COUNCIL AGENDA ITEM
DECEMBER 6, 2022
PREPARED BY: Melanie Correa, Administrative Services Director SUBJECT: Consider Resolution Naming and Confirming Signatories on the City's Bank Accounts

BACKGROUND/DISCUSSION
The City's General Checking account at Tri Counties Bank requires two signatures on accounts payable checks-per the request of the City. In the interest of efficient and effective government administration of the City's financial transactions, the Council has traditionally authorized the City Manager and Finance Director as well as two or three Council members as signatories for checks and as authorized agents for City accounts.

It is common practice to have more than one management staff as a signatory on municipal accounts.

With staffing changes, Council needs to pass an updated resolution to update bank records.

Staff recommends Council authorize the following individuals as signatories to the City's bank accounts at Tri-Counties Bank effective immediately: City Manager Anna Nicholas, Administrative Services Director Melanie Correa, Mayor Pat Nagy, and Mayor Pro Tem Derek Alexander. Staff will update the signatories once the City fills the Finance Director vacancy, and with the appointment of a new Mayor Pro Tem in early 2023.

FISCAL IMPACT
None.

RECOMMENDATION
City Council approve the attached resolution, naming and confirming signatories on each of the City's bank accounts.

COUNCIL AGENDA ITEM

PREPARED BY: Mario Gouveia, City Engineer
SUBJECT: North Avenue Sewer Lift Station Permanent Repair Expenditure

BACKGROUND/DISCUSSION
The City of Gustine (City) owns and operates a sanitary sewer lift station (SSLS) on North Avenue near the Borrelli subdivision. The SSLS has reached its useful life and has failed numerous times in the recent past. The SSLS is slated for rehabilitation and the City has budgeted for its replacement in the current fiscal year. In order to address operation failures, the City recently purchased a diesel-powered Gorman-Rupp portable pump to keep the SSLS in service during the times when the permanent pumps fail and are repaired.

The City wishes to upgrade the SSLS to a skid mounted Gorman-Rupp unit and standardize its equipment moving forward. The Gorman-Rupp supplier has informed the City that it will take near one year for delivery of a SSLS skid once it is ordered. These delays are presently typical throughout the industry. In order to minimize the time between now and when the SSLS is delivered and installed, the City wishes to sole source the skid from Gorman-Rupp and order it now to reduce or eliminate waiting for the equipment once the project is bid and help avoid construction delays. Shortening the overall time between now when the new SSLS is installed and operational will also help to minimize the use of the temporary pump with its inherent operational noise.

FISCAL IMPACT
The quote for the SSLS skid is $86,250.00 plus tax and freight. The project is budgeted in the current fiscal year.

RECOMMENDATION
Staff recommends that Council approve the expenditure of the skid in advance of the project bid process.

SUBJECT: DISSCUSSION AND DIRECTION: 2022 CMAQ Call for Projects

BACKGROUND/DISCUSSION
The Merced County Association of Governments (MCAG) initiated a Call for Projects on October 24th, 2022. MCAG is in the process of programming $3 million in future federal funds for the Congestion Mitigation and Air Quality (MAQ) Program. This funding is to be awarded to member agencies based on competitively scoring applications submitted to MCAG by its member agencies.

MCAG provided the following Tentative schedule for the Call for Projects:

Schedule:
• Application Deadline - December 21, 2022
• CMAQ Committee to Evaluate Applications - January 2023 (tentative) • MCAG Board to Act on Recommendations - February 2023 (tentative) Expected Federal approval of FTIP Amendment - April 2023 (tentative) The CMAQ program's primary goals are to improve air quality and reduce congestion. CMAQ funding is used to fund transportation projects that will contribute to the attainment or maintenance of the National Ambient Air Quality Standards for ozone, and particulate matter (both PM10 and PM2.5).

Using the CMAQ project criteria City staff reviewed transportation planning documents to develop potential projects that best fit the application requirements. The two projects summarized below are the result of that development process. Both projects are a part of the City's RTP project list and adopted ATP Plan.

1. Lucerne Avenue Infill Sidewalk Project
This project would consist of the construction of pedestrian sidewalk facilities along the West end of Lucerne Ave between Laurel Ave and Jensen Rd. The project is a "quality of life" project focused on the construction of sidewalks where there are still discontinuities in pedestrian facilities, hence providing connectivity and safe pedestrian access to schools, commercial areas, parks, churches, etc.

2. Lucerne/West Ave Roundabout Project
This project consists of the constructing a roundabout at the intersection of Lucerne Ave, West Ave, and 3rd Ave. The improvements will include the reconfiguration of the intersection as well as improvements to all four legs of the roundabout. The project will significantly improve traffic flow through this intersection by eliminating five stop signs.

Staff is seeking direction from the Council on which project or projects to submit for this "Call for Projects".

FISCAL IMPACT
All of the federally funded projects require a local match of 11.47%. The City can commit funds from its Measure V allocation, SB1 allocation, or use other available local funds. The City would need to budget for the local match expenditures for any of the funded projects that receive funding.

RECOMMENDATION
Staff recommends Council hold discussion and provide direction on which projects) of the two projects presented that the City will be submitting to MCAG to compete for CMAQ funding.

COUNCIL AGENDA ITEM
DECEMBER 6, 2022
PREPARED BY: Jami Westervelt, Economic and Community Development Director Tom Navarro, CSG Principal Planner
SUBJECT: Discussion and Direction on Non-Conforming Uses in the R-3 (Multiple Residential) District and R-4 (Residential Professional) District

BACKGROUND
The City recently received inquiries regarding rebuilding homes destroyed by fire in the northeast corner of the City in an area zoned as R-4. City Zoning Code defines R-4 as a Residential Professional District that includes "all uses permitted in the R-3 district (as found in that table)" as well as additional commercial uses. Therefore, current code calls considering code for both zones when evaluating projects.

While the R-3 zone district is a multi-family residential district focusing mostly on high- density residential needs, the R-4 zone expands upon that and provides for uses such as hotels, motels, professional offices and clinics. With approval from the City via a conditional use permit, commercial uses such as bars and restaurants may also operate in the R-4 zone.

The homes within the fire-damaged area do not meet the current definition of the R-4 zone they are located within, making them a legal, non-conforming use. As such, the current code regulations restrict expanding them.

Based upon the Residential Zoning Districts Table (Exhibit A-Table 2.1), the City does not allow Single Family dwellings to be built in the R-3 (or then R-4) zone. However, in instances of "involuntary damaged or destroyed dwelling" (such as fire, flood or natural disaster) the code allows for replacing the structure with the same "footprint, height and number of dwelling units" per Section 4-72-040 (Exhibit B- Residential Exemptions).

This effectively prohibits increasing the size of the structure in any way. This directive appears consistent with the intent of R-3 zones, generally characterized by increased densities rather than larger, single family dwellings.

However, while the code prohibits the expansion of an existing single-family residence or replacement of a previous single-family residence that is larger than the one destroyed within the R-3 and R-4 zoning regulations, staff has identified several provisions that require policy interpretation and direction from the City Council regarding these zones.

DISCUSSION
Requirement for Use Permit
Under current Code, the applicant must apply for a Use Permit in order to rebuild an involuntarily damaged dwelling that is a legal nonconforming existing structure, (Exhibit B- Residential Exemptions).

In comparing Gustine to other jurisdictions, while almost all limit rebuilding in involuntary situations to the existing footprint, most do not require a Use Permit to do so. Cities frequently use building permit processes to provide for the review that ensures that the rebuilding meets the City specifications.

City of Gustine code specifically limits the rebuild to the former footprint for residential nonconforming structures involuntarily damaged. Since staff has no discretion over the size of the structure, it is unclear what purpose the Use Permit serves. Additionally, time and expense of filing a Use Permit places a significant burden on the property owner.

Adding to the time to rebuild runs counter to the City objective to reduce blight in the community and to code which sets out a six-month timeframe for filing to rebuild. The current City fee schedule requires a $600 deposit to start work on the Use Permit and a fee not less than $300.

Small Lot Single Family Use
While the use tables clearly list single-family dwellings as not allowed in R-3, other sections of the code list the term "small-lot single-family housing" within the definition of R-3 district. Section 4-22-020 (D.) (Exhibit C) includes "small-lot single-family" in a sentence also referencing "various types of multi-family housing" but it does not specifically define "small lot."
The ambiguity of "small lot" and the inconsistency of inclusion of the term single-family while tables clearly prohibit such, warrants clarification. If the City intended to include "small lot" single-family projects, it is unknown why the zoning code lacks the detail needed to clearly and consistently implement such projects or why the tables would still prohibit such.

Purpose of R-3 Zoning
Traditionally, the definition of R-3 zone is that of a Multi-family Residential designation intended to promote the development of grouped housing such as townhouses, condominiums and apartments. Single family detached home are generally not included in R-3 zones.

Recent planning decisions have pointed to the City moving away from single-family dwellings in R-3 zones. In addition, both State law and the City's Housing Element have encouraged multi-family development over single-family in these zones.

In the Housing Element submitted in 2020 to the State of California, the City listed "Single Family dwelling" as a use not allowed for either the R-3 or R-4 zones in the City (Exhibit D). Whether this is an oversight as well or an error in the table submitted is unknown but this is the most recent document staff looked toward for interpretation on the direction the City was taking.

Recently, the State of California has taken additional steps to get jurisdictions to increase housing inventory in the state, including in mandating more building in general and specifically higher-density, affordable housing. If the City had intended to include single-family homes in its "higher-density" zones, it would seem to run contrary to recent State mandates on housing.

Options and Impacts
These issues came to attention of staff related to the recent loss of homes and resolving them becomes particularly important to property owners seeking to rebuild those homes as soon as possible. Staff seeks Council direction at this time not only upon the Use Permit but also upon Single Family inclusion within the R-3 and R-4 Zones. While the priority before the Council is how to treat rebuilding nonconforming residential structures, clarification on the zoning code is advisable.

Based on Council direction, staff will return with the appropriate code amendments at a later date. As this will require an amendment to the City's land use regulations it will first be presented to the Planning Commission to make a recommendation to Council.

The Council direction requested by staff follows below. Staff has provided the decision points, along with anticipated results of the direction and/or recommendations:

Inclusion of Single-Family Dwellings in the R-3 and R-4 zones. Either:

1. Provide direction to remove detached, Single-Family dwellings in R-3 and R-4 Zones by removing "small-lot single-family housing" references in R-3 and R-4 Zones. This is the recommendation of staff. Results of these actions are:
a. Existing detached, single-family homes in these zones would continue to be categorized as legal, nonconforming uses
D. Limited other changes to code needed beyond already-required future updates to the General Plan and Housing Element.

2. Provide direction to expand the definition and allow Single-Family dwellings in R- 3 and R-4 Zones by retaining "small-lot single-family housing" and changing tables and any other inconsistencies to match. The results of these actions are:
a. Requires development of a definition of "small-lot"-at minimum. b. Will require amendment of the Housing Element.
c. Depending upon the defined parameters (such as the definition of "small") some Single-family residences may remain legal, nonconforming uses. d. Homes which fall within the revised, allowable R-3 or R-4 definition would conform to code and could generally expand to the City's defined "small- lot" criteria, regardless of reason for the desired expansion.

If selecting option "T" above, the Council will also need to direct staff on:

1. Rebuilding to "same-footprint" requirement on legal, nonconforming dwellings in R-3 and R-4 zones that are "involuntary damaged or destroyed". Either:
a. Provide direction to retain the requirement to rebuild legal, nonconforming dwellings "involuntary damaged or destroyed" to the same footprint. This is the recommendation of staff as it is most consistent with the intent of the zones and Housing Element. The result is that the limitation remains the same. b. Provide direction to allow for the expansion of the size of dwelling. The result is that applicants could expand dwellings when rebuilding to either pre- determined specifications or the City could require a Use Permit review process (see below)-whichever the City specified. Staff advises that allowing for expansion in rebuilding for "involuntary" reasons is likely to bring questions of equity from applicants who wish to rebuild existing homes larger due to choice, rather than involuntary circumstances.

2. Requiring a Use Permit for "involuntary damaged or destroyed dwellings". Staff has differing recommendations on this, depending upon the choice made in question 2 above:
a. Provide direction to remove the requirement of the use permit. Staff recommends this option if Council chooses to retain the requirement to limit the "same footprint" option for "involuntary damaged or destroyed" dwellings.
b. Provide direction to retain the Use Permit for "involuntary damaged or destroyed dwellings." Should Council opt to allow for expanding the footprint, staff recommends that a Use Permit may be appropriate. If the Council allows for expansion, staff suggests that Council could defer this question for approval with the other items to be considered with the new code brought back to first the Planning Commission and then the Council.

FISCAL IMPACT
There is no direct, calculable fiscal impact to the clarifications being requested.

RECOMMENDATION
City Council discuss the three decision areas listed in the above staff report and provide direction to incorporate into changes to applicable code to come to the Council at a future meeting.

Sec. 4-22-020. Definitions of the residential zoning districts.

The definitions of each residential zoning district and the manner in which they are applied are as follows:

R-E (Residential Estate) zoning district. The R-E district is applied to areas appropriate for large-lot, single-family residential development, together with limited agricultural uses. The maximum allowable density is two dwelling units per acre. The R-E zoning district is consistent with and implements the Residential Estate District land use designation of the General Plan.

R-1 (Single-Family Residential) zoning district. The R-1 zoning district is applied to areas appropriate for neighborhoods of detached single-family homes, and related, compatible uses. The maximum allowable density is 2 - 7 dwelling units per acre. The R-1 zoning district is consistent with and implements the Low Density Residential land use designation of the General Plan.

C. R-2 (Medium Density Residential) zoning district. The R-2 zoning district is applied to areas appropriate for neighborhoods with a mixture of housing types, including detached single-family homes, zero lot line homes, duplexes, and related, compatible uses. The maximum allowable density is 10 dwelling units per acre. The R-2 zoning district is consistent with and implements the Medium Density Residential land use designation of the General Plan.

R-3 (Multiple Residential) district. The R-3 zoning district is applied to areas appropriate for a variety of housing types, including small-lot single-family housing, and various types of multi-family housing (for example, duplexes, triplexes, and townhouses). The maximum allowable density is 15 dwelling units per acre. The R-3 zoning district is consistent with and implements the Residential - Medium/High Density land use designation of the General Plan.

E. P-D (Planned Development) district. The P-D zoning district is applied to greenfield areas within the City that are intended for the development of new neighborhoods. As noted by the General Plan, "This use combines residential development densities to allow for a broad range of housing options, while trying to eliminate "cookie-cutter" housing. The P-D zoning district is also intended to provide for new neighborhoods that are based upon traditional neighborhood development (TND) design features. The P-D zoning district is consistent with and implements the Planned Development land use designation of the General Plan. Allowabe density is 1 to 6 units per gross acre.

Department of Justice Community Oriented Policing Grant - 2022 Crisis Intervention Teams in the Amount of $335,141.54

BACKGROUND/DISCUSSION
The safety of the public has traditionally been the primary goal of law enforcement.

Over the years, research into the traditional methods of keeping the community safe has evolved into using various new and innovative strategies in supporting these goals.

While our nation continues to recover from the pandemic, it is apparent many calls for service involve those suffering mental health crisis episodes which may benefit from alternate police methods and responses.

In 2021, the Gustine Police responded to 26 calls for service where the contacted person was in crisis and required to be evaluated by a mental health clinician. This required the officer to complete the evaluation and necessary paper work and coordinate the individual to be transported to the nearest hospital, usually in Los Banos.

There have been times where the officer was required to transport the person themselves for various reasons such as additional charges or being under the influence.

The implementation of Crisis Intervention Teams (CIT) has become more prevalent in larger cities and agencies. The County of Merced has a very robust program under the Department of Behavioral Health and Recovery Services. They have recently implemented mobile response teams mostly the eastern portion of the county. The resources for smaller rural communities are minimal. The Gustine community could benefit from a CIT to provide more front-line resources for those in crisis and to allow limited police resources to respond to other reported criminal activity.

The City of Gustine, through Capital Advocacy Partners, applied for Department of Justice - Community Oriented Policing (COPS) funding in the amount of $335, 141.54 to fund a CIT program. The program will be referred to as Gustine Police Crisis Intervention Team (GPCIT) and allow the hiring of one full time Mental Health Clinician to respond to these calls for service. The grant allows the contracting with a known and proven mental health provider, La Familia formerly First Behavioral Health Urgent Care Clinic, which the City of Gustine currently contracts with for the MAPS Program which is due to end June 30, 2023.

Moreover, the grant will provide crisis intervention training for the entire department as well as dispatchers who field the calls at the dispatch center. In the end, the main goal of this grant is to "Divert individuals with mental health and/or substance abuse disorders away from justice involvement." To achieve this goal, the objectives have been identified as:

1. Provide trauma-informed services in calls involving individuals experiencing mental illness, substance use disorders, and homelessness.

2. Improve access to medical, mental health, and wrap around services.

3. Understand/reflect community needs and partner organizations continually.

On October 26, 2022, the City was officially notified that the Gustine Police CIT Grant was approved for funding in the amount of $335,141.54. There is no match requirement for this grant.

FISCAL IMPACT
The two-year grant covers all expenses including 10% of the annual salary and benefits of the Finance Director to manage the grant. There are no additional costs to the City.

RECOMMENDATION
Staff recommends that City Council authorize the resolution accepting the grant from the Department of Justice - Office of Community Oriented Police Grant in the amount of $335,141.54 and authorizing the City Manager to execute any related documents.

Performance Measures: By August 31, 2024, 75% City of Gustine Police Officers will have participated in at least 16 hours of CIT training.

City of Gustine (Rural, population 6,091)
Merced County, California
Key Partners: First Behavioral Health Urgent Care Center, Merced County Behavioral Health & Recovery Services, Livingston Police Department
Request: $335,139
The rural Gustine Police Department will develop and launch a Crisis Intervention Team (CIT) program that appreciates rural culture through positive interactions with police, coupled with organized engagement and procedural justice, to improve response and reduce injury to officers and citizens. Compared with their urban counterparts, rural Americans have higher depression and suicide rates but are less likely to access mental health care services The requested federal funding will enable GPD to implement a CIT that collaborates with county and nearby municipalities to better coordinate resources with appropriate response and connection to 24-hour mental health services. Our CIT will have three key components: A community collaboration between law enforcement, a mental health provider/s, and families and consumer advocates.

Goal: Divert individuals with mental health and/or substance abuse disorders away from justice involvement.

Objectives:
(1) Provide trauma-informed services in calls involving individuals experiencing mental illness, substance use disorders, and homelessness;
(2) Improve access to medical, mental health, and wraparound services; (3) Understand/reflect community needs and partner organizations continually.

Twelve officers in four agencies, three dispatchers, and two clinicians will receive specialized training. Once a call has been assigned to the CIT, the officer trained in (32-40 hours) de- escalation, CIT, and suicide prevention will respond alongside a FBHUCC clinician. Officers be issued a mobile tablet to deliver crisis counseling and assessment that is proven to reduce response time in rural areas and improve the availability of limited mental health services. The clinicians will receive training through the Forensic Mental Health Association of California to determine if the person needs to be transferred to a hospital for further evaluation or can stay in place with a connection to local follow-up care. Deliverables include:

1. One police officer who will be the program director, the police chief, and the clinician will participate in the National Alliance of Mental Health (NAMI) 40-hour CIT training.

All Gustine Police and one police officer each from Newman, Los Banos and Dos Palos will participate in eight hours of CIT training with NAMI. 40% of consumers on 5150 calls will receive case management for long-term care. 70% attendance of Clinicians on 5150 calls (can be in-person or virtual), or other crisis incidents.

4. 50% decrease in repeat 911 calls from people with existing cases.

5. 25% of crisis calls will result in diversions to community support rather than incarceration.

6. An increase of 75% of officers will feel more comfortable dealing with individuals in a mental health crisis.

We have consulted with nearby crisis response efforts in Kern, Merced and Stanislaus Counties, as well as the Modesto Police Department. Our agency participates in the Merced County Criminal Justice/Behavioral Health Collaborative Partnership as well as the Merced County Behavioral Health and Recovery Services Ongoing Planning Council.

The City of Gustine Awarded $335,000 to Support Police
Response and Training to Mental Health Calls For Service GUSTINE, CA - The City of Gustine Police Department will develop specialized crisis response and provide training • officers on trauma-informed, best practices mental and developmental crisis response thanks to a federa Department of Justice Office of Community Oriented Policing Services grant for $335,00( The police department's Crisis Intervention Team (CIT) is proposed to have three key components:

1. Collaboration between law enforcement, mental health providers, and families and consumer advocates;

2. Expansion of community policing by giving problem-solving techniques to GPD officers; and

3. Training for GPD officers with the knowledge and practice to divert individuals experiencing mental crises away from the justice system.

While similar programs exist on the County level, Gustine officials believe the city is too isolated to benefit from them. "It just takes too long for the county unit to support Gustine given the distance and lack of resources," Gustine Police Chief Ruben Chavez said.

Program is designed to provide appropriate need-based services to increase officer and individual safety and, ultimately, free up time for police to deal with urgent public safety matters and violent crimes. The GPD only has eight officers on staff, leaving few resources to address pressing community public safety issues.

In 2021, the GPD responded to 26 individual 5150 calls, (a person experiencing a mental crisis requiring involuntary detention for a 72-hour psychiatric hospitalization). The new CIT program will work with La Familia Central Valley (LFCV) clinicians to provide real time in-person and virtual mental health counseling during response. "We are thrilled to receive this funding to help us appropriately address our residents' mental health needs," said Chavez. "We acknowledge the need for new solutions when it comes to mental health response, so we are proud to expand our partnership with La Familia to reduce law enforcement's role in mental health response, reduce justice- involvement for our residents in crisis, and ultimately, reduce harm for both our officers and the community at-large." Police presence at mental and behavioral health-related calls creates potential triggers and escalation risks. Gustine's CIT program will educate GPD officers on trauma-informed response, de-escalation, and appropriate response for individuals experiencing mental health crises to reduce police involvement in these calls. Ultimately, Gustine hopes to have La Familiar clinicians respond to 70 percent of 5150 calls, only requiring police when absolutely necessary.

This will ensure residents receive equitable access to the care and services they need, while building collaborative and trusting relationships between the police and our communities.
