COUNCIL AGENDA ITEM
JANUARY 18, 2022
PREPARED BY: Melanie Correa, Human Resources Director/Deputy City Clerk SUBJECT: CA Assembly Bill 361 and Findings - Continuance
BACKGROUND/DISCUSSION
At their regular meeting on November 2, 2021, Council approved a resolution to continue virtual and teleconference meeting parameters in accordance of AB361.
According to the bill, such determination must be revisited and determined every thirty (30) days thereafter.
AB 361 amends the Brown Act to allow local legislative bodies to continue mandating public attendance to public meetings in a virtual capacity. The allowance is contingent on the following conditions: that the state is under a gubernatorial "proclaimed state of emergency", and either (1) state or local officials have imposed or recommend measures that promote social distancing, or (2) the legislative body finds that meeting in person would present an imminent safety risk to attendees.
The proposed resolution continues Council's findings that the current declared state of emergency for the City is still in effect, and that in-person meetings would directly impact the ability of attendees to meet safely in person, or that County health officials continue to impose or recommend measures to promote social distancing.
If the Council Chambers were opened to public attendees, current OSHA requirements state that unvaccinated persons must wear a mask. In addition, staff would need to continue hosting meetings with the virtual component to accommodate anyone wishing to attend virtually due to concerns of COVID.
FISCAL IMPACT
There is no fiscal impact associated with this item.
RECOMMENDATION
City Council approve the resolution to continue in-person meetings in accordance to AB361 through the declared end of the City's state of emergency. This action will need to be revisited every 30 days, if approved.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GUSTINE CONTINUING THE
AUTHORIZATION TO CONDUCT VIRTUAL CITY COUNCIL MEETINGS DURING DECLARED STATE OF EMERGENCY PURSUANT TO GOVERNMENT CODE 54953 (AB 361) WHEREAS, AB 361 was recently signed by the Governor of the State of California, enacting certain changes to the Brown Act as set forth in Government Code section 54953; and
WHEREAS, AB 361 authorizes local legislative bodies to continue having purely virtual meetings using teleconferencing and virtual meeting technology as long as there is a gubernatorial "proclaimed state of emergency," and either (1) state or local officials have imposed or recommend measures that promote social distancing or (2) the legislative body finds that meeting in person would present an imminent safety risk to attendees; and
WHEREAS, the state of emergency proclaimed by the Governor on March 4, 2020, related to the pandemic of coronavirus commonly as COVID-19 has not been rescinded and remains in effect, along with the City's declared state of emergency; and WHEREAS, new variants of COVID-19 have developed, and risks of illness or death due to such variants remains significant to the general public; and WHEREAS, the City Council has determined that virtual meetings have not limited participation of Council Members, City staff and other potential attendees.
WHEREAS, the City Council approved a resolution on November 2, 2021 (Reso. 2021-2597) determining that virtual meetings continue in accordance with AB361; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Gustine:
Section 1. The City Council determines that the pandemic of COVID-19 creates an imminent safety risk to council members, staff and other potential attendees of City Council meetings.
Section 2. In accordance with AB 361, the City Council shall re-consider the passage of this resolution not less than every 30 days to determine whether state of emergency continues to directly impact the ability of the members to meet safely in person, or whether state or local officials continue to impose or recommend measures to promote social distancing, until the resolution is rescinded.

PREPAREd BY: Tiffany Vitorino, Recreation Manager
SUBJECT: Food Truck Attraction and Movie Night
BACKGROUND/DISCUSSION
The Recreation Department is planning a stream of Movie Nights to be held during the spring. The movie nights will be held on scheduled Friday nights for the months of March, April and May. Two of the events will be at Henry Miller Park and one will be hela at Joe DeGregori Field, in Schmidt Park at the beginning of the baseball season. The admission-free event will include free popcorn, crafts and the movie. The recreation department will have a plan in place for social distancing requirements if necessary for families to be able to enjoy the movie safely distanced from other families. Restrooms will be available and cleaned periodically according to safety guidelines.
Staff would like to include food vendors at the event as an attraction. Staff is in contact with a few vendors who have expressed interest in participating. Once approved, staff is hoping the advertising of the food trucks along with the promotion of the movie will encourage community participation. Staff is requesting Council's authorization to allow food truck vendors at Henry Miller Park and Harry Schmidt Park during Movie Night.
According to the Gustine Municipal Code Section 5-6-3, mobile kitchen type vendors are only allowed in manufacturing districts, except otherwise by special permission of the City Council during festivals, parades and other public events. Staff will ensure that the vendors will have the appropriate city business license and will work closely with Merced County.
FISCAL IMPACT
The FY 21/22 Recreation department budget has allocated funding to assist with the associated costs of the movie, and supplies needed for a successful movie night.
RECOMMENDATION
City Council to consider approving the request to allowing mobile food vendors to participate in the Movie Nights at Henry Miller Park and Harry Schmidt Park this spring.

BACKGROUND/DISCUSSION
Measure V, Merced County's transportation sales tax that was passed by voters in November 2016, is being administered by Merced County Association of Governments (MCAG). The Measure V Transportation Expenditure Plan (Plan) requires formation of a Citizens Oversight Committee to ensure the measure program is implemented as outlined in the plan. The committee will review financial and performance audits, reports from member agencies, annual receipts and other documents necessary to assess the program's consistency with the plan.
The committee consists of fourteen (14) members with seven (7) nominated by the six cities and County of Merced, and seven (7) selected by the MCAG Governing Board.
Committee terms will be two years, with a maximum of 8 years of service. The vacant seat for Gustine's representative is set to expire in May 2023.
The vacancy comes as a result of the City's most recent appointment's failure to attend meetings, as per bylaws. The City has received interest from one (1) applicant for consideration of appointment as the City of Gustine appointee. The applicant is Joe Oliveira. City appointees are due to MCAG as soon as possible.

PREPARED BY: Mario Gouveia, City Engineer
SUBJECT: Approve Resolution Accepting Completion of Green Acres Curb Ramp, Authorizing the Deputy City Clerk to file a Notice of Completion with Merced County, and Authorizing the City Manager to Make Final Payment of Retention Monies to TBS Contractors.
BACKGROUND/DISCUSSION
The City of Gustine requested proposals for the Green Acres Curb Ramp project on April 27, 2021, using an informal bid process pursuant to the California Public Contract Code Section 22034 and the City of Gustine Municipal Code. The informal bids were opened on May 11, 2021. TBS Contractors submitted the lowest responsive and responsible bid and was awarded a contract for $49,208.90.
The project's construction phase started on August 23, 2021 and the major work consisted of constructing curb and gutter, 5' wide concrete sidewalk, wheelchair ramps, an asphalt concrete ADA path, and minor asphalt concrete pavement repairs at Green Acres Mobile Home Park in the City of Gustine.
The Contractor completed all work within the time required in the Contract Documents.
A final inspection was performed and the work was found to be in compliance with the plans and specifications. Therefore, the work should be accepted as complete and a Notice of Completion filed. If no claims are filed within 35 days after recordation, retention in the amount of $2,460.44 should be paid to TBS Contractors.
FISCAL IMPACT
The final construction contract cost inclusive of all authorized work was $49,208.90.
Funding of this project will be paid with City Funds.
RECOMMENDATION

2. Authorize the Deputy City Clerk to record a Notice of Completion with Merced County.

JANUARY 18, 2022
PREPARED BY: Jami Westervelt, Economic and Community Development Director SUBJECT: Parks Resolution- City of Gustine Aquatic Center Application for Rural Recreation and Tourism Grant
BACKGROUND/DISCUSSION
The City of Gustine received parks funding through two Proposition 68 programs to • date. The City used its Per Capita allocation from California State Parks to install a new playground in Harry Schmidt Park. The City also received a $1.3 million award from Round 3 of the competitive Statewide Park Program (SPP) to renovate Pioneer Park.
During more than one general discussion on funding, State Parks staff has advised City staff to consider applying to the Rural Recreation and Tourism (RRT) grant program for the pool. The City wants to add competitive swimming lanes, providing the economic benefits required by RRT applications (along with the City's rural status).
While City staff currently work on estimates and options for repairs needed in order to go forward with the upcoming swim season, the RRT program application would go beyond that work and replace the foundational elements of the pool that the City has struggled to finance. The RRT program would not happen for the 2022 swim season.
The RRT program award maximum is $3 million with "significant visitor attraction" and "attraction to strengthen the local economy" being required. The program is also limited to rural applicants. The below highlights other differences between SPP and RRT:
GRANT SPECIFIC STATE PARKS ROUNDS 3 & 4 RURAL REC & TOURISM Maximum award $8.5 million per project park $3 million per project park Total Statewide $254.9 and $548.3 million $23.1 million.

Significant visitor One element of a multi- Along with "Health," visitor attractor part question attraction weighs heavily
Income points Based on % ranking in the Pre-determined points based upon applicant pool dollar amounts rather than ranking
Organizations Cities, Counties & Districts Cities, Counties & Districts Match Threshold Set amount each round Waived at $56,982 or under The unfunded SPP application for Henry Miller the City submitted in Round 4 totaled over $6.9 million, with aquatic portions accounting for the majority of the costs. The application included extensive additions (new pool lanes, replacing the pool and its equipment and erecting a new replacement pool house), renovating the playground and picnic area, and installing the new features of a Splash Pad and Outdoor Gym.
In order to apply for the RRT program, the City will need to limit the application to solely the pool project. Further, the City will need to reduce the scope of the pool project.
O'Dell engineering provided the Council estimates related to the pool and splash pad portion of the application in January 2021. State parks, which originally promised applicants that it would provide three full months for turnaround between Round 4 announcements and the RRT application deadline, did not announce Round 4 until December 8'h 2021 but has RRT applications due on January 20th 2022. The City, or a consultant working on the City's behalf, does not have sufficient time to solicit revised solid cost estimates-especially given the volatility of project materials. City project costs have increased continually since the start of the pandemic and often quite quickly.
Therefore, staff can only estimate costs and potential savings for cuts based upon the January 2021 numbers. Using those, staff assembled a rough estimate for $2,998,868, by developing a strategy that would:
• Retain the complete replacement of the pool and all equipment and decking. • Add the competitive swim lanes in the "L-shape" design previously submitted. • Cut the size of the new pool building significantly-likely half the 2,500 sq ft. • Repurpose the current pool house building-instead of demolishing it. • Use the current pool building to house only the snack bar, employee lockers and other types of areas the public does not need to access. Users would only approach the exiting "window" and would not go beyond that point. • Construct a smaller, new pool building to serve as the new entrance to the facility and house new, ADA compliant restrooms, showers and other required facility amenities.
• Explore options for both buildings with the selected project Engineer to make the maximum use of the funds if the City receives the award.
It is extremely important the Council understand the following regarding this estimate:
• Staff believes it is likely that, even with these changes, the project might exceed amount awarded.
• This is always a possibility with grants but especially so given the volatility of prices in recent years and the date of the estimate used as a base. • If this were to occur, the Council could not ask State Parks for additional funding. • At that point, the City would need to submit a budget change to State Parks, indicating the City would fund the remainder of the project. The City would need to either use available funds or finance the difference. • The City would need to be certain that, regardless of cost-cutting, the project:
• Meets the minimum project specifications listed in the grant • Complies in all manner with the American Disabilities Act and all State and Federal requirements.
Further, as with all the previous State Park Projects, the City will need to comply with the terms of the Resolution required and the contract State Parks will require. Among those is that the City agrees to keep the feature active (meaning operating the pool) for thirty years into the future. This requirement remains in place regardless of future costs or future financial condition of the City. Another requirement is that the pool be open for programming seven days a week during the swim season following project completion.
Given prior feedback from the Council and the January 20th deadline for RRT, staff has prepared the application based on the above and with a cost of $2,998,868. The application requires resolution. State Parks mandates the specific language in the attached Resolution and the department will not accept changes to it.
FISCAL IMPACT
The City application for RRT funds does not require the City to provide a match.
However, if the project receives funding and exceeds the award amount, the City would be required to make up that unknown difference. The City also will have an obligation to keep the park, as well as the pool, operating into the future per terms of the Contract the City will sign if it receives the funding.
RECOMMENDATION
City Council approval of the attached Resolution and direct staff to submit it with the application as required by the Rural Recreation and Tourism grant application.
