10. FINANCE DIRECTOR: (Information Only)
A. Preliminary FY 2025-26 fourth quarter and year-end financial report as of June 30, 2026, with a cash position update through August 28,
Finance Director Eli Martinez presented preliminary unaudited year-end results:
- Reported $10,900 deficit is incorrect due to accounting issues; adjustments will reduce the general fund deficit to approximately $1.2 million.
- A $1.2 million grant reimbursement was misposted and will be corrected. - Tax revenues: 113% of budget.
- Building and planning revenues: 63% of budget.
- Some enterprise fund transfers were halted pending audit review. - Water funds surplus: $291,000
- Wastewater Fund surplus: $695,000
- FY 2022-23 expected within two weeks.
Public Comment:
Frances Romero commented on the city's budget practices stating that council members questioning the current budget also approved minor budgets during years without audited financial statements. She thanked the Finance Director and City Administrator for their work and emphasized that budget and policy oversight is the council's responsibility. She noted the city continues to have a structural deficit similar in proportion to past years and stated that fiscal oversight must improve. She also expressed concern about criticizing the city while continuing to receive payment.
Mirya Beyer noted that the City Administrator provides a written management report linked to the agenda and stated that a prior request had not been completed. She asked for clarification regarding the reported $1.5 million in reimbursable funds and whether that amount included the approximately $750,000 previously discussed. She stated that clearer and more detailed financial reporting is needed to improve public understanding.
Ms. Beyer encouraged the City Council to communicate the specific actions being taken to address the City’s structural deficit and emphasized the need to increase revenue. She added that canceling projects intended to support downtown tourism would not help increase revenue.
September 8, 2026 City of Guadalupe Council Meeting Minutes Page 5 of 7 Council members asked brief clarifying questions regarding specific revenue and expenditure line items, including encroachment permits, fines and penalties, cannabis revenue classification, and departmental budgeting for FICA and medical insurance. They requested updates on the FY 2022-23 audit clarification on grant reimbursement postings, and information on enterprise fund transfers and the city's cash position.
The finance director provided responses and noted that additional review would be completed where needed.
REGULAR BUSINESS
11. Reduction of Elected Officials Monthly Stipends.
Written report: David Trujillo, City Administrator
Recommendation: That the City Council:
a. Approve a reduction of $300 per month in the stipend paid to each elected City official, resulting in monthly stipends of $200 for each Council Member, the City Treasurer, and the City Clerk, and $450 for the Mayor, effective on the date permitted by applicable law; and b. Direct the City Attorney to prepare the legally appropriate implementing ordinance, resolution, or other action and to confirm the effective date and application of the stipend reductions; and c. Authorize the Finance Department to implement the revised stipend schedule upon the legally effective date.
Staff presented a recommendation to reduce elected official’s monthly stipends by $300, resulting in stipends of $200 per month for council members, the city clerk, and the city treasurer, and $450 per month for the mayor, effective on the date permitted by law. Staff noted the reduction that would save approximately $25,000 annually was intended as a recurring cost-saving measure.
Public Comment:
Robert Diaz stated he supports reducing elected official stipends this year and recommended lowering them as much as possible. He said the savings are small but symbolic and would demonstrate leadership during the city's financial challenges. Mr. Diaz noted he is likely to serve on the next council and believes the reduction is reasonable, adding stipends could be reconsidered once the city's finances improve.
Frances Romero described her experience serving as mayor while working full time, noting she spent 15 to 20 hours weekly on city duties and received a stipend of about $142 per month after a symbolic 5% cut. She Stated stipend levels do not determine the quality of elected officials and that those unwilling to serve for a modest amount may not be the right fit.
Stephanie Krouse the stipe introduction would serve as an important symbolic gesture showing that everyone missed share in the city's financial sacrifices. She encouraged the council to approve the deduction and express confidence that future council members will serve at a commitment to Guadalupe rather than financial incentive.
Council members discussed timing and options reducing stipends, noting changes would not take effect until January under state law. Options considered included reducing stipends to zero, applying a $300 reduction or returning all stipends to $150.00 per month. The mayor's additional statutory duties were briefly referenced.
September 8, 2026 City of Guadalupe Council Meeting Minutes Page 6 of 7 An additional motion was made by Council Member Furness to reduce to zero dollars for each Council Member, the City Treasurer, the City Clerk and the Mayor starting in January.
Motion was made by Council Member Villegas and seconded by Mayor Pro Tempore Hernandez to reduce the monthly stipends to $150.00 dollars for each Council Member, the City Treasurer, the City Clerk, and the Mayor.
Pro Tempore Hernandez: Aye
Council Member Villegas: Aye
Council Member Furness: Nay
Council Member Costa Jr.: Absent
Mayor Julian: Aye
Motion passed. 3-0.
12. Consider Adoption of the New Travel, Expense Reimbursement, and Vehicle Use Policy.
Written report: David Trujillo, City Administrator
Recommendation: That the City Council adopt Resolution No. 2026-46 approving the new Travel, Expense Reimbursement, and Vehicle Use Policy and authorize non-substantive administrative updates necessary to maintain consistency with law, adopted rates, labor and employment agreements, and grant requirements.
Staff presented an update to the city's 2012 travel and vehicle use policy, noting it was outdated and lacked necessary financial controls. The revised policy incorporates current laws, IRS mileage and per diem rates, and requires all travel expenses to have a clear official business purpose and fall within an authorized budget. Staff explained the need for consistent approval procedures and updated reimbursement standards.
Council Member Villegas made a motion and Mayor Pro Tempore Hernandez seconded to adopt Resolution No. 2026-46.
Motion passed. 4-0. Council Member Costa Jr. was absent.

CITY COUNCIL STAFF REPORT
303 Site Improvements – EV/Bus Charging Facility Project Notice of Completion Meeting Date: September 22, 2026
Agenda Item: 7D
To: Honorable Mayor and Members of the City Council
From: Jeff van den Eikhof, City Engineer
Department: City Engineer
Subject: 303 Site Improvements – EV/Bus Charging Facility Project Notice of Completion
RECOMMENDED ACTION
1. Approve the filing of the Notice of Completion for the 303 Site Improvements – EV/Bus Charging Facility Project and authorize the City Clerk to file the Notice of Completion with the County Recorder immediately
2. Thirty days after the recordation of the Notice of Completion, if subcontractors file no liens, pay Quincon, Inc. the 5 percent retention payment of $37,704.50.
EXECUTIVE SUMMARY
On October 14, 2025, the City Council adopted Resolution No. 2025-54 approving an agreement for contractor services with Quincon, Inc. for the 303 Obispo Site Improvements – Charging Facility Project for $688,213.00. Four contract change orders increased the project cost by $65,877.00, bringing the project total to $754,090.00. The change orders authorized additional pavement areas, changed electrical breakers in the switchgear to match the plans and specifications, authorized repairs to the switchgear door, and added parking lot improvements.
Construction commenced on January 20, 2026, and was completed on August 17, 2026.
In accordance with state law, a percentage of the contract amount is withheld by the City until thirty days after filing the Notice of Completion. The City Engineer has determined the retention to be 5% for this project. The retention allows suppliers and subcontractors to file a lien with the City if they have a payment dispute with the prime contractor. It is unlikely that any subcontractors or suppliers will file a lien against the final five percent payment.
Assuming the City Clerk files the Notice of Completion with the County Recorder on or about September 24, 2026, the retention of $37,704.50 can be released (30 calendar days later) on or about October 24, 2026, if no liens are filed with the City by subcontractors.
Key finding: Construction of the 303 Site Improvements – Charging Facility Project was completed on August 17, 2026. Staff recommend approving the filing of the Notice of Completion and releasing the 5% retainage of $37,704.50 30 days after filing.
CITY OF GUADALUPE | CITY COUNCIL
FISCAL IMPACT
Current fiscal year: Release of $37,704.50 retention is included in the overall project cost and remains within the project budget. No additional expenditure is required.
Funding source: The FY 25/26 Budget for Capital Improvement Projects allocated approximately $1.56 million in funding to cover the cost of this project, including the following:
AHSC Grant Funds - $767,410
5339 - $250,000
SB125 - $500,000
Transit Funds - $44,118
Budget action: None required or requested.
Financial constraints: Release of $37,704.50 retainage must occur 30 calendar days after the filing of the Notice of Completion with the County Recorder.

Royal Theater Project Closeout Costs and Projected
Work
Informational update for the City Council
Report date September 17, 2026
Prepared for Mayor and City Council
Prepared by City Manager's Office
Project Royal Theater Revitalization Project, City Project No. 2023-05 Recommendation
Receive and file this update regarding documented project costs, preliminary remaining Schedule of Values balances, and the work currently identified to leave the Royal Theater site safe, structurally stable, weatherprotected, and secure. Direct staff to return to the City Council before authorizing material closeout work that requires a change order or exceeds existing contract authority.
Executive Summary
The design team has concluded that significant structural and weather-protection work remains necessary before the suspended project can be closed out safely. The most urgent work restores seismic stability after removal of the rear east wall and addresses exposed roofing, drainage, open excavations, building openings, and site security.
The cost workbook identifies approximately $309,857.43 as earned or paid to date against the items summarized in this report and approximately $622,542.57 in remaining balances associated with quantified closeout-related work. These figures are a planning baseline, not a final contractor proposal or authorization to proceed. Several required items remain unpriced, and some Schedule of Values entries require reconciliation before a final closeout amount can be presented.
Preliminary financial summary
Measure Amount Status
Earned or paid to date on quantified items $309,857.43 Documented item entries Remaining balance for quantified closeout work $622,542.57 Preliminary planning baseline Front facade CRB No. 1 $80,000.00 Rough estimate; subsequent and not authorized
Potential balance including front facade $702,542.57 Excludes unpriced closeout items Important limitation: Remaining SOV balances are not the same as the final cost to complete the closeout.
The contractor must identify what portion of each balance is required, provide detailed pricing for work outside the SOV, and receive written City authorization before proceeding.

Cost Reconciliation
The amounts below are derived from the line-item data in the closeout workbook. Staff should use the itemlevel reconciliation rather than the workbook's displayed main-table totals because the existing formulas omit certain entries and combine required and subsequent work.
Quantified cost categories
Category Scheduled value Earned or paid Remaining balance Structural stabilization items $626,000.00 $225,207.43 $400,792.57 Site utilities and restoration items $149,400.00 $14,000.00 $135,400.00 Roof framing, over-sheathing, and bowstring truss
work $157,000.00 $70,650.00 $86,350.00
Quantified closeout subtotal $932,400.00 $309,857.43 $622,542.57 Front facade CRB No. 1 $80,000.00 $0.00 $80,000.00
Potential total including front facade $1,012,400.00 $309,857.43 $702,542.57 Items Requiring Reconciliation
• The workbook's main-table earned or paid formula totals $225,207.43 but omits $14,000 recorded for the site storm-drain connection. The item-level amount is $239,207.43 before adding SOV 287 roof and truss work. • The workbook's main-table remaining-balance formula totals $588,692.57. It includes the $80,000 front facade estimate, omits the $27,500 site storm-drain balance, and excludes the $86,350 balance associated with SOV 287.
• A separate $40,800 Storm Drain System scheduled value has no earned or remaining balance entered. It may overlap with the $41,500 site storm-drain entry and is excluded from the report totals pending confirmation. • The workbook identifies steel wall braces and upper brace anchorage under SOV 266, while the Notice to Contractor references SOV 269 as the potential steel wall-brace item. The correct line item must be confirmed.
• SOV 287 appears to carry both roof over-sheathing and bowstring-truss work. The $86,350 balance is counted once. The contractor must provide a breakout showing how much applies to each required component. • The $80,000 front facade figure is described in the workbook as a rough verbal estimate. The Notice to Contractor treats it as subsequent work and not part of the first-priority closeout authorization.
What the Cost Figures Do Not Include
The current totals do not include reliable pricing for the following items. These costs may use existing SOV balances if applicable, or may require separately authorized extra work:
• Reinstallation of the existing storefront system and closure of upper-level window openings. • Full-height rear wall enclosure, weather protection, sealing, and cement plaster finish. • Demolition of the new addition to the foundation or, alternatively, weatherproofing and preserving it. • Final grading, backfill, erosion control, cleanup, security measures, and temporary access measures. • Purchase or continued rental of shoring if the design team determines that it must remain. • Force-account work, if authorized, for conditions that cannot be priced in advance. • Recommended marquee rehabilitation and other nonessential restoration work.

Projected Closeout Work
The projected work is organized below in the order that best protects public safety, the structure, and the City's financial position. The contractor has been asked to submit itemized pricing and an SOV reconciliation.
No work should begin until the City provides written authorization.
Priority 1 Structural Stabilization
• Construct the east-end concrete shear walls and the north-south steel moment frame, including associated shear transfer and anchorage.
• Install required wood shear walls or prefabricated shear panels where existing lateral-resisting elements were removed or stripped.
• Restore support at undermined or unconfined footings through planned concrete work or properly compacted material, as applicable.
• Complete steel wall braces, upper roof-to-wall brace anchorage, roof over-sheathing, and bowstring-truss retrofit work.
• Complete southeast-corner underpinning, hold downs and anchor bolts, and repair cracks in the south wall.
Priority 2 Weather Protection Drainage and Site Safety
• Complete or protect the roof system and reconnect roof drainage to the onsite StormTech system so water does not accumulate.
• Grade and backfill disturbed areas, ditches, slot cuts, and the north side of the site to prevent ponding, erosion, and runoff onto adjacent property.
• Complete, cap, protect, or safely terminate applicable lift-station, storm-drain, and other utility improvements. • Complete permanent asphalt patchback and restore disturbed street and trench areas that must be left safe for public use.
• Remove loose materials and debris, secure temporary conditions, and document remaining cleanouts, utilities, shoring, and structural elements.
Priority 3 Building Security and Enclosure
• Secure the front entrance, rear of the theater, and upper-level window openings. • Reinstall the existing storefront system where required for security and weather protection. • Construct and seal the rear wall with a full-height wall assembly and cement plaster finish. • Determine whether temporary stairs are needed and whether existing interior or exterior shoring must remain.
Priority 4 New Addition Decision
The Notice to Contractor requests separate pricing for two mutually exclusive alternatives:
• Alternative A - Remove the partially constructed wood framing to the foundation, dispose of materials, and leave the foundation and site safe.
• Alternative B - Retain the addition and weatherproof exposed framing, roof-to-wall interfaces, and exterior openings to prevent deterioration.
The August 8 architectural memo identifies removal to the foundation as required for closeout. The later Notice to Contractor requests both removal and preservation pricing so the City can compare the alternatives before giving direction.
Subsequent or Recommended Work
The front facade work under CRB No. 1 and marquee refurbishment, reinstallation, and electrification are not first-priority closeout items. They should remain separate until required safety work is priced and the Council understands the remaining available funding.
CITY OF GUADALUPE | CITY COUNCIL STAFF REPORT
Royal Theater Closeout Update | Page 4 of 4
Schedule and Administration
A final construction schedule cannot be established until the contractor submits a complete cost proposal, SOV reconciliation, sequencing plan, and pricing for the new-addition alternatives. The closeout checklist also calls for a written work plan, photographic documentation, and an updated site plan identifying capped utilities, cleanouts, temporary drainage, shoring, and remaining structural elements.
Recommended Administrative Sequence
1. Obtain the contractor's itemized proposal by SOV line item, including labor, materials, equipment, markups, and any requested time adjustment.
2. Reconcile the cost proposal against prior billings and the approved SOV, including the discrepancies identified in this report.
3. Have the architect, structural engineer, construction manager, and City staff confirm that the proposed scope leaves the building and site safe, stable, secure, and weather-protected.
4. Select the new-addition alternative and identify which subsequent or recommended items, if any, should proceed.
5. Return to the City Council with a final not-to-exceed closeout amount, funding source, schedule, and any required contract action.
6. Issue written authorization only after the City completes the required fiscal, legal, and contract review.
Fiscal Impact
The currently quantified planning baseline is $622,542.57 in remaining SOV balances associated with required closeout-related work. Adding the rough $80,000 front facade estimate increases the potential remaining amount to $702,542.57. These amounts exclude unpriced work and therefore should not be used as a final appropriation or contractor authorization.
Final fiscal impact will depend on the contractor's proposal, the amount of each SOV balance actually needed for closeout, the selected new-addition alternative, any force-account work authorized by the City, and whether subsequent facade or marquee work proceeds. Staff should identify the available project and grant funding, any restrictions on those funds, and the City's exposure for costs exceeding available balances before returning for Council action.
Key Risks Pending Resolution
• Life-safety and seismic risk if structural stability is not restored, and public risk from open excavations, unsecured openings, debris, or incomplete street restoration. • Water intrusion and deterioration if the roof, rear wall, storefront, and new addition remain exposed. • Cost and funding uncertainty if required work is not separated from optional work or proceeds without reconciled pricing and written authorization.
Conclusion
The City can identify the major closeout work and a preliminary financial baseline, but cannot yet approve a final amount. Staff should complete pricing and reconciliation, prioritize structural and weather-protection work, and return with a final scope, schedule, funding plan, and authorization request.

CITY COUNCIL STAFF REPORT
Public hearing to consider the HASBARCO Pioneer Street Apartment project. The project is a seven-unit bonus density apartment project, (2026-039-DR) at 855 Pioneer Street (APN 115-091- 006).
Meeting Date: September 22, 2026
Agenda Item: 11
To: Honorable Mayor and Members of the City Council
From: Larry Appel, Contract Planning Director
Subject: Public Hearing to consider HASBARCO bonus density seven-unit apartment project at 855 Pioneer Street, 2026-039-DR (APN 115-091-006).
RECOMMENDED ACTION
1) Receive a presentation from staff;
2) Conduct a public hearing, including: a) an opportunity for the applicant to present the proposed project, and b) receive any comments from the public; and 3) Adopt Resolution No. 2026-47 approving the CEQA Categorical Exemption, and approve 2026-039-DR, including Findings and Conditions of Approval.
EXECUTIVE SUMMARY
The Housing Authority of Santa Barbara County (HASBARCO) is proposing a new development of seven low-cost apartments on a vacant lot at 855 Pioneer Street. Under the city’s zoning regulations, only five apartment are allowed; however, these seven units can be approved by the City Council because of the state’s bonus density program which allows for increased density in exchange for deed-restricted units to guarantee the units remain affordable for the life of the project, and which, requires the city to accept certain “concessions” which will be discussed later in the report.
BACKGROUND
The project was reviewed in August 2025 by the City Council as a Pre-Application where staff and the applicant presented the preliminary project. There were several changes suggested by Council and those changes have been incorporated into the revised project. The fees for the project were received on August 25, 2026 which became the official submittal date for the project. The applicant requested that the project be processed under SB 35 which requires expedited processing for affordable multi-family projects. That statute requires projects like this to be reviewed and processed within 60 days. City staff has been able to bring this project to Council in less than 30 days and is being heard by Council only 15 days after the project was deemed complete for processing.
DISCUSSION AND ANALYSIS
CITY OF GUADALUPE | CITY COUNCIL
Staff Report 2026-039-DR Page 2 of 5 September 22, 2026 Site and Surroundings:
The apartments would be constructed on a vacant 7,500 square foot vacant parcel on the western side of Pioneer Street. There are currently single-family homes to the north and south. A large apartment complex is located across the street to the east and there are other multi-family homes on the same block. In the most recent update to the city’s general plan, this area was changed from General Commercial (GC) to High Density Residential (R-3).
Project Description:
The project consists of a three-story, type V-8 construction of a multi-family residential building located in an R-3 High Density Residential zone district. The project is utilizing the California Density Bonus Law (California Government Code §§ 65915, et seq.). Except for the manager’s unit, all dwelling units will be deed restricted to various levels of affordability ranging from 60% AMI to 120% AMI (low income range). The three-story building is comprised of seven dwelling units. The units are in 1-bedroom and 2-bedroom configurations with access to common laundry facilities on the first and second floor. The building is anticipated to be of modular construction in order to bring these dwelling units to the community more quickly. There will be three units on the first floor, and two units each on the second and third floor. Units will range from 420 square feet to 660 square feet. The height of the building is 38’-6”. Site improvements include eight onsite parking spaces (including one accessible space), limited landscaping, common open space for tables, benches and BBQ, etc. plus a common trash enclosure. Access will be taken from a single 24-foot-wide driveway off Pioneer Street. The trash receptacle is located at the front of the property at the south east corner.
Project Density:
The R-3 zone district allows one unit for each 1,452 square feet of gross square footage. Under the city’s zoning ordinance, five units could be built. Since the developer is providing the units at an affordable rate, they have been allowed pursuant to the State Density Bonus Law to add two additional units to the project, provided there is a deed restriction to keep the units affordable for the life of the project.
Concessions or Incentives:
Based on Government Code Section 65915 (d)(2)(D), the project is allowed up to five incentives or concessions. The applicant has asked for, and staff is recommending approval of: 1) Reduced rear yard setback, 2) Elimination of private open space, 3) Reduced parking, 4) Increased building height, and 5) Parking within the front yard setback. Each of these will now be discussed.
Reduced setbacks – normally a rear yard on a multi-family project would require a 15-foot setback.
In this case, for the development to fit the small lot, the setbacks on both sides and rear of the structure are proposed to be five feet. The applicant proposed landscaping in these areas in the plans submitted with its application: however, the Guadalupe Fire Department identified this as a CITY OF GUADALUPE | CITY COUNCIL
Staff Report 2026-039-DR Page 3 of 5 September 22, 2026 life safety issue. Fire personnel did not believe they would be able to access the building from the sides or rear if they had to deal with landscaping. Therefore, staff is not requiring any landscaping within the three five-foot setback areas in order to allow emergency access for hoses and ladders, but instead will require a denser planting for the remaining areas (see Condition #9 of the Conditions of Approval).
Elimination of private open space - Under normal circumstances, a multi-family project would be required to provide 100 square feet of private open space for each ground floor unit and 50 feet for balconies on above-ground level floors. In order to provide six low-income units on this site, it wasn’t possible to include private open space. However, the project will include an area for tables, benches and BBQs to serve the residents.
Reduced parking – The zoning ordinance was amended several years ago to address the problem of insufficient parking within multi-family developments in the city (Ord. No. 2023-509). This project would normally require 14 parking spaces with seven of them either carports or garages.
The developer is proposing eight uncovered spaces (including one accessible space). This concession would most likely cause additional vehicle parking on the street. This is the only issue involving the project that could impact the local neighborhood. Staff has made the Findings for approval to show that due to the concessions and incentives allowed or required under state law, and upheld through litigation, that the project would still need to be approved regardless of this impact because the Density Bonus Law preempts local zoning ordinances.
Increased building height - The zoning ordinance was recently amended to allow up to three stories with a 35-foot height for multi-family housing. Based on the pitch of the roof and the need for third floor apartments, this project is requesting concessions to allow the building height to be 38’- 6”.
Parking within the front yard setback - Normally a project would require structures and parking areas to be located outside the 20-foot setback. In order for this project to work, parking was required eight feet into the front setback. In addition, the only location acceptable for the trash enclosure was within the front setback.
General Plan Conformance:
The following General Plan policies and objectives are applicable to the project:
Land Use Policy LU-1.4: The City will support the development of underutilized land with a mix of land uses that increases livability and benefits the community.
The project will develop this vacant property with seven new multi-family housing units. The project will support the objectives of the City’s Housing Element and state mandates to increase the overall housing supply. It will also help with the city’s Regional Housing Needs Allocation.
Land Use Goal LU-9: To promote quality, attractive and self-sustaining residential development CITY OF GUADALUPE | CITY COUNCIL
Staff Report 2026-039-DR Page 4 of 5 September 22, 2026 at all levels of affordability for all segments of the population.
The project exhibits a good degree of design in terms of visual appearance. The new paving and landscape improvements and the building architecture will visually enhance the immediate surroundings. Each new development could potentially encourage new investment in properties in the area. Furthermore, the project will incrementally support General Plan objectives to increase the City’s affordable housing supply.
FISCAL IMPACT
Fiscal impacts are anticipated to be negligible. As noted, the project is an infill project located in an established neighborhood where City infrastructure and services are already provided. The project developer will install, and upgrade required utilities and public infrastructure necessary to serve the project.
ENVIRONMENTAL REVIEW
This project has been reviewed for compliance with the California Environmental Quality Act (CEQA), and the CEQA guidelines, and has been found to be exempt from the California Environmental Quality Act (“CEQA”) pursuant to Section 15332 (infill development). The project is exempt in accordance with CEQA Class 15332 because:
a) The project is consistent with High Density Residential General Plan land use designation and corresponding R-3 High Density Residential zoning that is applied to the property. b) The proposed development will occur on an infill site no more than five-acres in size; and the property is wholly within the Guadalupe City limits.
c) The site is surrounded by urban uses on all sides.
d) The property has been determined to have no value as habitat for rare or endangered species. e) Approval of the seven-unit apartment project would not result in significant effects related to traffic, noise, air quality, or water quality; and the infill site is adequately served by all required utilities and municipal services.
Based on the above, it can be seen with certainty that the proposed project could not have a significant effect on the environment.
PUBLIC NOTICE
Staff posted notice of this public hearing in three locations within the city, and published it in the Santa Maria Times.

Project Title: Pioneer Street Bonus Density Apartments
Project Applicant: HASBARCO
Project Location-Specific: 855 Pioneer Street
Project Location-City:City of Guadalupe Project Location-County: Santa Barbara County Description of Nature, Purpose, and Beneficiaries of Project:
The project is a Design Review (DR) permit to allow seven attached multi-family dwelling units and associated parking and landscaping on a 7500 square foot property in the R-3 (High Density Residential) zoning district. The project would support the City’s General Plan objectives to incrementally increase the City’s housing supply on vacant or underutilized infill sites where services and facilities are already in place.
Name of Public Agency Approving Project: Guadalupe City Council Name of Person or Agency Carrying Out Project: HASBARCO.
Exempt Status: (check one)
__ Ministerial (Sec. 15268);
__ Declared Emergency (Sec. 15269(a));
__ Emergency Project (Sec. 15269(b)(c));
XX Categorical Exemption. Section 15332
__ General Exemption (Section 15061(b)(3))
Reasons why project is exempt:
The project consists of the seven new apartments in the R-3 (high density) residential zoning district in the City of Guadalupe.
The project is exempt in accordance with CEQA Class 15332 (infill development) because:
a) The project is consistent with High Density Residential General Plan land use designation and corresponding R-3 High Density Residential zoning that is applied to the property. b) The proposed development will occur on an infill site no more than five-acres in size; and the property is wholly within the Guadalupe City limits.
c) The site is surrounded by urban uses on three sides and agriculture on the fourth side. d) The property has been determined to have no value as habitat for rare or endangered species. e) Approval of the seven-unit apartment project would not result in significant effects related to traffic, noise, air quality, or water quality; and the infill site is adequately served by all required utilities and municipal services. Furthermore, the project includes design measures that are sustainable.
Based on the above, it can be seen with certainty that the proposed project could not have a significant effect on the environment.

The Class 32 Exemption has been completed in compliance with CEQA and is adequate for this proposal.
1.2 FINDING OF NO SIGNIFICANT EFFECT
Based on the whole record, it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, and therefore the activity is not subject to CEQA.
1.3 LOCATION OF DOCUMENTS
The documents and other materials which constitute the record of proceedings upon which this decision is based are in the custody of the City of Guadalupe, 918 Obispo Street, Guadalupe, CA 93434.
2.0 Administrative Findings
2.1 DESIGN REVIEW FINDINGS
Pursuant to City of Guadalupe Municipal Code, Section 18.73.110, a Design Review Permit shall be approved only if all the following findings can be made:
A. The buildings, structures, and landscaping are appropriate and of good design in relation to other buildings, structures, and landscaping, on-site or in the immediate vicinity of the project.
The project has been designed with full consideration for both the livability for future residents and compatibility with the neighborhood in which the project is located. The building architecture, landscape improvements and open space amenities will be fitting and appropriate for the neighborhood.
Due to the bonus density nature of the project, several “concessions” must be given to the applicant for providing affordable housing. Those include 1) reduced rear yard setbacks, 2)
elimination of private open space, 3) reduced number of parking spaces, 4) increased building height, and 5) elimination of landscaping around the side yards and rear yard of the structure to meet fire safety conditions. Even with these concessions, the project will be an improvement to the surrounding neighborhood.
B. That the development will be compatible with the neighborhood, and its size, bulk and scale will be appropriate to the site and the neighborhood.
As shown on the approved plan set, the new three-story apartment buildings exhibit exteriors that include materials and colors that are harmonious and fit compatibility with the immediate neighborhood. While there are single family homes adjacent to the north and south, the area is transitioning into a multi-family neighborhood as exhibited by recent development across the street and two parcels to the south.
C. There is harmony of material, color, and composition of all sides of a structure or buildings as well as consistency and unity of composition and treatment of exterior elevation.
The apartment buildings are of simple but attractive design. The building materials and colors relate harmoniously with one another.
D. Any mechanical or electrical equipment is well integrated into the total design concept and screened from public view to the maximum extent practicable.
Any mechanical and/or electrical equipment will be designed and located to minimize visibility and will be screened from public view as applicable.
E. All on-site utility services are appropriate in size and location.
During the building permit review process, the applicant will need to show calculations for the size of water service needed for the seven units. The existing one-inch service line is inadequate for the size of the project. By the time a building permit has been issued, all utility services will be appropriate in their size and placement on the project site.
F. The grading will be appropriate to the site.
The grading is appropriate for the site with a projected need for 410 cubic yards of fill to bring the building pad above the 100-year flood level.
G. Adequate landscaping is provided in proportion to the project and the site with due regard to the preservation of existing trees, and existing native vegetation, and adequate provision will be made for the long-term maintenance of such landscaping.
Appropriate landscaping is provided in front of the building and along the common open space and parking areas. Due to the reduced setbacks around the building, the Fire Department has
required elimination of any landscaping so that it would be possible for emergency access for hoses and ladders, as necessary. The project has been conditioned to require permanent maintenance of the landscaped areas in accordance with Municipal Code 18.64.120.
H. The development will not adversely affect significant public scenic views.
The project would promote development of an underutilized infill site on the western portion of the city. Residents of this development would have the ability to view open space and agricultural fields towards the dunes for windows with a western view. The site improvements, landscape and tree planting plan are anticipated to improve the overall appearance of the project site and improve the current appearance of the undeveloped lot.
I. All exterior site, structure and building lighting is well-designed and appropriate in size and location.
All exterior lighting fixtures shall be located, directed, and shielded to minimize potential light and glare impacts on neighboring properties.
J. The proposed development is consistent with any additional design standards as expressly adopted by the City Council.
No additional design standards were required by the City Council. However, the project was designed in full consideration of the applicable historic and neighborhood preservation goals and objectives of the City’s General Plan.
K. The project architecture will respect the privacy of neighbors and is considerate of solar access.
The project location and the site design will ensure no impact will result to the privacy of neighboring properties in the project area.
L. The project will provide for adequate street design and sufficient parking for residents and guests in a safe and aesthetically pleasing way.
In exchange for six permanent affordable housing units (plus manager’s unit), the city is required to reduce parking from 14 spaces (with seven covered) to just eight spaces total. No guest parking is required nor is it being provided. Government Code Section 65915(p)(1) provides for this reduction. As a result, it is possible that some vehicles from the development may need to find parking on the street. This is obviously an impact on the neighborhood, but unfortunately, the city must comply with the regulations and find the project consistent with this Finding.
M. The proposed development as shown on the project plans is in conformance with all applicable policies of the General Plan and the requirements of this title.
As noted, the project design, with the exception of the previously noted concessions, is in full consideration of the urban design goals of the General Plan and the project meets or exceeds the minimum standards established by the City of Guadalupe Municipal Code.
N. The proposed development is an asset to the community through the provision of needed housing units along with expanded commercial/retail services.
This project will provide well needed affordable housing for the city and also help address the city’s need to meet its Regional Housing Needs Allocation (RHNA) numbers.

CITY COUNCIL STAFF REPORT
Amendment to City Administrator David Trujillo’s Employment Agreement Meeting Date: September 22, 2026
Agenda Item: 12
To: Honorable Mayor and Members of the City Council
From: Philip F. Sinco
Department: City Attorney
Subject: Amendment No. 1 to City Administrator David Trujillo’s Employment Agreement
RECOMMENDED ACTION
1. Approve, by motion, Amendment No. 1 to the City’s Employment Agreement with City Administrator David Trujillo, and authorize the Mayor to sign it on behalf of the City.
EXECUTIVE SUMMARY
Key finding: Approval of Amendment No. 1 to the City’s Employment Agreement with City Administrator David Trujillo will result in savings to the City in the estimated amount of $26,748 from September 26, 2026, through April 6, 2029.
BACKGROUND
The City Council approved a three-year employment agreement with Mr. Trujillo (with an effective date of April 1, 2026) at its meeting on April 14, 2026. Among other things, the agreement included an auto allowance of $150 per month and a 6% pay increase in the second year of the agreement (depending on satisfactory performance) as well as another 6% pay increase in the third year of the agreement.
At the last City Council meeting held on September 8, 2026, City Administrator David Trujillo announced his intention to voluntarily waive his monthly auto allowance and his 6% salary increase for the second year of his three-year employment agreement with the City of Guadalupe as a way to help with the City’s budget deficit.
DISCUSSION AND ANALYSIS
Voluntary Waiver of Monthly Auto Allowance and 6% Pay Increase in Year 2 of the Agreement
Mr. Trujillo has offered to waive his monthly auto allowance in the amount of $150 beginning on September 26, 2026 for the rest of the term of his employment agreement. He has also CITY OF GUADALUPE | CITY COUNCIL
offered to forego the 6% pay increase in the second year of the three-year agreement that would take effect on or after April 1, 2027 (contingent on a satisfactory performance evaluation).
The total savings from his waiver of the auto allowance from September 26, 2026, through the end of the agreement will be $4,500 ($150/mo. for approximately 30 months).
Mr. Trujillo’s current annual salary is $180,000, and therefore, the savings from his waiver of the 6% pay increase in the second year of his agreement will be $10,800 ($900 per month).
Therefore, the total savings to the City will be $15,300.
Furthermore, even if Mr. Trujillo is granted a 6% pay raise for the third year of his agreement (i.e., beginning on April 1, 2028), the City will still realize additional savings from his waiver of his 6% pay raise in the second year of his agreement in the amount of $11,448. This is because the pay raise in the third year of his agreement will be 6% of $180,000 rather than 6% of $190,800. Thus, all things considered, should the City Council approve Amendment No. to Mr.
Trujillo’s agreement, the City will realize savings in the estimated amount of $26,748.
FISCAL IMPACT
Current fiscal year: If the Council approves Amendment No. 1, the City will realize estimated savings of $4,257.69 in FY 2026-27 consisting of approximately $2,090.69 in salary savings and $1,2350 in savings from the monthly auto allowance.
Ongoing annual impact: The City will realize estimated savings of $12,849.46 in FY 2027-28 consisting of approximately $10,974.46 in salary savings and $1,875 in savings from the monthly auto allowance. Assuming Mr. Trujillo is granted a 6% pay raise on April 1, 2028 (i.e., for the third year of his agreement), the City will realize approximately $8365.85 in salary savings during FY 2028-29 as a result of his waiver of a 6% pay increase during the second year of his employment agreement, in addition to savings of $1,275 from his auto allowance, for a total of $9,640.85 in FY 2028-29.
Budget action: No budget action is required for the current fiscal year. The FY budget in 2027- 28 can include these savings.
Financial constraints: None.
