COUNCIL AGENDA ITEM
APRIL 18, 2023
PREPAREd By: Tiffany Vitorino, Recreation Manager
SUBJECT: Approve Request for Competitive Business at Motors on Main Event on April 29, 2023

BACKGROUND/DISCUSSION
On October 4, 2022, City Council approved a car show event hosted by Bernie Mederos and Motors on Main for February 25, 2023. All preparations were completed and ready to go. Unfortunately, due to weather, the event was postponed to April 29, 2023. The event times will remain the same from 8:00am to 4:00pm down 5*h (Main) Street between the blocks of 5th Ave and 3rd Ave. The Motors on Main event supports Jessica's House and many other local community projects and events.

Event preparations included Ms. Medeiros obtaining an ABC license for the local bars to sell outside to the public and allow the ability for attendees to walk around with their beverages enjoying the cars. Any adult beverages would be restricted to the boundaries of the car show which would be monitored by officers who are assigned to the event.

Ms. Medeiros has recently asked staff for permission to add a wine booth to the event.

Due to the agreement made and according to the staff report that was presented to Council, vendors in direct competition with any other downtown business would not be allowed at the event. Currently there are two local bars and a taproom; therefore, staff felt that the wine sales could be considered direct competition of those businesses.

According to Department of Alcohol and Beverage Control (ABC) the alcohol license that Motors on Main has obtained will also be sufficient to sell wine as vendor. In order to present, the amended approval to Council, staff requested Ms. Medeiros to obtain written permission from the three competing businesses in question and have them sign an agreement giving permission and stating these sales would not be in direct competition.

FISCAL IMPACT
There will be no fiscal impact for this amended approval.

RECOMMENDATION
Staff recommends that Council approve the request to add a wine vendor to the event.

Re: Memorial Car Show Wine Booth
Dear Distinguished City Council Members,
Motors on Main is requesting permission to have a wine booth at the 2nd Annual Motors on Main Memorial Car Show which will be held on April 29, 2023.

The current alcohol license that Motors on Main applies for will also be sufficient to sell wine.

The City of Gustine asked me to contact these businesses and get their consent before bringing the request to the City Council meeting on April 18, 2023.

I have reached out to the three local businesses in town selling alcohol:

The Pastime
The Gustine Club
Whichcraft Taproom
All three businesses stated that they did not feel that this would be in competition with them.

With deep appreciation,

COUNCIL AGENDA ITEM
APRIL 18, 2023
PREPARED BY: Melanie Correa, Administrative Services Director SUBJECT: Approve Updated Waste Water Operator Job Description

BACKGROUND/DISCUSSION
In September 2022, Council approved a new classification and job description for Waste Water Treatment Operator-In-Training (OIT). At that time, one current City staff member had secured an OIT certificate, and since has logged the necessary 1,800 qualifying experience hours and successfully passed the Waste Water Operator Grade I exam, securing his Grade I certificate on March 27, 2023.

As such, staff has reviewed and made minor updates to the already established Waste Water Operator job description. Updates include specifying reporting requirements, SCADA wastewater monitoring responsibilities, and adding a preference of a Class B driver's license designation.

A promotion to Waste Water Operator is the natural progressive movement for Waste Water OlTs. A salary range for Waste Water Operator is already established on the City's adopted Annual Salary Schedule.

With the reclassification of the OIT to the Waste Water Operator position, and the future hiring of a Public Works Director, the City will begin transitioning out the Task Order hours for services with Gouveia Engineering specific to Waste Water Treatment tasks.

FISCAL IMPACT
There is no fiscal impact associated with the updating of the job description.

With the approval of the updated job description, the current WW OIT will promote to Waste Water Operator, which will afford a 5% increase in base salary. Funding for this position will be cost-allocated according to the budgeted salary figures for Waste Water personnel. The reclassification will create a vacancy for a Maintenance Worker position which will be budgeted for in the annual operating budget.

RECOMMENDATION
Council approve the updated job description for Waste Water Operator.

COUNCIL AGENDA ITEM
APRIL 18, 2023
PREPARED BY: Jami Westervelt, Economic and Community Development Director SUBJECT: Multijurisdictional Housing Element and SB2 Planning Grant Work Update and Task Order for Related Planning Activities

BACKGROUND/DISCUSSION
In 2019, the City of Gustine received a grant from the State of California Department of of Housing and Community Development providing planning grant program funds (SB2) to the City. The staff report at the time identified the funds as intended for planning activities to assist with housing production and stated that the City intended to use the funds to update the City's General Plan.

The State has continually tightened housing mandates and planning requirements for local jurisdictions in recent years. Notable in that category is the sixth-cycle housing element update requirements. Merced County jurisdictions decided to work on this chalenge together and were able to obtain funding to help support a Multi Jurisdictional Housing Element (MJHE). Even with this funding, the jurisdictions need to each contribute additional local planning dollars to meet the cost of the individual needs related to the MJHE and sixth-cycle housing element requirements.

The Council approved the City of Gustine participation in the MJHE in November 2022.

Although the City budget did not contain the expenditure to participate or other funding toward work on the pending sixth-cycle housing element, the Council recognized that the State requires the City complete this work and identified the MJHE as providing distinct advantages over attempting the update completely on its own.

As was noted at the time, each of the jurisdictions also will need to conduct additional work to meet specific situations and requirements for its housing elements. These requirements vary by jurisdiction and some may have the capacity in-house to complete those, while others may need to enlist consultants to complete the work.

Need to contract out is generally a function of staff size/capacity, expertise, and complexity of applicable requirements on the jurisdiction. In recent history, the City of Gustine has contracted for Housing Element work as well as for planning services for both daily planning activities and project planning such as housing development applications. Working on the 2019 SB2 Planning grant were the City Manager and a contract consultant who had worked with the City on housing previously—Martin Carver/Net Zero consulting.

In August 2022, the Interim City Manager received notice from the State that they were extending deadline on the SB2 planning grants. At that time, following departure of the former City Manager, there were no current staff that had worked on that grant.

Current staff researched and confirmed no expenditures were recorded at the City for the grant and the state received no reimbursement requests for reimbursement.

Although the City worked on planning activities between 2019 and 2022, the consultant confirmed this was not the work within the SB2 planning grant. Since that time, the City has been working with the State to determine the allowable uses for those funds and discuss a scope change.

The City has submitted a scope change to the State that would allow the City to fund its portion of the MJHE as well as additional planning activities toward the MJHE housing planning and other planning elements related to the General Plan. While the SB2 grant cannot possibly cover a full General Plan update, which generally costs several thousands of dollars more than the amount of the SB2 grant and takes a significant amount of time to complete, the grant can fund vital planning the City needs to undertake as soon as possible.

The attached narrative of the draft scope submitted to the State illustrates a full range of scope work that the City seeks permission to use the SB2 funding on. The approval would allow the City to complete as many portions of the items listed as possible- providing flexibility for a host of potential developments and needs related to the MJHE and City activities for planning housing and the sixth-cycle submission.

The City will need to continue to contract out for this work, as with previous housing- related and planning work, and staff will continue to direct, coordinate and participate in the work. The City's former housing element consultant has retired. Staff proposes using CSG Planning Services to consult on this work. The City has a long history of working with the company in its building department, which is the same company but with a different area of concentration and specific expertise than planning.

The City has an existing Professional Services Agreement (PSA) with CSG planning dating back to 2018 that includes extended planning services, that refers specifically to activities being discussed herein. Staff has been working closely with planning staff for the better part of year now, specifically with Mr. Tom Navarro providing services on more complex planning and code questions such as recent code regarding R3/R4 zoning clarifications. CSG planning has worked with other smaller communities on same issues, recently with Sonora, California on its submission of sixth-cycle housing element.

Mr. Navarro and other CSG staff working on that project will work on the Gustine work.

CSG assisted the City in preparing its draft scope revision for the State.

Given the current PSA, staff has prepared a Task Order for the SB2/MJHE- related work.

The task order puts this work under the terms of the PSA but allows for establishing a specific scope of work and compensation related to this project. CSG will bill the project separately from other City work, providing a benefit to the City in submitting SB2 reimbursements.

The City needs to contract for this work regardless of the SB2 grant in order to complete its sixth-cycle housing element per the State requirements. The SB2 grant provides an opportunity to offset these costs, without which the City would need to find funding.

There is a time sensitivity to completing the work for both participation in MJHE and sixth-cycle state submission requirements and CSG is aware of those. Tasks have been developed in recognition of those and will be revised based on future changes to those by the applicable agency.

The overall cost estimate from CSG for the priority work related to the SB2 draft scope, which includes all its MJHE activities, is $119,800. The City has a previous commitment to MCAG to contribute another approximately $49,000 for its portion of the MJHE, including its consultant Rincon. These total $168,800 together. The City received $160,000 in SB2 funding and has requested that be used for these activities. This amount is significantly lower than the Council previously approved outside the 2022/23 budget for MJHE but in this scenario the City can budget for the additional $9,000 in its upcoming 2023/24 fiscal year budget.

FISCAL IMPACT
The majority of funding from the project will come from the anticipated approval of Scope change submitted to the State for SB2 planning funds. The remaining $9,000 will be included in the City Planning budget for FY 2023/24.

RECOMMENDATION
City Council adopt the attached Resolution approving the Task Order for planning services related to the SB2 grant and the Multi-jurisdictional Housing Element and authorize City Manager to execute this agreement and sign the anticipated Grant Scope revision with the State of California.

COUNCIL AGENDA ITEM

TOPORE NOT TER
APRIL 18, 2023
PREPARED BY: Anna Nicholas, City Manager
SUBJECT: City Council Seat Vacancy

BACKGROUND/DISCUSSION
Effective April 4, 2023, Dennis Brazil tendered his resignation as a City Council member.

The current seat that has been vacated by Mr. Brazil is set to expire November 2024.

Government Code 36512, provides the state law in how and when a vacant position must be filled. State law permits the City to adopt an ordinance providing that a vacancy be filled in one of the three following ways: (1) special election; (2) appointment, unless the City receives a petition for a special election; or (3) interim appointment, with the appointee serving only until a special election is complete.

Since the City has not adopted an ordinance pertaining to the filling of vacant seats, the City Council may fill a vacancy by (1) appointing someone to fill the unexpired Council term or (2) calling a special election to fill the unexpired term, pursuant to Government Code section 36512 (b):
(b) If a vacancy occurs in an elective office provided for in this chapter, the council shall, within 60 days from the commencement of the vacancy, either fill the vacancy by appointment or call a special election to fill the vacancy.

If a special election is called, it must be held on the next regular election date that is at least 114 days after the call for the special election. The City incurs the costs of conducting the election, and the term of the person elected to fill the vacancy runs to the end of the vacant seat's original term. (Gov. Code § 36512(b)(1).) If the Council fills the vacancy by appointment, the duration of the appointee's term is determined by the vacancy's timing:
• If the vacancy occurs in the first half of the term and 130 days or more before the next general municipal election, then the appointee's term runs to the next general municipal election. At that municipal election, the vacant City Council seat will be on the ballot, and the person elected to the vacant seat will serve the remainder of the vacant seat's original term. (Gov. Code § 36512(b) (2)(A).)
• If the vacancy occurs in the first half of the term and less than 130 days before the next general election, then the appointee's term runs to the end of the vacant seat's original term. (Gov. Code § 36512(b)(2) (B).) • If the vacancy occurs in the second half of the term, then the appointee's term runs to the end of the vacant seat's original term. (Gov. Code § 36512(b) (2) (B).

The City has not adopted an ordinance governing City Council appointments. As such, the default rules apply, and the City Council may (I) appoint someone to fill the unexpired Council term or (2) call a special election to fill the unexpired term. The successor will serve the duration of the complete seat term.

Staff recommends that the Council open an application period for those individuals interested in serving their City. This application period would be open for two weeks from April 19, 2023 and close by 5:00 PM on May 3, 2023.

Council at the May 16, 2023 Council meeting would then interview in open session the individuals that had applied and make an appointment that night.

FISCAL IMPACT
There is no fiscal impact associated with this item; however, it should be noted that should the City Council choose to fill the vacancy through the special election process, all costs associated with the special election will be expensed to the City and are estimated at approximately $20,000.

RECOMMENDATION
Staff is recommending Council open an application period beginning on April 19, 2023 and closing on May 3, 2023 at 5 PM for those individuals that are interested in serving their community as a Council member until November 2024.

COUNCIL AGENDA ITEM
APRIL 18, 2023
PREPARED BY: Anna Nicholas, City Manager
SUBJECT: Discussion and Direction of Community Contribution Payment Expenditures

BACKGROUND/DISCUSSION
In November 2020, and amended in June 2022, the City entered into an Operating Agreement with Tip Top Farms, a cannabis business located at 377 4th Street in the City of Gustine. The Operating Agreement defines specific terms for the business to operate in the City, including revenue payments that are to be paid from the business to the City. In addition to monthly revenues that are based on the business's gross receipts, Tip Top Farms pays an annual amount that is known as a 'Community Contribution' Section 6.D., of the Operating Agreement defines Community Contributions (as it pertains to the Operating Agreement) that are to be paid from the business to the City each fiscal year. The agreed upon amount is $20,000 per fiscal year. The City's fiscal year (FY) runs from July 1 to June 30.

Section 6. D. ii.:

The Cannabis Business agrees to donate $20,000 to the City per fiscal year, beginning Fiscal Year 2020 unless otherwise reasonably agreed by the City due to timing of State licensing and commencement of business operations, to be used toward a community event or events held in the City. The acceptance and use of the donations shall be subject to City Council approval, with input from the Cannabis Business. Nothing in this Agreement binds the City to acceptance of the donations or use of funds for particular events, nor shall this Agreement in any way operate to restrict or bind the City Council's discretion and legislative authority.

Staff is seeking clarification and direction from the governing body on the City Council's desire to use the revenue received thus far and going forward. The City has received $20,000 for FY 2021-22, and is expected to receive another $20,000 for FY 2022-23, on or before June 30, 2023. The main discussion points are:

A. Spending of the FY 2021-22 $20,000
B. Spending of the FY 2022-23 $20,000
C. Establishing a process for future revenues received
For A and B listed above, staff is seeking direction on the use of the Community Contribution for FY 2021-22 and FY 2022-23. Some items identified by staff that are needed at this time and provide a public benefit are:
• Harry Schmidt Park improvements:
• Replacement of picnic tables (approximate cost is $800-1000/table) • Bleachers for the tennis court area
• Improve the former playground area
• Henry Miller Park Gazebo Improvements
• Al Goman Center improvements:
• Kitchen upgrades: remodel/paint/cabinets
• Bar Remodel
• Restroom Remodel
• Cef Jamero Park improvements:
• Trees/bushes
• Musical theme upgrades/equipment
• Basketball court improvements
• Watering system/bark/weed mat
• Trailer-Mounted Portable Electronic Message Board:
• Electronic message board would be an asset to all City departments and could be used to communicate information pertaining to events and safety reminders.
• New lawn mower
• Other Items or Ideas?
For item C, staff is seeking clarification from City Council on how the governing body would like to decide future Community Contribution revenue use. Staff has identified two options and is seeking input from City Council on the options presented, in addition to any additional options desired.
• Creating a Special Revenue Fund
• In accordance with Governmental Accounting Standards Board Statement No. 54, City Council would (by way of resolution) authorize the creation of a new fund.

The special revenue fund would pre-designate expenditure priorities and legally restrict the expenditure of all Cannabis Community Contribution revenues.
• Common considerations are:
• Public safety and code enforcement activities and expenses • Service and facility enhancements such as recreational services and improving and upgrading parks and public facilities • Offsets to City departments for administration of the fund (such as Finance)
• Expenditures can be in the form of services, supplies, other invoice related expenses, or transfers to other funds (such as General Fund). • Annually, bring the discussion and subsequent decision forward for City Council direction.

FISCAL IMPACT
The annual per fiscal year Community Contribution payment is $20,000.

RECOMMENDATION
City Council provide consideration and direction on spending of FY 2021-22 and FY 2022-23 Cannabis Community Contribution revenue. City Council provide consideration and direction on future revenue use.
