REGULAR BUSINESS
12. Root One request for public benefit fee reduction and its support for a cannabis tax ordinance.
Written report: Philip F. Sinco, City Attorney
Recommendation: That the City Council consider the information provided by staff during its presentation of this report, and also, from representative(s) of SLOCAL Roots Management LLC dba Root One (“Root One”) and any interested members of the public before deliberating on Root One’s request for a temporary reduction in its 6% annual public benefit fee and its support for a cannabis tax ordinance.
Council Member Hernandez stated support on moving forward toward a tax on the ballot noting it is important the city does not lose cannabis-related revenue.
Mayor Julian agreed with the idea of a tax ordinance and expressed the importance of retaining the local business.
Council Member Costa Jr. indicated his agreement to pursue the tax ordinance and agreement with the Mayor.
Attorney Philip Sinco made remarks on the staff recommendations for non-support due to the 6% rate being a factor in the city’s selection of the entity and current budget deficit. Root One’s records indicate a 40% gross profit margin is below the 60% statewide average. Neighboring jurisdictions maintain a 6% fee. Staff remain neutral regarding a transition to a formal cannabis tax but are prepared to assist with the necessary steps for a ballot measure if directed by the council.
Public Comment
Austen Connella. Mr. Connella spoke on behalf of Root One regarding a temporary reduction for the public benefit fee.
Motion was made by Council Member Furness and seconded by Council Member Costa Jr. to temporarily reduce the public benefit fee for Root One from 6% to 4% for a period of one year, with the provision that the reduction would end early if a formal cannabis tax ordinance were passed by the voters before that year concludes. Motion passed. 5-0.

13. Approval of Employment Agreement with David Trujillo as City Administrator.
Written report: Sylvia Estrada, Human Resources Manager Recommendation: That the City Council adopt Resolution No. 2026-16 approving the Employment Agreement with David Trujillo as City Administrator and authorize the Mayor to sign on behalf of the City.
Council Member Villegas expressed concern regarding the administrate leave accrual language within the employment contract for Mr. Trujillo. She noted there were 80 hours of leave upfront and the accrual rate of 20 hours per month did not mathematically align with the intended annual total. And suggested this maybe a clerical error carried over from the previous contract and requested clarification the document was accurate before approval. Acknowledgement was made by city staff for the error, and it was confirmed it would be corrected.
Motion was made by Council Member Hernandez and seconded by Council Member Furness to adopt Resolution No. 2026-16 approving the Employment Agreement with David Trujillo as City Administrator.
Motion passed. 5-0.

Agenda Item No. 7D
REPORT TO THE GUADALUPE CITY COUNCIL
Agenda of April 28, 2026
__________________________________ _______________________________________ Prepared by: Approved by:
Philip F. Sinco, City Attorney David Trujillo, City Administrator SUBJECT: Amendment No. 6 to the agreement for services between the City of Guadalupe and Andrew Goodwin Designs (AGD) to retroactively approve preparation of 90% construction design cost estimate and to revision design plans for reconstruction of the front wall design due to water and fire damage, and also, to extend the term of the agreement to June 30, 2027.
RECOMMENDATION:
It is recommended that the City Council adopt Resolution No. 2026-17 approving Amendment No. 6 to the agreement with AGD to retroactively approve preparation of 90% construction design cost estimate and to revision design plans for reconstruction of the front wall design due to water and fire damage, and also, to extend the term of the agreement to June 30, 2027.
BACKGROUND:
AGD was hired to complete the design work for the redevelopment of the Royal Theater and the two adjoining lots (now merged into one lot). Five (5) previous amendments to the original agreement have been approved by the City Council. The detailed history of these previous amendments has been reported to the City Council several times in previous staff reports, most recently at the Council meeting on October 4, 2024. If any member of the Council or the public wishes to review this information, it can be found on the City’s website.
The most recent amendment (Amendment No. 5) was approved at the City Council’s meeting on January 28, 2025. This amendment was necessary because it was discovered during the ADA and sidewalk improvement project on Guadalupe Street by Caltrans that approximately four feet of the existing sidewalk adjacent to the Royal Theater was outside the Caltrans right-of-way. The City granted an easement to Caltrans so its project could proceed. The redesign was for the purpose of accounting for the new Caltrans easements and to match the proposed sidewalk in front of the Royal Theater.
This current amendment (Amendment No. 6) is needed to retroactively approve preparation of 90% construction design cost estimate and to revision design plans for reconstruction of the front wall design due to water and fire damage.
Philip F. Sinco
DISCUSSION:
AGD prepared an “add service” agreement dated January 31, 2025, to provide a 90% level construction drawings estimate for presentation to City Council, in the total amount of $16,100. (Attachment 1). This “add service” request was necessary because the City had asked AGD to hire the construction estimator to complete a cost estimate for the one-story revised project. As the Council will remember, the original project involved a three-story building, but the project was revised to the current one-story building in late 2024 to reduce project costs after a proposed bond measure was not placed on the ballot for the election that year. This new estimate was intended to provide the City Council with a 90% estimate, which in construction terms refers to a pre-final estimate indicating that the project design is roughly 90% complete, requiring only finishing touches. This is a critical milestone where the project scope is largely locked in, and the cost estimate is expected to be highly accurate. By requesting that this be accomplished through AGD, an otherwise longer procurement process (where the City would hire the estimator) was not necessary. The cost to pay the estimator that was hired (Precision) was $14,900, with an additional 10% charged by AGD for administration costs to manage the estimator.
City staff is not sure what happened, but this “add service” request was “lost” and only recently came to the attention of Project Manager Tom Brandeberry. Based on what staff has been able to ascertain recently, it seems that it went to former City Administrator Todd Bodem for approval, and neither staff nor AGD kept track of it thereafter. Staff believes it was mistakenly sent to Mr. Bodem for approval, with the assumption he would get it approved. Typically, the procedure for “add service” requests was to send them to the Project Manager (Tom Brandeberry) to complete a staff report for Council’s approval. Mr. Bodem did not prepare a staff report or ask Mr. Brandeberry to do so, and staff believes that the fact the normal process was not followed contributed to it getting “lost.” Staff regrets this and will ensure that this does not happen again.
The other “add service” request submitted by AGD more recently (on or about February 28, 2026) is related to the need to revise the construction drawings to for the front wall of the Royal Theater due to water and fire damage. (Attachment 2). This request is to essentially to authorize AGD to revise the construction plans for reconstruction of the front wall design due to water and fire damage (including the fact that the marquee and original façade are not salvageable as had been previously assumed).
The estimated cost to revise the construction drawings is $18,600. Note: The inclusion on the add service request of the amount of $60,000 as the “Opinion of Probable Additional Construction Cost” is confusing, but unrelated to the amount of additional funds AGD is requesting to revise the construction drawings, which as previously stated, is $18,600.
Pursuant to Amendment No. 5 to the agreement between the City and AGD which was approved by the City Council on January 28, 2025, the term of the agreement was extended to June 30, 2025. In light of the need for the additional services, as well as AGD’s ongoing responsibilities for construction administration under the Agreement, it is necessary to extend the term of the agreement, and staff is recommending that the term of the agreement be extended through June 30, 2027.
FISCAL IMPACT:
The additional cost for Amendment No. 6 to the AGD agreement will be approximately $34,700.

Recruitment for the temporary Maintenance Worker I position is currently underway. Applications are being reviewed and screened to identify candidates who meet the minimum qualifications and operational needs of the department.
WORKERS’ COMPENSATION
During this reporting period:
• Three (3) workplace injuries were reported in March. As modified duty assignments were not available at the time, all cases resulted in employees being placed on temporary disability.
• One (1) long-term workers’ compensation claim remains active and continues to be managed in coordination with the City’s third-party administrator. • One (1) employee who was previously on modified duty remains on temporary disability due to updated medical restrictions. The claim remains under active management.
Human Resources continues to work closely with the City’s third-party administrator and departments to monitor all open claims, facilitate appropriate medical care, and support timely and safe return-to-work efforts where feasible. Efforts also remain focused on identifying opportunities for modified duty assignments when operationally possible.

TRAINING & DEVELOPMENT
The next employee training session, CPR/First Aid, Fire Extinguisher, and Safety Training, is scheduled to take place in April. This training supports workplace safety initiatives and ensures employees are equipped with essential emergency response skills.
Recent changes to California law, including SB 827, have expanded ethics training requirements for local government agencies to include certain management and supervisory employees. In response, the City will be implementing a structured training program to ensure compliance with these requirements. This will include both ethics training and financial responsibility training, to be completed within the required timelines. Human Resources will coordinate the training, track completion, and ensure all compliance and record-keeping obligations are met.
MISCELLANEOUS UPDATES
• Job Description Review Project
We will begin a comprehensive review of job descriptions. This effort is intended to ensure alignment with current duties and organizational needs, and support improved recruitment and retention. Updated descriptions will also be incorporated into the City’s website for enhanced accessibility.
• Personnel Policy Manual Update
The updated Personnel Policy Manual has been distributed to all bargaining units for review. Given the scope and significance of the revisions, Human Resources anticipates follow-up discussions, questions, and potential in-person meetings with bargaining unit representatives to ensure clarity and alignment prior to final adoption.

REPORT TO THE CITY COUNCIL OF THE CITY OF GUADALUPE
Agenda of April 28, 2026
__________________________________
Prepared by:
David Trujillo, City Administrator
SUBJECT: Change in Primary Representative Member to the Central Coast Water Authority (CCWA) Board
RECOMMENDATION:
It is recommended that the Mayor nominate, and the City Council ratify the Mayor’s nomination of a primary representative to the Central Coast Water Authority (CCWA) Board to fill the vacancy until the new election cycle.
BACKGROUND:
Historically, after each election cycle, the City Council makes appointments to the various regional and local boards and committees throughout the County that have Council and or City Staff representation. Options generally include filling vacancies, making appointments, and/or selecting new assignments. Once the appointments are approved by the City Council, the Council’s past practice has been to determine board and committee assignments (primary representatives and alternates), again, through a process nominated by the Mayor, discussion by the City Council, and finally ratification.
DISCUSSION:
At the August 13, 2024, City Council meeting, Todd Bodem was appointed to represent the CCWA Board, with Council Member Whitney Furness as the alternate.
Since that time, Todd Bodem left the City of Guadalupe and there have been no reappointments; therefore, it is recommended that the Mayor nominate, and the City Council ratify the nomination of a primary representative to the CCWA Board to fill the vacancy until the new election cycle.
FISCAL IMPACT:
There are no fiscal impacts to the City of Guadalupe.
CENTRAL COAST WATER AUTHORITY
The Central Coast Water Authority (CCWA) is a public entity organized under a joint exercise of powers agreement dated August 1, 1991, by the cities and special districts responsible for the creation and maintenance of water resources in portions of the North County, Santa Ynez Valley, and the South Coast areas of Santa Barbara County.
CCWA is presently composed of eight members, all of which are public agencies. Each member agency is represented on the CCWA Board of Directors by one individual and an alternate. In addition, CCWA has one associate member, the La Cumbre Mutual Water Company and two nonmember, private water users, Raytheon, Inc., and Morehart Land Company. Water service is also provided to Golden State Water Company and Vandenberg Air Force Base.
For more information please visit: www.ccwa.com
CCWA BOARD MEETINGS:
The board of directors meets on the fourth Thursday of each month at 9:00 a.m., except in November and December when the Board meets on the third Thursday of those months at 9:00 a.m.. The board may also schedule special meetings at other times when needed, and will post notice according to the Brown Act.

REPORT TO THE CITY COUNCIL OF THE CITY OF GUADALUPE
Agenda of April 28, 2026
_____________________________________ _________________________________ Prepared by: Approved by:
Sylvia Estrada, HR Manager David Trujillo, City Administrator SUBJECT: Adoption of New SEIU Classification – Maintenance Supervisor – Public Works (Range 205A) RECOMMENDATION:
That the City Council adopt the attached Resolution No. 2026-18 establishing the SEIU‑represented classification of Maintenance Supervisor – Public Works, assigning the classification to SEIU Range 205A, and authorizing inclusion of the classification in the City’s Classification and Salary Plans.
BACKGROUND
The Public Works Department currently utilizes the classifications Lead Maintenance – Facilities/Parks and Maintenance Worker I/II to perform a wide range of streets, facilities, and parks maintenance duties. As the City’s infrastructure and service demands have grown, there is an operational need for a designated first-line supervisory position to provide consistent supervision, work planning, and performance management over multiple maintenance crews.
In addition, the City was recently awarded a grant that funds two additional maintenance positions in the Public Works Department. The addition of these grant-funded positions will increase the number of maintenance staff and the volume of work to be coordinated. Without a dedicated supervisory position, the expanded workforce would continue to rely on informal supervisory arrangements, which can create gaps in accountability, consistency, safety oversight, and documentation.
Establishing a Maintenance Supervisor classification will formalize supervisory responsibilities, ensure appropriate span of control for the increased staffing, and align the City’s structure with comparable agencies.
DISCUSSION:
The proposed Maintenance Supervisor – Public Works classification is a first‑line supervisory position responsible for planning, organizing, assigning, and supervising staff engaged in the maintenance, repair, and cleaning of City streets, sidewalks, storm drains, buildings, parks, park buildings, playgrounds, restrooms, and related facilities and infrastructure. The position will directly supervise the Lead Maintenance position and Maintenance Worker I/II classifications and will report to the Public Works Director or designee.
Sylvia Estrada
The grant-funded maintenance positions are time-limited; however, staff anticipates an ongoing need for appropriate supervision of maintenance operations and recommends establishing this classification as part of the City’s regular classification plan.
Key responsibilities include:
Work planning, scheduling, and coordination of streets, facilities, and parks maintenance activities; Direct supervision of public works maintenance staff, including training, performance evaluation, and discipline;
Oversight of contracts for routine facility and park maintenance and minor upgrades; and Ensuring adherence to City and OSHA safety requirements, including job‑site safety and proper use of tools, equipment, and vehicles.
Salary Range
The City proposes to assign the classification to SEIU Range 205A, which is an existing salary range currently used for a comparable supervisory role. Using an existing range maintains internal equity within the SEIU bargaining unit and does not require modification of the SEIU salary schedule beyond adding the new classification title at that range.
Range A B C D E L1 L2
205A 41.062 43.115 45.271 47.534 49.911 52.407 55.027
Meet and Confer with SEIU
The Maintenance Supervisor – Public Works classification will be placed in the SEIU bargaining unit.
Consistent with the City’s obligation to meet and confer, Human Resources provided SEIU with notice of the proposed classification, including the draft job description and proposed salary range, and offered to meet and confer.
SEIU representatives were satisfied with the City’s offer to meet and confer and support the City’s recommendation to adopt the classification as presented.
Upon Council approval, the classification will be added to the City’s Classification Plan and SEIU salary schedule, and the position may be included in the City’s budget and recruitment processes.
FISCAL IMPACT
The fiscal impact of adding the Maintenance Supervisor – Public Works classification at SEIU Range 205A:
If Council subsequently authorizes one full-time employee in this classification, the estimated annual cost, including salary and benefits, will be approximately $129,303.
No changes to the overall SEIU salary schedule are proposed beyond adding this classification title at the existing Range 205A.
