COUNCIL AGENDA ITEM
NOVEMBER 15, 2022
PREPARED BY: Jesus Chavez Jr., Public Works Director
SUBJECT: Emergency Water Line Repair on Sherwood/Edith Dr.

BACKGROUND/DISCUSSION
On October 3, 2022, a water leak at Sherwood and Edith Drive was reported to City staff. Staff assessed the leak and determined it was 6" water main line, and the repair was quickly deemed emergency. The water was flowing fast and causing the asphalt road material to lift. Swift and rapid action was needed to prevent a sinkhole in the road. The dimensions of the roadway that were affected was more or less 20' in length and 8' wide.

Staff isolated the area by closing water valves; this caused service interruption to 70 residential homes. Staff knocked on the doors of all affected residences to explain the temporary and unexpected water outage. Due to being short staffed and not having the proper equipment to handle this emergency, staff immediately contacted three local contractors. Two of which were unresponsive. The third company, Rolfe Construction was working in Newman and they advised they could assist and they immediately dispatched staff and equipment. Within five hours, the water leak was repaired and water was restored to the affected residents. After the repair, staff opened hydrants to expel the possibility of discolored water as a result of the main water line repair.

Under Section 2-6-38(m) of the Gustine Municipal Code the City Manager is authorized in the case of an emergency threatening public health and safety to "take any directly related and immediate action required by that emergency, and procure the equipment, services, and supplies for those purposes, without giving notice for bids to let contracts." Once the purchase is made, the code further requires the City Manager to report to the City Council the reasons why the emergency required dispensing with the competitive solicitation for bids process.

FISCAL IMPACT
The total cost for the emergency repair was $12,572.00. Staff is recommending that the funding come from the Water Fund - 060-0710-540.011-00 (Other Contract Services).

RECOMMENDATION
Staff recommends that the City Council ratify and approve emergency water main repairs on Edith/Sherwood Drive.

COUNCIL AGENDA ITEM
NOVEMBER 15, 2022
PREPARED BY: Jami Westervelt, Economic and Community Development Director SUBJECT: Approval of Multi-jurisdictional Housing Element Participation and Adoption of required Resolution

BACKGROUND/DISCUSSION
On October 18, 2022 Council discussed for the second time the possibility of participating in a countywide, Multi-Jurisdictional Housing Element (MJHE) and considered draft cost sharing amounts provided by the lead agency-Merced County Association of Governments (MCAG).

The MJHE would assist all participating jurisdictions in meeting the new sixth-cycle requirements from the California Department of Housing and Community Development (HCD). HCD must certify housing elements by February 18, 2024 and legislative changes have increased the complexity and cost of the updates considerably for all jurisdictions.

The Council expressed interest in moving forward based upon the draft cost amounts provided in October, contingent upon revised information from MCAG to come from the consultant selection process. The Council noted savings in both time and money in participating in the MJHE versus the City undertaking its own, separate process for updating the element.

Members of the Regional Early Action Planning (REAP) program workgroup participated in interviews of the preferred candidate Rincon Consultants, Inc. along with MCAG staff. MCAG has now provided the final Cost Sharing Agreement amounts based upon this process.

The final $48,695 cost share for the City represents a very slight ($614—or approximately 1%) increase over the cost estimate from October. This increase does not change the anticipated savings in both dollars and time that the City expects to realize by joining the Multi-Jurisdictional effort, rather than undertaking this mandatory planning alone.

In order to participate in the MJHE, the jurisdictions need to provide to MCAG a signed resolution (attached) confirming the commitment to go forward, including a commitment to the financial contribution required of each jurisdiction. MCAG has set a deadline of December 1, 2022 for receipt of that signed resolution.

MCAG is also requiring all participating jurisdictions to agree to pay 20% of their share up front, as a deposit to assist with cash-flow for that agency. Due to the nature of the organization, MCAG does not have reserves or the opportunity to borrow against other funds to float large billings on a reimbursable project. The Cost Sharing Agreement calls for the City of Gustine to pay MCAG approximately $9,739 of its full share no later than December 30, 2022. The remainder would come due at currently undetermined times, based upon consultant billing requirements and the progression of the project.

FISCAL IMPACT
While the State requires the City to update its Housing Element, the City budget for 2022-23 does not appear to contain the funds required to complete the work that needs to be taking place. This is true whether the City is part of the MJHE or completing its update alone.

Staff believes the $48,695 in the MJHE represents a significant cost savings over what the City would expend for similar work if choosing not to participate in the MJHE. Staff is looking into grants and funding options to fund its portion, but nothing is confirmable at this time. Barring any other funding, the City would need to pay out of its General Fund.

RECOMMENDATION
City Council adopt the attached Resolution indicating participation in the Multi- jurisdictional Housing Element being coordinated by MCAG, including the $48,695 cost commitment and the deposit requirement as outlined in the Sixth Cycle Multijurisdictional Housing Element Cost Sharing Agreement attached.

COUNCIL AGENDA ITEM
NOVEMBER 15, 2022
PREPARED BY: Melanie Correa, Administrative Services Director SUBJECT: Authorize Interim City Manager to Execute Amendment to Contract with Municipal Resource Group for Accounting Services

BACKGROUND/DISCUSSION
On September 6, 2022 at their regular meeting, Council approved the Interim City Manager to enter into contract with Municipal Resource Group (MRG) for accounting services. At that meeting, it was discussed that through authority granted in Gustine Municipal Code section 2-6-33(12), the Interim City Manager engaged the services of Mr. Zenoni through MRG on July 1, 2022, in an initial contract not to exceed $10,000. The approved contract allocated an additional $26,000 to MRG for continued work on behalf of the City for FY 21/22 financial audit preparation and other financial projects as they presented themselves.

Since that meeting, MRG has assisted the City with the annual Streets and Road Report, and the FY 21/22 Measure V audit. MRG continues to work with the City's audit firm, R.J.

Ricciardi, to work through the necessary reports and documents for the FY 21/22 financial audit as well.

The contract amount has since been expended, which is the reasoning behind staff's request for Council to authorize the execution of an amendment with MRG to continue financial project management services, as the recruitment process for Finance Director continues.

The proposed amendment approves an amount not to exceed $25,000. As a reminder, the agreement may be terminated by either party within a 10-day notice. With the City's recent hiring of a City Manager, Human Resources has already started discussions with her to brainstorm methods in which the recruitment for a Finance Director can be rejuvenated, along with other creative avenues by which the position can be filled.

When that position is filled, the intent would be to terminate this contract, as services in this capacity will no longer be necessary.

FISCAL IMPACT
If the full amount of this contract is utilized, total fiscal impact would be $61,000. Funding would be appropriated from the salary and benefit savings from the Finance Director salary account allocations.

RECOMMENDATION
Authorize Interim City Manager to execute an amendment to the contract with Municipal Resource Group for financial project management services.

COUNCIL AGENDA ITEM
NOVEMBER 15, 2022
PREPARED BY: Jami Westervelt, Economic and Community Development Director Patrick Borrelli, Fire Chief
SUBJECT: Authorize Additional Expense to Pay Capitol Advocacy Partners to Develop Grant for Fire Equipment for City of Gustine

BACKGROUND/DISCUSSION
The City of Gustine has a current contract with Capital Advocacy Partners (CAP) for grant services with the City. The contract includes development of one Community Project Request funding application yearly. CAP also provides the City updates on funding opportunities and actions in Washington, D.C. as well as advocating on the City's behalf for funding, particularly with its elected representatives.

Beyond the annual large submission for Community Project Requests for congressionally-directed spending, the City contract specifies additional fees to write other grants outside of that program. The cost of the services varies, depending upon the complexity of the grant and the application requirements.

The City of Gustine is in one of multiple jurisdictions working with the County on its grant application to the Federal Emergency Management Agency (FEMA) for self-contained breathing apparatus (SCBA) for several jurisdictions throughout the County. The grant is through the agency's Assistance to Firefighters Grant (AFG) program. The County is paying for the grant match on behalf of the participating jurisdictions for that application.

FEMA has not yet opened up the grant application for AFG for this cycle yet but the County is already working on the application due to the historically small window to apply for these funds. CAP states FEMA normally only allows a 30-day window to complete the application-which is considered a short turnaround for grant programs and especially those with multiple jurisdictions.

The Gustine Fire Department has expressed an interest in also applying to this same program as a separate agency in order to purchase new radios for the volunteer fire department.

Gustine Fire would like to submit the application for the equipment listed in the three agenda attachments, which total $40, 136. FEMA requires matching funds for these grants based upon the community size. With a population of fewer than 20,000 people, the match would be 5%. If the City is successful in its application it will leverage $38,129 from FEMA and pay $2,007 (5% of total) to complete the radio purchase.

CAP has expressed its availability to write the grant and has experience applying for these types of programs. In order to provide a final estimate for the application, CAP will need to see the full application packet. CAP states FEMA normally comes out with applications for this program in October or November but that FEMA has some challenges at present so determining the actual opening is difficult and CAP would advise starting work on the application as soon as possible. CAP states that its fee to the City to write the application will not exceed $7,000 but whether CAP could charge less than that amount would depend upon final application length and requirements.

CAP staff has stated they believe the City has a very good chance at receiving the funding, especially the grant amount the Fire Department is requesting.

FISCAL IMPACT
It does not appear that any grant writing services were included in the 2022/23 budget although there was discussion of using CAP services as grant opportunities arise- particularly for public safety in which CAP has had successes for the City. The City must pay CAP its $7,000 grant-writing fee regardless of the application outcome. The funding for this, along with the $2,007 match, will need to come from the City General Fund.

RECOMMENDATION
City Council consider a motion to authorize staff to pay Capitol Advocacy Partners no more than $7,000 to develop and submit an application to the FEMA Assistance to Firefighters program and, if approved to provide up to $2,500 match as required by the grant; for a total of no more than $9,500 to come from the general fund.

COUNCIL AGENDA ITEM
NOVEMBER 15, 2022
PREPARED BY: Jami Westervelt, Economic and Community Development Director SUBJECT: Provide direction and take potential action on PLHA Funding

BACKGROUND/DISCUSSION
In 2017, Governor Brown signed a 15-bill housing package aimed at addressing the state's housing shortage and high housing costs. Specifically, it included the Building Homes and Jobs Act (SB 2, 2017), which established a $75 recording fee on real estate documents to increase the supply of affordable homes in California. Because the number of real estate transactions recorded in each county will vary from year to year, the revenues collected will fluctuate.

The California Department of Housing and Community Development administers two types of assistance under the Permanent Local Housing Allocation (PLHA) program:

Grants to entitlement and non-entitlement jurisdictions based on the formula prescribed under federal law for the Community Development Block Grant and competitive grants to non-entitlement jurisdictions. This staff item addresses the noncompetitive non- entitlement allocations available to the City of Gustine as staff is not recommending application for the competitive grants at this time.

Current City staff recently became aware of the program allocation for the City starting in 2019. Thus far, the allocation has increased each year, with the City of Gustine's allocations as follows: Year 1(2019) was $73,575, Year 2 (2020) was $118,021 and Year 3 (2021) was $150,920. The allocation for the first three years is available but the final two years will depend upon fees collected.

Current staff recently became aware that the City will lose the $73,575 in program funds allocated to Gustine for 2019 if the City does not apply by the end of this month.

Application requires submittal of forms clarifying the programs) in the form of the City Plan, as well as a public hearing, which is a part of the agenda item before the Council.

The City has time to develop the projects in its plan, but the other items are required prior to November 30.

The City can apply for the any of the below eligible activities:
1) Predevelopment, development, acquisition, rehabilitation and preservation of multifamily, residential live work, rental housing that is affordable to extremely low-, very low-, or moderate-income households, including necessary operating subsidies. 2) Predevelopment, development, acquisition, rehabilitation, and preservation of affordable rental and ownership housing, including accessory dwelling units (ADUs), that meets the needs of a growing workforce earning up to 120 percent of Area Median Income (AMI), or 150 percent of AMI in High-cost areas. ADU's shall be available for occupancy for a term of no less than 30 days. 3) Matching portions of funds into local or regional housing trust fund. 4) Matching portions of funds available through the Low-and Moderate Housing Asset Fund pursuant to subdivision (d) of HSC Section 34176.
5) Capitalize reserves for Services connected to the preservation and creation of new permanent supportive housing.
6) Assist persons experiencing or at risk of homelessness, including, but no limited to, providing rapid rehousing, rental assistance, supportive/case management services that allow people to obtain and retain housing, operating and capital costs for navigation centers and emergency shelters, and the new construction, rehabilitation, and preservation of permeant and transitional housing. 7) Accessibility modifications in Lower-income Owner-occupied housing. 8) Efforts to acquire and rehabilitate foreclosed or vacant homes and apartments. 9) Homeownership opportunities, including, but not limited to, down payment assistance.
10) Fiscal incentives made by a county to a city within the county to incentivize approval of one or more affordable housing projects or matching funds invested by the county in an Affordable housing development project in a city within the county, provided that the city has made an equal or greater investment in the As the list illustrates, the City could use its allocations to fund a wide array for programs and projects to address housing inventory and costs. While staff has not asked Council to provide direction on the use of these types of funds in recent years, based upon previous discussions and in questions posed by the community, staff believes that increasing inventory of affordable housing rises to the top of options available to the City. Specifically, as a small, disadvantaged community, availability of affordable multifamily rental housing can prove challenging. Staff suggests that program area listed in #1 above would provide the City a great deal of flexibility in developing and implementing affordable multifamily rental housing for the community.

While the Plan submitted must address the intended program at this time, should the City decide to change activities after submittal, it could apply to HCD for approval of that change prior to spending on that activity. Generally, staff would assume HCD would approve changes to other eligible activities within reason and with explanation, but this is not guaranteed.

A turnaround of the initial Plan required for submittal by the end of the month would be difficult given staff levels and numbers of other priority projects currently being undertaken by staff. However, the City could accomplish this by working with established organizations familiar with these types of projects.

In addition to communication from HCD, staff also recently received an inquiry on the PLHA funds from Self- Help Enterprises. The City worked with the organization to develop homes in the Borrelli Ranch subdivision in which the owners were required to provide construction assistance to reduce the cost of construction of those homes. The organization is well known and has worked with jurisdictions and developed projects throughout the eight counties in the San Joaquin Valley.

Self-Help Enterprises has offered its services for developing the required application and plan and to submit per the requirements of HCD. They also have stated an interest in working with the City to identify potential sites for the development of affordable housing in the City. Self-Help will help the City develop its application with HCD by the end of November regardless of whether the City ultimately chooses to partner with the organization on implementation or not. However, should the City desire only to have Self-Help assist with the submission to HCD by the end of the month, the organization would charge the City a fee of $2,500. However, they have offered to defer that fee if the City both chooses to move forward with a multifamily project and agrees to work on developing the project with Self-Help.

Whether the City ultimately chooses to work with Self-Help or another provider on activities related to this funding, staff strongly recommends that the City continue to utilize services of an outside agency with expertise in this area if planning to move a project like this forward. The funding can pay for those services.

HCD has stated it anticipates to issue award letters related to the November 30 deadline in February of 2023.

FISCAL IMPACT
It is unknown if former City staff were either aware of the program or the potential loss of funding years starting this year, but the City did not budget for this project in its 2022/23 budget. Therefore, the Council would need to approve the expenditure of $2,500 for Self-Help to participate, unless the Council approves a multifamily project to be developed by Self-Help-in which case the agency would waive that fee.

If HCD approves the Plan, the City would receive not less than the $342,516 allocated to the City for the first three years of the plan, in addition to potential allocations for the final two years. Self-Help states it would expect the City not to receive less than $441,452 as its five-year total for the Plan.

RECOMMENDATION
City Council hold a public hearing on PLHA and then make a motion to:

1. Appropriate $2,500 from the General Fund and authorize staff to make payment to Self-Help Enterprises for preparation of submission to the PLHA program

2. Approve the attached resolution:
• Authorizing and adopting the Local government Plan and certifying that the public had adequate opportunity to review and comment on the Plan. • Authorizing the City Manager to execute the PLHA Program Application, the PLHA Standard Agreement and any subsequent amendments or modifications thereto, as well as any other documents which are related to the Program or the PLHA grant awarded to Applicant, as the Department may deem appropriate

ITEM NO. 9

GUSTINE

COUNCIL AGENDA ITEM
November 15, 2022
PREPARED BY: Mario Gouveia, City Engineer
SUBJECT: Discussion and Direction: Traffic Control and Schedule impacts for the Construction of the Roundabout on SR-33/140 and the Construction of the Roundabout in Downtown Gustine

BACKGROUND/DISCUSSION
In 2020 the City Engineer's office prepared project plans for the SR 33/140 Roundabout that were reviewed and approved by Caltrans. These plans included Traffic Management Plans specific to the closure of the intersection and the detour of traffic around the project site. The detour includes two major components. The first is the detour of local traffic and the second is the detour of regional traffic. When the plan is implemented for construction, temporary traffic control measures will be put into place to facilitate the detours. These measures include the use of portable message signs directing regional traffic away from the project area as well as the installation of temporary stop signs at a number of intersections along the detour route.

This past summer the design for the downtown roundabout was completed and a traffic management plan was developed as part of that project. The traffic management plan for this project diverts traffic away from the intersection of 5th Street and 4th Avenue.

East/West traffic is directed to 3rd Avenue and 5th Avenue while North/South traffic is directed to 6'h Street and SR-33/140.

The project construction schedules as they are estimated to occur currently overlap. The Traffic Management Plans account for this condition, allowing both projects to use 5th Avenue for a traffic diversion. The overlap in construction of both projects would not change the impact on this corridor as it would see increased traffic volumes during the construction of either project regardless of the overlap in timeframe.

FISCAL IMPACT
None.

RECOMMENDATION
Staff recommends Council hold discussion and provide direction on proceeding with both projects concurrently.
