CA ITEM NO. 4

COUNCIL AGENDA ITEM
FEBRUARY 15, 2022
PREPARED BY: Melanie Correa, Human Resources Director/Deputy City Clerk SUBJECT: CA Assembly Bill 361 and Findings - Continuance

BACKGROUND/DISCUSSION
At their regular meeting on November 2, 2021, Council approved a resolution to continue virtual and teleconference meeting parameters in accordance of AB361.

According to the bill, such determination must be revisited and determined every thirty (30) days thereafter.

AB 361 amends the Brown Act to allow local legislative bodies to continue mandating public attendance to public meetings in a virtual capacity. The allowance is contingent on the following conditions: that the state is under a gubernatorial "proclaimed state of emergency", and either (1) state or local officials have imposed or recommend measures that promote social distancing, or (2) the legislative body finds that meeting in person would present an imminent safety risk to attendees.

The proposed resolution continues Council's findings that the current declared state of emergency for the City is still in effect, and that in-person meetings would directly impact the ability of attendees to meet safely in person, or that County health officials continue to impose or recommend measures to promote social distancing.

If the Council Chambers were opened to public attendees, current OSHA requirements state that unvaccinated persons must wear a mask. In addition, staff would need to continue hosting meetings with the virtual component to accommodate anyone wishing to attend virtually due to concerns of COVID.

FISCAL IMPACT
There is no fiscal impact associated with this item.

RECOMMENDATION
City Council approve the resolution to continue in-person meetings in accordance to AB361 through the declared end of the City's state of emergency. This action will need to be revisited every 30 days, if approved.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GUSTINE CONTINUING THE

AUTHORIZATION TO CONDUCT VIRTUAL CITY COUNCIL MEETINGS DURING DECLARED STATE OF EMERGENCY PURSUANT TO GOVERNMENT CODE 54953 (AB 361) WHEREAS, AB 361 was recently signed by the Governor of the State of California, enacting certain changes to the Brown Act as set forth in Government Code section 54953; and
WHEREAS, AB 361 authorizes local legislative bodies to continue having purely virtual meetings using teleconferencing and virtual meeting technology as long as there is a gubernatorial "proclaimed state of emergency," and either (I) state or local officials have imposed or recommend measures that promote social distancing or (2) the legislative body finds that meeting in person would present an imminent safety risk to attendees; and
WHEREAS, the state of emergency proclaimed by the Governor on March 4, 2020, related to the pandemic of coronavirus commonly as COVID-19 has not been rescinded and remains in effect, along with the City's declared state of emergency; and WHEREAS, new variants of COVID-19 have developed, and risks of illness or death due to such variants remains significant to the general public; and WHEREAS, the City Council has determined that virtual meetings have not limited participation of Council Members, City staff and other potential attendees.

WHEREAS, the City Council approved a resolution on November 2, 2021 (Reso. 2021-2597) determining that virtual meetings continue in accordance with AB361; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Gustine:

Section 1. The City Council determines that the pandemic of COVID-19 creates an imminent safety risk to council members, staff and other potential attendees of City Council meetings.

Section 2. In accordance with AB 361, the City Council shall re-consider the passage of this resolution not less than every 30 days to determine whether state of emergency continues to directly impact the ability of the members to meet safely in person, or whether state or local officials continue to impose or recommend measures to promote social distancing, until the resolution is rescinded.

COUNCIL AGENDA ITEM
FEBRUARY 15, 2022
PREPARED BY: Ruben Chavez, Chief of Police
SUBJECT: Approve Request from West Side Auto Club for the Annual Linguica Run July 10, 2022

BACKGROUND/DISCUSSION
Staff has received a request from the Westside Auto Club to hold their "Annual Linguica Run" on Sunday July 10th, 2022. City Council authorization is necessary, as the request requires the use and closure of City Streets, the use of City Facilities and the use of City Personnel. The city street affected by this event and requested for closure will be Second Avenue, from West Avenue to Sixth Street.

The Westside Auto Club is requesting to install a temporary curb ramp on Sixth Street, north of Third Avenue. This ramp will provide safe access to the park for vehicles entering and exiting the car show.

The Westside Auto Club is also requesting utilization of the entire Henry Miller Park Facilities, not including the swimming pool. The use of Henry Miller Park and the street closures will be from 5:00 AM to 5:00 PM on Sunday, July 10, 2022. In addition, the Westside Auto Club is requesting access to the park and facilities on Saturday, July 9, 2022 for preparations.

Don Gomes, the President of Westside Auto Club will be required to obtain all required permits regarding the use of Henry Miller Park, prior to the event.

The Westside Auto Club has held this event in Henry Miller Park for 40 years and was unable to host in 2020 and 2021 due to the pandemic. The event has proven to be a great success with over 310 vehicles on display. This year is the 41st Anniversary. Staff will ensure that all proper permits are secured, and that Police and Public Works Personnel are assigned as needed. Staff will also ensure adherence to all regulations established for previous events.

FISCAL IMPACT

1. Public Works Manager, Jesus Chavez, estimated that barricade placement and retrieval would require four labor hours. The projected labor cost was set at $200.00. (4 hours X$50.00)

2. Additional Police staffing will be required to provide security at this event. A 4- hour commitment, with a labor cost estimated at $240.00 (4 hours X $60.00) has been projected.

3. Total cost to the City (Public Works and additional Police Staffing) is $440.00.

4. Don Gomes is aware of the estimated labor cost.

RECOMMENDATION
Approve the request from West Side Auto Club to close Second Avenue, from West Avenue to Sixth Street, and to allow the installation of a temporary curb ramp as outlined in the attached letter.

COUNCIL AGENDA ITEM
FEBRUARY 15, 2022
PREPARED BY: Tiffany Vitorino, Recreation Manager
SUBJECT: Consider Rental and Deposit Payment Procedures for Facility Rentals

BACKGROUND/DISCUSSION
On December 1, 2021 City staff started utilizing CivicRec, the City's new Recreation and Facility Rental software system. The new system creates many advantages and conveniences to staff and customers, but also has many different options for obtaining customer payments and deposits.

Prior to Civic Rec, the City would hold customer rental dates with a credit card number on file. The City would charge the card the applicable fees if the customer cancelled the reservation, if issues arose with the cleaning, or if the renter damaged the facility.

For rental fees, customers have paid no later than five days prior to the event with the option of paying in cash or check, as well as credit card.

However, because it is an online system, CivicRec cannot "hold" a card number. The system allows credit card input by the customer only when the customer makes an actual purchase.

Therefore, if we continue with past procedures, and allow customers to pay rental fees just 5 (five) days prior to the rental and pay the rental by cash or check, the City will have no card on file. If customers cancel, staff must send the customer an invoice for cancellation fees, hoping that the customer will pay. The same would be true for not properly cleaning the facility or causing damage.

To avoid these situations and to obtain a more secure payment, staff needs to change current rental fee and deposit collection procedures. Staff has come up with options that fit the capabilities of the CivicRec program, limit staff time and limit risk. Each of the options would allow the CivicRec system to obtain the credit card information that staff could also access to charge applicable fees in the case of cancellation, damage or cleaning issues.

1. Charge a non-refundable $25 Admin Fee at the time of the facility request.

Currently, the City adds this fee only when a customer cancels a reservation but the Fee Schedule lists the fee under the cancellation section. Most Cities charge an Admin (or Application) Fee for facility rentals.

2. Require the customer pay the full rental fee up front online via credit card. This would follow the policy as stated on the refund section of the Fee Schedule. This option may also reduce the number of cancelled reservations.

3. Charge the customer the approved refundable deposit, per the fee schedule, up front. The deposit would remain in the CivicRec System until after the event.

The City would refund the deposit to the card following the event if the customer cleans the facility fully and does not cause damage.

Staff seeks guidance from Council that could include one of the above, all the above, any combination of the above or other alternatives that can be implemented in the online system.

For any of the options, staff will work with the City Attorney to make sure the City provides the legal language necessary to allow the customer to authorize the charges online when the system requests the card numbers.

FISCAL IMPACT
In continuing the current procedure, the City could lose the ability to recoup fees associated with damage or staff time related to cleaning the facility.

RECOMMENDATION
Staff recommends that Council provide direction on preferred facility rental deposit and fee collection procedures.

GUSTINE CITY CALIFORN

COUNCIL AGENDA ITEM
FEBRUARY 15, 2022
PREPARED By: Doug Dunford, City Manager
Ann Siprelle, City Attorney
SUBJECT: Consideration of an Ordinance Updating Various Sections of the Gustine Municipal Code Regarding Family Day Care Homes, Residential Care Facilities, and Transitional and Supportive Housing BACKGROUND:

On January 26, 2022, The Planning Commission held a meeting to consider updating the Gustine Municipal Code regarding Family Day Care Homes, Residential Care Facilities and Transitional and Supportive Housing. The Planning Commission passed the recommendation with a 4-0 (Gandy- absent) vote to authorize and recommend approval to City Council.

In recent years, the State of California has preempted local regulation of certain residential uses, including family day care homes, residential care facilities, and transitional and supportive housing. The proposed ordinance (Attachment 2) amends various provisions of the Gustine Municipal Code ("GMC") to increase clarity and ensure compliance with changes in State law.

DISCUSSION:

The ordinance's amendments to the GMC include, but are not limited to:
• Updating the City's definitions for "supportive housing" and "transitional housing" to have the same meaning as defined under State law (reflected in GMC, § 4-80- 020).
• Clarifying that transitional housing and supportive housing are considered residential uses of property and subject to those restrictions that apply to other residential dwellings of the same type in the same zone as required under State law (reflected in GMC, § 4-44-190(A)).
• Clarifying that supportive housing is a use by right in all zones where multifamily and mixed uses are permitted as required under State law (reflected in GMC, § 4- 44-190(B)).
• Updating the City's "adult day care," "residential care facility" ("RF") and "residential care facility for the elderly" ("RCFE") definitions to have the same meaning-and use the same terminology—as provided under State law (reflected in GMC, § 4-80-020). For example, adult day cares and RCFs are now covered by the definition for "Community Care Facility" (which is a defined term under State 28859.00009\34672582.2
law that encompasses RCFs and adult day cares).
• Reorganizing and updating GMC Section 4-22-030's Table 2.1 (Allowed Land Uses and Permit Requirements for Residential Zoning Districts) to regulate small and large family day care homes, as well as RCEs and Community Care Facilities (which include adult day cares and RCFs) in accordance with State law. • Revising Table 3-7 of GMC Section 4-36-040 to delete the reference to special parking requirements for large family day care homes, as state law now provides that large family day care homes must be treated identically to small family day care homes (and that both must be treated as by right residential uses). • Revising GMC Section 4-44-040 (Child Day Care Facilities) to clarify that child day care centers are separately defined and regulated from small and large family day care homes.

For reference, a redline displaying this ordinance's amendments to the GMC is attached as Attachment 3.

California Environmental Quality Act
This proposed ordinance has been assessed in accordance with the authority and criteria contained in the California Environmental Quality Act ("CEQA"), the State and local CEQA Guidelines, and the environmental regulations of the City. Staffs' recommended Planning Commission action is a recommendation that the City Council find that the ordinance is not subject to CEQA pursuant to Sections 15060(c) (2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c) (3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly.

FISCAL IMPACT:

None.

RECOMMENDATION:

It is recommended that the Council introduce and waive the first reading updating various sections of the Gustine Municipal Code regarding Family Day Care Homes, Residential Care Facilities and Transitional and Supportive Housing.

COUNCIL AGENDA ITEM
FEBRUARY 15, 2022
PREPARED By: Doug Dunford, City Manager
Ann Siprelle, City Attorney
SUBJECT: Consideration of Amendment to Gustine Zoning and Subdivision Code to Authorize Body Art Facilities in C-1 and C-2 Zones without Use Permit

INTRODUCTION
On January 26, 2022, The Planning Commission held a meeting to consider amending the Gustine Zoning Code and Subdivision Code to authorize body art facilities in C-1 and C-2 Zones without a permit. The Planning Commission passed the recommendation with a 4-0 (Gandy- absent) vote to authorize and recommend approval to City Council.

On November 17, 2021, this Planning Commission considered a request from staff to allow operation of tattoo and other body art facilities in both the "C-1" (Downtown Commercial) and "C-2" (General Commercial) without requiring a use permit. After discussion with staff and the public, including consideration of a recent Supreme Court case prohibiting tattoo parlor establishments and associated conditional use permits, the Planning Commission advised staff to bring back a proposed ordinance amending Section 4-24-030 of the Gustine Zoning and Subdivision Code to authorize operation of tattoo and body art facilities without a use permit in both the C-1 and C-2 zones.

BACKGROUND/DISCUSSION
The Gustine Zoning and Subdivision Code defines tattoo/body art as a "Personal Service-Restricted," which is only allowed in the C-2 zone, and only with a use permit (Section 4-24-030). In 2010, the 9th Circuit Court of Appeal held that municipal prohibitions on the establishment of tattoo parlors is unconstitutional because tattoo/body art is a First Amendment protected form of expression. (Anderson v. City of Hermosa Beach (2010) 621 F3d 1051.) Accordingly, the City's requirement of a conditional use permit for such businesses is probably not legally defensible, because while the Anderson court did create a carve-out for reasonable "time, place, and manner" restrictions on tattoo parlors, it was clear that any action by a municipality that appeared to ban or unreasonably prohibit body art facilities outright. In other words, the City may determine the zone(s) where such businesses may operate, as long as it does not ban them altogether, and may place reasonable time, place, and manner restrictions on operations of such facilities.

At its October 27 meeting, the Planning Commission asked staff to research whether other cities in the County use Conditional Use Permits (CUP) for this purpose, to provide 28859.00009134534016.2
Commissioners a broader local perspective when recommending to the Council whether the City's Zoning Code should continue to require a CUP for body art establishments. Staff contacted the other cities in the County and spoke with staff there. The two largest nearby cities do not require CUP in either code or practice. Two others have codes that do not specifically call out body art facilities as requiring a CUP, but staff indicated internal procedure has resulted in them requiring a comparable permit in the past. The other City surveyed has a code that calls out the CUP requirement specifically, and City staff indicated that their procedure follows that code (i.e., CUPs are required).

Merced County currently requires body art practitioners to submit an annual registration form identifying the types of services offered, locations, and certain health information.

Otherwise, the Merced County Code sets certain fees for body art facilities (§ 9.49.010), and defines body art facilities as a "restricted personal service," needing to be dispersed from other similar uses in order to minimize adverse community effects. (§

18.200.160.) Accordingly, it is up to the City to determine in which zones it wishes to permit body art facilities, and what (if any) reasonable time, place, and manner restrictions to place upon such operations.

Rather than requiring a CUP for body art facilities to operate, which may be more susceptible to challenge in light of the Anderson court's cautionary statements, the Planning Commission can consider a recommendation that the City Council adopt the attached proposed ordinance permitting body art facilities in the C-1 and C-2 zones without a use permit restriction.

FISCAL IMPACT
None.

RECOMMENDATION
It is recommended that the Council introduce and waive the first reading of the attached proposed ordinance to permit tattoo/body art establishments in the C-l zone without a use permit and eliminate the requirement for a conditional use permit in the C-2 zone.

ORDINANCE NO. XXX

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GUSTINE AMENDING GUSTINE ZONING AND SUBDIVISION CODE SECTION 4-24-030 REGARDING

TATTOO AND BODY ART FACILITIES
WHEREAS, on September 9, 2010, the Ninth Circuit Court of Appeals issued a decision in Anderson v. City of Hermosa Beach holding that a municipal prohibition on the establishment of tattoo parlors is an unconstitutional restriction on freedom of expression; and
WHEREAS, AB 1168 was adopted by the State Legislature in 2013, and requires body art facilities to obtain local health permits, which are currently issued by the County of Merced; and
WHEREAS, AB 1168 also requires all body art services, including tattooing and piercing, to take place only at properly licensed permanent or temporary body art facilities; and
WHEREAS, Section 4-80-020 of the Gustine Zoning and Subdivision Code defines Personal Services - Restricted to include tattoo and body piercing services; and WHEREAS, Table 2-4 of Section 4-24-030 of the Gustine Zoning and Subdivision Code currently only authorizes Personal Services - Restricted uses in the "C-2" (General Commercial) commercial zone, and only with a use permit; and WHEREAS, at a public hearing of the Planning Commission duly noticed and held on January 26, 2022, the Planning Commission considered and took public testimony regarding this matter, and the Planning Commission has recommended approval of this Ordinance; and
WHEREAS, the City Council wishes to authorize the establishment of tattoo and body art facilities in the "C-I" (Downtown Commercial) district, as well as the C-2 district, as by-right uses without the need for a use permit by amending Table 2-4 of Section 4-24-030 of the Gustine Zoning and Subdivision Code to include Tattoo/Body Art Facilities as a permitted use in the C-1 and C-2 districts.

ITEM NO. 9

STIE CITY CALFON

COUNCIL AGENDA ITEM
FEBRUARY 15, 2022
PREPARED BY: Doug Dunford, City Manager
SUBJECT: Council to Consider Approving a Resolution to Oppose the "Tax Fairness, Transparency and Accountability Act"

BACKGROUND/DISCUSSION
In 2018, the "Tax Fairness, Transparency and Accountability Act" or (AG# 17-0050 Amdt. #1), was being circulated to qualify for the November 2018 ballot. This initiative would have drastically limited local revenue authority. Through the successful work and advocacy of the League of California Cities and its coalition, the measure's proponents withdrew the initiative from the ballot in June 2018.

On Jan. 4, 2022, the California Business Roundtable filed the Taxpayer Protection and Government Accountability Act or AG# 21-0042A1. This measure is far more detrimental to cities than the measure filed in 2018, because it would decimate vital local and state services to the benefit of wealthy corporations.

Cal Cities, along with a broad coalition of local governments, labor and public safety leaders, infrastructure advocates, and businesses, strongly oppose this initiative. This measure would limit voter input and disallow local voters from providing direction on how local tax dollars should be spent by prohibiting local advisory measures.

The standard may significantly restrict the amount oil companies, utilities, gas companies, railroads, garbage companies, cable companies, and other corporations pay for the use of local public property. Rental and sale of local government property must be "reasonable" which must be proved by "clear and convincing evidence."

FISCAL IMPACT
Unknown at this time.

RECOMMENDATION
Council consider approving a resolution opposing the "Tax Fairness, Transparency and Accountability Act".

EXHIBIT(S)
A) Resolution 2022 - XXXX
RESOLUTION NO. 2022-XX

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GUSTINE TO OPPOSE THE

TAX FAIRNESS, TRANSPARENCY AND ACCOUNTABILITY ACT
WHEREAS, an association representing California's wealthiest corporations is behind a deceptive proposition aimed for the November 2022 statewide ballot; and WHEREAS, the measure creates new constitutionál loopholes that allow corporations to pay far less than their fair share for the impacts they have on our communities, including local infrastructure, our environment, water quality, air quality, and natural resources; and
WHEREAS, the measure includes undemocratic provisions that would make it more difficult for local voters to pass measures needed to fund local services and infrastructure, and would limit voter input by prohibiting local advisory measures where voters provide direction on how they want their local tax dollars spent; and WHEREAS, the measure makes it much more difficult for state and local regulators to issue fines and levies on corporations that violate laws intended to protect our environment, public health and safety, and our neighborhoods; and WHEREAS, the measure puts billions of dollars currently dedicated to state and local services at risk, and could force cuts to public schools, fire and emergency response, law enforcement, public health, parks, libraries, affordable housing, services to support homeless residents, mental health services, and more; and WHEREAS, the measure would also reduce funding for critical infrastructure like streets and roads, public transportation, drinking water, new schools, sanitation, and utilities.

NOW, THEREFORE, BE IT RESOLVED that the City of Gustine, opposes Initiative 21- 0042A1, and will join the NO on Initiative 21-0042A1 coalition, a growing coalition of public safety, labor, local government, infrastructure advocates, and other organizations throughout the state.
