Jeff van den Eikhof, City Engineer Todd Bodem, City Administrator SUBJECT: 303 Obispo Site Improvements Contract Amendment- Ashley and Vance Engineering, Inc.
RECOMMENDATION:
It is recommended that the City Council adopt Resolution No. 2025-68 to approve a contract amendment with Asley and Vance Engineering, Inc. for Engineering Services during Construction (ESDC)
DISCUSSION:
In January 2023, the City Council approved a contract with Asley and Vance Engineering, Inc. for the development of plans, specifications, and an engineer’s estimate for the development of an EV and Bus Charging Station at the City’s corporation yard at 303 Obispo St. The design portion of their contract is complete.
On October 14, 2025, the City Council approved a Contractor Services Agreement with Quincon, Inc. for the construction of the 303 Obispo Site Improvements- EV/ Bus Charging Facility Project, and a service agreement with Cannon Corporation to provide construction management and project inspection.
For most construction related issues, the City Engineer and Cannon Corporation will be able to make final decisions. However, it is critical that the design firm be involved during construction to answer technical questions related to their plans and specifications, especially those related to electrical components.
Typically, Engineering Services during Construction (ESDC) are included in the design contract to allow the design firm to answer technical questions regarding their plans and specifications, and to prepare record (as-built) drawings upon completion. Unfortunately, these services were not included in the original contract with Ashley and Vance Engineering, Inc. Staff recommends approving a contract amendment with Ashley and Vance to provide ESDC. The approximate fee for these services is $16,140 (Attachment 2).
Jeff van den Eikhof
FISCAL IMPACT:
The cost of CA services will be covered by the project's approved funding, included in the FY 25/26 Budget for Capital Improvement Projects. There is no impact on the general fund.

WHEREAS, Engineering Services during Construction (ESDC) are vital for the successful completion of the construction project; and
WHEREAS, City staff have recommended that Ashley and Vance Engineering, Inc. provide these services; and
WHEREAS, City staff have determined that adequate funds are available to complete the work.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Guadalupe, as follows:

REPORT TO THE CITY COUNCIL OF THE CITY OF GUADALUPE
Agenda of November 25, 2025
________________________________ __________________________________ Prepared by: Approved by:
Jeff van den Eikhof, City Engineer Todd Bodem, City Administrator SUBJECT: Pioneer Lift Station Rehabilitation Project
RECOMMENDATION:
It is recommended that the City Council adopt Resolution No. 2025-69, approving an amendment to the Consultant Services Agreement with Michael K. Nunley and Associates (MKN) to provide engineering support services during construction.
BACKGROUND:
In October 2014, the City Council adopted the Wastewater Collection System & Treatment Plant Master Plan 2014. In that document, under Lift Stations, it states, “It is recommended to replace the Pioneer Lift Station. The Pioneer Lift Station is past its useful life, is a confined space safety hazard, the pumps are oversized for existing ADF & PHFs conditions, and the force main is not located within City easement or right-of-way. It is recommended the City design a new lift station to meet existing and future flow conditions as identified in this Master Plan. It is also recommended to reroute the existing force main along Eighth Street to Highway 1 so that the force main is accessible in the City’s right-of-way.” In 2016, the City entered an agreement with Michael K. Nunley and Associates (MKN) to design the Guadalupe Lift Stations and Trunk Main Project, which included the Pioneer Lift Station, Highway 1 Lift, and the Sewer Trunk Main. The single project was split into three separate projects due to funding issues.
The Sewer Trunk Main Project is completed, and the Highway 1 Lift Station Project is under construction.
The Pioneer Lift Station is the last critical component of the original project.
On January 28, 2025, the City Council entered into an agreement with W.M. Lyles Co. to construct the Pioneer Lift Station Project and reallocated $600,000 from the Wastewater Treatment Plant Project to the Pioneer Lift Station Project to cover the construction, project management, inspection, and contingencies.
Jeff van den Eikhof
DISCUSSION:
On July 23, 2024, the City Council approved a contract amendment with MKN for the Pioneer Lift Station Design. Due to project delays and complexity, MKN has nearly expended the previously approved amount. Staff recommends approving a contract amendment to add $20,000 to MKN’s agreement to cover engineering services during construction. These services include reviewing submittals, responding to questions during construction, and providing other engineering services as needed on a time-andmaterial basis.
FISCAL IMPACT:
The cost of engineering services during construction will be covered by the IRWM grant and previously approved project funding.

WHEREAS, the City entered into an agreement with Michael K. Nunley and Associates (MKN) in January 2015 for a total not to exceed $35,782.00 to design the Pioneer Lift Station Project; and WHEREAS, the City approved a contract amended for $9,000 on July 23, 2024, due to the project having been delayed and redesigned several times during the course of the project; and WHEREAS, the consultant has developed a not-to-exceed amount of $20,000.00 to provide engineering services during construction, for a total revised contract total of $64,782.00; and WHEREAS, City staff have determined that adequate funds are available to complete the work.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Guadalupe, as follows:
SECTION 1: Amendment 2 to the agreement with Michael K. Nunley and Associates is hereby approved.
SECTION 2: The Mayor is authorized to sign the amendment with Michael K. Nunley and Associates on behalf of the City.

Re: Pioneer Lift Station Replacement Project Engineering Services During Construction - Scope Amendment #2
Dear Dayanira,
MKN and Associates, Inc., (MKN) is currently providing Engineering Services During Construction (ESDC) for the Pioneer Lift Station Replacement Project. Services include office engineering tasks such as submittal reviews, requests for information (RFI) responses, field observation as needed, lift station startup support, and record drawings.
The contract budget was prepared in November 2022 and was based on various assumptions, including number of hours for submittal reviews, the number of RFI responses, and an estimated construction duration. Per the contract, invoicing and payment is based on time and materials expended. As of our last invoice (September 2025), MKN had less than approximately $3,900 remaining in the project budget. Work performed this last month has fully exhausted our contracted budget amount. Additional budget authorization is required to continue to provide services through the end of the project construction.
MKN and IRJ (Electrical Design Consultant) have expended a greater number of hours reviewing submittals than originally estimated. This has been due to several submittals requiring re-submittal and review and the additional review and conversations regarding the lift station MCC and control panel. MKN and IRJ have been required to spend additional hours reviewing proposed revisions to the lift station electrical and controls arrangement at the request of the Contractor. MKN and IRJ anticipate the need for additional submittal review and re-reviews as not all required project submittals have been received from the contractor.
ATTACHMENT 2
Dayanira Cruz | 2
It is also requested that budgets for scope items not yet provided or completed be replenished with this scope amendment. These tasks include:
• Responses to RFIs
• Responses to Requests for Change Orders
• Engineer’s Observation of Work In Progress
• Lift Station Startup Support
• Record Drawings
Estimated budget to provide these services is based on the original anticipated number of hours.
Budget
The current authorized budget for the project is $44,782. This scope amendment (SA#2) includes additional budget required to continue to provide ESDC. Budgets for this scope amendment have been updated to MKN’s 2025 rates (see attached 2025 Rate Sheet). The total requested amount for this scope amendment is $20,000. The revised total contract amount will be $64,782. Work will be invoiced on a time and materials basis.

REPORT TO THE CITY COUNCIL OF THE CITY OF GUADALUPE
Agenda of November 25, 2025
_______________________________ _________________________________ Prepared by: Approved by:
Philip F. Sinco, City Attorney Todd Bodem, City Administrator SUBJECT: Approval of need for continuing emergency regarding Supervisory Control and Data Acquisition (SCADA) system.
RECOMMENDATION:
That the City Council review the need to continue the emergency related to the partial failure of the City of Guadalupe’s Supervisory Control and Data Acquisition (SCADA) system approved by the City Council when it adopted Resolution No. 2025-53, and by motion and at least a 4/5 vote, approve the continuation of the existence of a public facilities emergency pursuant to Guadalupe Municipal Code section 4.04.030.F. and California Public Contracts Code section 22035.
BACKGROUND:
The City Council adopted Resolution No. 2025-53 at its meeting held on September 23, 2025. This resolution found that the partial failure of the City’s SCADA system constituted an emergency pursuant to City of Guadalupe Municipal Code Section 4.05.030.F. and California Public Contract Code Section 22035, which sections allow the City to proceed at once to replace or repair any public facility without adopting plans, specifications, strain sheets or working details, or giving notice for bids to let contracts, and pursuant to California Public Contract Code Section 22050(a)(2), that the emergency did not permit a delay resulting from a competitive solicitation for bids, and that the action is necessary to respond to the emergency.
The City Council has subsequently approved the need for the continuance of the emergency at each of its meetings since it adopted Resolution No. 2025-53.
DISCUSSION:
Pursuant to California Public Contracts Code section 22050(c)(3), the City Council is required to review the emergency action at its next regularly scheduled meeting after finding that an emergency exists, and also, at every regularly scheduled meeting thereafter until the action is terminated, to determine, by a four-fifths vote, that there is a need to continue the action.
Staff believes that the emergency still exists since the SCADA system could experience a complete failure at any time. While the agreement between the City and Nviro, the contractor selected by staff to perform the necessary work on the SCADA system, has been entered into and the work has commenced, Philip F. Sinco
there is still a continuing emergency situation, and therefore, staff recommends that the Council approve the continuation of the existence of a public facilities emergency pursuant to Guadalupe Municipal Code section 4.04.030.F. and California Public Contracts Code section 22035 by a 4/5ths vote.
FISCAL IMPACT:
There is no additional costs related to the requested action to continue the need for the emergency proclamation.
The total cost of the SCADA project is estimated at $209,779. Funding is available through existing Enterprise Fund reserves, and potential CIP fall out funds. This project will not impact the City’s General Fund.
Long-term savings from reduced labor, compliance efficiencies, and extended equipment life are expected to offset the investment over time.

Ian Livingston, CASp, CBO, Contract Building Official Todd Bodem, City Administrator SUBJECT: Ordinance No. 2025-524, repealing Guadalupe Municipal Code Ordinance No. 2022- 504, Title 15.04, Adoption of Building Codes; and adopting a new Chapter 4 of Title 15, Adoption of State of California 2025 Building Standards Code.
RECOMMENDATION:
That the City Council introduce Ordinance No. 2025-524, and continue to the meeting of December 9, 2025, for second reading and adoption, to update and amend Title 15, Chapter 4 of the Municipal Code to be consistent with the State of California 2025 Building Standards Code of which become effective January 1, 2026.
DISCUSSION:
Each city in the State of California is required to adopt the current California Building Standards Code and is authorized to do so by reference (Health and Safety Code § 17922 and Government Code § 50022.2). The Municipal Code of the City of Guadalupe Title 15, Chapter 4 has not been comprehensively updated since November 22, 2022, with the adoption of the 2022 California Building Codes of which will expire January 1, 2026. The City of Guadalupe Municipal Code, Title 15, Chapter 4, has provided minimum standards to safeguard life or limb, health, property, and public welfare by regulating the construction, quality of materials, use, and occupancy, location and maintenance of all buildings and structures within its jurisdiction. The 2025 California Building Standards Code incorporates the latest national standards in the International Building Code, International Residential Building Code, National Electrical Code, Uniform Plumbing Code, Uniform Mechanical Code and other national standards and codes. The State of California has also adopted the International Wildland-Urban Interface code, creating the California Wildland-Urban Interface code, Volume 7 of the Building Standards Codes.
There are currently no local amendments to the City of Guadalupe Municipal Code Title 15.04 from previous code adoptions and thus none are carried forward. Any new amendments are considered administrative in nature and therefore would not require justification using local climatic, geological, or topographical conditions.

1 Agenda Item No. 14
REPORT TO THE CITY COUNCIL OF THE CITY OF GUADALUPE
Agenda of November 25, 2025
_________________________________ ____________________________________ Prepared by: Approved by:
Philip F. Sinco, City Attorney Todd Bodem, City Administrator SUBJECT: Memorandum of Understanding for Operation of a Farmers Market at Le Roy Park RECOMMENDATION:
It is recommended that City Council approve a memorandum of understanding between the City and the Guadalupe Business Association regarding the operation of a Farmers Market at Le Roy Park.
BACKGROUND:
At a Council meeting held on November 8, 2022, the Council was informed about various groups within Guadalupe that had been working to find a way to establish a farmers market in Guadalupe. 1 One of
these groups was an organization referred to as FRESA (Food Resiliency, Equity, Sustainability, & Action) which had spent a couple of years researching and documenting the feasibility of a farmers market. Out of this effort, a working group arose that was separate from FRESA, but which intended to work together with FRESA on the Guadalupe farmers market. The working group was referred to as the Cosecha Guadalupe Farmers Market.
The plan proposed at the November 8, 2022, Council meeting was to operate the farmers market every Friday from 2:00 PM until 6:00 PM at the Veterans’ Memorial Plaza. The group requested support from the City in a few ways. First, they requested the use of the Veterans’ Memorial Plaza free of charge.
Second, they requested that the City allow the market access to electricity and water free of charge.
Finally, they requested that they be allowed to keep a porta potty on site year-round as they are rented by the month, and if possible, that the City pay for the cost of the porta potty rental.
Due to concerns on the part of City staff, City staff recommended Le Roy Park as the location for the farmers market rather than the Veterans’ Memorial Plaza.
The City Council ultimately approved the use of the Veterans’ Memorial Plaza for the farmers market, but directed staff to work with the Cosecha Guadalupe Farmers Market working group on the other issues which were not decided by the City Council (e.g., waiver of fees, free use of electricity/water, etc.). 1 A previous staff report from the Council meeting of July 8, 2025, erroneously stated that the date of this meeting was October 25, 2022.
Philip F. Sinco
2 In 2025, the Cosecha Guadalupe Farmers Market became affiliated with the nonprofit Guadalupe Business Association. Under this arrangement, the farmers market would be operated by a market manager who would be subject to the oversight of the Cosecha Guadalupe Farmers Market Committee of the Guadalupe Business Association.
In June 2025, the Cosecha Guadalupe Farmers Market Committee informed the City that, after completing its “due diligence,” it had determined that LeRoy Park was the best location for the farmers’ market, to be held on Sundays between 10 AM and 2 PM.
City staff brought a new proposal from the Cosecha Guadalupe Farmers Market Committee to the City Council at its meeting on July 8, 2025. This proposal included a request that the City’s rental fees for Le Roy Park be waived for 12 months to ensure financial viability during its startup phase, and that it be allowed to use a small portion of the Veterans Memorial Plaza for 6 months for a “pop-up” and signage (also, without charge) to help bring awareness about the farmers market at Le Roy Park. The proposal did not include a request for free use of electricity or water, and also, provided that all trash from each farmers market event would be taken away and deposited in other approved locations.
The City Council generally approved this proposal; however, it agreed to waive rental fees for only 6 months and directed staff to negotiate a memorandum of understanding (MOU) between the City and the GBA setting forth each parties responsibilities.
DISCUSSION:
City staff and the GBA have successfully negotiated the terms of an MOU for the Cosecha Guadalupe Farmers Market. (See Attachment 1). The main provisions of the MOU are:
• Term: A six (6) month term that may be extended for an additional six (6) month term upon written agreement of the parties.
• City’s Responsibilities:
o Allow GBA/Cosecha to operate its farmers market events on Sundays from 9 AM to 3 PM, which includes one hour before and one hour after the operational hours of 10 AM to 2 PM for setting up and closing down without charge (the City agrees to waive its normal fee of $520 flat rate (nonprofit rate) for rental of the full park).
o The City shall also allow GBA/Cosecha to use a portion of the Downtown Parking Lot adjacent to Guadalupe Street to set up a small “pop-up booth” and signage from 10 AM to 2 PM on those Sundays the Cosecha farmers market events are held without charging any fees. • GBA/Cosecha’s Responsibilities:
o GBA/Cosecha will ensure that all of its farmers market events will fully comply with all applicable laws and its rules for vendors.
3 o GBA/Cosecha will not use any City electrical power or water at either Le Roy Park or the Downtown Parking Lot in connection with the farmers market events. o GBA/Cosecha will ensure that all trash, junk, and debris related to any of the farmers markets events held pursuant to this MOU will be removed from both Le Roy Park and the Downtown Parking Lot and deposited in appropriate receptacles off-site. o GBA will maintain adequate insurance with levels of coverage to cover its obligations and responsibilities under the MOU.
o GBA agrees to indemnify, defend, and hold harmless the City and its officers, agents, and employees from and against any claims, damages, liabilities, and expenses arising out of the negligence or misconduct of GBA/Cosecha in connection with any of its farmers market events. • City and GBA/Cosecha Partnership Acknowledgment and Co-Branding Agreement:
The City of Guadalupe will acknowledge and recognize GBA/Cosecha as a key community partner in the provision of the GBA/Cosecha Farmers Market at LeRoy Park. This partnership will be reflected through co-marketing, joint branding, and the acknowledgment and promotion of GBA/Cosecha programs and services by the City.
Recognition will be implemented through the following materials and platforms:
a. Website: GBA/Cosecha shall be acknowledged as a partner on the City of Guadalupe’s website, including but not limited to service listings, resource pages, and other relevant informational sections.
b. Printed Materials: All printed materials distributed to residents and the broader community that reference services provided by GBA/Cosecha shall include City of Guadalupe co-branding and partnership acknowledgment.
c. Public Communications: Press releases, newsletters, and other public communications related to the GBA/Cosecha Farmers Market at LeRoy Park shall recognize the City of Guadalupe’s partnership role.
d. Co-Branding Standards: i. The GBA/Cosecha logo and organization name shall be displayed in accordance with both the City of Guadalupe’s and GBA/Cosecha’s brand guidelines. ii. Partnership acknowledgment language shall be mutually agreed upon by both parties. iii. The City of Guadalupe shall provide GBA/Cosecha with appropriate logo files and draft brand guidelines within thirty (30) days of this Agreement’s execution. e. Reciprocal Obligations: The City of Guadalupe agrees to adhere to reciprocal co-branding requirements as outlined above, including the submission of all resident-facing materials to the GBA/Cosecha Program Manager for review and approval prior to distribution. f. Notwithstanding the foregoing, the City of Guadalupe is not obligated or required to prepare and/or distribute any “printed materials” or “public communications” as described above. 4 FISCAL IMPACT:
The City’s support through the waiver of facility fees for Le Roy Park would result in foregoing revenue however, the market is expected to yield significant public benefit. In addition, the BBQ section of the park will still be available for rent during the event days that might offset some of this lost revenue. No direct cost to the City’s General Fund is anticipated beyond waived fees because City staff is not providing any direct or financial assistance to the market.
The full park rental for Le Roy Park at the nonprofit rate is $520 per day (although the farmers market would not necessarily be renting the full park, for example, the BBQ area would still be available). Six (6) months at this rate would equal $13,520in fees that would be waived ($520 per day x 26 weeks (six months) = $13,520.

Executive Summary
Cosecha Guadalupe Farmers’ Market was established in 2025 under the umbrella of the nonprofit Guadalupe Business Association to provide community residents and local businesses with a central location to purchase fresh fruits and vegetables, cottage foods, arts/crafts, and attend associated events in Guadalupe, Ca. Core to the market is to accept EBT or other Market Match programs.
The market will be held weekly and governed by the Market Manager and the GBA farmers’ market committee.
Description
The Cosecha Guadalupe Farmers’ Market grew out of an identified need in northern Santa Barbara county for fresh fruits and vegetables. The Guadalupe community is heavily agricultural yet high poverty. Thus, we are home to many CalFresh participants, however, local farmers’ markets in Santa Maria do not currently accept EBT or other Market Match programs. Nonprofits such as FRESA, Family Service Agency, Little House by the Park, Community Environmental Council, the Guadalupe Business Association, the city of Guadalupe, and Route1 Farmers’ Market worked together to advocate for a Guadalupe farmers’ market prior to 2024. Consequently, this market was established in 2025 under the umbrella of the nonprofit Guadalupe Business Association to provide community residents and local businesses with a central weekly location to purchase fresh fruits and vegetables, cottage foods, arts/crafts, and attend associated events in downtown Guadalupe. Core to the market is the eventual acceptance of EBT and Market Match.
The market will be held weekly and governed by the Market Manager and the GBA farmers’ market committee.
