There will also be several contests for the participants and sponsors throughout the event.

Staff would like to include various types of vendors including a few food vendors who have expressed interest in participating. Once approved, staff is hoping the advertising of the vendors along with the promotion of the event will encourage community participation and to join in the events return. COUNCIL AGENDA ITEM
APRIL 5, 2022
PREPARED BY: Ruben Chavez, Chief of Police
SUBJECT: Approve Request from Tip Top Farms to Close 3rd Ave between 4'h Street (Hwy 33) and 5th Street to host Special Event and Open House

BACKGROUND/DISCUSSION
Staff has received a request from Tip Top Farms to host a Special Event and Barbeque on Wednesday, April 20, 2022 also referred to as "420". The date April 20th is significant to those in the cannabis industry as it marked the legalization of cannabis through the passage Senate Bill 420 in 2003. This bill authorized those with a medical need to consume cannabis which has since additionally become legalized for recreational use.

The business wishes to host an event to celebrate the date as well as showcase the dispensary and all it has to offer customers. Tip Top Farms respectfully requests the closure of 3rd Ave between 4'h St. and 5'h St. similar to when other large events on 5th St., however would only use a section of 3rd Ave of about 200 feet in length from the Highway (4'h Street) to the alley on 3rd Ave. The closure would be from 11:00 am to 7:00 pm. This would allow them to host a barbeque and gathering in the space. City Council authorization is necessary, as the request requires the use and closure of City Streets and the use of City Personnel.

The adjacent businesses, which may be impacted by the street closure, have been contacted and support the event. These include 33 Market and Parreira's Auto Repair.

The restaurant, RJ's, is no longer in business and there are currently no tenants for the location. In addition, the owner, Robert Villalobos has obtained signed waivers expressing their support of the special event and that the event would not impact their business. Mr. Villalobos further promoted the benefit to the local restaurants who may see an increase in customers during the event.

Similar to other closures and special events, this would require Public Works dropping off approximately 8 barricades on 3rd Ave and have two Police Reserve Officers staff the event through the duration.

Tip Top Farms would like to have several food vendors and would like Council's authorization to allow these vendors at the event. According to the Gustine Municipal Code Section 5-6-3, mobile kitchen type vendors are only allowed in manufacturing districts, except otherwise by special permission of the City Council during festivals, parades and other public events. If approved, these vendors will be responsible to obtain the necessary business license with the City and with the guidance of the Recreation Manager, the owner of Tip Top Farms, will be submitting the proper paperwork to Merced County Environmental Health Department to obtain the appropriate health permits.

FISCAL IMPACT

1. Public Works Manager, Jesus Chavez, estimated that barricade placement and retrieval would require one labor hour. The projected labor cost was set at $50.00.

2. Additional Police staffing will be required to provide security at this event. The two Reserve Police Officers at 8 hours for a total of 16 hours at $50/hour. The total would be $800.

3. Total cost to the City (Public Works and additional Police Staffing) is $850.00.

4. Robert Villalobos is aware of the estimated labor cost.

RECOMMENDATION
Approve the request from Tip Top Farms to close a 200-foot section of 3rd Ave between 4th Street and 5th Street to host the special event.
