COUNCIL AGENDA ITEM
MARCH 15, 2022
PREPARED BY: Melanie Correa, Human Resources Director/Deputy City Clerk SUBJECT: CA Assembly Bill 361 and Findings - Continuance
BACKGROUND/DISCUSSION
At their regular meeting on November 2, 2021, Council approved a resolution to continue virtual and teleconference meeting parameters in accordance of AB361.
According to the bill, such determination must be revisited and determined every thirty (30) days thereafter.
AB 361 amends the Brown Act to allow local legislative bodies to continue mandating public attendance to public meetings in a virtual capacity. The allowance is contingent on the following conditions: that the state is under a gubernatorial "proclaimed state of emergency", and either (II) state or local officials have imposed or recommend measures that promote social distancing, or (2) the legislative body finds that meeting in person would present an imminent safety risk to attendees.
The proposed resolution continues Council's findings that the current declared state of emergency for the City is still in effect, and that in-person meetings would directly impact the ability of attendees to meet safely in person, or that County health officials continue to impose or recommend measures to promote social distancing.
If the Council Chambers were opened to public attendees, current OSHA requirements state that unvaccinated persons must wear a mask. In addition, staff would need to continue hosting meetings with the virtual component to accommodate anyone wishing to attend virtually due to concerns of COVID.
FISCAL IMPACT
There is no fiscal impact associated with this item.
RECOMMENDATION
City Council approve the resolution to continue in-person meetings in accordance to AB361 through the declared end of the City's state of emergency. This action will need to be revisited every 30 days, if approved.

SUBJECT: Council to Waive the Second Reading and Consider Adoption of an Amendment to Gustine Zoning and Subdivision Code to Authorize Body Art Facilities in C-1 and C-2 Zones without Use Permit
INTRODUCTION
Staff presented to Council this agenda item on February 15, 2022. Council introduced and waived the first reading with a 5-0 vote to make the necessary changes to the Gustine Zoning Code.
It should be noted that the proposed ordinance presented at the February 15, 2022 meeting did not fully encompass the recommendation of the Planning Commission due to a typographical error in Table 2-1. The attached proposed ordinance has been corrected to reflect the exact tables recommended by the Planning Commission. The error related to tattoo/body art facilities being permitted within only C-2 zones, as opposed to both C-1 and C-2 zones.
On January 26, 2022, The Planning Commission held a meeting to consider amending the Gustine Zoning Code and Subdivision Code to authorize body art facilities in C-1 and C-2 Zones without a permit. The Planning Commission passed the recommendation with a 4-0 (Gandy- absent) vote to authorize and recommend approval to City Council.
On November 17, 2021, this Planning Commission considered a request from staff to allow operation of tattoo and other body art facilities in both the "C-1" (Downtown Commercial) and "C-2" (General Commercial) without requiring a use permit. After discussion with staff and the public, including consideration of a recent Supreme Court case prohibiting tattoo parlor establishments and associated conditional use permits, the Planning Commission advised staff to bring back a proposed ordinance amending Section 4-24-030 of the Gustine Zoning and Subdivision Code to authorize operation of tattoo and body art facilities without a use permit in both the C-1 and C-2 zones.
BACKGROUND/DISCUSSION
The Gustine Zoning and Subdivision Code defines tattoo/body art as a "Personal Service-Restricted," which is only allowed in the C-2 zone, and only with a use permit (Section 4-24-030). In 2010, the 9ih Circuit Court of Appeal held that municipal prohibitions on the establishment of tattoo parlors is unconstitutional because tattoo/body art is a First Amendment protected form of expression. (Anderson v. City of Hermosa Beach (2010) 621 F3d 1051.) Accordingly, the City's requirement of a conditional use permit for such businesses is probably not legally defensible, because while the Anderson court did create a carve-out for reasonable "time, place, and manner" restrictions on tattoo parlors, it was clear that any action by a municipality that appeared to ban or unreasonably prohibit body art facilities outright. In other words, the City may determine the zone(s) where such businesses may operate, as long as it does not ban them altogether, and may place reasonable time, place, and manner restrictions on operations of such facilities.
At its October 27 meeting, the Planning Commission asked staff to research whether other cities in the County use Conditional Use Permits (CUP) for this purpose, to provide Commissioners a broader local perspective when recommending to the Council whether the City's Zoning Code should continue to require a CUP for body art establishments. Staff contacted the other cities in the County and spoke with staff there. The two largest nearby cities do not require CUP in either code or practice. Two others have codes that do not specifically call out body art facilities as requiring a CUP, but staff indicated internal procedure has resulted in them requiring a comparable permit in the past. The other City surveyed has a code that calls out the CUP requirement specifically, and City staff indicated that their procedure follows that code (i.e., CUPs are required).
Merced County currently requires body art practitioners to submit an annual registration form identifying the types of services offered, locations, and certain health information.
Otherwise, the Merced County Code sets certain fees for body art facilities (§ 9.49.010), and defines body art facilities as a "restricted personal service," needing to be dispersed from other similar uses in order to minimize adverse community effects. (§
18.200.160.) Accordingly, it is up to the City to determine in which zones it wishes to permit body art facilities, and what (if any) reasonable time, place, and manner restrictions to place upon such operations.
Rather than requiring a CUP for body art facilities to operate, which may be more susceptible to challenge in light of the Anderson court's cautionary statements, the Planning Commission can consider a recommendation that the City Council adopt the attached proposed ordinance permitting body art facilities in the C-1 and C-2 zones without a use permit restriction.
FISCAL IMPACT
None.
RECOMMENDATION
It is recommended that the Council introduce and waive the first reading of the attached proposed ordinance to permit tattoo/body art establishments in the C-l zone without a use permit and eliminate the requirement for a conditional use permit in the C-2 zone.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GUSTINE AMENDING GUSTINE ZONING AND SUBDIVISION CODE SECTION 4-24-030 REGARDING
TATTOO AND BODY ART FACILITIES
WHEREAS, on September 9, 2010, the Ninth Circuit Court of Appeals issued a decision in Anderson v. City of Hermosa Beach holding that a municipal prohibition on the establishment of tattoo parlors is an unconstitutional restriction on freedom of expression; and
WHEREAS, AB 1168 was adopted by the State Legislature in 2013, and requires body art facilities to obtain local health permits, which are currently issued by the County of Merced; and
WHEREAS, AB 1168 also requires all body art services, including tattooing and piercing, to take place only at properly licensed permanent or temporary body art facilities; and
WHEREAS, Section 4-80-020 of the Gustine Zoning and Subdivision Code defines Personal Services - Restricted to include tattoo and body piercing services; and WHEREAS, Table 2-4 of Section 4-24-030 of the Gustine Zoning and Subdivision Code currently only authorizes Personal Services - Restricted uses in the "C-2" (General Commercial) commercial zone, and only with a use permit; and WHEREAS, at a public hearing of the Planning Commission duly noticed and held on January 26, 2022, the Planning Commission considered and took public testimony regarding this matter, and the Planning Commission has recommended approval of this Ordinance; and
WHEREAS, the City Council wishes to authorize the establishment of tattoo and body art facilities in the "C-l" (Downtown Commercial) district, as well as the C-2 district, as by-right uses without the need for a use permit by amending Table 2-4 of Section 4-24-030 of the Gustine Zoning and Subdivision Code to include Tattoo/Body Art Facilities as a permitted use in the C-1 and C-2 districts.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Gustine:

COUNCIL AGENDA ITEM
MARCH 15, 2022
PREPARED BY: Doug Dunford, City Manager
Ann Siprelle, City Attorney
SUBJECT: Waive the Second Reading and Consider Adoption of an Ordinance Updating Various Sections of the Gustine Municipal Code Regarding Family Day Care Homes, Residential Care Facilities, and Transitional and Supportive Housing
BACKGROUND:
Staff brought this before the Council on February 15, 2022. Council waived the first reading with a 5-0 vote. On January 26, 2022, the Planning Commission held a meeting to consider updating the Gustine Municipal Code regarding Family Day Care Homes, Residential Care Facilities and Transitional and Supportive Housing. The Planning Commission passed the recommendation with a 4-0 (Gandy- absent) vote to authorize and recommend approval to City Council.
In recent years, the State of California has preempted local regulation of certain residential uses, including family day care homes, residential care facilities, and transitional and supportive housing. The proposed ordinance (Attachment 2) amends various provisions of the Gustine Municipal Code ("GMC") to increase clarity and ensure compliance with changes in State law.
DISCUSSION:
The ordinance's amendments to the GMC include, but are not limited to:
• Updating the City's definitions for "supportive housing" and "transitional housing" to have the same meaning as defined under State law (reflected in GMC, § 4-80- 020).
• Clarifying that transitional housing and supportive housing are considered residential uses of property and subject to those restrictions that apply to other residential dwellings of the same type in the same zone as required under State law (reflected in GMC, § 4-44-190(A)).
• Clarifying that supportive housing is a use by right in all zones where multifamily and mixed uses are permitted as required under State law (reflected in GMC, § 4- 44-190(B)).
• Updating the City's "adult day care," "residential care facility" ("RCF") and "residential care facility for the elderly" ("RCFE") definitions to have the same meaning-and use the same terminology-as provided under State law (reflected in GMC, § 4-80-020). For example, adult day cares and RCFs are now covered by the definition for "Community Care Facility" (which is a defined term under State law that encompasses RCFs and adult day cares).
• Reorganizing and updating GMC Section 4-22-030's Table 2.1 (Allowed Land Uses and Permit Requirements for Residential Zoning Districts) to regulate small and large family day care homes, as well as RCEs and Community Care Facilities (which include adult day cares and RCFs) in accordance with State law. • Revising Table 3-7 of GMC Section 4-36-040 to delete the reference to special parking requirements for large family day care homes, as state law now provides that large family day care homes must be treated identically to small family day care homes (and that both must be treated as by right residential uses). • Revising GMC Section 4-44-040 (Child Day Care Facilities) to clarify that child day care centers are separately defined and regulated from small and large family day care homes.
For reference, a redline displaying this ordinance's amendments to the GMC is attached as Attachment 3.
California Environmental Quality Act
This proposed ordinance has been assessed in accordance with the authority and criteria contained in the California Environmental Quality Act ("CEQA"), the State and local CEQA Guidelines, and the environmental regulations of the City. Staffs' recommended Planning Commission action is a recommendation that the City Council find that the ordinance is not subject to CEQA pursuant to Sections 15060(c) (2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c) (3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly.
FISCAL IMPACT:
None.
RECOMMENDATION:
It is recommended that the Council waive the second reading and adopt the ordinance updating various sections of the Gustine Municipal Code regarding Family Day Care Homes, Residential Care Facilities and Transitional and Supportive Housing.

ITEM NO. 8
COUNCIL AGENDA ITEM
MARCH 15, 2022
PREPARED BY: Jami Westervelt, Economic and Community Development Director SUBJECT: Consider Request for Fee Waiver for use of City Facilities for 2022 Gustine Summer Camp for Youth
BACKGROUND/DISCUSSION
Ine City of Gustine started its summer youth program to provide a positive experience tor school-aged youth over the summer. Over many successful seasons, the Y-LEAD program provided programming that reinforced self-esteem for children, encouraged them to lead and participate in civic activities, and provided a structured setting to be active outside and spend time with other youth over the summer.
Some of the general elements of the program over the years:
• Began programming for students a week after Gustine Unified School District ended for the summer and ended a week prior to the new school year. • Core programming for youth (going into) fourth through eighth grades. • Provided small group as well as program-wide activities. • Accepted up to 100 students per summer.
• The City employed paid group Captains, generally college-aged adults from the area, selecting them through a competitive recruitment process. • High-school-age teens could volunteer to assist the paid group leaders as Junior Captains. This provided additional leadership skills and experience useful for those intending to apply for paid positions in later years.
The program evolved over time. At its height, Y-LEAD had a waiting list as it exceeded its available youth slots. Most recently, the program had available slots within the 100.
With the onset of COVID, the City had to forgo offering the program. During this time, staff discussed the hope to bring back the program and used the break to think about how to improve and expand while retaining the core tenets of the program. Expanding the curriculum came up as one priority and staff began researching curriculum options.
Staff found an impressive and comprehensive curriculum that the Boys and Girls Club (BGC) of America uses in its youth camps and contacted the Merced County office to discuss. City staff also contacted Gustine Unified School District (GUSD), initially to make them aware, gather input and discuss facilities. Staff found both excited to collaborate with the City to both benefit area youth as well as to meet their program goals.
Through several meetings, a program outline has emerged that will provide an expanded, all-day, program to the youth of Gustine without additional costs to the City.
The attached sheet provides an outline of the program as currently proposed.
BGC will build upon the former youth program and add to the experiences by providing a full day of varied activities and adding a camp in Santa Nella. BGC has also suggested a work-training program for high-school teens to provide paid employment opportunities for this age group. BGC has worked on this component with Merced County WorkNet in recent weeks and will finalize details in coming weeks.
The BGC of Merced County has offered to run the camp, implementing a dynamic and tested curriculum. They will handle all the personnel aspects of the program including hiring, background-check, training and supervising all employees. They will also administer the program, developing the budget, purchasing the materials and implementing the services to youth on a daily basis.
GUSD has offered to provide the funding to BGC needed to complete the portions above and all the other hard costs related to the program-through a Memorandum of Understanding between the two being developed. The District will also provide use of Gustine High School for half the day for programming. GUSD will also provide several meals throughout the day for participants through its summer nutrition program.
GUSD has the funding needed for this year and potentially future years. If GUSD does not have funding in future years, the City, BGC and GUSD will have data and participation rates from this year that are very helpful to include in funding applications that the three can collaborate on for the future.
The City program included time in all the Henry Miller Park facilities including the park grounds, gazebo, library community room and pool. The pool was very popular with youth and the group swam as frequently as weekly in years past.
Staff recommends the City provide those same facilities to the new program as in-kind contributions, waiving all fees related to use:
• Henry Miller Park Facilities in the morning for the full summer program (including grounds, gazebo and Rotary shelter area.
• Gustine Library Community Room for the full summer program for storage and as necessary for program meetings (allowing use by service groups already scheduled in the facility at this time).
• City pool at least once weekly for the program, to include providing lifeguards.
City staff will work closely with BGC to schedule these facilities. Since BGC will be the entity legally responsible for the activities and the employees, the Council needs to approve a fee waiver for facility use to BGC to provide the programming. BGC will provide insurance coverage naming the City.
All partners will promote this program. BGC will handle registration, including coming down to City Hall and holding an evening registration event. GUSD will promote the program to parents through direct communications with parents. The City will promote the program to the community through its outlets, including social media and marquee.
FISCAL IMPACT
The City will provide in-kind support through facilities use and waiver of fees, all of which the City incurred with its prior summer youth program. The City will save upon all other costs related to running the former program, paid previously from the Utility User Fund.
RECOMMENDATION
City Council consider a motion to approve the program concept, partner with the supporting agencies and waive all facility use fees for Boys and Girls Club (BGC) of Merced County related to the summer youth camp.

SUBJECT: Consider Authorizing Expenditure for Replacement of Fire Hydrant on 697 West Avenue Project and To Authorize the City Manager to Enter Into Contract
BACKGROUND/DISCUSSION
Staff has solicited quotes to replace a faulty fire hydrant located in 697 West Avenue.
This fire hydrant main line runs through an existing storm drain, making this replacement more extensive than the average hydrant replacement. The contractor will be excavating two different locations and a new water line will be installed under the existing storm drain, lastly implementing the new hydrant (wet barrel).
The project consists of:
• Full road closures on the affected area of West Avenue. • Provide excavation and backfill for pipeline modification and hydrant replacement.
• Remove existing TEE from 8' line in West Ave and replace with new TEE to new fire hydrant location and new turn shut off valve for HWY 33. • Remove and seal off the existing hydrant and 6" line inside the adjacent storm drain.
Staff solicited bids from applicable contractors in the beginning of February, and received a total of two (2) proposals by the end of business on March 1, 2022. The quotes received were:
CONTRACTOR TOTAL BID
R.L. Friend Construction $ 28,171.00
Conco West Inc. $ 35,900.00
Rolfe Construction $ No Quote
FISCAL IMPACT
The project will be funded from the water fund.
RECOMMENDATION
Staff recommends that the City Council consider authorizing an expenditure in the amount of $29,171 to replace the faulty fire hydrant located at 697 West Avenue, along with the remedial work required at this hydrant location, and authorize the City Manager to enter into contract for said work.

COUNCIL AGENDA ITEM
MARCH 15, 2022
PREPARED BY: Jesus Jr Chavez, Public Works Manager
SUBJECT: Consider Expenditure for a Sand Filter for Well #7 and to Authorize the City Manager to Enter into Contract
BACKGROUND/DISCUSSION
Well #7 is the City's newest water well. Staff has noticed a significant sand problem at this well site. This well upon initial start-up, pumps for 25 minutes to clear all the sand out of the system. Staff reached out to Foster's Pumps as they have previously worked on this pump and are familiar with the well. Staff asked for a proposal on installing a sand filter to remove the excess sand from the water before being pushed out to our water distribution system. In an effort to reduce or eliminate excess sand, this well has been air lifted before, well casings replaced and even new water screens. Our next step in trying to mitigate the sand issues is to install a sand separator.
The project consists of labor and materials to install the following:
New 6" Lakos Sand Separator
• Install turn off valve in the road
• Plumb filter to discharge line with steel pipe and paint • Wire in purge valve
• Plumb to floor drain
• Terminate, test and energize pump
The proposal received totals $25,279.30
FISCAL IMPACT
The project will be funded by the use of Water Funds.
RECOMMENDATION
Staff recommends that the City Council authorize an expenditure for work necessary to install a sand separator at Well #7, and authorize the City Manager to enter into contract for said work.

COUNCIL AGENDA ITEM
MARCH 15, 2022
PREPARED BY: Jesus Jr Chavez, Public Works Manager
SUBJECT: Consider Approving Expenditure for Gustine Museum Window Restoration and to Authorize the City Manager to Enter Into Contract
BACKGROUND/DISCUSSION
At the direction of Council, staff conducted an exhaustive search for contractors to quote restoring the Gustine Museum windows. Staff was happy to receive three quotes for project. The project entails both a wood frame and glass window component, which proved difficult to obtain quotes from companies willing to quote both aspects of the project. You will notice that one quote received only quotes the glass window component, not the wood frames. Because of the difficult nature in obtaining any quotes for this project, staff included it as reference for Council. Staff is seeking to maintain the historical aesthetic of the existing windows so as to not compromise the overall aesthetic of the museum.
The project consists of cutting the existing bars and installing plates so the bars are removable. Removing and replacing 3-30"x60" windows and replacing wood frames, adding paint and stain to all new windows and paint to the exterior of all other windows.
Staff solicited bids from applicable contractors in November 2021, and received a total of three (3) proposals by the end of business on February 15, 2022. The quotes received were:
CONTRACTOR TOTAL BID
CV Construction Pro's (wood and glass) $ 12,480.00
Les Warkentin Construction (wood and glass) $ 15,470.00 Everything Glass & Mirror (glass only) $ 10,300.00
FISCAL IMPACT
Staff is recommending that Council consider the use of User Utility Tax (UUT) funding for this project.
RECOMMENDATION
Staff recommends that the City Council consider approving an expenditure for restoring the Gustine Museum windows, and authorizing the City Manager to enter into contract for said work.

COUNCIL AGENDA ITEM
March 15, 2022
PREPARED BY: Jesus Jr Chavez, Public Works Manager
SUBJECT: City Council to consider Authoring the Purchase of a 36" Roller and authorizing the City Manager to Execute Purchase Documents
BACKGROUND/DISCUSSION
Staff is requesting Council consider approving the purchase of a Ride-on Roller to allow for staff to improve city roads, in addition to allowing staff to apply disintegrated granite (DG) around tennis courts and other locations around town. Having this roller in the long run will save the city money on road repairs and other improvements that city staff can perform in-house.
As a member of Sourcewell Cooperative Purchasing, staff will save time and money by combining the buying power of more than 50,000 governments, education, and nonprofit organizations. Sourcewell holds hundreds of competitively solicited contracts ready for use. Staff inquired for information on 36" ride-on rollers, and was provided a quote from MQ Multiquip, which totaled $18,703.00. As Sourcewell Cooperative Purchasing is a government purchasing tool, the quote is guaranteed to be the lowest quote available.
FISCAL IMPACT
The project will be funded with a 50/50 split between the Water and Wastewater Funds.
RECOMMENDATION
Staff recommends that the City Council authorize the purchase of a 36" Ride-On Roller and authorize the City Manager to execute any purchase documents.

COUNCIL AGENDA ITEM
MARCH 15, 2022
PREPARED By: Jesus Jr Chavez, Public Works Manager
SUBJECT: Consider Expenditure for the Addition of SCADA Controls for Both Sanitary Sewer Lift Stations and to Authorize the City Manager to Enter Into Contract
BACKGROUND/DISCUSSION
The City of Gustine operates wastewater utilities that serve the City residents with vita services. To monitor and control these systems the City relies on a float system to determine sewer level and a red light as an alarm. This system is extremely outdated and not reliable. In the past, staff has relied on hopes that a resident call and let staff know that the red light is on, during times when staff is not present.
Staff is recommending that the City integrate into the existing lift station, new lift station control panels and add level transducers into our existing City Supervisory Control and Data Acquisition Control System (SCADA). We currently have SCADA controlling our water wells and this system is linked via WiFi into the City's computer system. This system allows staff to view on one screen all water levels and pressure of our drinking water system and amperage. With the addition of the SCADA for the lift stations, staff will have audible alarms alerting them to respond to correct an issue.
Staff will install new 20'-30' antenna at each lift station to save on costs and for better reception of the signals to the City system.
ControlPoint Engineering completed the previous SCADA installation on the City's drinking water wells. Due to the availability of expansion of the current system, and ControlPoint Engineering's familiarity with City facilities, staff contacted ControlPoint for a proposal for the expansion. ControlPoint provided a proposal and assured staff that the project would be completed in a timely manner. The proposal from ControlPoint Engineering totals $54,600.00.
FISCAL IMPACT
The project will be funded through the use of Wastewater Funds.
RECOMMENDATION
Staff recommends that the City Council approve an expenditure in the amount of $54,600.00 to integrate SCADA control for the Sanitary Sewer Lift Station and authorize the City Manager to enter into contract for said work.

• Large memory (10 KB user program with 10 KB user data) to solve a variety of applications.
• True online editing allows tuning of program, including PID, without going offline. • Support for MicroLogix 1400 controller online editing in RSLogix 500 Professional, Standard, and Starter software version 8.1 and later, as well as RSLogix Micro. • Mode switch for Run/Remote/Program through LCD keypad operation. • Time-based or event-triggered data logging capability stores controller data records with optional time stamp in a separate 128 Kbyte memory area for later analysis (for example, trending and I/0 status during alarm condition data). • Recipe storage (up to 64 KB that is deducted from Data Logging memory) that is accessible by your ladder program, enabling quick and easy batch changes of program data for timers, counters, and other data types. • High performance expansion I/0 options (up to seven 1762 l/0 modules, in any combination).
• Twelve high-speed inputs (except 1766-L32AWA and 1766-L32AWAA controllers) that can be used individually as latching (pulse-catch) inputs, event interrupts, or alternately combined as three 100 kHz high-speed counters featuring 10 modes of operation.
• Two available built-in O... 10V DC analog outputs (for controllers with analog I/0 options) with 12-bit resolution (not isolated).
• Three high-speed outputs that can be configured as 100 kHz pulse train output (PTO) or 40 kHz as pulse width modulated (PWM) outputs (only on 1766-L32BXB and 1766-L32BXBA controllers).
• Multiple input commons let you use the controller for either sinking or sourcing input devices, and multiple output commons provide individual isolation in multi-voltage output applications.
• One, 1 ms, selectable timed interrupt (STI).
• High-resolution, 1 ms timers.
• Communication Channel 0 provides isolated RS-232 or RS-485 electrical compatibility (selectable through the choice of communication cables). • Through RS-232, we support all serial protocols.
• Through RS-485, we support direct interface to DH-485, DF1 half-duplex master/slave, ASCII, and Modbus RTU master/slave networks, DNP 3 slave using the 1763-NC interface (1761-NET-AIC interface is not required). • Communication Channel 1 consists of an embedded RJ45 port that supports EtherNet/IP, Modbus TCP/IP and DNP3 over IP. This 10/100 Mbps port supports BOOTP and DHCP.
• Communication channel 2 provides a 9-pin, non-isolated RS-232 port supporting all serial protocols.
• Communication toggle selection that allows the controller's Channel 0 port to toggle between user-configured communication parameters and factory default settings for an easy way to switch from Modbus RTU or ASCli protocols (which do not support programming) to DF1 full-duplex (to upload/download, monitor, or edit your program).
So a programming computer is able to connect to a controller with an unknown or incorrect communication-parameter settings for troubleshooting. • Embedded real-time clock.
• Embedded web server with email functionality.

LIft STatIon LeveL TRansMITTER LEVELRAT
NON-FOULING DESIGN FOR WASTEWATER APPLICATIONS
Specifically designed for extended service in sewage lift station environments, the LevelRat by KELLER America features a wide sensing diaphragm yet small overall size. Unlike competing models which feature a fragile Teflon®-coated rubber dia- phragm, the LevelRat incorporates a monolithic diaphragm which combines the non- stick quality of Teflon with superior toughness and abrasion resistance.
The LevelRat utilizes proven piezoresistive silicon measurement technology com- bined with KELLER's state-of-the-art, microprocessor-based signal conditioning TYPE: LawniRal circuitry to provide outstanding accuracy and reliability over a wide compensated PNE: 102201007.08:907.13 temperature range.
Perfectly suited for pump control applications, the LevelRat is compatible with any standard 2-wire, 4...20 mA current loop or 3-wire voltage systems. The RS485 inter- CLUCIN face allows users to scale the analog output to any desired range within the standard pressure range. The LevelRat is typically suspended into the liquid by a standard PE-jacketed cable that is both self-supporting and vented. Optional Hytrel or Tef- zel-jacketed cables are available, should the installation require greater protection against chemical interaction.

THE CITY CALIFORN
COUNCIL AGENDA ITEM
MARCH 15, 2021
PREPARED BY: Doug Dunford, City Manager
SUBJECT: Discussion and Direction on the Goman Center North Parking Lot Project
BACKGROUND/DISCUSSION
Staff presented to Council at the October 3, 2021 meeting a proposal to partner with the Lion's Club to help expand the parking lot area on the north side of the Goman Center.
The original project was proposed by the Lion's Club to expend $27,000 to install a parking lot area on the north side of the Goman Center. Staff believed that the City could add additional area by partnering with the Lion's Club. The original amount presented to the Council was approximately $15,000 to add the additional concrete.
However, due to a number of factors, the project has been delayed and is now ready to move forward. The caveat is that the price of concrete has increased significantly.
The original price of $15,000 has now ballooned to $47,500. This is for the exact same project parameters.
Staff is asking Council for direction on whether to proceed as planned or alter the plans and reduce the concrete footprint. This project will be paid for through the use of UUT funding.
FISCAL IMPACT
The fiscal impact would be $47,500 debited from the UUT fund.
RECOMMENDATION
Staff is asking Council for direction on proceeding with the project or altering the plans for the Goman Center North Parking Lot Project.

CITY COUNCIL AGENDA ITEM
MARCH 15, 2022
PREPARED BY: Jami Westervelt, Airport Manager
SUBJECT: Approve Bipartisan Infrastructure Law (BIL) and Airport Capital Improvement Program (ACIP) for submission to FAA
BACKGROUND/DISCUSSION:
At the end of 2022, a Bipartisan Infrastructure Law (BIL) passed that provided new funding to airports that the Federal Aviation Administration (FAA) will administer. The BIL is in addition to existing FAA programs, including the Capital Improvement Program. The funding came down to FAA quickly without additional staffing to FAA to administer the program and without full details. Information has trickled down as FAA works through the important details about this new funding, including project eligibility.
FAA recently provided additional information but also put in place some tight timelines for each airport to submit, by March 31, initial plans to spend these funds. The following summarizes the information FAA staff provided in response to questions from Gustine staff and through the most recent discussions between the two:
• The law calls for annual funding for four years.
• Gustine Airport (and similar small airports) should receive $110,000 per fiscal year. • For projects over $110,000, the airport could "roll over" the money if funding a larger project with a second year of funding.
• The funding for BIL generally mirrors allowable uses under the FAA Airport Capital Improvement Program (CIP).
• Funding cannot go toward Gustine Airport hangars.
While similar uses apply for both types of funding, airports cannot split projects between the two sources.
While FAA uses allowable CIP projects as general guidance, FAA staff states that the law may also fund some additional projects the CIP does not. Gustine staff specifically asked the FAA if it could use BIL funds to pay for runway lights and a new fuel pump at the airport.
The airport lights recently broke and, as the repair will replace many components for the lights, staff recommends exploring converting the lights to energy-efficient and cost- saving LED while repairing them. FAA staff stated the City could use BIL to fix the runway lights and likely to replace them with energy-efficient LED as well.
Regarding the fuel pump, FAA states that it appears likely airports may be able to use BIL for fuel pumps but cannot provide absolute confirmation at this time and does not expect to be able to provide that prior to the March 31 deadline to submit the initial BIL estimates to FAA. However, FAA staff indicated support for Gustine submitting the fuel pump if it would like to do that project, with the understanding the City would have opportunity to replace projects in the list later if it was ultimately disallowed by FAA.
Finally, staff asked FAA about planning, such as the Master Plan for the airport. BIL can fund a Master Plan update, as can the ACIP. The current ACIP list for Gustine airport (attached for your reference) has an Airport Layout Plan with Aeronautical Survey slated for 2022. The current ACIP submission does not call for a Master Plan update within the next five years.
The FAA funds Master Plans for specific reasons including changes in airport activity or related activity, such as planned development not depicted in the existing Master Plan.
FAA advises airports to allow at least 18 months for the actual work on their Master Plans and advises limiting other project work during the Master Plan process. The direction underscores that Master Plans are costly, time-consuming investments that the FAA likely does not intend to fund for any jurisdiction on a frequent basis.
Therefore, in considering when to request instituting such a planning process, airports should consider major changes that would necessitate a Master Plan update. Staff recognizes that significant factors triggering a Master Plan may occur related to Gustine Airport within the timeframe of the BIL funding. Therefore, staff recommends listing the Airport Master Plan in the last years of the BIL.
Attached you will find an updated sheet for capital projects, incorporating anticipated use of BIL funds and AIP entitlement, as FAA recently requested. The sheet features an approach aimed at using BIL to fund pressing needs not routinely funded through ACIP, while continuing to move forward with important projects listed on the ACIP The figures for BIL are solely for estimation purposes and may come back higher than listed. FAA staff has repeatedly stated that FAA will provide for estimate and timing changes to these plans as BIL program moves forward, as it does for the ACIP program.
The Airport Commission will have discussed this item on Monday, March 14 and staff will report that feedback at the Council meeting.
RECOMMENDATION:
Staff recommends the Council consider approving the attached funding sheet showing the BIL and ACIP, for staff submittal this month as requested by FAA.
