COUNCIL AGENDA ITEM
OCTOBER 3, 2023
PREPARED BY: Gary Ingram, Public Works Director
SUBJECT: Approve Sewer Lateral Replacement

BACKGROUND/DISCUSSION
The new construction at 430 2nd Ave., Family Dollar/Dollar Tree (FD/DT), has been ongoing tor some time. During construction, the building's sewer main was tied into the City's sewer lateral in the alley. The condition of the City's lateral was not taken into consideration at the time of the tie in. FD/DT began experiencing backup and hired a local plumber to investigate and solve their problem. The plumber excavated the lateral and immediately discovered it was collapsing in several areas. The plumber contacted Public Works to give an update of the condition of the pipe.

This particular section is approximately 100' and serves three customers with Family Dollar being at the northern point and Sovanna's Doughnut Shop being the last service before the next manhole. After investigation and discussion, it would be in the City's best interest to remove the old section and replace it with a new line that will flow as designed for many years to come. The proposed project also includes a new patch of asphalt over the lateral. City staff will ensure the repair and patch will be done according to City standards. With Council's approval, the repair can begin quickly and not cause any delay with FD/DT reaching their final approval.

FISCAL IMPACT
The Public Works Department requested a quote from A-Plus Plumbing who was already conducting the original repair for FD/DT. The proposal was submitted for $26,250. The expense will be funded by the sewer fund (Fund 061) "other contract services" line item, as approved in the FY 23/24 adopted budget.

RECOMMENDATION
Staff recommends Council authorize to move forward with the sewer lateral replacement with A-Plus Plumbing, and authorize the Interim City Manager to enter into contract for the repair.

COUNCIL AGENDA ITEM
OCTOBER 3, 2023
PREPARED BY: Gary Ingram, Public Works Director
SUBJECT: Approve Expenditure and Authorize Interim City Manager to Enter into Contract for Phase 1 of Proposed Tree Maintenance Schedule

BACKGROUND/DISCUSSION
The City's tree maintenance program has taken a long pause. The City's trees are overly established and are in major need of trimming. The Public Works department is using its resources to the best of their ability to provide clearances of City trees but does not have the resources to address the overgrown tree population. The Public Works department contracted a tree assessment report with an Arborist through Grover Tree Service last fiscal year. From that report, the Public Works department has generated a priority list of trees that need maintenance. This list is broken down into four phases. This staff report is concerning the first phase or highest priority trees. A map of the phases is included as an exhibit to this report.

Tree maintenance is essential to the health of the trees and safety to the community.

Conducting tree maintenance ahead of the upcoming storm season would assist the City in getting a hand on potential claims resulting from fallen limbs. This effort will also allow the City's Public Works department to develop an ongoing preventative maintenance schedule. Our strategy is to use a professional tree service throughout the four phases over the next two years as the budget permits.

FISCAL IMPACT
The Public Works department has sought the expertise of Grover Tree Service, who is familiar with the City's tree needs. Grover Tree Service employs five arborists, certified with the International Society of Arboriculture. Grover Tree Service has provided a quote for the identified Phase 1 for $17,970.00. Phase 1 encompasses forty-four trees.

The adopted FY 23/24 budget included funding to get the City's tree maintenance restarted. This expense will be funded from the general fund (Fund 001).

RECOMMENDATION
Our goal in developing this strategy is to reduce the risk of potential damage to property, general public safety, and to preserve the health of our City's trees that provide us with many benefits from shade to oxygen, but most of all they contribute to the charm of Gustine that we appreciate so much. Staff's recommendation is Council approve contracting with Grover Tree Service for Phase 1 as described in Exhibit B, and authorizing the Interim City Manager to execute said contract.

ITEM NO. 10
CA

COUNCIL AGENDA ITEM
OCTOBER 3, 2023
PREPARED BY: Melanie Correa, Interim City Manager
SUBJECT: Resolution Opposing Initiative 21-0042A1

BACKGROUND/DISCUSSION
Initiative 21-0042A1 is aimed for the November statewide ballot and is described by the attorney general as:

LIMITS ABILITY OF VOTERS AND STATE AND LOCAL GOVERNMENTS TO RAISE REVENUES FOR GOVERNMENT SERVICES. INITIATIVE CONSTITUTIONAL AMENDMENT.

For new or increased state taxes currently enacted by two-thirds vote of Legislature, also requires statewide election and majority voter approval. Limits voters' ability to pass voter-proposed local special taxes by raising vote requirement to two-thirds.

Eliminates voters' ability to advise how to spend revenues from proposed general tax on same ballot as the proposed tax. Expands definition of "taxes" to include certain regulatory fees, broadening application of tax approval requirements. Requires Legislature or local governing body set certain other fees. Summary of estimate by Legislative Analyst and Director of Finance of fiscal impact on state and local governments: Lower annual state and local revenues, potentially substantially lower, depending on future actions of the Legislature, local governing bodies, voters, and the courts. (21-0042A1).

CalCities is seeking opposition from its membership, as the initiative would significantly jeopardize cities' ability to provide essential services and infrastructure for our residents.

The measure includes undemocratic provisions that would make it more difficult for local voters to pass measures needed to fund local services and projects and would limit voter input by prohibiting local advisory measures where voters can express a preference on how they want their local tax dollars spent. This measure creates new constitutional loopholes that allow corporations to pay far less than their fair share for the impacts they have on our communities, including impacts on local infrastructure and our environment.

This measure also may make it much more difficult for state and local regulators to issue fines and levies on corporations that violate laws intended to protect our environment, public health and safety, and our neighborhoods. Unless defeated, the measure puts billions of dollars currently dedicated to local services at risk, and could force cuts to fire and emergency response, law enforcement, public health, parks, libraries, affordable housing, services to support homeless residents, mental health services, and more.

FISCAL IMPACT
This item has no fiscal impact.

RECOMMENDATION
Council approve a resolution opposing Initiative 21-0042A1.

GUSTINE

COUNCIL AGENDA ITEM
OCTOBER 3, 2023
PREPARED BY: Tiffany Vitorino, Recreation Manager
SUBJECT: Council Authorize City Manager to Enter into Agreements to Resurface Pool

BACKGROUND/DISCUSSION
The City of Gustine dedicated the swimming pool in 1953. The facility has changed a little over many decades as it has welcomed generations. Costs to maintain and operate a municipal pool are quite high and revenue sources are few. Utility User Tax funds supplement a good portion of yearly operating costs.

Many municipalities have shuttered or demolished aging pools due to rising costs and increasing mandates on the facilities. These include building codes and accessibility for those living with a physical disability. The City has done much with limited funding but there is much needed at the facility in the future. The pool is at a point at which the City cannot open for the next season without significant work to the pool structure.

There are a limited number of sources for grants for aquatic centers. While the City views its pool as providing a valuable service to the community, many charitable foundations view a pool as a "luxury" type of recreation.

Recent grants from California State Parks, notably under Proposition 68, allowed jurisdictions to apply for aquatic projects. The City found this a rare opportunity and applied three separate times to California State Parks for pool funding:

1. Statewide Park Development and Community Revitalization (SPP) Program- Submitted August 2019. Complete pool rehabilitation and expansion to add competitive swimming lanes. Pool portion of the grant was $2.95 Million with the entire park application totaling $4.7 Million.

2. SPP Program- Submitted March 2021. Complete pool rehabilitation and expansion to add competitive swimming lanes. Also included the construction of new pool building to provide ADA access, as well as all new decking, fencing and all other needs. Pool portion of the grant was $3.86 Million, with the full grant request totaling $6.98 Million.

3. Rural Recreation and Tourism Program- Submitted January 2022. Grant program focusing on rural recreation with requirement to show how the feature would economically benefit the community. The grant included the pool rehabilitation and expansion to add competitive swimming lanes. Also included the construction of new pool building to provide ADA access, as well as all new decking, fencing and all other needs. The grant solely included the aquatic center, with the application amount totaling $2.99 Million.

Each application required extensive staff time and for each round the City waited for several months before the state made its award announcements. Although the City received follow up inquiries on all three of its applications, which might indicate extended review, the State ultimately did not fund any of the above. The State awarded very few grants to pools during the above award cycles and, of those, the funds went predominantly for constructing new projects. As the grants all gave scoring priority to new features over the rehabilitation of existing ones, this makes logical sense.

Given the condition of the pool, and the scarcity of applicable funding sources for pool rehabilitation, staff sees no feasible grant opportunities for the basic rehabilitation of the pool that must be complete prior to starting another season in the pool.

This year's aquatics season, it was discovered that water was continually needing replenishment. Lifeguard staff also noticed several areas with chipped and missing fiberglass at the bottom of the pool. Lifeguard staff patched the areas, however, during that process air pockets from the water building up between the layers of fiberglass and plaster were discovered in the shallow end of the pool. These pockets are most likely also in the deep end but harder to detect due to the depth of the pool.

Staff contacted Burkett's Pool Plastering, Inc and Adams Pool Solutions for estimates to repair the surface. Both vendors felt that spot patching the areas and remediating the pockets would not be cost effective and would only be a temporary fix. Both vendors advised it would be in the best interest of the City to resurface the entire pool with plaster. Both estimates include the demolition and removal of the current surface material, and adding tile racing lanes and targets. Below are the estimates received:

Adams Pool solutions - $208,340.00
Burkett's Pool Plastering Inc. - $167,700.00
Each vendor has included in their quote to submit plans to the Merced County Environmental Health for approval. Some adjustments to the pool will be made to code and are listed in the quotes. As you can see in both quotes, the steps located in the shallow end are wider than the code requires. Changes to constructing the steps to code have been added in the estimates, however the current step widths are preferred by the lifeguard staff and pool patrons. The current steps have a large first step that allows easier entry for senior citizens, assists in swim lessons and are used as guard stations. Staff had a discussion with Merced County and the vendors on keeping the existing steps. Merced County informed staff to request keeping the current steps in the submitted plans to the county for approval. The County at that time will decide if it is possible to keep the existing steps keeping the project moving forward. If not approved, the steps will be adjusted to the County's requirement.

Staff will continue to seek additional funding for larger projects and repairs to the pool.

In speaking to Recreation staff in other cities that have done large pool projects, they all suggest not closing for a season if at all possible. In their experiences, closing for a season has caused many Aquatics Centers to lose patron momentum, something the Gustine Pool has no shortage of.

As council is aware, the pool budget does not have the necessary funds for this type of repair. After consulting with the Interim City Manager and Finance Director, it is recommended Council consider approving these expenditures from the UUT fund that as of September 26, 2023 has a balance of $555,735.

It is recommended that Council select for staff to proceed with the quote with Burkett's Pool Plastering, Inc as the lower of the two bids. Staff contacted the City of Riverbank as a reference of Burkett's. Riverbank recently contracted with Burkett's for their resurfacing project last year and they recommend Burkett's, informing staff that they were easy to work with and no issues with the job after its completion. Staff has spoken to Burkett's and they are confident that these repairs would be complete prior to the 2024 pool season. If approved, the project is expected to start January 2024. Burkett's has also agreed to assist Public Works in draining the pool properly as their schedules permits prior to the start of the project. Draining the pool will save costs in chemicals and staff time during the off-season prior to waiting for the project to begin in January.

FISCAL IMPACTS
Staff is requesting Council's approval to utilize User Utility Tax (UUT) Funds (Fund 002). The contracted price is $167,700 + 10% contingency, totaling $184,470.

RECOMMENDATION
Council to approve and authorize the Interim City Manager to enter into a contract with Burkett's Pool Plastering Inc, for the amount of $167,700 and to be funded by the UUT account. Undertaking these types of projects, issues can always arise after the surface has been removed, therefore staff is suggesting a 10% contingency be added to the project budget in the event any issues arise during the project's process.

Performance and completion bonds included in pricing.

Access
Access to swimming pool common area is required with parking at nearest available location To be provided and secured by onsite prior to execution of any proposed scope of work. Burkett's crews need direct access to pool common area along with parking within the Nearest parking area to perform and complete the above proposed scope of work.

All access and parking to be provided and secured by the property.

Utilities:

Adequate power and water provided at or near pool common area by property owners.

Leaks and Leak Detection:

Older pools, specifically pools/spa plumbed with copper, often have small nearly undetectable leaks. The act of draining, leaving a pool empty for some time and then refilling will often cause minor shifts in surrounding soils and the pool structure itself causing these minor leaks to grow. Burkett's recommends that a leak detection be performed during the permit process while the pool/spa is still full of water and fully functional to pre-determine if any leaks are present. This will help eliminate the need for unforeseen repairs during the renovation process as well as additional repairs after completion of the pool/spa resurfacing. The most common cause for delay during the renovation process is the need to make unforeseen repairs. If needed, a leak detection agency may be provided as part of the "scope of work" or can be handled by the property independently.

Please note: This proposal and or contract does not include any changes, additions or additional permit fees added or required by the Building and or Environmental Health Departments.

If you have any questions, please feel free to call me at 209-495-9634.

SUBJECT: Discussion of Projects and Appointment of Delegates to Attend the 2024 MCAG One Voice Washington DC Trip

BACKROUND/ DISCUSSION
Next year's Merced County Association of Governments (MCAG) One Voice Washington DC trip has been scheduled for May 14-17. The One Voice trip is a County- wide lobbying mission for grants, federal funding, and new or amended legislation. The City has participated annually, along with the other cities in Merced County. The trip includes numerous meetings with legislators and federal agencies to discuss issues of regional importance to Merced County.

MCAG has reached out to participating agencies to advise that due to feedback from past delegations, the planning process of the trip will start earlier, in November. A list of delegation meetings is expected to be distributed in early November 2023. Delegates are required to attend regular trip planning meetings to ensure a fruitful and cohesive effort while in the nation's capital.

This administrative item is intended to allow for Council to discuss and provide direction on which members) would be interested in attending the trip this year to represent the City. Traditionally, two delegates have been selected (usually one Council member and a staff member or two Council members). The costs for two attendees are budgeted for in the FY 2023-24 operating budget.

To spark the discussion on priority projects, staff has encompassed the following list of suggestions:

Funding for park rehabilitation, pool rehabilitation, and public facility upgrades (to include: Gustine Museum, Goman Center, City rental facilities) - Funding for water and sewer infrastructure upgrades
- Funding for public safety staffing and equipment needs - Funding for city infrastructure (water lines and valves, sewer lines and manholes, storm drain lines, fire hydrants)
Prior delegations from the City have secured contacts with the U.S. Department of Fish and Game which was instrumental in obtaining the City's cattle egret depredation permit, among other numerous legislative contacts to collaborate on funding opportunities for various improvements around the City. Submitting priority projects enables MCAG to plan the group's meeting schedule to incorporate the proper legislative officials and representatives.

FISCAL IMPACT
In looking at prior years travel, expenses are estimated to cost approximately $1,800 per person, which includes the delegate attendee fee, airfare, per diem, ground transportation, and lodging.

RECOMENDATION
City Council to select delegate(s) and establish priority projects for the MCAG One Voice trip in May 2024.
