INCOR COUNCIL AGENDA ITEM
PORATED HOY, TAD•
MARCH 1, 2022
PREPARED BY: Tiffany Vitorino, Recreation Manager
SUBJECT: Request from Gustine Lions Club for permission to use Harry Schmidt Park baseball fields and vendor authorization

BACKGROUND/DISCUSSION
The Gustine Lions Club Easter Egg hunt has been a long-standing tradition for many years. Due to the pandemic the Lions put a hold on the hunt plans in order to keep the community sate. The free event has proven to be a great success in the past, with thousands of children enjoying the fun filled morning. Staff has been in contact with the Lions Club to bring back the "Annual Easter Egg Hunt". They would once again like to utilize the Harry Schmidt Park Baseball Fields and the surrounding area. The event will be held on the Saturday before Easter, which falls on April 16th.

The Easter Bunny will continue his long-standing tradition helping the Lions in hiding thousands of eggs in the surrounding area of the Schmidt Park baseball fields. Among those eggs will be prize-winning eggs, which the Lions Club provides Easter baskets and chocolate bunnies. The event will also have a visit from the Easter Bunny for photos and the community's enjoyment.

In celebration of the events return, the Lions Club would like to add additional attractions and include face painting, balloons, music, and a few vendors such as Kona Ice. The Lions are also discussing with Gustine Youth Baseball and Softball to sell Linguica sandwiches as a fundraiser for the youth baseball/softball.

According to the Gustine Municipal Code Section 5-6-3, mobile kitchen type vendors are only allowed in manufacturing districts, except otherwise by special permission of the City Council during festivals, parades and other public events. Staff will ensure that the vendors will have the appropriate city business license will ensure all proper health permits and business licenses are properly obtained and that Police and Public Works Personnel are assigned as needed.

FISCAL IMPACT
None.

RECOMMENDATION
For City Council to consider and approve the request from the Gustine Lions Club and allow access to the Harry Schmidt Park and baseball facilities and to consider approving the request to allowing mobile food vendors to participate.

COUNCIL AGENDA ITEM
StEL
MARCH 1, 2022
PREPARED BY: Doug Dunford, City Manager
SUBJECT: Adopt Resolution No. 2022-XXXX Authorizing the City Manager, or the Finance Officer as Designee,
the Fit to Cofficer as ence i to the Colore menti
of Resources Recycling and Recovery (CalRecycle).

BACKGROUND/DISCUSSION
CalRecycle, in consultation with the California Air Resources Board, has adopted regulatory requirements, consistent with the mandate of Senate Bill 1383 (Lara, 2016), that are designed to achieve the organic waste reduction goals established in Section 39730.6 of the Health and Safety Code through a 50% reduction by 2020 of the level of the statewide disposal of organic waste from the 2014 level and a 75% reduction by 2025.

Requirements of this regulation include: the diversion of Organics and recyclables from the solid waste stream in both the residential and commercial sectors, the implementation of an Edible Food Recovery Program, inspections of residential and commercial generators, and other related program activities. (More information is available at www.calrecycle.ca.gov/organics/sicp.)
CalRecycle will be reviewing jurisdictions' activities to ensure each jurisdiction throughout the State of California is meeting SB1383 compliance. CalRecycle will not be able to impose fines on jurisdictions until 2024; however, CalRecycle could impose fines retroactively if it is deemed that a jurisdiction had "violations" of SB1383 requirements during January 1, 2022, through December 31, 2023.

Through amendments to Section 42652.5 of the Public Resources Code, Senate Bill 619 (Laird, 2021) created a mechanism called a "Notification of Intent to Comply," through which a jurisdiction may secure administrative civil penalty relief from any continuing violations of the Regulations for the 2022 calendar year and may be eligible for a broader and longer-term regulatory compliance path, including suspended administrative civil penalties, through a corrective action plan.

The Resolution authorizes the submittal to CalRecycle of a "Notice of Intent to Comply" (NOIC) with SB 1383 regulations, along with any other related documents.

The NOIC will include an explanation of a change in collection services, and with the change in franchise haulers, a three-container collection service for solid waste, Organics and recycling will take place. Note: even though SB1383 targets the diversion of Organics from being landfilled, it also includes having the collection of recyclables to be diverted from being landfilled.

If the NOIC is approved by CalRecycle, the City of Gustine can implement the required programs (with the assistance of its franchise hauler) during 2022, without facing penalty for not doing so as of January 1, 2022.

FISCAL IMPACT
There are no foreseen fiscal impacts associated with the City Council authorizing the submittal of the attached Notice of Intent to Comply to CaRecycle. The authorization of doing so may offer relief from CalRecycle issuing fines to the City of Gustine regarding what CalRecycle may deem as "Violations to SB1383 Regulations" during calendar year 2022.

RECOMMENDATION
Adopt a resolution authorizing the City Manager to submit a Notice of Intent to Comply (NOIC) with SB 1383 requirements to the California Department of Resources Recycling and Recovery (CaRecycle).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GUSTINE

AUTHORIZING THE SUBMITTAL OF A NOTICE OF INTENT TO COMPLY WITH SB1383, AND ANY RELATED AUTHORIZATIONS, TO THE CALIFORNIA DEPARTMENT OF

RESOURCES RECYCLING AND RECOVERY (CALRECYCLE)
WHEREAS, CalRecycle, in consultation with the California Air Resources Board, has adopted regulatory requirements (Regulations), consistent with the mandate of Senate Bill 1383 (Lara, 2016), that are designed to achieve the organic waste reduction goals established in Section 39730.6 of the Health and Safety Code through a 50 percent reduction in the level of the statewide disposal of organic waste from the 2014 level by 2020 and a 75 percent reduction in the level of the statewide disposal of organic waste from the 2014 level by 2025.

CalRecycle is providing this optional form as a convenience to assist jurisdictions (counties, cities, a county and city, or special districts providing solid waste collection services) for purposes of submitting a notification of intent to comply to CalRecycle [see Public Resources Code (PRC) section 42652.5(c)].

A jurisdiction may submit a notification of intent to comply if it is facing continuing violations of the Short-lived Climate Pollutants: Organic Waste Reductions requirements in Title 14 California Code of Regulations (14 CCR). The written notification of intent to comply, adopted by resolution of the jurisdiction's governing body, shall be sent to CalRecycle no later than March 1, 2022, to [email protected].

A jurisdiction shall, at minimum, include the following in its notification:

1. A description, with specificity, of the continuing violations.

2. A detailed explanation of the reasons, supported by documentation, why the local jurisdiction is unable to comply.

3. A description of the impacts of the COVID-19 pandemic on compliance.

4. A description of the proposed actions the local jurisdiction will take to remedy the violations within the timelines established in 14 CCR section 18996.2 with a proposed schedule for doing so. The proposed actions shall be tailored to remedy the violations in a timely manner.

Upon approval by CalRecycle of a jurisdiction's notification and implementation of the intent to comply, a jurisdiction may be eligible for both of the following:

1. Administrative civil penalty relief for the 2022 calendar year pursuant to PRC section 42652.5(d).

2. A corrective action plan pursuant to 14 CCR section 18996.2. a. CalRecycle may address through a corrective action plan any violations disclosed in a jurisdiction's notification that will take more than 180 days to correct. In this situation, the proposed actions and schedule in the jurisdiction's approved notification will be in effect until a corrective action plan is issued.

CalRecycle will respond in writing to a jurisdiction within 45 business days of receiving its notification with an approval, disapproval, request for additional information, or timeline for a decision on approval or disapproval. CalRecycle will include details about why a jurisdiction did not meet the requirements for a Notification of Intent to Comply when disapproving the jurisdiction's notification.
