In addition, 2nd Avenue between West and 6th Street will be barricaded off and have 25 designated parking slots for OLM Society Leadership to be controlled by vehicle parking passes issued by OLM Society leaders. In addition, 2nd street between 5'h Street and 6th Street will be reserved for buses to park as there are several large buses expected to arrive for the event.

OLM Society is requesting to set up lighting, stages, and booths in and around Henry Miller Park, beginning on September 4, 2023 utilizing the park through September 11,

In addition to the aforementioned costs, the OLM Society Committee agrees to incur, as they have in the past, all expenses associated with, but not limited to:

COUNCIL AGENDA ITEM
JULY 18, 2023
PREPARED BY: Melanie Correa, Administrative Services Director SUBJECT: Declaration of Surplus Property

BACKGROUND/DISCUSSION
Periodically, the City departments conduct reviews over various City owned equipment and facility appliances to verify the usefulness and operability of such equipment and property. Staff has recently conducted said review and have identified City-owned equipment that is ready to be declared as surplus.

A declaration of surplus by the Council allows staff to destroy, donate, auction or sell equipment that is no longer serving a useful purpose to the City. All proceeds from any sale of City property will be placed into the general fund.

FISCAL IMPACT
The fiscal impact to the City is considered to be insignificant, if any.

RECOMMENDATION
Staff recommends the City Council declare the indicated property as surplus and authorize staff to sell, auction off or destroy property.

COUNCIL AGENDA ITEM
JULY 18, 2023
PREPARED BY: Anna Nicholas, City Manager
SUBJECT: Emergency Purchase Over $10,000; Foster's Pumps

BACKGROUND/DISCUSSION
Recently, Public Works personnel became aware of a failed booster pump and back staff has been performing temporary and manual measures to keep the park green utilizing the existing loop system.

In order for the irrigation to work properly on the timer system, a replacement booster pump, timer and backflow needed to be procured and installed. This was an immediate need, as the City does not maintain sufficient staffing levels to dedicate to the manual turning on of the irrigation system and with the summer seasonal temperatures and lack of precipitation, the park grass could begin to die quickly. To mitigate this, the City Manager approved the purchase of the replacement booster pump, timer and backflow to ensure the vitality of the park grass for the community, in accordance with the City of Gustine Municipal Code.

Pursuant to the City of Gustine Municipal Code, section 2-6-38(m): the City Manager is delegated authority to approve the acquisition of the park irrigation parts due to emergency needs in operating the municipal infrastructure; including the repair of a public facility, and shall report such action to the City Council at its next meeting. The pump and starter were installed on July 7, 2023, the backflow component has been ordered and will be installed as soon as it is received. This item serves as the subsequent report.

FISCAL IMPACT
$14,465.69 from Fund 001, Dept 0610 (General Fund - Parks).

RECOMMENDATION

COUNCIL AGENDA ITEM
JULY 18, 2023
PREPARED By: Melanie Correa, Administrative Services Director SUBJECT: Approve Resolution Establishing List of City-Paid Holidays

BACKGROUND/DISCUSSION
During the negotiations process, staff became aware that the City had not formally adopted a list ot City-paid holidays. Establishing a formal list of City-paid holidays outside of bargaining group Memorandum of Understandings is beneficial for various reasons, including establishing a list of City-paid holidays for those employees not organized into bargaining groups and whose employment with the City is established through an employment agreement, and for transparency purposes.

The proposed list of holidays mirrors those afforded to the City's three bargaining groups: Gustine Clerks Association, Gustine Public Works Association, and the Gustine Police Officers Association.

Once adopted, any changes to the established list of City-paid holidays will be brought back by resolution for Council's formal action.

FISCAL IMPACT
There is no fiscal impact for this item.

RECOMMENDATION
Council approve the resolution establishing a list of City-paid holidays.

COUNCIL AGENDA ITEM
JULY 18, 2023
PREPARED BY: Anna Nicholas, City Manager
SUBJECT: Addition of One Full-Time Police Officer to the Approved Positions

BACKGROUND/DISCUSSION
In April of 2023, the City began negotiations with the Police Officers Association (POA) for updated deal points of the Memorandum of Understanding, for Fiscal Year(s) 2023- 24, and 2024-25. During this time, discussions were held regarding the number of Full- Time (FT) budgeted Police Officers, and why the number of budgeted officers decreased by two. Upon further research, City staff determined the budgeted number of FT Police Officers was reduced in FY 2018-19 from seven (7) to five (5) Police Officers.

From what staff can gather from the documentation, cost of living adjustments (COLA) and years of service level bonuses were implemented during this period. Potentially, as a cost saving measure to offset these implementations, two positions were left unbudgeted. This reduction in FT positions has put staffing constraints on the Police Department, which was already operating at lean staffing levels.

In recognizing that low staffing levels can have an impact on the service levels provided to the community; while being mindful of budgetary constraints, and also wanting to ensure the currently represented staff of the POA receive a budgeted COLA, the recommendation is to approve the addition of one (1) FT Police Officer at the present time, so City staff can begin the recruitment process to fill the position.

Due to the 24/7/365, nature of staffing Police Operations, the costs of an additional FT position will have a positive impact for the City service levels and for the existing staff. The additional position will be added to the list of approved positions and will be budgetea for in the City's annual operating budget. As this position will not be filled for the entire twelve months of the fiscal year, there will be some costs savings during the initial part of FY 2023-24. At the time of proposed budget, the estimated revenues exceeded the estimated expenditures for the General Fund, to allow this position to be added to the budget.

FISCAL IMPACT
The annual cost for the additional FT Police Officer will be just under $118,000, inclusive of benefit costs. A budget amendment will be made to the appropriate accounts in Fund 100, General Fund, and any other pertinent funds/accounts for FY 2023-24.

RECOMMENDATION
Approve the addition of one Full-Time Police Officer to the approved Budgeted Elected Officials and Staff list.

COUNCIL AGENDA ITEM
JULY 18, 2023
PREPARED BY: Tiffany Vitorino, Recreation Manager
SUBJECT: Consider Expenditure to add Aeration to the Harry Schmidt Park Pond

BACKGROUND/DISCUSSION
One of the many assets of Gustine is the 26-acre Harry Schmidt Park that is located at the south entrance of Gustine. The park consists of many amenities like the baseball fields, tennis and pickleball courts, new playground, walking path, and the pond. The pond is one of the most eye-catching features that travelers notice about Gustine while passing by. The pond is also a pleasing view for residents as people walk the path.

In October of 2022, the Recreation Department held the annual Kid's Fishing Day at the pond. Staff noticed the pond was extremely green and had a muckiness to it. Every year the Recreation Department contacts Namakan West Fisheries to supplement additional fish to the pond so that the kids are able to have a successful fishing day.

When the fishery staff arrived, they noticed the ponds unhealthy look as well. At that time, they used a probe and tested the oxygen levels in the pond. They explained the oxygen level of the pond was extremely low, well below the normal oxygen threshold.

They informed staff that if the prolonged low oxygen levels could prohibit wildlife from thriving within the pond. They also mentioned that low oxygen levels can cause a stench and encourage mosquito reproduction, as wildlife such as fish, frogs, turtles discourage mosquitoes from laying eggs in bodies of water where they are present.

The fishery staff suggested the City look into aeration options as soon as possible. City staff conducted research and learned that aeration provides a steady mixing of oxygen into the water. Aerated ponds tend to be clearer, cleaner, and have less bottom muck- all current issues at the City's pond. Although the project can be costly, aeration is the simplest, yet effective, process of increasing oxygen levels and can not only greatly enhance the aesthetic beauty of a pond, but can also improve the natural ecological systems beneath the water's surface.

Staff believes installing an aeration system will be beneficial for the livelihood of the pond and the community's enjoyment for years to come. The benefits provided by aeration will keep the pond clean, clear and balanced all season long. After more research City identified one contractor who provided an estimate for the aeration system. The sole source quote was received from Eric Doss with Incentive New. Mr. Doss has worked with the Public Works Department on Schmidt Park's irrigation system for several years. The submitted quote totals $37,175.00.

FISCAL IMPACT
The fiscal impact is $37,175, for the pond aeration and fountain. The UUT fund (Fund 002), has appropriate fund balance. A budget amendment will be made by the Finance Department upon approval.

RECOMMENDATION
Staff recommends moving forward with executing a standard professional services contract with Incentive New. Once contracts are executed, the project would start shortly thereafter. Staff estimates work to begin in approximately 30 days and is hoping the completion before the next Kids Fishing Day to be held in September.
