BUSTINE CITY ITEM NO. 5
COUNCIL AGENDA ITEM
MARCH 21, 2023
PREPARED BY: Tiffany Vitorino, Recreation Manager
SUBJECT: Approve Request for Use of City Park and Services for Annual 4th of July Celebration
BACKGROUND/DISCUSSION
Staff is requesting to hold activities in and around Henry Miller Park on July 4, 2023. The activities are expected to begin immediately after the 4th of July parade. Park events are scheduled to start around noon and conclude at 3:00 P.M. Public Works will be required to assist with the placement and removal of barricades, the placement and removal of extra garbage cans and general cleanup after the event. It is unknown how many people are to be expected in the park, we are planning for attendance levels to be at the pre-pandemic level of several hundred people. Two Gustine Police Officers are required to provide security at the event.
Staff would like to have several food vendors. Staff is requesting Council's authorization to allow these vendors in the park during the event. According to the Gustine Municipal Code Section 5-6-3, mobile kitchen type vendors are only allowed in manufacturing districts, except otherwise by special permission of the City Council during festivals, parades and other public events. If approved, these vendors will be responsible to obtain the necessary business license with the City and with the assistance of the Recreation Manager, will be submitting the proper paperwork to Merced County Environmental Health Department to obtain the appropriate health permits.
The following events and activities are tentatively being planned:
-Food and craft booths
-Beer booth and margarita booth
-Kids activities including bounce houses and rides
-Adult corn-hole tournament
-Music in the gazebo
-Aquatics Center open from 12PM-2PM
Staff would also like to allow the Aquatics Center to be open from 12:00PM - 2:00PM for open swim and would like Council's permission to waive the fees for patrons 12 and under.
The requested street closures, relating to the activities in the park are as follows:
-Second Avenue, between Sixth Street and West Avenue.
Streets will be closed at approximately 7:00 A.M. and are expected to re-open at approximately 3:00 P.M. Staff will ensure coordination between the Gustine Police Department, Public Works, and City staff.
FISCAL IMPACT
In the past, the pool has had approximately 30 kids under the age of 12 visit on the 4th of July therefore, would be approximately $90 in loss of revenue for the Aquatics Center.
Any staff overtime costs have been accounted for within the City's current budget.
RECOMMENDATION
Approve the request for use of City streets and services for the annual 4th of July Celebration in the Park, allow mobile food vendors to participate, and waive the fees for the Aquatics Center for the ages 12 and under.

COUNCIL AGENDA ITEM
MARCH 21, 2023
PREPAREd BY: Tiffany Vitorino, Recreation Manager
SUBJECT: Consider Authorizing the City Manager to Enter into Memorandum of Understanding with the Newman Garden Club
BACKGROUND/DISCUSSION
In the past Council approved several improvement projects for the Al Goman Community Center. The latest project completed was the front window and door replacement. With the recent exterior painting combined with the new window facade, the Goman Center's exterior has improved, however, there is a need for landscaping. Staff has been in contact with the Newman Garden Club, also known as the Newman-Gustine Garden Club, which boasts several Gustine members. The group along with staff has come up with a solution to landscape the front of the building at a limited cost to the City.
Staff has met with the Club who are interested in landscaping the area by adding large potted plants and trees that would be donated by the Club. The Club would also agree to design, implement, and maintain the landscaping and replenish the area with seasonal flowers. Currently the Goman Center's landscape consist of a few straggly plants and recently Public Works removed a large tree that was causing damage to the entrance sidewalk. This has given the Club a blank canvas to work with.
If approved, the Garden Club is asking the City's Public Works Department to upgrade the existing drip system and install a timer that will provide a consistent water supply to the improved landscape. The Garden Club is asking that the City pay for any irrigation and drip system supplies including a timer with a budget that should not exceed $500.
The Garden Club raises funds for projects like this and one of their major fundraisers is their annual "Garden of Tables." This event normally takes place at Pea Soup Andersen's and consists of a luncheon with members and volunteers decorating and arranging individual garden-like tables. Tickets are sold to residents of Gustine and Newman and the profit is used for projects throughout the two communities. The Pea Soup Anderson location in Santa Nella has always been suitable in the past however, the Garden Club is having issues with the stairs to their banquet room and would like to move the event closer to the two communities. The Garden Club would like to move this event to the Goman Center and in exchange for their year-round upkeep of the exterior front landscape, they are requesting Council to waive the Goman Rental fees for this annual event. The Club would also like to have the cleaning fees waived as well.
Exhibit B to this staff report is the proposed Memorandum of Understanding (MOU) between the City and the Newman Garden Club, which clearly states each party's responsibilities with regard to the Club's installation and regular upkeep of the exterior landscaping in the front of the Goman Center. The MOU as presented states that the Club will receive full waiver of all rental fees and cleaning fees associated with their two-day event held once annually. As a means of recognition, the Garden Club would like the City to erect a yard sign with the club name and project listed. The sign would cost approximately $50.
FISCAL IMPACT
The fiscal impact would be the loss of revenue for the Al Goman Community Center at the current service club rate of $475 per day for two days which comes to $950. Council can choose to waive the cleaning fee of $300 as well if they wish; however, it is customary to hold a refundable deposit pending completion of the event in which City staff verify no damages or excessive cleaning charges are warranted. Fiscal impact would also include the expense of the drip system repairs not to exceed $500 and the purchase of a yard sign listing the project and Clubs name not to exceed $50. Staff is suggesting the drip system, timer and sign be funded from the User Utility Tax Fund (Fund 002). Staff has identified this minimal loss of revenue to be negated by the enhanced landscaping that will be beneficial to all that visit the Al Goman Center.
The MOU also allows for an automatic renewal annually, waiver amounts would be subject to the current approved rental fee and cleaning fee rates of the facility, and have the potential to increase if the rental fees are increased over time.
RECOMMENDATION
Staff recommends Council to:
1. Consider authorizing the City Manager to enter into a Memorandum of Understanding with the Newman Garden Club for landscaping the front exterior of the Goman Center, which also approves waiving the rental fees and cleaning fees of the Goman Center for their two-day annual fundraiser event annually for the term of the agreement.
2. Consider authorizing an expense from the UUT not to exceed $550 for installation of a drip irrigation system, associated timer and yard sign.

Of the $248,395 "other" monies, the City of Gustine will receive $4,968 to use for local streets and roads purposes.
At the August 18, 2022, Merced County Association of Governments (MCAG) Board of Directors meeting, the Governing Board approved the allocation of Local Transportation Funds (LTF) to be allocated to all member agencies, based on the allocation shown in the table below:
