingly, 23 CFR, Chapter 1, Part 645 is hereby incorporated into this Agreement.

OWNER understands and acknowledges that this project is subject to the requirements of the Buy America law (23 U.S.C., Section 313) and applicable regulations, including 23 CFR 635.410 and FHWA guidance, and will demonstrate Buy America compliance by collecting written certification(s) from the vendor(s) or by collecting written certification(s) from the manufacturer(s) mill test report (MTR). Certification(s) should state, “All manufacturing processes for these steel and iron materials, including the application of coatings have occurred in the United States. All manufacturing processes means melting of the steel through final manufacturing of steel components.” “All documents obtained to demonstrate Buy America compliance will be held by the OWNER for a period of three (3) years from the date of final payment to the OWNER and will be made available to STATE or FHWA upon request.” “One set of copies of all documents obtained to demonstrate Buy America compliance will be attached to, and submitted with, the final invoice.” “This does not include products for which waivers have been granted under 23 CFR 635.410 or other applicable provisions or excluded material cited in the Department’s guidelines for the implementation of Buy America requirements for utility relocations issued on December 3, 2013.

Agenda Item No. 10

REPORT TO THE CITY COUNCIL OF THE CITY OF GUADALUPE
Agenda June 24, 2025
_______________________________ _________________________________ Prepared by: Approved by:

Janice Davis, Finance Director Todd Bodem, City Administrator SUBJECT: Fiscal Year 2025-2026 Final Budget
RECOMMENDATION:

It is recommended that the City Council review the correction identified in the June 10, 2025 meeting and adopt Resolution No. 2025-37 accepting the proposed Final Budget for fiscal year 2025-2026, along with the Capital Improvement Projects Budget and Capital Facilities Program of Projects Budget.

BACKGROUND:

City Council and City staff reviewed the FY25-26 preliminary budget draft on June 10, 2025 and identified $25,000 remaining in the Fire personnel budget that should be 0.00 noting this was to hold hiring PCF’s in FY25-26. The difference is rolled into the reserve budget as a contingency.

DISCUSSION AND PROPOSED BUDGET OVERVIEW:

General Fund Summary
The preliminary budget includes revenues of $7,460,584 and expenditures of $8,291,605.

Janice Davis

Page 2 of 13 ends

The difference between budgeted revenues and budgeted expenditures is -$831,021 with expenditures exceeding revenues.

The City reserve requirement was higher in FY24-25 and because of this we have a fund balance that has helped the City to have a balanced FY25-26 budget, as well as meet the audit expectation of having a minimum of 10% General Reserve and 5% Emergency Reserve. 2025-2026

Expected revenues related to Building and Planning are $282,200 which is a decrease of about 15% total $39,567 from the approved FY24-25 budget which was forecasted at 321,767. The California Local Government Finance Alamanac February 2013 Citizens Option for Public Safety (COPS)
A Primer on Supplemental Law Enforcement Services Account (SLESA) Grants Background: A Sales Tax for Public Safety Born Out of ERAF The Citizens Option for Public Safety (COPS)i program was originally adopted in AB3229 (Brulte) 1996 with funding from the state general fund. COPS provides funding for o front-line law enforcement (city police, county sheriffs, and police protection districts); o county jails;
o district attorneys for prosecution; and
o local juvenile justice programs (since 2000-01).

State COPS funding is allocated by the State Controller to counties for deposit by the county auditor in a Supplemental Law Enforcement Services Account (SLESA)ii established in each county. The county auditor is required to allocate the moneys in the county's SLESA within 30 days of the receipt of those moneys from the State Controller.

As a part of the 2011 realignment of various public safety programs from the state to local government, the Legislature approved the Local Law Enforcement Services Act (AB118) and shifted all remaining motor vehicle license fee (MVLF) revenue that was previously cities to pay for various local law enforcement grant programs including the COPS/SLESA programs (SB89). The MVLF is a constitutionally guaranteed revenue to cities and counties and had been a critical general purpose revenue and the shift is under legal challenge by the League of California Cities. These law enforcement grants had previously been funded from the state general fund.

Historic details of COPS/SLESA allocations by agency are available at http://www.californiacityfinance.com/#SUBVENTIONS.

Frontline Law Enforcement
Front line law enforcement funds are allocated to cities, counties and five police protection districts1 on a population basis. County allocations under this program are for services to unincorporated areas and county allocations are based on unincorporated area population. In FY2000-01 the law was amended to provide a minimum frontline law enforcement allocation of $100,000 to any local agency receiving funding under the program.

Local Use and Procedural Requirements
Funds from the COPS program must be used exclusively to fund frontline municipal police services, “in accordance with written requests submitted by the chief of police … or the chief administrator of the law enforcement agency that provides police services for (the) city.” iii For counties, the board of supervisors must appropriate the funds in response to written requests submitted by the county sheriff and the district attorney.iv The requests must identify the needs to be addressed and must specify the personnel, equipment, and programs that are necessary to meet those needs.

These moneys must supplement existing services, and may not be used to supplant any existing funding for law enforcement services.v Administrative overhead costs charged to SLESA funding may not exceed 0.5 percent of the total allocation.vi SLESA funds must be expended or encumbered no later than June 30 of the fiscal year following receipt or be forfeited to the County Enhancing Law Enforcement Activities Subaccount for reallocation to other law enforcement grants pursuant to law.vii SB1023 (2012) removed various reporting and public hearing requirements for cities and counties expending SLESA moneys and removed the requirement for each county to have a Supplemental Law Enforcement Oversight Committee (SLEOC) to determine whether the recipient entities have expended moneys received from the SLESA appropriately.

2025-26 Annual Recognized Obligation Payment Schedule
Pursuant to Health and Safety Code (HSC) section 34177 (o) (1), the City of Guadalupe Successor Agency (Agency) submitted an annual Recognized Obligation Payment Schedule for the period July 1, 2025 through June 30, 2026 (ROPS 25-26) to the California Department of Finance (Finance) on February 1, 2025. Finance has completed its review of the ROPS 25-26.

Based on a sample of line items reviewed and application of the law, Finance made the following determinations:
• Item No. 2 – Property Investment in the requested amount of $31,847 is not allowed. It is our understanding this item is fully satisfied and no amounts remain outstanding. However, the Agency is requesting $31,847 in Other Funds to retroactively authorize payments made despite the Agency not requesting funds, or funding being denied on the ROPS. Pursuant to HSC section 34177 (l) (3), the ROPS shall be forward-looking. As a result, Finance does not retroactively authorize funding for items already paid. Therefore, Other Funds in the amount of $31,847 are not approved.
• Item No. 34 – Al's Union Site Remediation Project in the total outstanding amount of $48,763 is not allowed. The Agency was unable to provide documentation to support the requested amount of $48,763; therefore, it is not eligible for Redevelopment Property Tax Trust Fund (RPTTF) funding at this time. To the extent the Agency can provide suitable documentation to support the requested amount, the item may be considered on a future ROPS.

Pursuant to HSC section 34186, successor agencies are required to report differences between actual payments and past estimated obligations (prior period adjustments) for the July 1, 2022 through June 30, 2023 (ROPS 22-23) period. The ROPS 22-23 prior period adjustment (PPA) will offset the ROPS 25-26 RPTTF distribution. The amount of RPTTF authorized includes the PPA resulting from the County Auditor-Controller’s review of the PPA form submitted by the Agency.

EXHIBIT I

Page 2 ends

The Agency’s maximum approved RPTTF distribution for the reporting period is $420,628, as summarized in the Approved RPTTF Distribution table (see Attachment).

RPTTF distributions occur biannually, one distribution for the July 1, 2025 through December 31, 2025 period (ROPS A period), and one distribution for the January 1, 2026 through June 30, 2026 period (ROPS B period), based on Finance's approved amounts.

Since this determination is for the entire ROPS 25-26 period, the Agency is authorized to receive up to the maximum approved RPTTF through the combined ROPS A and B period distributions.

Except for the adjusted items, Finance approves the remaining items listed on the ROPS 25-26 at this time. If the Agency disagrees with our determination with respect to any items on the ROPS 25-26, except items which are the subject of litigation disputing our previous or related determinations, the Agency may request a Meet and Confer within five business days from the date of this letter. The Agency must use the RAD App to complete and submit its Meet and Confer request form. The Meet and Confer process and guidelines are available on our website:
http://dof.ca.gov/Programs/Redevelopment/Meet_And_Confer/ Absent a Meet and Confer, this is our final determination regarding the obligations listed on the ROPS 25-26. This determination only applies to items when funding was requested for the 12-month period. If a determination by Finance in a previous ROPS is currently the subject of litigation, the item will continue to reflect the determination until the matter is resolved.

The ROPS 25-26 form submitted by the Agency and this determination letter will be posted on our website:
http://dof.ca.gov/Programs/Redevelopment/ROPS/
This determination is effective for the ROPS 25-26 period only and should not be conclusively relied upon for future ROPS periods. All items listed on a future ROPS are subject to Finance's review and may be adjusted even if not adjusted on this ROPS or a preceding ROPS. The only exception is for items that have received a Final and Conclusive determination from Finance pursuant to HSC section 34177.5 (i). Finance’s review of Final and Conclusive items is limited to confirming the scheduled payments as required by the obligation.

The amount available from the RPTTF is the same as the amount of property tax increment available prior to the enactment of the redevelopment dissolution law.

Therefore, as a practical matter, the ability to fund the items on the ROPS with property tax increment is limited to the amount of funding available to the Agency in the RPTTF.
