ITEM NO. 4
COUNCIL AGENDA ITEM
DECEMBER 20, 2022
PREPARED BY: Melanie Correa, Administrative Services Director Patrick Borrelli, Gustine Fire Chief
SUBJECT: Consider Resolution Authorizing Expenditure from User Utility Tax Fund for Fire Department Ceiling Retrofit
BACKGROUND/DISCUSSION
With the addition of the City's newest fire engine, through FEMA's Assistance to Firefighters Grant, the need to retrofit the department's ceiling to accommodate for additional parking in the department garage has become apparent.
Staff requested bids from competent contractors, and received only one in return from Granite and Tile Gallery Inc. (Exhibit A). The repair includes interior work, and minor roofing retrofits to match the existing met acrylics coating roof. The total project cost is quoted at $18,460.
As per the previously approved Fire Suppression Services Liability Agreement between the City and Merced County, the City and County shall split costs 50/50 for the City's fire station maintenance. At their December 6, 2022 meeting the Merced County Board of Supervisors approved the request to allot fifty percent of the cost for this project. The agreement further stipulates that the City is responsible for procurement and payment, with reimbursement coming from the County by way of an invoice from the City.
FISCAL IMPACT
This project was not budgeted for in the FY 22/23 adopted budget; therefore, staff is recommending the City's expense to be allocated from the User Utility Tax (UUT) fund, Fund 002. After reimbursement, per the cost sharing agreement, the total net cost to the City is $9,230.
RECOMMENDATION
City Council approve the attached resolution, approving the project and authorizing the expense from the UUT.

COUNCIL AGENDA ITEM
DECEMBER 20, 2022
PREPARED BY: Melanie Correa, Administrative Services Director SUBJECT: Cancellation of January 3, 2023 Regular Council Meeting
BACKGROUND/DISCUSSION
For the past several years, Council has approved the cancellation of the first meeting in January, in consideration of the closure of City Hall during the week between Christmas and New Year's. The closure is due to the lack of customer traffic during this week, paired with the boost to employee morale to afford staff time with their families. The closure is not city-paid, therefore staff utilizes accrued leave to supplement their pay while out of the office.
To distribute an agenda for January 3rd, staff would need to forgo time off during this week to coordinate, compile, and distribute the agenda in accordance with the agenda-distribution guidelines and requirements. As such, staff is requesting consensus from Council to cancel the regular meeting scheduled for January 3rd. Staff confirms that no actions or reports are pressing causing need for the meeting.
FISCAL IMPACT
None. The subsequent consent calendar item addresses staff's request to send out warrants in advance of the January 17th Council meeting, should Council approve the meeting cancellation request.
RECOMMENDATION
Provide Council consensus to cancel the January 3, 2023 regular City Council meeting.

PREPARED BY: Melanie Correa, Administrative Services Director SUBJECT: Direct staff to send out Warrant Checks prior to January 17, 2023 Meeting
BACKGROUND/DISCUSSION
Dependent on the approval of consent calendar item #5, the Council will not hold their regularly scheduled meeting on January 3, 2023 and will instead have their next meeting on January 17, 2023. During this time, the City will still have bills that must be paid in order to continue to do business.
In order to continue business as usual, staff requests Council's direction to send out payments for bills in advance of the January 17'h Council meeting. Staff will mail out the checks ahead of the meeting and all checks sent after the December 20th meeting will be listed on the warrant list included in the January 17th agenda packet.
FISCAL IMPACT
No negative impact. The action is expected to save the City money from potential late fees on City accounts.
RECOMMENDATION
Direct staff to send out payments in advance of the January 17t meeting and include those payments on the Warrant List for that same meeting.

SUBJECT: Resolution Accepting Completion for the Soil Removal and Disposal Project, Authorizing the Deputy City Clerk to file a Notice of Completion with Merced County, and Authorizing the City Manager to Make Final Payment of Retention Monies to Rolfe Construction, Inc.
BACKGROUND/DISCUSSION
The Soil Removal and Disposal project was advertised on July 20, 2022 and bids were opened on August 4, 2022. Rolfe Construction, Inc. submitted the lowest responsive and responsible bid and was awarded a contract for $52,374.00.
The major work consisted of removing approximately 1,850 tons of soil material from the site of the future SR-140/33 Roundabout located at 404 South Avenue Gustine, CA 95322, loading the material, transporting the material, and disposing of the material at the Billy Wright Landfill site located at 17173 S. Billy Wright Road, Los Banos, CA 93635.
The contractor completed all work within the time required in the contract documents. A final inspection has been performed and the work was found to be in compliance with the plans and specifications; therefore, the work should be accepted as complete and a Notice of Completion filed with Merced County. If no claims are filed within 35 days after recordation, the retention in the amount of $2,363.15 should be paid to Rolfe Construction, Inc., 3573 Southern Pacific Avenue, Atwater, CA 95301.
FISCAL IMPACT
The final construction contract cost inclusive of all authorized work was $47,262.96. Funding of this projects is covered by Regional Measure V funds.

SUBJECT: Approve Resolution for California Department of Transportation Airport Improvement Program (AIP) Matching Grant Application
BACKGROUND/DISCUSSION
On September 11, 2022, the City of Gustine executed an agreement with the Federal Aviation Administration (FAA) for the preparation of an Airport Layout Plan (ALP) Narrative Report with updated ALP Drawings and Aeronautical Survey at the Gustine Municipal Airport. The federal grant provided a maximum of $315,000.00 in funding with a required local match share of $35,000.00, for a total project cost of $350,000.00. The Aeronautics Division of the California Department of Transportation provides grants in the amount of 5% of the project cost to offset a portion of the required local match share. The City of Gustine is eligible for approximately $17,500.00 in grant funds to offset the required local match share.
FISCAL IMPACT
The proposed California Department of Transportation AlP matching grant in the amount of $17,500.00, if received, would reduce the City's required local match share of the Federal Aviation Administration (FAA) Grant to approximately $17,500.00.
RECOMMENDATION
Staff recommends that the City Council approve the attached resolution to apply for an AlP matching grant with the California Department of Transportation and authorize the City Manager to sign any documents required to apply for and accept subject funds on behalf of the City.

SUBJECT: Approve Adoption of the Safety Element to the Merced County Multi-Jurisdictional Hazard Mitigation Plan 2021-2026
BACKGROUND/DISCUSSION
On June 7, 2022, Council approved the adoption of the Merced County Local Hazard Mitigation Plan (LHMP) 2021-2026. The Merced County Local Hazard Mitigation Plan presents a comprehensive risk assessment of natural hazards that have the potential to affect Merced County. The term "hazard mitigation" describes actions that can help reduce or eliminate long-term risks caused by hazards, such as floods, wildfires, and earthquakes. Hazard mitigation is best accomplished when based on a comprehensive, long-term plan that is developed before a disaster strikes.
The Federal Emergency Management Agency (FEMA) has completed its review of the Merced County Multi-Jurisdictional Hazard Mitigation Plan Update 2021 and has approved the LHMP for adoption by the County which occurred through adoption on February 1, 2022. To ensure the City of Gustine is completely covered under the plan, the California Office of Emergency Services additionally requires the governing boards to adopt a resolution which adds the "Safety Element" language to the City's General Plan. This is a required formality to support the goals of the Safety Element.
The General Plan for the City of Gustine must be amended by adding the following language:
The Local Hazard Mitigation Plan (LHMP) for the City of Gustine planning area was developed in accordance with the Disaster Mitigation Act of 2000 (DMA 2000) and followed FEMA's 2011 Local Hazard Mitigation Plan guidance. The LHMP incorporates a process where hazards are identified and profiled, the people and facilities at risk are analyzed, and mitigation actions are developed to reduce or eliminate hazard risk. The implementation of these mitigation actions, which include both short-term and long-term strategies, involve planning, policy changes, programs, projects, and other activities.
The full Local Hazard Mitigation Plan can be accessed on the City's website in the Document Center under Police, or can be found at this web location:
https://web2.co.merced.ca.us/pdfs/oes/MercedCounty-MJHMP-2021-2016.pdf
FISCAL IMPACT
There is no fiscal impact to the City for adopting the additional language in the general plan. Failure of a jurisdiction to have the Safety Element language adopted into the General Plan could prevent approval of FEMA recovery assets to assist the jurisdiction.
Depending on the gravity of the hazard, this could result in the loss of thousands to millions of dollars to the City.
RECOMMENDATION
Staff recommends Council approve a resolution amending the City's General Plan to include suggested safety element compliance language in accordance with AB 2140.

COUNCIL AGENDA ITEM
DECEMBER 20, 2022
PREPARED BY: Jami Westervelt, Economic and Community Development Director Anne Branham, Assistant City Attorney
SUBJECT: Urgency Ordinance Amending Section 4-72-040 of the Gustine Municipal Code Regarding Use Permit Requirement to Repair or Rebuild Involuntarily Damaged Legal Nonconforming Residential Structures
BACKGROUND
Earlier this year, a number of residential structures in the northeast corner of the City (in an area zoned "R-4: Residential Professional") were damaged in a fire. R-4 does not presently authorize single-family residential structures, which means that any such structures constructed prior to the current zoning regulations are considered legal nonconforming uses.
Pursuant to current Gustine Municipal Code ("GMC"') Section 4-72-040, the City currently requires a use permit before reconstructing or rebuilding an involuntarily damaged or destroyed nonconforming single-family dwelling, even within the preexisting footprint. Several of the owners of the structures damaged in the fire have not yet been able to rebuild or replace the damaged portions of their structures, and the use permit process can take a substantial amount of time.
At the December 6, 2022 meeting, the City Council provided direction to staff to, as an initial matter, amend Section 4-72-040 to delete the requirement to obtain a use permit before repairing or reconstructing a legally nonconforming residential structure within the preexisting footprint.
The Council further directed staff to bring a later amendment to the Code to clarify that residential uses are not permissible within the R-3 and R-4 zones; that process will occur separately from and subsequent to the present urgency ordinance to allow the property owners whose homes were damaged in the recent fire to rebuild their residences without first obtaining a use permit.
Attached is an urgency ordinance prepared by the City Attorney, identifying the proposed amendment to Section 4-72-040 to allow repairs to or reconstruction of legal nonconforming residential structures within the preexisting footprint without a use permit. It is necessary to proceed on an urgency basis, under Government Code section 36937, because there are significant health and safety concerns associated with damaged residential structures having to await a use permit before rebuilding. For instance, because the property owners may not be able to occupy the remainder of the home while awaiting rebuilding, the damaged portions of the home can become an attractive nuisance to children or vandals, and can be a dangerous and unsafe structure with the potential for injury.
Accordingly, staff proposes adoption of an urgency ordinance to take effect immediately to remove the requirement for owners of legally nonconforming residential structures to obtain a use permit before rebuilding or repairing those structures within the preexisting footprint. This will allow owners to act more quickly to repair and rebuild the damaged portions of their homes to the preexisting footprint, and it will continue to be prohibited for single-family homes to expand their status as a nonconforming use.
Staff will also move forward with the process to change the Code to clarify that small lot single-family housing uses are not authorized in the R-3 or R-4 zones (multifamily/higher density housing will continue to be allowed). Noticing and ordinance adoption requirements mean that staff will return with a follow-up ordinance for that purpose no sooner than the first quarter of 2023.
FISCAL IMPACT
There is no direct, calculable fiscal impact in connection with the current proposed update to the Code.
RECOMMENDATION
City Council approve the attached Urgency Ordinance amending Section 4-72-040 of the Gustine Municipal Code regarding use permit requirement to repair or rebuild involuntarily damaged legal nonconforming residential structures.

ORDINANCE NO. XXXX
AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GUSTINE AMENDING SECTION 4-72-040 OF THE CITY OF GUSTINE MUNICIPAL CODE REGARDING
USE PERMIT REQUIREMENT TO REPAIR OR REBUILD INVOLUNTARILY DAMAGED LEGAL
NONCONFORMING RESIDENTIAL STRUCTURES
WHEREAS, the City of Gustine ("'City") is empowered by California Constitution Article XI, Section 7 to make and enforce within its limits all local, police, sanitary, and other ordinances and regulations not in conflict with general laws; and WHEREAS, a fire recently damaged several residential properties in the northeast corner of the City, in an area zoned R-4; and
WHEREAS, R-4 is defined by the Gustine Municipal Code ("GMC") as a "residentia professional district," in which single-family residences are not authorized; and WHEREAS, the residences affected by the fire in the R-4 zone were constructed prior to the zoning restrictions taking effect, which makes them legal nonconforming uses subject to the requirements of Chapter 4.72 of the GMC, "Nonconforming Uses, Structures, and Parcels"; and
WHEREAS, pursuant to GMC Section 4-72-040, the City currently requires a use permit before reconstructing or rebuilding an involuntarily damaged or destroyed nonconforming single-family dwelling, even within the preexisting footprint; and WHEREAS, upon further discussion, the City Council has determined that it does not wish to require a use permit for nonconforming single-family residences to rebuild involuntarily damaged structures within the preexisting footprint, because it delays repairs to homes which have been damaged, resulting in hardship to the homeowners and the potential for the site to become dangerous or a public nuisance while awaiting the use permit; and
WHEREAS, the City therefore proposes to amend Section 4-72-040 remove the requirement to obtain a use permit, and instead allow involuntarily damaged legal nonconforming single-family residences to rebuild within the preexisting footprint without any permit from the City, as long as the rebuild complies with applicable Building and Fire Code requirements.
NOW, THEREFORE, the City Council of the City of Gustine does ordain as follows:
SECTION 1. Recitals. The recitals set forth above are true and correct and are incorporated as though fully set forth herein. These recitals constitute findings justifying the adoption of this Urgency Ordinance under Government Code section 36937.
SECTION 2. Amendment. Section 4-72-040 of the Gustine Municipal Code is hereby amended to read in full as follows:
"Sec. 4-72-040. - Residential Exemptions.
An involuntarily damaged or destroyed single-family dwelling, or multi-family structure containing two or more dwelling units, may be reconstructed, repaired, or replaced, within a o- month period, with a new structure with the same footprint, height, and number of dwelling units, regardless of the requirements of the applicable zoning district; provided that the new or repaired structure shall comply with the current Building and Fire Code requirements."
SECTION 3. Severability. If any section, subsection, subdivision, paragraph, sentence, clause or phrase added by this Ordinance, or any part thereof, is for any reason held to be unconstitutional or invalid or ineffective by any court of competent jurisdiction, such decision shall not affect the validity or effectiveness of the remaining portions of this Ordinance or any part thereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase thereof irrespective of the fact that any one or more subsections, subdivisions, paragraphs, sentences, clauses or phrases are declared unconstitutional, invalid or ineffective.
SECTION 4. CEQA. Adoption of this Ordinance is categorically exempt from the California Environmental Quality Act pursuant to Section 15301(d)(1) of the CEQA Guidelines, as it is a regulatory action covering restoration or rehabilitation of deteriorated or damaged structures to meet current standards of public health and safety (14 CCR 15301 (a) (1)).
SECTION 5. Publication. The City Clerk shall certify to the adoption of this Ordinance and shall publish or post the Ordinance as required by law.
SECTION 6. Effective Date. This Ordinance shall take effect immediately as set forth in Government Code section 36937.
