Mayor Nagy opened the public hearing at 6:54 P.M.

There was no public comment.

The public hearing was closed at 6:55 P.M.

Council member Marsigli inquired why the San Francisco Consumer Price Index was applicable to our region. Mr. Madsen explained there is no index established for Sacramento area, and relayed that San Francisco's index is considered the typical index for the region.

Council member Marsigli expressed concern in regards to consultant fees and the City's recovery, to which Mr. Madsen attested to the estimation practices, and attested the estimate to be reasonable.

Council member Marsigli inquired on the Council waiving Service Club early access fee for facility rentals, to which Recreation Manager Vitorino advised of existing clarifying language in the footnotes, and the need to add "only" to "Service Clubs can request waiver of fee."
Council member Marsigli inquired if the City can do inspections on City daycares, to which Mr. Madsen advised he is unsure of the requirements and advised he thinks the law is linked to family daycare. He stated the fee for daycare was left in the study in case it is needed but if it is not applicable or needed it wouldn't be collected.

Mayor Nagy advised many daycares are inspected by the County.

Council member Marsigli inquired how ClearSource arrived at the estimated $28K anticipated fiscal impact as displayed in his presentation. Mr. Madsen advised the figure is based on historical data from the City.

Council member Marsigli suggested adding language to the resolution to mandate the City Council be advised before the rates are adjusted according to the CPI escalator.

Mr. Madsen advised the City could add additional language. There was some additional discussion, during which City Attorney Siprelle reminded Council that development fees are subject to the same CPI escalator and are not required to come back before the Council. City Manager Nicholas advised that expenses generally increase in accordance with the CPl. Council member Giles clarified that even with the escalator not all expenses will be fully reimbursed, to which City Manager Nicholas affirmed.

Council member Giles inquired if future fee studies will be done with the use of a consultant, to which City Manager Nicholas advised the City has done fee studies on a 5-year cycle, and that this current update has been delayed due to City turnover.

Mayor Pro Tem Ford inquired if the City were to forgo another fee study in five years, this resolution would remain intact, to which City Manager Nicholas affirmed.

Mayor Nagy inquired on copy fees and their disproportion to the City's expenses. Mr.

Madsen advised that along with many other fees, these are governed by the Public Records Act specific to idea of cost of toner and paper, and not inclusive of labor.

Mayor Nagy further inquired on police copy fees, to which Mr. Madsen advised the City has limitations on cost recovery especially as it relates to records.

Mayor Nagy also inquired on Airport transient parking, to which Mr. Madsen advised there is flexibility in that fee, as it is use of City property.

Mayor Nagy inquired on the notes "see Merced County fee schedule," to which Mr.

Madsen advised these notes within the Animal Control fee section refer to the most reasonable administrative comparison, as Gustine's specific cost recovery would be too great to offset, and aligning with the Merced County schedule follows historical precedent.

Mayor Nagy inquired on the definition of "strong motion implementation," to which Mr.

Madsen advised it is a state fee and is linked to seismic monitoring and reporting.

Council member Bonta made a motion to approve the resolution establishing and adopting various user and regulatory fees.

Ms. Nicholas also advised the City can use some of the Community Contribution money to settle up the 22/23 FY deficit of $3,389.26 and suggested leaving the 23/24 FY as-is because the year is still in progress.

Mayor Nagy expressed concern with the downward trend in donations received. He stated his opposition in allocating towards the fireworks fund as doing so could perpetuate the diminishing donations. Mayor Nagy also attested that this funding is not guaranteed, as it is dependent on the status of the payee.

Council member Marsigli suggested the City cover the FY 22/23 4th of July deficit, set aside $2,000 for the audio system repair, and purchase benches for Henry Miller Park.

Council member Giles inquired on the cost to fix the gazebo, to which Recreation Manager Vitorino advised she has not received estimates yet.

Mayor Nagy commented further on the donation process, he advised the most fruitful efforts are done in-person, face-to-face to gather donations. Recreation Manager Vitorino agreed, and advised that the Miss Gustine court are willing to step up as volunteers to assist with donations and fundraisers.

Mayor Nagy inquired how donations work with the City being categorized as 501 (c) (3), to which City Manager Nicholas advised of an upcoming meeting that will provide additional information in regards to this item and stated the City needs to learn how donations can flow through the 501 (c)(3).

Recreation Manager Vitorino inquired if the 501 (c) (3) donations will have to be ran on fiscal year, to which City Manager Nicholas advised she was unsure how the accounting is set up. There was some discussion related to the 501 (c) (3)'s operation.

She advised the quote was for $167K annually for weekly services.

Council member Giles inquired if there are additional costs for special event services, to which City Manager Nicholas affirmed. Public Works Director Ingram advised the Public Works department has other equipment that can be used for small special events or a specific area.

Mayor Pro Tem Ford provided his favorable opinion on owning a street sweeper rather than hiring a company.

City Manager Nicholas advised the City can put out another RFP or look into purchasing a street sweeper. She commented on additional costs for an extra employee and with a Prop. 218 approval process that will come with purchasing a street sweeper. She reiterated that hiring a company now could alleviate the community distress in not having a regular sweeper, so staff could work through implementing what was needed to acquire a sweeper.

Mayor Pro Tem Ford asked City Attorney Siprelle if the City can add a line item to the Utility bill for street sweeping, to which City Attorney Siprelle affirmed through a Prop. 218 process. There was a brief discussion related to the components of a Prop. 218 process.

Mayor Pro Tem Ford requested a side-by-side comparison in purchasing a street sweeper and the City taking on the service and equipment.

There was further discussion in regards to selecting the right equipment for the City.

COUNCIL AGENDA ITEM
SEPTEMBER 5, 2023
PrEPaREd BY: Ruben Chavez, Chief of Police
SUBJECT: Request to Close City Streets for the September 11th Memorial Walk

BACKGROUND/DISCUSSION
The City has received a request from local resident Zachary Ramos of the Traveling Library who is coordinating the annual September 11th Memorial Walk. As in past years, the streets will be barricaded off to allow for pedestrian traffic to walk and commemorate the 22nd anniversary of this tragic event. Mr. Ramos is requesting to use Fifth Street from Coast Hardware (545 Fifth Street) north to the Veterans of Foreign Wars (VFW) Hall (145 Fifth Street) on Monday, September 11, 2023 from 7:30 PM to approximately 9:30 PM to host a "22nd Anniversary of September 11th Memorial Walk" to honor and remember those who perished in this historic tragedy.

Staff will ensure that proper barricades will be in place and personnel will be on hand to provide traffic control. Street closures will be in effect beginning at 6:30 PM, with the roadway re-opening at approximately 9:30 PM. The actual walk will kick off at 7:30 PM and end at approximately 8:30 PM. The walk is currently scheduled to include a short program inside the VFW Hall.

FISCAL IMPACT
Public Works personnel will provide all barricades on Monday, September 11'h at an estimated cost of two hours of labor to place and remove the barricades at $50 per hour ($100 total). The police department will staff on-duty personnel as well as Police Volunteers and Police Explorers. Mr Ramos is requesting any fees associated with this even to be waived.

RECOMMENDATION
Staff recommends that Council approve the requested street closure for the "9/11 Memorial Walk" on Monday, September 11, 2023 from 6:30 PM to approximately 9:30 PM.

LIBRARY
To the Honorable Members of the City Council of Gustine, I am writing to request your support and approval for the Gustine Traveling Library to have access to Main Street for the purpose of hosting the 9/11 Memorial Walk from Coast to Coast to the Veterans Hall. The event is scheduled to take place on September 11th, and we believe that it would be a fitting tribute to the brave men and women who lost their lives on that fateful day.

By closing Main Street, we would be able to ensure the safety of participants and allow the community to come together to honor the memory of those who were lost.

We kindly request that you grant us permission to use Main Street for the 9/11 Memorial Walk from Coast to Coast to the Veterans Hall.

We assure you that we will take all necessary precautions to ensure the safety of participants and minimize any inconvenience to the community. We would also like to ask the city to waive the fees for the event.

Thank you for your consideration.

Sincerely,
Zechery Ramas

COUNCIL AGENDA ITEM
SEPTEMBER 5, 2023
PREPARED BY: Jami Westervelt, Airport Manager
SUBJECT: Airport Capital Improvement Plan (ACIP) Submission

BACKGROUND
The Federal Aviation Administration (FAA) requires the City to provide an updated Airport Capital Improvement Plan (ACIP) submission on a yearly basis in order to request its annual entitlement funding. Traditionally, the ACIP contained the spending plan for Airport Improvement Plan funds, which provide the bulk of the City funding to complete airport capital projects. The funds must be used to maintain and improve the safety and integrity of the airport. Common projects include FAA plans and narrative reports, and runway and taxiway improvements and additions. The FAA has not in the past allowed Gustine's ACIP to include constructing new hangars or rehabilitating existing ones.

At the end of 2021, a Bipartisan Infrastructure Law (BIL) passed providing new funding to airports to be administered by FAA. The BIL came as additional federal funds for a limited time. Gustine Airport receives $110,000 for four years in BIL funding. BIL funds have expanded potential uses beyond the AlP funds, with some restriction. Although the programs have some differences in requirements and spending allowances, the FAA tracks and manages the BIL funds through its annual ACIP list submissions.

Council may recall that it approved the ACIP Plan list for the last cycle earlier this calendar year. However, FAA continues to be short staffed and has implemented new timeframes on projects and the City needs to submit its ACIP for next funding cycle.

It is important to keep in mind that the ACIP is a fluid and living document and the City has the flexibility to alter future projects annually, based upon the most recent information it has available.

DISCUSSION
The attached ACIP document references future projects for FAA planning based on current information and is useful for that purpose. However, in considering the future projects, the City must consider current projects and their potential future impacts.

The two ACIP projects the City of Gustine currently has in process from previous funding years are the Pavement Maintenance Management Plan and the Airport Layout Plan Narrative with Aeronautical Survey. Gouveia Engineering is the Engineer of record for the Airport, working on both of the projects.

Pavement Maintenance Management Plan (PMMP)
The FAA requires this Plan that assesses pavement condition prior to any additional paving work for the City. It has been some time since the City has completed a PMMP so this project was a priority to confirm the need levels of the pavement for future prioritizing, as well as for meeting FAA requirements. Gouveia states engineers are a few months away from the report FAA requires. The results could impact ACIP priorities in future years, which contributes to the staff ACIP recommendation below.

Airport Layout Plan (ALP) Narrative with Aeronautical Survey The FAA requires airport sponsors to regularly update planning documents, including the Airport Master Plan. The City last updated its Plan in 1996 and, although an update to this document would be preferable, updates are extremely costly and time consuming. Given the nature of Gustine Airport, as a general aviation airport with very limited traffic and no tower or terminals, and more limited changes to the airport and City than forecasted in the 1996 plan, FAA has agreed that the City may at this time instead update its ALP instead of the full Master Plan. Although this is a substantial savings in cost and effort, the ALP will require a significant amount of work to complete.

ACIP Recommendation
The current ACIP projects represent a significant workload to both the consultants and staff, in addition to work beginning on the BIL projects in order to move toward implementation of those projects.

In most recent meetings with FAA staff, it was suggested to the City that the agency would be looking toward capacity of sponsors for applications in the future and suggested that the current project lists represented a full-load for the City, given the limited resources of the City in both its staffing and engineering capacity. City and Engineering staff find this assessment fair, given bare-bones Airport staffing and current project load for both City and Engineering staff for both the airport and other capital projects at the City that these same individuals implement.

The Airport Commission looked at this item at its last meeting and indicated unanimous approval for not adding any additional AIP projects to its ACIP for the coming year. This recommendation is based upon potential changes stemming from current ACIP projects and very limited City resources, both from the standpoint of workload as well as finding required funding for the project match for additional AIP Projects.

Staff has sought feedback on the format but, as of the writing of this staff report, has not received confirmation on submittal format details. Therefore, staff requests approval of the content portion of the ACIP document with flexibility to alter the document itself to meet the final, confirmed FAA submission requirements.

RECOMMENDATION
Approve draft ACIP submission in concept, authorizing signature by the Interim City Manager following any format changes requested by the FAA.

COUNCIL AGENDA ITEM
SEPTEMBER 5, 2023
Prepared By: Ruben Chavez, Chief of Police
SUBJECT: City Council Authorize the Purchase of a Changeable Message Board/Radar Trailer

BACKGROUND/DISCUSSION
The use of changeable message board/radar trailers have provided municipalities with a tool and resource for traffic management, among other things. The trailer has many features that are useful for this purpose. The trailer can provide the motoring public timely information on upcoming events that may impact roadway conditions such as "Festival this weekend, expect delays" or "Roadway construction ahead from October 1 to October 31, 2023; 8 A.M. to 5 P.M." or similar. Moreover, trailers are equipped with speed radar and can warn speeding vehicles of their speed in school zones or areas of complaints warranting additional resources to deter motorists from speeding. In addition, the proposed radar trailer sign can track and gather statistic data of vehicle speeds during any given period, even if no speeds are displayed to motorists. The trailer can also display simple traffic safety messages such as "Do NOT Drink and Drive" or "Hands Free Enforcement Campaign in Progress" which reinforces traffic safety campaigns. These are only a few ideas of the usefulness these sign trailers provide.

Both the Police and Public Works Departments find these trailers very useful not only in maintaining roadway safety, but as another avenue in educating, informing, and alerting the public. With the upcoming traffic projects and numerous special events, the City hosts, this would be an additional resource for both departments during these events.

FISCAL IMPACT
Stalker Radar provided a NASPO quote of $20,838.13 for delivery of a unit to the City.

The NASPO quote is a formalized state contract reflecting costs that have been approved without the need to acquire more than one quote. Funding for this item has previously been approved through the City of Gustine FY 2023-24 budget. Council approved allocating $20,001.00 for "Message Board utilizing three separate cost codes:
001-0210-540-030-00 (General Fund), 060-0210-540-030-00 (Water Fund), and 061-0210- 540-030-00 (Sewer Fund). The balance of $837.13 will be allocated to cost code: 001- 0210-520-030-00 (General Fund, Police Department, Motor Vehicle Expense).

RECOMMENDATION
Staff recommends that Council approve the purchase of the changeable message board/radar trailer.

PREPARED BY: Tiffany Vitorino, Recreation Manager
SUBJECT: Approve Food Vendors at Kid's Fishing Day

BACKGROUND/DISCUSSION
The Recreation Department is planning to hold the Annual Kid's Fishing Day at the Harry Schmidt Park Pond on September 30, 2023. This event is always met with great enthusiasm from everyone in the community, and is well attended.

The Recreation Department has already received many donations by local organizations and businesses. During the event a free sponsored lunch is served to the youth participants. The event starts at 7:00 A.M. and ends at 1:30 P.M. Staff would like to have Kona Ice and a few other food truck options for the participant families that also attend.

Staff is requesting Council's authorization to allow food vendors during the event.

According to the Gustine Municipal Code Section 5-6-3, mobile kitchen type vendors are only allowed in manufacturing districts, except otherwise by special permission of the City Council during festivals, parades and other public events. If approved, staff will ensure that proper permits and licenses will be obtained. The Recreation Department will submit the proper paperwork to Merced County Environmental Health Department to obtain the appropriate health permits for the event and each vendor.

FISCAL IMPACT
Staff will continue to seek donations from local businesses to provide some supplies and prizes for the event. Any staff time costs have been accounted for in the City's current budget.

RECOMMENDATION
Approve staff's request authorizing mobile food vendors for Kids Fishing Day.

COUNCIL AGENDA ITEM
SEPTEMBER 5, 2023
PREPARED BY: Jami Westervelt, Economic and Community Development Director SUBJECT: Broadband Service Application Submission

BACKGROUND/DISCUSSION
The City of Gustine for some time has identified the lack of reliable, affordable internet ccess tor both its businesses and residences as a major challenge and priority. A eported to the Council in June of this year, opportunities have recently arisen tha have the potential to change that for residents and businesses in Gustine.

In the beginning of 2023, the City was surprised with word that the FY 23 Omnibus Spending Bill included funding of Gustine's $1.35 Million Project request for "Broadband Equity and Expansion Project." The project came through a spending request submission by U.S. Senator Dianne Feinstein and U.S. Representative Jim Costa.

The City also became aware of interest by two providers to install fiber service to the City. For at least the last decade prior, the City had attempted to persuade different companies to provide high-speed internet for the entire community but was told that the City did not have enough rooftops to make a full-scale wired service investment.

Since the June update to Council, staff has been in contact with the funding agency.

The funds come as a grant through the United States Department of Agriculture (USDA) ReConnect Grant Program. Staff for USDA has advised the City that:

1. The City may utilize the grant to partner to install the service. Any partners become sub-recipients beholden to all the same requirements as the City.

2. The City is not under any requirement from the funding organization to conduct an RFP process to select partners. Going through an RFP process for this project would have proven prohibitive for the City because the timeframe for applying makes such as RFP infeasible. The application requires that the fully-formed project be submitted by the end of this month, September 2023.

3. Fiber can replace the originally proposed 4G and 5G service as long as the project provides comparable or better service (which fiber will) within the City of Gustine limits, per the application.

While USDA does not require an RFP, staff felt it important to offer both providers working on installation in the City, Comcast and Unwired, the same opportunity to partner. Staff discussed the grant award with representatives of both companies prior to the June Council meeting and has provided phone updates to both as additional information has come from the funder. City staff also has formally offered both the same opportunity to partner via identical confirmed emails, as follows:

A. July 7: The City sent out formal confirmation of the grant and opportunity to partner. The email requested reply indicating interest and ability to work within all funder requirements in order to provide "an undergrounded fiber project that provides the impetus to offer affordable, high-speed internet access to the entire community."
B. July 13: As both companies expressed initial interest (details below), the City provided an email with additional information, including the application letter from the funder (Exhibit A attached) containing specific application and reporting requirements. The City asked for a reply that both included a commitment to the project as outlined in correspondence "A" above and confirmed the ability to provide all the information in the USDA application letter.

Further, the email asked for any questions about the letter that the potential partners might have.

The City received responses from both Comcast and Unwired.

Unwired Broadband
Unwired responded to both of the City's requests first, including a stated strong desire to partner on the project. Unwired has not yet submitted plans for review to the City but has indicated in its reply to the above that it will install an entirely-underground project.

As was the original intention the company brought to the City, Unwired has been pursuing other public funds in order to implement the project due to the cost to underground the entire City.

Undergrounding is the current standard for new projects, with entirely new developments generally having all utilities and services underground. The City prefers to have the services underground but Counsel confirmed the City has no ability within applicable approval rights to force either company to underground its services as part of the general encroachment and review process. However, by signing on to this project, Unwired will be agreeing with the City specification for the funds that the project be underground. Without such an agreement for the grant funds, Unwired could have brought plans to utilize both poles and undergrounding, as Comcast has.

Comcast
In response to the initial July 7 request, Comcast indicated it would "be happy to chat about (the City's) thoughts for the grant" so staff included Comcast in the second request email. In response, Comcast returned a letter proposing an alternate use of funds. Correspondence from the City detailed an entirely-underground project within Gustine City limits, with no construction to begin until the approval was received by the funder. The Comcast reply proposed it would use the USDA funds for a "Phase 2" of its project, for "expansion project to incorporate additional households and business in the City's sphere of influence." The majority of the project area would remain as Comcast initially proposed, including overhead lines in the design and moving forward on the majority of the project immediately.

Rather than eliminate Comcast for failure to comply with the project partner opportunity as outlined, City staff reached out again to the company to clarify that the project proposed in the letter did not comply with either the City specification to underground or funder requirements for the service area. The reply from Comcast was as follows: "At this point the company would prefer to keep our project submission as-is.

Undergrounding of the project wouldn't be feasible for the amount of the grant and we'd like to keep our project moving forward without any further delays." Following receipt of this formal notification from Comcast, City staff immediately notified Unwired that it was the sole partner on the funds and the company began working in earnest with the City on the submission for the application due this month.

Since that time, the same Comcast representative that authored the above decline email, contacted the City to ask if Comcast, in regard to its having declined the partnership might "put that decision on pause" in order to come back to the City with revised design work to propose. Staff clarified to Comcast that notifications were already made and work had already begun on the single-partner submission.

The City has worked in good faith with both companies to offer partnership by providing the identical correspondence requests and opportunities to move forward.

Pausing the application now for Comcast to possibly reconsider provides no advantage to the City but provides significant risk as time is short to prepare the application. Failure to follow through on this funding application would reflect poorly on the City in regard to future Congressionally Directed Spending asks and USDA projects.

As the City has communicated to Comcast, nothing about this grant opportunity prohibits Comcast from continuing to take forward its current project submission without grant funds. Comcast has to this point indicated its ability to implement an above- ground and underground combination for its project without additional public funding.

Without grant funding Comcast does not have to wait for funder approval to construct.

Similarly, nothing in the grant proposal prevents Unwired from going forward with review on its project either. The grant funds only physical build so Unwired will not be able to begin its construction unless/until the funder provides the executed grant agreement.

Application Process
Since Comcast passed on the partnership, staff has been working with Unwired toward submittal of the application, which requires specific project information needed by the end of the month. Staff has confidence in the ability to continue to work with Unwired to submit the required application on time. However, the application will likely not reach completion prior to the deadline for the next Council agenda. If USDA accepts the application, the Council will see the formal commitment documents from the funder prior to signature by the City Manager.

FISCAL IMPACT
No negative impacts to the City. Providing competition through multiple service provider options should result in more competitive pricing for residents and businesses and dependable service should translate to more financial opportunities for all.

RECOMMENDATION
Council authorize staff to submit the application to USDA ReConnect program, including Unwired Broadband as sub-recipient, in order to apply for the $1.3 Million award appropriation as required by the funder.
