JUNE 30, 2022
PREPARED BY: Jas Birring, Finance Director
SUBJECT: Approve a Resolution Establishing an Appropriations Limit and Certifying the Population Estimate for Fiscal Year 2022/23
BACKGROUND/DISCUSSION
Article XIII (B) of the California Constitution Section 7910 of the Government Code provides that each year the Governing body shall, by resolution, establish the Appropriations Limit and certify the population estimate for the City for the fiscal year at a regularly scheduled meeting or noticed special meeting.
The Appropriations Limit is based on actual appropriations during the base year (1986- 87) and increases each year using specified growth factors. The Appropriations Limit applies only to those revenues defined as "proceeds of taxes", so operating within the Limit has not been problematic for the City in years past and should not be for FY 2022/23.
It is important to note that the Department of Finance, (DOF), shows a decrease to the overall population for the City. The calculated appropriations limit this year (attached).
The population number provided by DOF for Jan. 1, 2022 is 5,981.

OFFICE OF THE DIRECTOR
May 2022
Dear Fiscal Officer:
Subject: Price Factor and Population Information
Appropriations Limit
California Revenue and Taxation Code section 2227 requires the Department of Finance to transmit an estimate of the percentage change in population to local governments. Each local jurisdiction must use their percentage change in population factor for January 1, 2022, in conjunction with a change in the cost of living, or price factor, to calculate their appropriations limit for fiscal year 2022-23. Attachment A provides the change in California's per capita personal income and an example for utilizing the price factor and population percentage change factor to calculate the 2022-23 appropriations limit. Attachment B provides the city and unincorporated county population percentage change. Attachment C provides the population percentage change for counties and their summed incorporated areas. The population percentage change data excludes federal and state institutionalized populations and military populations.
Population Percent Change for Special Districts
Some special districts must establish an annual appropriations limit. California Revenue and Taxation Code section 2228 provides additional information regarding the appropriations limit.
Article XIII B, section 9(C) of the California Constitution exempts certain special districts from the appropriations limit calculation mandate. The code section and the California Constitution can be accessed at the following website: http://leginfo.legislature.ca.gov/faces/codes.xhtml.
Special districts required by law to calculate their appropriations limit must present the calculation as part of their annual audit. Any questions special districts have on this requirement should be directed to their county, district legal counsel, or the law itself. No state agency reviews the local appropriations limits.
Population Certification
The population certification program applies only to cities and counties. California Revenue and Taxation Code section 11005.6 mandates Finance to automatically certify any population estimate that exceeds the current certified population with the State Controller's Office. Finance will certify the higher estimate to the State Controller by June 1, 2022 Please Note: The prior year's city population estimates may be revised. The per capita personal income change is based on historical data.
If you have any questions regarding this data, please contact the Demographic Research Unit at (916) 323-4086.

COUNCIL AGENDA ITEM
JUNE 30, 2022
PREPARED BY: Ann Siprelle, City Attorney
SUBJECT: Public Hearing and Resolution Regarding Proposed Increases to Solid Waste Collection Rates Effective July 1, 2022
BACKGROUND
The SB 1383 Regulations, which took effect January 1, 2022, require the City to provide organic waste collection services for residential and commercial customers. The City of Gustine recently entered into an exclusive franchise agreement with Mid-Valley Disposal, LLC, for the collection and handling of solid waste, including garbage, green waste, recycling, and additional services.
ANALYSIS:
Rate Increases
Exhibit A to the resolution includes the proposed solid waste rates that reflect the cost for the City's new solid waste hauler, Mid-Valley Disposal, LLC to provide solid waste collection services pursuant to the new franchise agreement. Mid-Valley Disposal, LLC will be providing organic waste collection services to meet new state mandates under the SB 1383 Regulations. The proposed rate increases will take effect July 1, 2022, if there is no majority protest and the City Council approves the resolution.
In addition to the new rates effective July 1, 2022, the rates would be adjusted for inflation and changes in tipping fees passed through by Merced County. For the fiscal year beginning July 1, 2023, and annually thereafter on July 1 through and including July 1, 2027, the following adjustments would be made to the rates:
• The service component of the maximum rates provided in Exhibit A to the resolution will be automatically adjusted based upon the annual percentage change in the Consumer Price Index (CPI), All Urban Consumers, All Items, for the San Francisco-Oakland-Hayward, CA Metropolitan Area, as determined by the United States Department of Labor Statistics.
• The disposal component of the maximum rates provided in Exhibit A to the resolution shall be automatically adjusted based on any changes to the tipping fee passed through by Merced County for the disposal of City waste.
Both adjustments will each be capped at 15%, each year. Notice of rate increases (for the two adjustments) must be provided by mail to property owners and solid waste customers at least 30 days before the rate increases take effect (i.e., at least 30 days before July 1) for each of the five years (in 2023-2027).
Public Hearing
The City mailed a notice of the public hearing on the proposed solid waste rate increases to property owners and customers of record informing them of the public hearing at least 45 days before the public hearing in accordance with Proposition 218.
Between May 10, 2022 to June 28, 2022 the City received 5 valid written protests. Written protests may be received up until the date of the hearing and a total number will be provided orally at the meeting. If written protests against the proposed rate increases are presented by a majority, or 50 percent plus 1, of the property owners of the identified parcels upon which the rates are proposed to be imposed and tenants directly responsible for the payment of the solid waste service fees, the City Council cannot adopt the rate increases. If there is no majority protest and the City Council adopts the resolution approving the new rates, the rates will take effect July 1, 2022.
FISCAL IMPACT
There is no direct fiscal impact on the General Fund associated with adopting and approving the resolution.
RECOMMENDATION
Staff recommends that the City Council:
1. Open the public hearing, hear and consider all oral and written statements, protests, objections, or other communications made or filed with respect to proposed increases to solid waste collection rates and close the public hearing;
2. At the conclusion of the public hearing, staff recommends that the City Council, by motion, adopt a resolution Adopting Rates for Solid Waste Collection Services.

CITY OF GUSTINE
NOTICE OF PUBLIC HEARING
PROPOSED INCREASES TO
SOLID WASTE SERVICE CHARGES
The City of Gustine will hold a Public Hearing at 6:00 P.M. on June 30, 2022, in the City of Gustine City Council Chambers, 352 Fifth Street Gustine, CA 95322, to consider adopting increases to the City's solid service charges.
REASON FOR THE PROPOSED SOLID WASTE SERVICE RATE INCREASES & BASIS UPON WHICH THE PROPOSED SOLID WASTE
RATE INCREASES WERE CALCULATED
The City of Gustine (the "City") recently entered into an exclusive franchise agreement with Mid-Valley Disposal, LLC, for the collection and handling of solid waste, including garbage, green waste, recycling, and additional services as set forth in the agreement (collectively, "solid waste services"). Properties within the City subscribe to the solid waste services provided by Mid-Valley. Pursuant to the franchise agreement, the City collects solid waste service fees from customers who receive solid waste services from Mid-Valley. The City uses the revenues from the fees to pay Mid-Valley for the solid waste services provided under the franchise agreement, and to recover its operational and administrative costs of providing these services, including billing and collection of the service fees.
The City is proposing to increase solid waste services reflect the new franchise with Mid-Valley and the associated proposed rates. Please note that in part these services are necessary to meet new state mandates under Senate Bill 1383.
The proposed maximum solid waste service charges would go into effect on July 1, 2022. The rates for the service fees will be increased to account for inflation, as described herein, and changes in the disposal fees annually.
PROPOSED SOLID WASTE SERVICE CHARGES
The City provides solid waste collection, disposal, and materials processing services to all residents and businesses within the City.
Revenues from solid waste service charges pay for the operations and maintenance of materials collection vehicles, disposal sites, and processing facilities, as well as the administrative and regulatory costs that enable the City to manage its solid waste. In addition, solid waste service charges support infrastructure investments, such as necessary system improvements to meet new regulations, capital improvements, debt payments, and prudent reserves for the solid waste system.
The solid waste service fees apply to customers depending on the frequency of pick-ups, the types of bins and the types of solid waste, as well as special rates for specific services provided. The rates are set forth in Exhibit A to this notice. The solid waste service fees are derived based on two components: (1) a service component, and (2) a disposal component.
PROPOSED INFLATIONARY ADJUSTMENTS
In addition to the rate increases provided above, beginning on July 1, 2023, and each July 1st thereafter, through and including July 1, 2027, the rates for the solid waste service fees identified above may be adjusted annually to account for inflation and any pass-through costs to reflect increases in the disposal fees charged by Merced County for use of its landfill. However, any adjustment shall not cause the affected component of the rates to increase by more than 15% in any year, and in no event shall such an increase cause the solid waste service fees to exceed the cost of providing service. The City shall mail written notice to each affected property owner at least 30 days in advance of such an adjustment. The solid waste service fees shall be adjusted as follows:
a) The service component shall be adjusted based on the annual percent change in the Consumer Price Index for All Urban Consumers, All Items, for the San Francisco-Oakland-Hayward metropolitan area (Series ID #CUURS49BSAO);
b) The disposal component shall be adjusted based on any changes to the tipping fee charged by Merced County for disposal of City waste.
PUBLIC HEARING AND PROTESTS
The City of Gustine will hold a Public Hearing on June 30, 2022, in the City of Gustine City Council Chambers, 352 Fifth Street Gustine, CA 95322, to consider adopting the proposed solid waste service charges, resulting from changes to the cost for its solid waste services.
Any property owner whose property will be subject to the imposition of the proposed solid waste service fees and any tenant directly responsible for the payment of such fees (i.e., a customer of record) may submit a written protest to the proposed changes; provided, however, that only one protest will be counted per identified parcel.
Written protests may be submitted by mail or in person to the City Clerk at 352 Fifth Street Gustine, CA 95322 or at the Public Hearing (date and time noted above), provided they are received prior to the conclusion of the public comment portion of the Public Hearing. Please identify on the front of the envelope for any protest, whether mailed or submitted in person to the City Clerk, Attn: Public Hearing on Solid Waste Rates. Please note that the City is conducting this protest hearing in an abundance of caution and without conceding the applicability of Proposition 218 to privately provided solid waste service.
Any protest submitted via e-mail or other electronic means will not be accepted.
Any written protest must: (1) state that the identified property owner is in opposition to the proposed solid waste service charges; (2) provide the location of the identified parcel (by assessor's parcel number, street address, or customer account); and (3) include the name and signature of the property owner submitting the protest.
At the Public Hearing, the City Council will hear and consider all written and oral protests to the proposed solid waste service charges. Oral comments at the Public Hearing, however, will not qualify as formal protests unless accompanied by a written protest.
At the conclusion of the Public Hearing, the City Council will consider adoption of an ordinance authorizing the proposed solid waste service fees and the annual adjustments as described herein.
If written protests against the proposed rate increases are not presented by a majority of the property owners of the identified parcels upon which the rates are proposed to be imposed and tenants directly responsible for the payment of the solid waste service fees, the City Council will be authorized to impose the rate increases and annual inflationary adjustments as outlined above. If adopted, the proposed solid waste service charges will take effect beginning July 1, 2022.
RESOLUTION NO. 2022-XXXX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GUSTINE, CALIFORNIA, ADOPTING RATES FOR SOLID WASTE
COLLECTION SERVICES
• WHEREAS, as a result of regulations implementing Senate Bill 1383 (Chapter 395, Statutes of 2016) that took effect January 1, 2022, organic waste can no longer be disposed of in the landfill and organic waste collection services must be provided to all residents and businesses; and
WHEREAS, the City of Gustine recently entered into an exclusive franchise agreement with Mid-Valley Disposal, LLC, for the collection and handling of solid waste, including garbage, green waste, recycling, and additional services; and WHEREAS, the rate structure for the monthly solid waste service fees has two customer classes: (i) residential, and (I) commercial; and WHEREAS, the rate structure for refuse, recycling and organics collection is based on the container size, type of service, and frequency of collection; and WHEREAS, the City has determined that it is necessary to impose new, increased or modified rates for its solid waste service charges (collectively herein, the "Charges"); and WHEREAS, the revenues derived from the charges will not exceed the funds required to provide the solid waste services and shall be used exclusively for the provision of solid waste collection services; and
WHEREAS, the amount of the charges will not exceed the proportional cost of the service attributable to each parcel upon which they are proposed for imposition; and WHEREAS, the charges will not be imposed on a parcel unless the solid waste services are actually used by, or immediately available to, the owner of the parcel; and WHEREAS, the California Constitution, article XIII D, section 6 ("Article XIII D") requires that prior to imposing any increase to the charges, the City shall provide written notice (the "Notice") by mail of the proposed increases to the charges to the record owner of each parcel upon which increases to the charges are proposed and any tenant directly liable for payment of such charges (collectively herein referred to as "customers"); and WHEREAS, the Notice provides information about the amount of the charges proposed to be imposed on each parcel, the basis upon which the charges were calculated, the reason for the increases to the charges, and the date, time and location of a public hearing (the "Hearing") on the proposed increases to the charges; and WHEREAS, pursuant to Article XIII D, such notice is required to be provided to the affected customers not less than 45 days prior to the hearing on the proposed rate increases; and
WHEREAS, the notice was mailed in accordance in compliance with Article XIII D; and
WHEREAS, the hearing was held on this day, June 30, 2022; and 28859.00009\40113920.2
WHEREAS, at the hearing the City Council heard all oral testimony, and considered all written materials and written protests concerning the establishment and imposition of the proposed rate increases to the charges, and at the close of the hearing the City did not receive written protests against the establishment and imposition of the increases to the charges from a majority of the record owners of property upon which the charges are proposed or any tenants directly liable for payment of the charges (i.e., a customer of record who is not a property owner).
NOW, THEREFORE, BE IT RESOLVED the City Council of the City of Gustine:
SECTION 1. Recitals. The above recitals are all true and correct and are incorporated herein.
SECTION 2. The City Council hereby adopts the charges for solid waste collection services at the maximum rates, effective July 1, 2022, as set forth in Exhibit A attached hereto and incorporated herein by this reference.
SECTION 3. For the fiscal year beginning July 1, 2023, and annually thereafter on July 1 through and including July 1, 2027, the service component of the maximum rates provided in Exhibit A shall be automatically adjusted based upon the annual percentage change in the Consumer Price Index (CPI), All Urban Consumers, All Items, for the San Francisco-Oakland-Hayward, CA Metropolitan Area, as determined by the United States Department of Labor Statistics. For the fiscal year beginning July 1, 2023, and annually thereafter on July 1 through and including July 1, 2027, the disposal component of the maximum rates provided in Exhibit A shall be automatically adjusted based on any changes to the tipping fee passed through by Merced County for the disposal of City waste. However, the inflationary adjustment for the service component and the pass- through adjustment for the disposal fee component, are each capped by a 15% maximum rate adjustment each year.
SECTION 4. To the extent any charges established by this resolution are inconsistent with any charges previously adopted by the City Council, it is the explicit intention of the City Council that the charges adopted pursuant to this resolution shall prevail.
SECTION 5. CEQA: The City Council hereby finds that the administration, operation, maintenance, and improvements of the solid waste collection system, which are to be funded by the charges, are necessary to maintain solid waste services within the City's existing service area. The City Council further finds that such charges are necessary and reasonable to fund the administration, operation, maintenance, and improvements of the solid waste collection system. Based on these findings, the City Council hereby determines that this resolution is statutorily exempt from the requirements of CEQA pursuant to California Public Resources Code section 21080(b)(8) and State CEQA Guidelines section 15273(a). The documents and materials that constitute the record of proceedings on which these findings have been based are located at 352 Fifth Street, Gustine, CA, 95322. The custodian for these records is the City Clerk of the City.
SECTION 6. If any section, subsection, subdivision, sentence, clause, or phrase in this resolution or any part thereof is for any reason held to be unconstitutional or invalid, ineffective by any court of competent jurisdiction, such decision shall not affect the validity or effectiveness of the remaining portions of this resolution or any part thereof. The City Council hereby declares that it would have adopted each section irrespective of 28859.00009\40113920.2
the fact that any one or more subsections, subdivisions, sentences, clauses, or phrases be declared unconstitutional, invalid, or ineffective.
