ITEM NO. 4

COUNCIL AGENDA ITEM
APRIL 4, 2023
PREPARED BY: Anna Nicholas, City Manager
SUBJECT: Approval of Resolution authorizing the Amended and Restated Farm Lease Agreement for Parcel Number 063-160-014, between the City of Gustine and Dustin Kuykendall, tenant

BACKGROUND/DISCUSSION
On April 25, 2017, City Council approved a five-year lease agreement with Dustin Kuykendall, "Tenant". The lease agreement was for grazing rights for Assessor's Parcel Number 063-160-014. The said agreement expired on January 27, 2022, as per the agreement.

From discussions with the Tenant, and further research, it appears after the lease expired in 2022, a verbal agreement was authorized by previous City administration to continue the grazing rights arrangement that was established by the former lease.

There was no written agreement, or written extension to the previously expired agreement. The Tenant continued annual payments and paid in March 2022, to lease the parcel for the operating year of 2022-2023.

Earlier this year, the Tenant reached out to the City with the desire to continue the lease agreement. City staff have negotiated an agreement with the Tenant and have come to a mutual agreement that again includes a five-year leasing term. The first payment is due upon execution of the lease and represents a five (5) percent increase from the previous year's (2022) payment. Each annual payment thereafter includes a five (5) percent increase from the prior year.

Operating Year Operating Dates Payment Date Amount
Year 1 2023-2024 4/1/23-3/31/24 4/1/2023 $23,692.00

Year 3 2025-2026 4/1/25-3/31/26 4/1/2025 $26,121.00
Year 4 2026-2027 4/1/26-3/31/27 4/1/2026 $27,427.00
Year 5 2027-2028 4/1/27-3/31/28 4/1/2027 $28,798.00

FISCAL IMPACT
The City will gain annual leasing revenue which is currently set up to be deposited as General Fund Revenue: Grazing Income, per the above payment table.

WHEREAS, City currently leases the property to Dustin Kuykendall ("Tenant") under the certain Farm Lease Agreement that ended January 2022, and continued for one year thereafter; and
WHEREAS, Tenant and City wish to continue its leasing agreements; and WHEREAS, the City is willing to lease Tenant the property under the terms of that Farm Lease Agreement attached as Exhibit "B" ("Lease"); and WHEREAS, subject to the terms and conditions of the Lease, Tenant shall use the property solely for agricultural farming and related purposes, in accordance with good husbandry and the best practices in the agricultural community in which the property is located; and
WHEREAS, pursuant to its authority under Government Code section 37350 the City of Gustine may purchase, lease, receive, hold, and enjoy real and personal property, and control and dispose of it for the common benefit; and WHEREAS, the Lease of the property to Tenant serves the common benefit by ensuring the property is put to good and productive agricultural use and maintained in good order, preventing waste and nuisance; and
WHEREAS, the property is not surplus property subject to the requirements of Government Code section 54220 et seq. because the property may be necessary in the future for City wastewater purposes or other City uses; and WHEREAS, the City Council wishes to approve the Lease of the property to Tenant on the terms and conditions set forth in this Resolution.

The Lease of the property from City to Tenant for agricultural purposes, a use consistent with the property's existing use, serves the common benefit and community by ensuring the land is used and maintained in good order and repair for a productive and beneficial use, and therefore also helps prevent waste and nuisance from occurring on the property.

2. The property is not surplus, and therefore is not subject to the requirements and procedures set forth in Government Code section 54220, because the property may be necessary for future City uses and purposes, including for the City's Wastewater Treatment Plant activities or other needed public uses. As such, the City Council finds and determines that the property is still necessary for the City's use.

21. Mechanics' Liens. Tenant shall keep Premises free and clear of any and all liens arising out of any work performed or materials furnished at the request of Tenant, or obligations incurred by Tenant. If a lien or claim of lien is recorded against the Premises, whether the same arises out of any work performed, materials furnished or obligations incurred by Tenant or is imposed by any agency including the Central California Irrigation District, Tenant shall remove or discharge the same within ten (10) days after the lien or claim of lien is filed. City shall have the right, but not the obligation, to pay and discharge any such lien. If City pays and discharges any such lien, Tenant shall reimburse City for all costs and expenses incurred by City in discharging such lien, including attorneys' fees, within ten (10) days after the date of receipt of City's invoice for such costs and expenses.
28859.00009\29724856.1 4
Insurance. Tenant shall obtain and maintain during the term of this Lease, at Tenant's expense, fire and general liability insurance coverage to protect City and Tenant from any public liability, property and fire damage occurring upon the Premises ("Required Insurance"). The limits of liability under this Required Insurance must be for amounts not less than one million dollars ($1,000,000.00) single limit, two million dollars ($2,000,000.00) general aggregate. Such coverage shall be obtained from a company licensed in the State of California. Tenant shall provide evidence of insurance to City, showing City as an additional insured. City shall receive written notice no less than 30 days prior to any cancellation of insurance. If Tenant does not keep insurance in force, City may obtain necessary insurance and pay the premium. Tenant shall repay the premium within 10 days of City's written demand. Tenant further agrees to maintain during the term of this Lease at Tenant's own expense proper and adequate worker's compensation insurance as required by law.

23. Indemnity. Tenant agrees to indemnify, protect, defend, and hold City harmless from all liability and claims for damages arising directly or indirectly from any injury from any cause to any person, including Tenant or any employee or agent of Tenant, or to property of any kind belonging to anyone, including Tenant or any employee or agent of Tenant, while in, upon, or in any way connected with the Premises. Tenant's obligation shall survive termination or expiration of this Lease, and shall not be restricted to insurance proceeds, if any, received by City or its directors, officials, officers, agents or employees.

24. Use of Fertilizers, Pesticides and Other Hazardous Substances and Environmental Indemnity. Tenant shall not generate, use, treat, store, handle, release or dispose of, or permit the generation, use, treatment, storage, handling, release or disposal of Hazardous Materials on, under, about or within the Premises, or transport or permit the transportation of Hazardous Materials to or from the Premises, except for such Hazardous Materials as may be required in the operation and maintenance of the Premises, and then only upon the written consent of City (such consent may be withheld in City's sole and absolute discretion) and in compliance with all laws.

During the term of this Lease, Tenant shall comply with any and all federal, state, or local laws, rules, regulations, ordinances, codes, policies or rules of common law now or hereafter in effect and in each case as amended, and any judicial or administrative interpretation thereof, including any judicial or administrative order, consent decree or judgment, relating to the environment, health, safety or Hazardous Materials and applicable to the operation or use of the Premises. Tenant will cause all other persons occupying or using the Premises to comply with all such laws and authorities, and will immediately pay or cause to be paid all costs and expenses incurred by reason of such compliance.

For purposes of this Lease, the term "Hazardous Materials" means: (a) any substance, products, waste, or other material of any nature whatsoever which is or becomes listed, regulated, or addressed pursuant to the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), 42 U.S.C. § 9601 et seq.; the Resources Conservation and Recovery Act, 42 U.S.C. § 6901 et seq; the Clean Water Act, 33 U.S.C. § 1251 et seq.; the Toxic Substances Control Act, 15 U.S.C. § 2601 et seq.; the California Hazardous Waste Control Act, Health and Safety Code § 25100 et seq.; the California Safe Drinking Water and Toxic Enforcement Act, Health and Safety Code § 25249.5 et seq.; California Health and Safety Code Section 25280 et seq. (Underground Storage of Hazardous Substances); California Health and Safety Code Section 25501 et seq. (Hazardous Materials Release Response Plans and Inventories); or the California Porter-Cologne Water Quality Control Act, Water Code § 13000 et seq., all as amended (the above cited California state statutes are hereinafter collectively referred to as "the State Toxic Substances Law"); or any other federal, state, or local statute, law, ordinance, resolution, code, rule, regulation, 28859.00009\29724856.1 5
order or decree regulating, relating to, or imposing liability or standards of conduct concerning any Hazardous Material, now or at any time hereinafter in effect; (b) any substance, product, waste or other material of any nature whatsoever which may give rise to liability under any of the above statutes or under any statutory or common law theory based on negligence, trespass, intentional tort, nuisance or strict liability or under any reported decisions of a state or federal court; (c) petroleum or crude oil, other than petroleum and petroleum products which are contained within regularly operated motor vehicles; and (d) asbestos.

City makes no warranty or representation whatsoever concerning the Premises, including without limitation, the condition, fitness or utility for any purpose thereof, of any improvements thereto with applicable laws, ordinances or governmental regulations. Tenant's right to use the Premises is strictly on an "as is" basis with all faults. City hereby disclaims all warranties whatsoever, express or implied, regarding the condition of the soil (or water), geology, and any warranty of merchantability or habitability or fitness for a particular purpose.

City or its officers, employees, contractors, or agents shall at all times have the right to go upon and inspect the Premises and the operations conducted thereon to assure compliance with the requirements herein stated. This inspection may include taking samples for chemical analysis of substances and materials present and/or testing soils on the Premises and taking photographs.

Tenant shall, within forty-eight (48) hours of the discovery by Tenant of the presence of, or believed presence of, a Hazardous Material as defined herein, give written notice to City in the event that Tenant knows or has reasonable cause to believe that any release of Hazardous Material has come or will come to be located on, under, about or within the Premises. The failure to disclose in a timely manner the release of a Hazardous Material, including but not limited to, an amount which is required to be reported to a state or local agency pursuant to law (e.g., California's Hazardous Materials Storage and Emergency Response Act, Health and Safety Code § 25550 et seq.) shall be grounds for termination of this Lease by City in addition to actual damages and other remedies provided by law. Tenant shall immediately clean up and completely remove all Hazardous Materials placed by Tenant or anyone else on, under, about or within the Premises, in a manner that is in all respects safe and in accordance with all applicable laws, rules and regulations. Tenant shall disclose to City the specific information regarding Tenant's discovery of any Hazardous Materials placed on, under, about or within the Premises by Tenant or its employees or agents, and provide written documentation of its safe and legal disposal.

Breach of any of the covenants, terms, and conditions contained in this section shall give City the authority to either immediately terminate this Lease or to require the shutdown of Tenant's operations thereon, at the sole discretion of City. In either case, Tenant will continue to be liable under this Lease to remove and mitigate all Hazardous Substances placed by Tenant on, under, about or within Premises. Tenant shall be responsible for, and bear the entire cost of removal and disposal of, all Hazardous Materials introduced to the Premises by Tenant during Tenant's period of use and possession of the Premises. Upon termination of this Lease, Tenant shall, in accordance with all laws, remove from the Premises any equipment or improvements placed on the Premises by Tenant that may be contaminated by Hazardous Materials.

Tenant shall defend, indemnify and hold City and its officials, officers, employees, contractors and agents free and harmless from any and all claims, liability, injury, damage, costs, or expenses (including, without limitation, the cost of attorney's fees) arising as a result of the presence of use of any Hazardous Materials placed or caused to be placed by Tenant or its agents, contractors or employees on the Premises. The foregoing indemnity is intended to operate as an agreement pursuant to, among other requirements, Chapter 103, subdivision (e) of CERCLA, 42 U.S.C. § 28859.00009\29724856.1 6
9607, and California Health and Safety Code § 25364, to insure, protect, hold harmless and indemnify each Party from any liability created by the other Party pursuant to such sections. The provisions of this section shall survive the expiration or termination of this Lease.

25. Default by Tenant / Liquidated Damages. All covenants and agreements contained in this Lease are conditions to this Lease. In the event Tenant breaches this Lease, City may exercise all of its rights and remedies as may be available at law or in equity, including but not limited to, the remedy provided by Section 1951.2 of the California Civil Code. All rights, powers and remedies of City hereunder and under any other agreement now or hereafter in force between City and Tenant, shall be cumulative and not alternative and shall be in addition to all rights, powers and remedies given to Lessor by law, and the exercise of one or more rights or remedies shall not impair City's right to exercise any other right or remedy.

Without limiting the generality of the foregoing, City has the remedy described in California Civil Code section 1951.4 (City may continue Lease in effect after Tenant's breach and abandonment and recover rent as it becomes due, if Tenant has right to sublet or assign, subject only to reasonable limitations). Consequently, if Tenant breaches this Lease and abandons the property, City may elect that (1) the Lease will continue in effect for so long as City does not terminate Tenant's right to possession, and (2) City may enforce all of City's rights and remedies under this Lease, including the right to recover the rent as it becomes due under this Lease. For these purposes, the following do not constitute a termination of Tenant's right to possession: (a) acts of maintenance or preservation, (b) efforts to re-let the property, and (c) the appointment of a receiver on initiative of City to protect City's interests under this Lease.

Should Tenant default in the performance of any covenant, condition or agreement contained in this Lease, City may, in addition to other rights and remedies, terminate this Lease and re-enter and regain possession of the Premises in the manner then provided by the unlawful detainer laws of the State of California. If Tenant defaults in the performance of any covenant, condition or agreement in this Lease, City shall be released from any obligation to lease the Premises to Tenant.

Further, City may harvest, retain, and dispose of, as liquidated damages, all crops, harvested or unharvested, on Premises. After taking possession of such crops, City shall not be obligated to compensate Tenant for them. If the cost of harvest or disposal of any crops exceeds the monetary value of those crops, Tenant shall pay City the difference in the monetary value of the crops and the cost of harvesting or disposal of them. City shall be entitled to all other remedies available under the laws of the State of California, and the retention of crops, if any, shall not be in lieu of City's rights to all rent, past, present and future, as well as other costs provided in this Lease.

Further, in the event of Tenant's default, City may remove all persons and property from the Premises, and take possession of any such property without obligation to compensate Tenant for it.

If City elects to re-enter, as provided above, or to take possession under legal proceedings or under any notice provided for by law, City may (a) terminate this Lease, or (b) from time to time, without terminating this Lease, re-let the entire or any part of the Premises for such terms (which may extend beyond the term of this Lease) and at such rentals and other conditions as City, in City's sole discretion, deems advisable. City also has the right to make alterations and repairs to the Premises. On each re-letting, at City's discretion, Tenant shall be immediately liable to pay City (a) the expenses of re-letting and of making alterations and repairs incurred by City, (b) any amount by which the rent specified in this Lease for the period of re-letting exceeds the amount agreed to by the new tenant to be paid for the Premises, with the deficiency to be calculated and paid monthly, and (c) all other indebtedness due under the Lease. 28859.00009\29724856.1 7
No re-entry or taking possession of the Premises by City shall be construed as an election by City to terminate this Lease unless written notice of such an intention is given to Tenant or the Lease is declared to be terminated by a court of competent jurisdiction. Even though the re-letting was without termination by City, City may at any future time elect to terminate the Lease for the previous breach by Tenant. If City terminates the Lease for a breach in addition to any other remedy City may have, City may recover from Tenant all damages City incurs by reason of the breach, including both the cost of recovering the Premises and the worth, at the time of termination, of the excess of the amount of rent and charges equivalent to rent specified in this Lease, for the remainder of the stated term, over the then-reasonable rental value of the Premises for the remainder of the term. All of these amounts shall be immediately due from Tenant to City.

Nothing contained in this Lease, and no security or guarantee of the Tenant that City holds now or in the future under the Lease, shall in any way constitute a bar or defense to an action by City in unlawful detainer or for recovery of the Premises.

Insolvency by Tenant. The insolvency of Tenant, as evidenced by the appointment of a receiver to take possession of all or substantially all of the assets of Tenant, the making of a general assignment by Tenant for the benefit of creditors, or an action taken or suffered by Tenant under any bankruptcy or insolvency act, shall, at the option of City, constitute a breach of this Lease by Tenant. Under such circumstances City may terminate this Lease and re-enter and regain possession of the Premises.

27. Waiver. The waiver by City of any breach of any term, covenant, condition or provision contained in this Lease shall not be deemed to be a waiver of such term, covenant, condition or provision, or as a waiver of a future breach of the same or any other term, covenant, condition or provision contained in this Lease. The acceptance of rent by City shall not be treated as a waiver of a previous breach by Tenant of any term, covenant, condition or provision in this Lease, other than the failure of Tenant to pay the particular rental so accepted, regardless of City's knowledge of a previous breach at the time of acceptance of rent.

28. _ Action of Receiver. If, in an action against Tenant, City has a receiver appointed to take possession of the Premises, or to collect the rents or profits derived from the Premises, or both, the receiver has the right, if it is necessary or convenient in order to collect rents or profits, to conduct the business of Tenant then being carried on on the Premises and to take possession of any personal property belonging to Tenant and used in the conduct of the business, and to use the personal property in conducting the business on the Premises. Neither the application for the appointment of the receiver, nor the appointment of the receiver, shall be construed as an election by City to terminate this Lease unless a written notice of such intention is given to Tenant.

29. Attorneys' Fees. The prevailing party in any action brought by either party hereto, based on any claim arising under this Lease, shall be entitled to reasonable attorneys' and/or consultants' fees.

30. Time and Materiality. Time is of the essence with respect to the performance of every provision of this Lease in which time or performance is a factor. Each provision of this Lease is made and declared to be a material, necessary and essential part of this Lease.

31. Notices. All notices, demands and the like, which are required to be given under this Lease, or which either Party may desire to give to the other, shall be given in writing and may be delivered personally or may be sent by registered or certified mail, postage prepaid, to each of the parties at 28859.00009\29724856.1 8

Such 2016 Lease is expressly terminated and of no further force or effect.

33. Invalidity. SUBJECT: Approve Resolution Directing the Filing of Annual Reports for the City's Assessment Districts

BACKGROUND/DISCUSSION
The attached Resolution is the first step in the yearly process of establishing and levying assessments for assessment districts formed under the Landscaping and Lighting Act of 1972.

In order to meet the timelines required by the Landscaping and Lighting Act of 1972 (herein the "Act") and the Government Code, it is now necessary to initiate proceedings for the annual levy of assessments against all properties in the District. The City of Gustine has three assessment districts: 1. Citywide Lighting and Landscaping Assessment District, 2. Southport Assessment District, and 3. Borelli Assessment District.

The process will determine the per parcel rate to be charged for lighting and landscaping for the upcoming budget year. Once the analysis has been completed the reports will be brought back for Council review and approval.

COUNCIL AGENDA ITEM
APRIL 4, 2023
PREPARED BY: Tiffany Vitorino, Recreation Manager
SUBJECT: 5th Annual Westside 5K Color Run/Walk Street Closure Request

BACKGROUND/DISCUSSION
The City of Gustine Recreation Department is excited to host the 6th Annual Westside 5K Color Run/Walk on July 1, 2023. Statt has re-evaluated the event and is proposing cost saving changes with minimal impact on the events enjoyment for the participants.

In the past, the event would require several street closures from 5'h Street all the way to the west side of Ranchwood, which became costly to the event especially the expense for barricade rentals, as well as arranging volunteers. This year staff would like to make a change and cut the route in half, this will require the participants to make a second lap to complete the full 3.1-mile (5K) race. Staff will organize the same number of color stations as before, however the shorter route will allow them to be closer. Staff is hoping these changes will allow a more organized and cost efficient event. The Color Run/Walk start time will also change to be an hour later and will begin at 9:00 AM, this is in hopes that more community members can participate or just come to cheer on the participants.

The Start/Finish line will continue to be at the intersection of 5th Street and 4'h Avenue.

The event will conclude at approximately 11:00 AM the street closures will begin at 7:00 AM and reopen at 12:00 PM and will include the following streets:

Leg 1 - 5th Street between 4th Ave and 5th Ave
Leg 2 - 5'n Ave between 5'h Street and West Ave.

Leg 3 - West Ave. between 5th Ave. and Lucerne Ave.

Leg 4 - Lucerne Ave. between West Ave. and Laurel Ave.

Leg 5 - Laurel Ave. between Lucerne Ave. and North Ave.

Leg 6 - North Ave. between Laurel Ave and 5'h Street.

Leg 7 - 5th Street between North Ave. and 4th Ave
The Recreation Department will be working with the Police Department and Public Works to ensure all safety precautions and street barricades are in place. The Color Run will end with an award ceremony that will be on a stage/trailer at the intersection of 5'h Street and 4* Avenue between the Gustine Hotel and Pioneer Drug. There will also be several contests for the participants and sponsors throughout the event.

Staff would like to include various types of vendors including a few food vendors who have expressed interest in participating. Once approved, staff is hoping the advertising of the vendors along with the promotion of the event will encourage community participation. Staff is requesting Council's authorization to allow food truck vendors downtown during the event. Food vendors chosen will not be in direct competition of the downtown businesses that will be open during the event.

According to the Gustine Municipal Code Section 5-6-3, mobile kitchen type vendors are only allowed in manufacturing districts, except otherwise by special permission of the City Council during festivals, parades and other public events. Staff will ensure that the vendors will have the appropriate City business license and will work closely with Merced County.

FISCAL IMPACT
Any staff overtime costs have been accounted for within the City's current budget.

RECOMMENDATION
Council to consider authorizing the use of City streets and allowance of mobile food vendors for the 6th Annual Westside 5K Color Run/Walk.

COUNCIL AGENDA ITEM
APRIL 4, 2023
PREPARED BY: Ruben Chavez, Chief of Police
SUBJECT: Approve Resolution Approving Contract Between City of Gustine and Gustine Unified School District for School Resource Officer Services

BACKGROUND/DISCUSSION
The City of Gustine has been providing School Resource Officer (SRO) services to the Gustine Unified School District since 2010. This allows the School District to employ one police officer, through the City, to work at all District Schools to include Gustine High School, Gustine Middle School, Gustine Elementary, and Romero Elementary in Santa Nella.

The SRO employed is duly sworn Gustine Police Officer assigned to the assignment by the Chief of Police. At times the officer may not be available at which times a day shift officer may be assigned for the day. The officer provides a variety of services to include campus patrols, presentations, law enforcement, and Police Explorer advising.

The SRO may at times be assigned special school details such as sporting events, dances, and graduation.

FISCAL IMPACT
The contract pays at total of $57,240 per year billed on a quarterly basis. While the contract is equal to a Police Officer Step A, without benefits, there are times, such as school holidays and summer school that the officer is not required to be on campus.

This allows the officer to assist with other patrol assignments. The contract is for one year ending June 30, 2024 with an optional automatic one-year extension.

RECOMMENDATION
Approve the resolution which approves the contract with the Gustine Unified School District for School Resource Officer services for the 2023-2024 School Year with an automatic one-year renewal, as well as authorizes the City Manager to execute said contract.

The Parties understand student privacy rights limit the City's and assigned officer's access to District information, which may limit the City's and officer's ability to perceive a potential threat.

The Parties anticipate the assigned officer's duties and travel between campuses will take the officer off-campus and result in the lack of the presence of an officer and marked vehicle during such times.

G. The Parties acknowledge there is no viable legal theory on which a claim and/or cause of action could arise out of the absence of the assigned officer and/or the patrol vehicle at a school.

Therefore, the Parties agree that absence of the assigned officer and/or the patrol vehicle at a school shall not be considered a substantial cause of an act or omission giving rise to a claim and/or cause of action against the City or the assigned officer.

NOW, THEREFORE, in consideration of the recitals, covenants, terms, and conditions, in this Agreement, the Parties agree:

AGREEMENT

SECTION 3. DUTY SCHEDULE. SRO duty hours shall be from 7:30 AM to 3:00 PM. Whenever possible, it is the intent of the Parties that the SRO's duty hours shall conform to the school day. It is not a material breach of this Agreement if the SRO and/or marked police vehicle is absent from campus.

SECTION 9. TERMINATION OR SUSPENSION OF AGREEMENT OR SERVICES.

9.1 The Parties understand that staffing and/or operational demands may require City to withdraw the SRO for other duties and agree that City may do so at its discretion at any time. If the City withdraws pursuant to this Section, it will notify the District as soon as practical.

9.2 Either Party may suspend the performance of the Services, in whole or in part, or terminate this Agreement, with or without cause, by giving thirty (30) days prior written notice thereof to the other Party. Upon receipt of such notice, City will immediately discontinue its performance of the Services.

9.3 Upon such suspension or termination by either Party, City will be paid for the Services rendered or materials delivered to District in accordance with the Scope of Services on or before the effective date (i.e., 30 days after giving notice) of suspension or termination. TINE CITY ITEM NO. 8

COUNCIL AGENDA ITEM
APRIL 4, 2023
PREPARED BY: Anna Nicholas, City Manager
SUBJECT: Approve signing League of California Cities support letter for AB 1708

BACKGROUND/DISCUSSION
The League of California Cities, of which the City of Gustine is a member city, has asked tor member cities to complete letters of support for AB 1708. AB 1708 would amend Proposition 47 to increase accountability for repeat theft offenders and offer pathways for pre-plea diversion programming. Due to an increase in repeated crime, such as shoplifting, Assemblymember Al Muratsuchi has authorized AB 1708 to assist in reversing some of the trends created by Proposition 47.

Approved in 2014, Prop. 47 re-categorized some nonviolent offenses, such as shoplifting, as misdemeanors. AB 1708 would require a person convicted of petty theft or shoplifting, with two or more prior convictions for specified theft-related offenses, to be punished by imprisonment in county jail for up to one year. In addition, AB 1708 would authorize a city or county prosecuting authority, or county probation department, to create a diversion program for persons who commit repeat theft offenses.

The League of California Cities is requesting the support of member cities in its mission to advance cities' interests by working with lawmakers on bills that target common issues cities are confronted with. Any provisions that amend Prop. 47 would become effective only upon approval by the voters at the next statewide general election. If signed into law, the changes proposed by AB 1708 would be placed on the 2024 statewide ballot for voter approval.

FISCAL IMPACT
There is no fiscal impact associated with this item.

RECOMMENDATION
The recommendation is for City Council to authorize the City Manager, or designee, to complete a letter of support for AB 1708 and forward to the appropriate recipients.

SUPPORT
- ACTION
AB 1708 would amend Proposition 47 to increase accountability for repeat theft offenders and offer pathways for pre-plea diversion programming.

Voice your support for AB 1708 by contacting your legislators and submitting a letter TODAY. A sample letter is attached.

Background: Proposition 47 made promises of safe neighborhoods, but the unintended consequences that followed have provided anything but. Our communities deserve better, and cities are more than ready to find solutions that fix Proposition 47.

What does AB 1708 specifically do?
• Require a person convicted of petty theft or shoplifting, with two or more prior convictions for specified theft-related offenses, to be punished by imprisonment in county jail for up to one year.
• Authorize a city, county prosecuting authority, or county probation department to create a diversion program for persons who commit repeat theft offenses.
• Any provisions that amend Proposition 47 would become effective only upon approval by the voters at the next statewide general election.

Talking points:
• According to a February 2023 study conducted by the Public Policy Institute of California, a strong majority of Californians worry they or a family member will be a victim of a crime.
• Cities are feeling impacts from crime-related activity in their communities and are looking for solutions to fix Proposition 47. According to a February 2023 study conducted by the Public Policy Institute of California, a strong majority of Californians worry they or a family member will be a victim of a crime (21% very, 44% somewhat).
• We need to increase accountability for those who continue to create victims throughout our communities.
• Mental health and substance use treatment programming are essential to lowering recidivism rates and increasing community wellness.
• AB 1708 would provide appropriate revisions to Proposition 47 that more holistically address the root causes of crime.

RE: AB 1708 (Muratsuchi) Theft.

Notice of SUPPORT (As Amended 3/9/23)
Dear Assembly Member Jones-Sawyer,
The City/Town of is pleased to support AB 1708 (Muratsuchi). This measure would increase accountability for repeat theft offenders and offer pathways for pre- plea diversion programming. If passed, the bill would send the issue to the voters for approval at the next statewide general election.

This strategy is one of many supported by cities to address crime and its underlying causes. We remain committed to improving California's carceral systems, interrupting and ending cycles of recidivism, and building a community-based system of care that appropriately meets the needs of all community members.

Proposition 47 of 2014 made promises of safe neighborhoods, but the unintended consequences that followed have provided anything but. According to a February 2023 study conducted by the Public Policy Institute of California, a strong majority of Californians worry they or a family member will be a victim of a crime (21% very, 44% somewhat). This is the sentiment being felt by residents of cities throughout the state.

PLEASE CITE HOW YOUR CITY WILL BE AFFECTED BY THIS BILL HERE.

Our communities deserve better, and cities are more than ready to find solutions that fix Proposition 47.

The City/Town of is keenly interested in exploring additional strategies to address the impacts of crime in our communities. This includes resources to improve community safety through prevention and early intervention programming, as well as improved re- entry service provision for our formerly incarcerated community members. While these provisions have historically been the responsibility of state and county departments, cities are interested in increased collaboration to meet these urgent needs.

For these reasons, the City/Town of requests your support on AB 1708.

Sincerely,
