ADMINISTRATIVE AGENDA

1. DISCUSSION AND DIRECTION: Implementation of SB1383 Waiver

1. Receive staff report and presentation

2. Receive public comment

3. Conduct discussion and provide staff with direction
Interim City Manager Kilger presented the staff report.

Joseph Kalpakoff, President and CEO, Mid-Valley Disposal, presented background on the transition period, provided information on their attendance at events within the City and provided a brief overview of SB 1383 legislation.

Council member Ford inquired on the difference between tier one and tier two edible food generators, to which Mr. Kalpakoff explained tier one generators are the larger square foot facilities, such as a grocery store.

Council member Ford inquired examples of tier one and tier two generators in the City, to which Jennifer Halpin, Halpin Recycling and consultant to the City, advised that Dollar General qualifies as a tier one generator and City school cafeterias would be classified as tier two.

Council member Ford inquired if schools are exempted from the edible food recovery portions of the law through the waiver, to which Ms. Halpin advised that the schools are not exempt.

Council member Ford also inquired if the City is required to monitor the school's compliance, to which Interim City Manager Kilger answered his belief is that the City is not required to monitor the school district, but staff will check.

Council member Brazil requested information on liability surrounding recovered edible food, to which Ms. Halpin explained the "good samaritan clause" within the law that explains the liability is not on food provider.

Council member Ford inquired on the process for unused and unopened food within cafeterias, to which Ms. Halpin advised it would be at the discretion of the school.

Mr. Kalpakoff advised each government entity is responsible for their own recovery reporting. He provided information on AB341 and AB1826, and spoke how the bills are separate of SB1383. He advised waivers are available for commercial customers who generate less than two cubic feet of waste weekly.

Interim City Manager Kilger advised staff could provide detail on Gustine's middle-tier businesses at a later date. Mr. Kilger also informed Council that Mid-Valley Disposal has offered to revisit commercial businesses when requested to re-assess bin use and demand.

Council member Ford inquired who determines the two cubic yard of waste or less requirement, to which Mr. Kalpakoff advised it is measured on disposal qualities of the resident/commercial business.

Council member Bonta reiterated that the waiver is for a five-year term, and it is uncertain how future legislature would affect the waiver.

Josh Nelson, City Attorney, provided legal perspective on SB1383. He provided additional information on allowances under the waiver. He advised small commercial customers are covered by the waiver, mid-customers may qualify under "right sizing" assessments, and large customers are not included within the waiver. He also advised that if the City wants to modify or change standards then an ordinance amendment would be required. Mr. Nelson further advised the grant received from CaRecycle might be at risk if any changes are adopted.

Interim City Manager Kilger advised the City will work on amending ordinance penalty clauses under the waiver.

Joe Heisdorf, CFO, Mid-Valley Disposal, provided information on the Notice to Comply filed by the City with the State. He also advised with waiver approval, policing and enforcing fines is waived.

Council member Bonta inquired on financial implications of changing the 3-cart system, to which Mr. Heisdorf advised of the potential expenditures that might occur if the City choose to revise or reduce service levels.

Interim City Manager Kilger advised cost is not impacted directly with removing one cart. He asked City Council to initially focus on the policy aspects of the waiver.

Mayor Nagy inquired why customer bills state "3 90-gallon cans", to which Mr. Heisdorf advised this would be a City billing question.

Mayor Nagy inquired on emission efficiency related to the amount of Mid Valley trucks being used and the number of passes required to collect each can, to which Mr.

Heisdorf provided information on route design and reduced emissions. He advised there are two trucks currently servicing Gustine and that each do one pass for the organics and recycling respectively, with both trucks making a second pass for the garbage.

Mayor Nagy inquired on seasonal usage fluctuations, and reduced rates to assist customers, to which Mr. Heisdorf advised of the many moving parts associated with the possibility of a "seasonal" reduced rate, including negligible cost savings.

Council member Bonta inquired on a facility that meets or exceed organic waste content recovery requirements, to which Mr. Heisdorf advised Mid-Valley Disposal does not have a facility within those standards and advised there are none in the State.

Council member Brazil inquired on the population listed on the waiver application, to which Ms. Halpin advised the City used the population estimate from the Department of Finance, as it is updated annually.

PUBLIC COMMENT
Craig Christenson, 657 West Avenue, expressed concern about lack of garbage policing. He provided his opinion disagreeing with Mid-Valley Disposal relating to negligible savings with removing one can from the current 3-cart system. He advised Mid-Valley Disposal should have known Gustine would qualify for waiver.

Mayor Nagy addressed that the waiver was officially denied.

Interim City Manager Kilger advised the city's filing of the Notice of Intent gave Mid- Valley Disposal and Gilton information that Gustine was going to comply with the law as stated.

Mr. Christenson inquired whether after "right-sizing" unnecessarily large bills for commercial customers would be retroactively prorated. He inquired if residents can elect to get larger cans.

Mr. Kalpakoff advised the cost difference between a 96-gallon and 64-gallon carts is $4.

Rick Nagle, 404 Jensen Road, stated he is in favor of the 3-cart system. However, on behalf of his business, Independent Order of Odd Fellows, 3-bins per tenant equals a total of 15 bins, which is overdone. He expressed concern over discrepancy between billing, individual customer needs, and actual cans.

Sherri Marsigli, 820 North Avenue, inquired on whether her business qualified as edible food generator, to which Mr. Heisdorf advised her business does not qualify.

Sherri Marsigli commented without the governing component, costs for truck drivers should present a cost savings to residents. She also advised community members should be educated on self-hauling component of the law.

Keith Collins, 76 Linden Avenue, observed that the grey can is mostly being utilized among community members.

COUNCIL DISCUSSION
Council member Brazil inquired on the tenant scenario presented by Mr. Nagle in public comment, to which Ms. Halpin advised that if a subscriber has water service they are required to have garbage service. She also advised that under a communal landlord, the bins subscription is based on lot size per the ordinance and State mandate.

Council member Brazil inquired on the status of street sweeping, to which Interim City Manage Kilger advised this item will be on the next agenda for Council's direction.

Council member Brazil inquired why the City doesn't bill commercial, to which Mr.

Heisdorf advised that going through Mid-Valley Disposal directly for commercial billing speeds up the response time because there are a lot of moving parts with commercial accounts. He also advised the franchise fee for commercial accounts is reported to City Hall every month, and deducted from the remittance for residential service.

Mayor Nagy advised Council would like to proceed with the 3-cart system and recycling. He also advised they would like to enhance the education program for residents and businesses prior to the enforcement of policing and fines.

Ms. Halpin offered to work with staff to educate the residents and businesses. She offered additional options to advertise the Regional Waste Authority's guide. She provided information in regards to public comments.

Interim City Manager Kilger inquired if an ordinance needs to be brought to Council for revision, to which Mr. Nelson affirmed and advised an ordinance will need to be done to modify the enforcement and commercial provisions under the waiver.

Council member Ford suggested the ordinance state a clearer definition of self-haul.

Mr. Nelson advised this topic would need to be discussed with Mid-Valley Disposal.

Council direction: 1) Retain the current commercial and residential 3-cart system for solid waste collection, recyclable materials collection, transportation, and organic materials processing and recycling; 2) implement a more proactive education program for residents and businesses; and 3) return to Council with a revised solid waste ordinance to be consistent with Council direction and the SB 1383 waiver, including reduced reporting, enforcement and penalty requirements.

SUBJECT: Veteran's Day Procession

BACKGROUND/DISCUSSION
The Veterans Day Procession is scheduled for November 11, 2022, beginning at 11:00 AM.

The procession will require Police escort, and the route is as follows:

The procession will form at the intersection of Grove Ave and South Ave. It will travel northbound Fifth Street where it will conclude at the Veterans of Foreign Wars/American Legion Hall at 145 5'h Street. FISCAL IMPACT
Public Works personnel should be able to deliver and retrieve approximately 12 barricades, incurring about 2 hours of overtime, at a cost of $100.00. Police escort for the procession will require two uniformed Police Officers. American Legion Post 240 has requested that the City Council waive any and all fees associated with this event.

COUNCIL AGENDA ITEM
NOVEMBER 1, 2022
PREPARED BY: Melanie Correa, Administrative Services Director Anne Branham, City Attorney's Office
SUBJECT: Consideration of a Resolution Approving Employment Agreement for City Manager Services with Anna Nicholas

BACKGROUND AND DISCUSSION
On March 10, 2022, former City Manager Doug Dunford tendered his resignation to the City Council. The City Council appointed Brad Kilger as Interim City Manager as of May 2, 2022.

On May 17, 2022, the City Council directed staff to solicit proposals from qualified recruitment firms to conduct the recruitment for the next permanent, full-time City Manager. The City received four responses by the deadline of June 9, 2022, and on June 21, 2022, the City Council selected Ralph Andersen & Associates to conduct the recruitment. As part of their search process, Ralph Andersen & Associates conducted targeted outreach and developed a recruitment brochure to reach the greatest number of potential qualified applicants.

On September 20, 2022, the City Council met with and interviewed the candidates recommended by Ralph Andersen & Associates in closed session. After interviewing these candidates and considering the needs of the City, the City Council selected Ms.

Anna Nicholas as its choice for the next City Manager. The City Council authorized Mayor Nagy and Mayor Pro Tem Alexander to negotiate with Ms. Nicholas, through the recruitment firm, on the terms of an employment agreement to be brought back for consideration at a public meeting.

On September 28, October 3, October 12, October 18, and October 25, the City Council met in closed session to discuss the selection of a candidate and the negotiation of a mutually agreeable contract for employment of a City Manager from among the candidates. The City Council has completed these negotiation efforts, and now wishes to authorize Mayor Nagy to execute the attached three-year City Manager Employment Agreement with Anna Nicholas. If the Agreement is approved, she will begin work on December 5, 2022.

FISCAL IMPACT
The attached Employment Agreement provides for an annual salary of $148,500, which is comparable to other local cities, and to the previous contract with Mr. Dunford.

RECOMMENDATION
City Council adopt a resolution approving the Employment Agreement with Anna Nicholas for City Manager services and authorizing the Mayor to execute said Agreement on behalf of the City.

G. The City Manager is an exempt employee and is expected to engage in those hours of work that are necessary to fulfill the obligations of the City Manager's position. It is the expectation of the Council that the City Manager will work a five (5) day work week (with a presence at City Hall Monday through Friday), with the understanding that the City Manager does not have set hours of work as they are expected to be available at all times.

3. CITY COUNCIL RESPONSIBILITIES AND COMMITMENTS
A. The City Council sets policies for the governance and administration of the City, and it implements its policies through the City Manager.

B. The City Council recognizes that to meet the challenges facing the City it must exercise decisive policy leadership. As one step in carrying out this leadership responsibility, the City Council commits to spending time each year outside of regular City Council meetings to work with the City Manager on setting goals and priorities for the City government, and to work on issues that may be inhibiting the maximal achievement of City goals.

C. Except for the purpose of inquiry, the City Council and its members shall deal with all subordinate City employees, officers, contractors, and consultants solely through the City Manager or the City Manager's designee, and neither the City Council nor any member thereof shall give orders to any subordinate of the City Manager, either publicly or privately.

D. The City Council agrees none of its individual members will order the appointment or removal of any person to any office or employment under the supervision and control of the City Manager.

E. The City Council agrees that any criticism of a City staff member by a City Council member shall be done privately through the City Manager.
2 F. Neither the City Council nor any of its members shall interfere with the execution of the powers and duties of the City Manager. The City Manager shall take orders and instructions from the City Council only when it is sitting as a body in a lawfully held meeting.

G. Any failure of the City Council or member of the City Council to adhere to this Section 3 or Section 5 shall not constitute a material breach of this Agreement, nor shall any such failure prohibit the City Council from terminating this Agreement pursuant to Section 10. The City Manager shall provide the City Council with written notice of any alleged failure to adhere to any provision of this Section 3 or Section 5.

4. CITY RESPONSIBILITIES AND COMMITMENTS
A. The City shall provide the City Manager with the compensation, incentives, and benefits specified elsewhere in this Agreement.

C. The City agrees to pay professional memberships, dues, and subscriptions on behalf of the City Manager which are beneficial to the City, as determined by the City Council, or for the continuing professional development of the City Manager. These include, but are not limited to, the International City Management Association (ICMA) and the California City Management Foundation (CCMF).

5. PERFORMANCE EVALUATION
A. Annual performance evaluations are an important way for the City Council and City Manager to ensure effective communications about expectations and performance. The City Council recognizes that for the City Manager to respond to its needs and to grow in the performance of the City Manager's job, the City Manager needs to know how the City Council Members evaluate the City Manager's performance.

B. To assure that the City Manager gets this feedback, the City Council shall conduct an initial evaluation six (6) months from the City Manager's start date, and thereafter shall conduct an annual evaluation of the City Manager's performance no later than December 1" of each year unless the Parties mutually agree to a different date.
3 C. As part of the annual review and evaluation the City Manager and the City Council will jointly develop goals and priorities that will provide the basis for determining the next year's performance evaluation.

D. The Parties may use an outside facilitator paid by City funds to assist them in conducting this evaluation, when agreed to by both Parties.

6. TERM
A. The term of this Agreement shall be from December 5, 2022 to December 31, 2025, or until terminated by either Party in accordance with this Agreement, with an optional two-year extension, under the same terms as this Agreement, that may be exercised upon mutual agreement of both Parties.

B. The City Manager agrees to remain in the exclusive employ of the City during the term of this Agreement. The term "employed" shall not preclude the City Manager from engaging in occasional teaching, writing or consulting performed on the City Manager's time off when approved by the City Council.

7. COMPENSATION
A. The City agrees to provide the City Manager with an annual base salary of One Hundred Forty-Eight Thousand Five Hundred Dollars ($148,500).

B. The annual base salary shall increase on the first anniversary of the Effective Date of this Agreement, and each December 1 thereafter, by an amount equal to either two percent or the federal cost of living adjustment (COLA) established by the Social Security Administration (SSA), whichever percentage is less. In the event the COLA established by SSA in any given year is less than two percent, the City Council will grant the increase only if the Council first determines that the increase is warranted based on the City Manager's annual performance evaluation.

C. The City Council may also review the City Manager's base salary rate annually for any appropriate adjustments during the annual evaluation of the City Manager's performance.

D. Salary changes approved for and applied to any other City employees shall not be applied to the City Manager unless the City Council expressly provides that they shall apply.

10. SEPARATION
A. Resignation or Retirement.
1) The City Manager may resign at any time and agrees to give the City at least 45 days advance written notice of the effective date of the City Manager's resignation, unless the Parties otherwise agree in writing. If the City Manager retires from full time public service with the City, the City Manager may provide six months' advance notice, but shall provide a minimum of 45 days' notice. The City Manager's actual retirement date will be mutually established.
2) The Parties agree that the City Manager shall not use any accumulated comprehensive leave during the 45 day notice period, without express written consent of the Mayor.

Stated another way, the Parties agree that during the 45 day notice period prior to leaving, it is expected that the City Manager will be working. 6 B. Termination or Removal.
1) The City Manager is an at-will employee serving at the pleasure of the City Council as provided in Government Code Section 36506.
2) The City Council may remove the City Manager at any time, with or without cause, by a majority vote of its members. Notice of termination shall be provided to the City Manager in writing. "Termination" as used in this section shall also include any request that the City Manager resign, a reduction in salary or other financial benefits of the City Manager (excluding a general City Management salary reduction), a material reduction in the powers and authority of the City Manager, or the elimination of the City Manager's position. Any such notice of termination or act constituting termination shall be presented at or effectuated at a duly noticed regular meeting of the City Council.
3) The City Manager shall not be removed during the 90-day period preceding or following any City election for membership on the City Council, or during the 90-day period following any change in membership of the City Council, except upon unanimous vote of the City Council.
4) Given the at-will nature of the position of City Manager, an important element of the employment agreement pertains to termination. It is in both the City's interest and that of the City Manager that any termination of the City Manager is done in a professional and businesslike manner.

C. Severance Pay.
1) In the event the City Manager is terminated by the City Council within the first six months of the City Manager's employment with the City, and during such time that the City Manager is willing and able to perform the City Manager's duties under this Agreement, the City agrees to pay the City Manager two (2) months' base salary then in effect as provided in Section 7.A. of this Agreement, conditioned on the City Manager's execution of a waiver and release of claims.
2) In the event the City Manager is terminated by the City Council any time after the first six months of the City Manager's employment with the City, and during such time that the City Manager remains willing and able to perform the City Manager's duties under this Agreement, the City agrees to pay the City Manager four (4) months' base salary 7 then in effect as provided in Section 7.A. of this Agreement, conditioned on the City Manager's execution of a waiver and release of claims.
3) If the City Manager resigns following a suggestion, whether formal or informal, by a majority of the City Council, the City Manager may, at the City Manager's option, be deemed to be "terminated" as of the date of such suggestion to resign and this severance pay provision shall apply.
4) All payments required under Sections 10.C. (1) and (2) are subject to and shall be interpreted to comply with the limitations set forth in Government Code Section 53260.

D. Separation for Cause.
1) Notwithstanding the provisions of Section 10.C., the City Manager may be terminated for cause. As used in this section, "cause" shall mean only the following:
a) Conviction of a misdemeanor of moral turpitude or any felony; b) Continued abuse of drugs or alcohol that materially affects the performance of the Manager's duties; or
c) Repeated and protracted unexcused absences from the City Manager's office and duties.
d) Material breach of this Agreement which is not cured after reasonable notice. 2) In the event the City terminates the City Manager for cause, then the City may terminate this Agreement immediately, and the City Manager shall be entitled to only the compensation accrued up to the date of termination, and any other termination benefits and payments as may be required by law. The City Manager shall not be entitled to any severance benefits.
3) In the event the City terminates the City Manager for cause, the City and the City Manager agree that neither Party shall make any written or oral statements to members of the public or the press concerning the City Manager's termination except in the form of a joint press release which is mutually agreeable to both Parties. The joint press release shall not contain any text or information that would be disparaging to either Party. The Parties further agree that, if they are unable to mutually agree on the contents of a joint press release within 72 hours after notice of termination, the City may state solely that the City Manager is no longer employed by the City. 8 E. Payment for Unused Leave Balance.
1) On separation from City employment, the City Manager shall be paid for all unused accrued vacation leave allowance provided in this Agreement, and/or the City Manager may apply the leave time to service credit for retirement purposes if permitted by PERS. Accumulated leave balances shall be paid at the City Manager's monthly salary rate at the effective date of separation. Accrued administrative leave is not vested, and is not payable upon separation. Accrued sick leave will be reported as service credit for retirement purposes as required by PERS. 2) In the event the City Manager dies while employed by the City under this Agreement, the City Manager's beneficiaries or those entitled to the City Manager's estate, shall be entitled to the City Manager's earned salary, and any in-lieu payments for accrued benefits, including compensation for the value of all accrued leave balances.

11. INDEMNIFICATION
A. To the full extent of the law as provided by the California Torts Claims Act (Government Code Section 810 et seq.) and the indemnity provisions of this Agreement, whichever shall provide the greatest protection to the City Manager, the City shall defend and indemnify the City Manager against and for all losses sustained by the City Manager in direct consequences of the discharge of the City Manager's duties on the City's behalf for the period of the City Manager's employment.

B. Subject to the provisions of Section 14.A, the City shall defend, save harmless and indemnify the City Manager against any tort, professional liability claim or demand, or other legal action, whether groundless or otherwise, arising out of an alleged act or omission occurring in the performance of the City Manager's duties as City Manager. The City may compromise and settle any such claim or suit and pay the amount of any settlement or judgment rendered thereon.

C. Whenever the City Manager shall be sued for damages arising out of the performance of the City Manager's duties, the City shall provide defense counsel for the City Manager in such suit and indemnify the City Manager from any judgment rendered against the City Manager; provided that such indemnity shall not extend to any judgment for damages arising out of any willful wrongdoing. This indemnification shall extend beyond termination of employment and the otherwise expiration of this Agreement to provide protection for any such acts undertaken or committed in the City Manager's capacity as City Manager, regardless of whether the notice of filing of a lawsuit occurs during or following employment with the City. This indemnity provision shall survive the termination of the Agreement and is in addition to any other rights or remedies that the City Manager may have under the law.

D. The City, and all parties claiming under or through it, hereby waives all rights of subrogation and contribution against the City Manager, while acting within the scope of the City Manager's duties, from all claims, losses, and liabilities arising out of or incident to activities or operations performed by or on behalf of the City or any party affiliated with or otherwise claiming under or through it, regardless of any prior, concurrent, or subsequent active or passive negligence by the City Manager.

12. SEVERABILITY
If any clause, sentence, part, section, or portion of this Agreement is found by a court of competent jurisdiction to be illegal or unenforceable, such clause, sentence, part, section, or portion so found shall be regarded as though it were not part of this Agreement and the remaining parts of this Agreement shall be fully binding and enforceable by the Parties hereto.

13. ENTIRE AGREEMENT
This Agreement represents the entire agreement of the Parties, and no representations have been made or relied upon except as set forth herein. This Agreement may be amended or modified only by a written, fully executed agreement of the Parties.

For purposes of this Section, "abuse of office or position" means either: (1) an abuse of public authority, including waste, fraud, and violation of the law under color of authority as those crimes are specifically defined under specific provision of California statute, or (2) a crime against public justice, including 10 a crime described in Title 7 commencing with section 92 of the Penal Code, or as specifically defined under separate provision of California statute.

B. City Manager shall perform their duties in accordance with all the laws, ordinances, rules, and regulations applicable to the position. This Agreement shall be interpreted in accordance with the laws of the State of California.

COUNCIL AGENDA ITEM
NOVEMBER 1, 2022
PREPARED BY: Brad Kilger, Interim City Manager
Jesus Jr Chavez, Public Works Director
SUBJECT: DISCUSSION & DIRECTION: City of Gustine Street Sweeping Service - Contract or Lease/Purchase

BACKGROUND
In January of this year, the City of Gustine issued a Request for Proposals (RFP) to qualified companies to provide solid waste collection, recyclable materials collection, transportation, and organic materials processing. The RFP was issued in part in response to SB 1383 which was signed into law in 2016 by then Governor Jerry Brown. At the time the RFP was released the City was receiving street sweeping services from its then solid waste collection provider Gilton Solid Waste Management. However, the RFP issued in response to SB 1383 did not include street sweeping as a part of the services to be provided. Apparently, the City Manager at that time anticipated issuing a separate RFP for those services. Furthermore, it appears his intent was to fund the street sweeping through the anticipated increase in franchise fees, which were planned to be raised from 10% to 15% of gross receipts.

On March 21, 2022 the City approved a franchise agreement with Mid Valley Disposal to commence on July 1, 2022. In late April, the prior City Manager left Gustine to take a position in another city. As a result, a separate RFP for street sweeping services was never issued. The Interim City Manager was tasked with assisting staff in working with the new service provider and implementing the new three can solid waste and organics collection and recycling program required under SB 1383. Until an RFP could be prepared and issued, the staff engaged a local street sweeping contractor to provide periodic sweeping of the City's streets and to assist in special event clean-ups.

During the time staff was preparing an RFP for street sweeping they were informed by the City Attorney that the State Department of Industrial Relations had issued an opinion that concluded street sweeping qualified as a public works project and therefore subject to prevailing wage requirements (California Code of Regulations, title 8, section 16001).

Knowing that this could potentially increase the cost of the service, the staff issued the RFP nonetheless in early August.

DISCUSSION
The City received only two responses to the RFP - Mid Valley Disposal and Ronnie's Inc. (attached). As anticipated the proposals came in very high. Of the two bids Mid Valley was the lowest at $69,384.00 annually plus $160.00 per hour for emergency call outs and special events. Also, during the time, the City staff were working on the RFP, they spoke to several neighboring cities, such as Newman, who were doing their own street sweeping, partially in response to the requirement to pay prevailing wage. Looking into this option, staff requested a Sourcewell Cooperative Purchasing price quote from Municipal Maintenance Equipment to lease/purchase a street sweeper. The quote offered several options for leasing and eventually purchasing its own sweeper (see attached quote sheet). The least expensive option was a 7-year lease paid annually at a cost of $38,494.91 per year.

An important consideration when purchasing equipment is the annual maintenance cost and in this case the requirement for staff time to operate it on a regular basis. Staff researched maintenance costs for a typical sweeper and estimated that the annual cost sweeper 4-5 hours a week and the expense of regular oil changes and replacement of metal sweeper brooms, tires and smaller wear items as needed. In regards to staffing, the staffed, it will be challenging to maintain a regular schedule if they are down staff or have an emergency to attend to. However, the staff believes the potential for periodic disruptions in service will be outweighed by the advantages of having the sweeper available for special events, emergency water breaks, resident-initiated complaints, and road cleaning during harvest season. The sweeper will also be very helpful during the busy Fall leaf season.

Notwithstanding the increased costs, which all cities are experiencing, street sweeping serves an important public service, as well as, assists in preserving the City's infrastructure investments. The community relies on effective and thorough sweeping of the streets to preserve their drivability and cleanliness, as well as enhance the City's quality of life.

Additionally, the street sweeper provides an equally important function for emergency cleanup, annual catch basin cleaning, and storm water management.

FISCAL IMPACT
In comparing the cost between the Mid Valley proposal and the City acquiring its own sweeper, the cost of the Mid Valley Disposal proposal would be approximately $70,000+ annually (including emergency call outs and special events). The lease-to-purchase option has a total) estimated annual cost of $45,500 using existing staff).

Based on the current number of waste accounts and the rate schedule approved by the City Council, the previous Finance Director estimated that the City's 15% franchise fee would generate $144,000 annually. Therefore, 5% would equal $38,000. If the City applied the 5% to street sweeping services, it would be necessary to supplement the services from the General Fund. The amount of supplemental funding for the Mid Valley proposal would be approximately $32,000 annually and for the lease-purchase option, $7,500 annually.

RECOMMENDATION
For City Council to consider the street sweeper options and provide staff with direction on a preferred option of either contracting with Mid Valley Disposal or lease/purchase a street sweeper.
