ITEM NO. 5
COUNCIL AGENDA ITEM
SEPTEMBER 20, 2022
PREPARED BY: Melanie Correa, Administrative Services Director SUBJECT: Consider Approving Waste Water Treatment Plant OIT Classification and Approving Job Description
BACKGROUND/DISCUSSION
In March, 2022, after dismal response to a recruitment for Wastewater Operator, Council approved a task order with Gouveia Engineering to provide staff to operate the Waste Water Treatment Plant. One component of the scope of work for the task order was for the contracted staff to train up to two Operators-In-Training.
At the start of this agreement for service, two public works staff members identified themselves as being interested in pursuing certification from the State Water Resource Control Board (SWRCB) for Wastewater Operator. The Public Works Director worked with both staff to enroll them in the required training, and take the required exam to obtain an Operator-In-Training (OIT) certificate, which is the required first step in the full certification process.
One staff member has successfully achieved an Operator-In-Training certificate. This employee has been working alongside the contracted Operator since the start of the contract agreement, as has been gaining the necessary knowledge to comply with the requirements set forth by SWRCB, and to eventually operate the City's plant independently.
According to the SWCRB certification process, OIT's are eligible OlTs may take the Grade I exam any time after achieving OIT status from SWRCB, however in order to qualify for the Grade I Operator certificate, they must pass the Grade I exam and obtain 1,800 hours of qualifying experience in operations at a Waste Water Treatment Plant.
The current work hours of the contracted Operator have been reduced to 30 hours per week and will be reduced again to 20 hours per week on or around the last week of October 2022. The City expects to continue the contracted Operator at 20 hours per week from that point to assist with installing the new aerators, and provide the OIT with continued training that will include mandated reporting. The City expects to terminate the contracted Operator agreement on or before March 23, 2023, dependent upon the OITs exam results.
Staff is proposing the addition of a WWTP OIT classification to formalize the position, and develop a structured classification to assist with a plan to fill the City's vacancy of Wastewater Operator. Staff has also developed a job description for the position, included as Exhibit A.
FISCAL IMPACT
No fiscal impact. Funding for this new classification will be cost-allocated according to the budgeted salary figures for Waste Water personnel. The OIT candidate is currently assigned in a Maintenance Worker classification. Once the contracted staff is terminated, leaving the OIT as the sole staff allocated to the Waste Water department, a vacancy for Maintenance Worker will arise.
RECOMMENDATION
Council approve the new classification of Waste Water Treatment Plant Operator in Training, and corresponding job description.

The two, alongside with School Resource Officer Michael Erickson, have truly made a positive impact on the lives of the youth in Gustine.
The City has learned that Caleb Wilkinson plans to move out of state and has given his last day of city employment as of September 30, 2022. While the grant period has only 8 months remaining, staff looked at alternatives to hiring another employee to replace the YSPC position. This is especially true as Caleb has done a superb job in this role and is well versed in all the grant reporting and budget requirements of the grant. Starting over with a new employee would not allow enough time for training and embracing the goals and objectives of the grant as Caleb has.
One option that was proposed to CalVIP program coordinators was to alter the grant to change the YSPC position to a consultant position and reallocate the funding from the YSPC to the Professional Services line item. This would allow us to retain Caleb as a consultant to work remotely and capture all the required data and activities that is reported to the state. Remaining tasks for the grant are two quarterly reports and one final report.
On August 25, 2022, Katrina Jackson approved the modification and asked to include the modification for future reports. With the approval of City Council, Caleb Wilkinson will cease to be employed by the City on September 30, 2022 and begin to work as a MAPS Consultant on October 1, 2022. He will retain the grant allocated cellphone and laptop to continue his work.
Over the next 8 months, it is estimated that he will continue approximately 40% of his previous workload. To ensure his other work is covered at the schools which he previously performed, it is recommended to complete his "boots on the ground" work by increasing the contract load with La Familia to bring on a part-time program worker to work closely with Sergio Lara and Caleb Wilkinson and ensure nothing falls through the cracks. This modification was also approved by Katrina Jackson.
FISCAL IMPACT
The initial budget for Youth Services Coordinator Position including benefits was $232,254 for the life of the grant. Of that, approximately $114,520 remains. Caleb has estimated the time needed to manage the grant and complete the reporting at his same hourly salary for approximately 320 hours per grant reporting period for a total of 960 hours. This will require $25,000 be reallocated to the Professional Services line time for his consulting fee. The balance of the YSPC funding will be reallocated to contract with La Familia for the part time worker. There are no additional costs to the City as a result of this modification.
RECOMMENDATION
Staff recommends that Council authorize the Interim City Manager to enter into contract with Caleb Wilkinson for consulting work related to the CalVIP grant.

COUNCIL AGENDA ITEM
SEPTEMBER 20, 2022
PrePAreD BY: Mike Brinkman, Building Official
SUBJECT: Waive the Second Reading and Consider Adoption of an Ordinance regarding the California Code of Regulations Title 24, 2022 Edition of the California Buildings Standards Code
BACKGROUND/DISCUSSION:
At their regular meeting on September 6, 2022, City Council moved to waive the first reading and introduce this proposed ordinance updating the City's building codes to conform to the California Building Standards Code. Ordinances require two readings prior to being fully adopted.
The model codes are updated every three years. This allows for the codes to improve and adjust to the newest materials, methods of construction and technological advances in the industry.
The California Building Standards Commission adoption of the 2022 code comes after a comprehensive multi-state agency and stakeholder update of the 2019 building codes.
The objective is to produce a practical building code that ensures public safety first and foremost while implementing the most efficient technology available to conserve the state's natural resources and energy use. California's building code is applied to virtually every commercial and residential structure in the state.
The new 2022 California Building Standards Code contains thirteen parts that incorporate public health, life safety, and general welfare standards used in the design and construction of buildings in California. These parts incorporate the latest national standards in the International Building, Residential and Fire Codes, California Green Building Code, California Energy Code, National Electrical Code, and the Uniform Mechanical and Plumbing Codes. Along with the usual Energy and Green code updates, below are a few noteworthy updates:
• Permit expiration has been extended from 6-months to 12-months. Every permit shall remain valid if the work on the site is commenced within 12-months after its issuance.
• Aging-in-place design and fall prevention has been added for new residential construction. Added to address specific design elements to facilitate access to operational features and to allow people to stay longer in their homes as they age.
• Expanding Electric Vehicle Charging requirements to install EV charging receptacles and chargers to new multifamily dwellings, hotels, and motels.
Health and Safety Code Section 18941.5 mandates that the Building Standards contained in the 2022 California Building Standards Code shall be effective 180 days after publication by the California Building Standards Commission. If these codes are not adopted by ordinance, they become effective by default without any amendments.
The proposed effective date for the City of Gustine will be January 1, 2023. As part of the adoption process the department has made every effort to notify all affected parties of the proposed changes.
FISCAL IMPACT
None.

COUNCIL AGENDA ITEM
SEPTEMBER 20, 2022
PREPARED BY: Tiffany Vitorino, Recreation Manager
SUBJECT: Consider Expenditure to improve the exterior of the Al Goman Community Center
BACKGROUND/DISCUSSION
On March 16, 2021, City Council approved the interior painting of the Al Goman Community Center. Since then staff has received numerous compliments from renters and community members. Rentals have of the Goman Center have increased since the pandemic and are almost back to pre-pandemic rental frequency. Now that the rentals are on their way back on track and bringing in revenue, staff would like to suggest continuing the improvements.
The exterior of the Center has never been painted, and has small areas of mismatched paint that was used to cover graffiti or other markings. Painting the exterior of the building will help give it a more attractive look to entice more renters to the facility. Staff has received the following three estimates to paint the exterior the building:
• Joaquin Painting - $13,720.00
• Lancaster Painting - $14,667.00
• Cordeiro Custom Remodeling - $27,174.34
Staff would also like to propose replacing the front entrance doors of the Center. For the past several years staff has received calls from renters in the evening hours that the front doors of the Center are not closing or locking property. This causes staff to go assist the renter with locking the facility. The front doors are damaged and the locking mechanism is not working correctly. Several attempts have been made to repair the doors but the equipment is outdated. Staff feels it is time to replace the doors to ensure security of the building. Staff has requested bids from three different local glass companies. The bids include not only replacing the doors but the entire front entrance windows of the building. All three companies feel that the outdated framing would not be compatible with the new doors and they would not be able to ensure security, therefore the suggestion is to replace the entire entrance. The following are the bids for replacing the entire front entrance including the doors of the facility:
Don's Mobile Glass - $15,972.00
• Patterson Glass - $11,425.00
• Paul's Glass Company $8,307.29
Staff would coordinate the two projects to be completed concurrently. Staff would hold off on installing the new doors and windows for a short period in order for the painters to complete the painting of the exterior walls. Once the painting is complete, the installation of the entrance windows and doors would occur.
Staff has also been in contact with the Gustine-Newman Garden Club and they have volunteered to do a landscaping project for the front of the building to add to the refreshed look. Public Works has done some minor repairs to the current drip system and are making adjustments so that the system will work with a timer to ensure the landscaped areas are watered properly. Funding for the landscape project is still in discussion between staff and the Garden Club and staff will return to council if needed.
FISCAL IMPACT
The fiscal impact to the City would be the monetary amount for painting the exterior of the Al Goman Center and the replacement of the front doors and windows with the contractor selected by Council. After meeting with the Finance Department and Interim City Manager, staff is recommending that Council authorize this expenditure from the UUT fund. If this item were to be approved, once all exterior upgrades are complete, staff would bring an item to Council during the User Regulatory Fee Update to consider adjusting the rental fee higher for the facility to reflect the upgrades made to the facility. Staff is also requesting a contingency of an additional 10%, not to exceed $2,202.73, to accommodate for any additional related repairs.
RECOMMENDATION
In reviewing the submitted bids, staff has determined that Joaquin Painting, Inc. is the lowest bidder for the exterior painting with a bid of $13,720.00; and Paul's Glass Company is the lowest bidder for the front entrance replacement with a bid of $8,307.29. The total cost of both projects, if Council was in agreement of the contractor selection is $22,027.29.
Staff is recommending that Council approve the use of UUT funds for these two projects.
Further, staff recommends that Council authorize the Interim City Manager to enter into contracts with both contractors to complete the aforementioned projects. Once contracts are executed, staff will appropriately coordinate the project between the painter and the door and glass installer.
