PREPARED BY: Melanie Correa, Interim City Manager
SUBJECT: Declaration of Surplus Property

BACKGROUND/DISCUSSION
Periodically, City departments conduct reviews over various City owned equipment and facility appliances to verify the usefulness and operability of such equipment and property. Staff has recently conducted said review and have identified City-owned equipment that is ready to be declared as surplus.

A declaration of surplus by the Council allows staff to destroy, donate, auction or sell equipment that is no longer serving a useful purpose to the City. All proceeds from any sale of City property will be placed into the appropriate allocating fund.

FISCAL IMPACT
The fiscal impact to the City is considered to be insignificant, if any.

RECOMMENDATION
Staff recommends the City Council declare the indicated property as surplus and authorize staff to sell, auction off or destroy property.

SUBJECT: Veteran's Day Procession

BACKGROUND/DISCUSSION
The Veteran's Day Procession is scheduled for November 11, 2023, beginning at 11:00 AM. The procession will require Police escort, and the route is as follows:

The procession will form at the intersection of Grove Ave and South Ave. It will travel northbound Fifth Street to Third Ave., where it will conclude at the Veterans of Foreign Wars/American Legion Hall at 145 5'h Street. At this point, the procession will conclude with a short program.

American Legion Post 240 Commander Kris Walton has invited City personnel and members of the Police Department to join in the festivities inside the hall. American Legion Post 240 is additionally requesting restricted parking on 5'h Street in the surrounding block of the hall to accommodate disabled Veterans attending the event.

FISCAL IMPACT
Public Works personnel should be able to deliver and retrieve approximately 12 barricades, incurring about 2 hours of overtime, at a cost of $100.00. Police escort for the procession will require two uniformed Police Officers. Typical dayshift staffing on November 11, 2023 is one Officer, which means this event will require one additional Officer to be called out for 2 hours of overtime. The current fee schedule for a Gustine Police Officer is $60.00 per hour, for an overall cost of $220.00.

American Legion Post 240 has requested that the City Council waive any and all fees associated with this event.

RECOMMENDATION
City Council to authorize the request to use City streets and services by The American Legion Post 240 in Gustine and the Veterans of Foreign Wars for the annual Veterans Day Procession, and waive all associated fees.

COUNCIL AGENDA ITEM
OCTOBER 17, 2023
PREPARED BY: Melanie Correa, Interim City Manager
SUBJECT: National Flood Insurance Program Participation

BACKGROUND/DISCUSSION
During the severe weather storms earlier this year, the City was made aware that residents of Gustine were ineligible to obtain flood insurance protections because the City had not elected to participate in the National Flood Insurance Program (NFIP). NFIP is a Federal program, administered by the Federal Emergency Management Agency (FEMA) that enables property owners to purchase flood insurance. In order to purchase flood insurance, the property must be located within a jurisdiction that participates in the NFIP.

In order to participate in the NFIP agencies are required to adopt a resolution declaring intent to participate in the NFP, submit an application, and adopt a floodplain management ordinance that conforms to the State of California model floodplain management ordinance. This item is intended to achieve two of the three required necessities to participate in the NFIP.

For the third component, staff is working to prepare the required ordinance which will include regulations designed to ensure that new buildings and existing buildings that are being substantially modified are protected from flood damages. Currently, the City's municipal code adopts by reference the California Building Code Appendices "G- Flood Resistant Construction" and "K - Central Valley Flood Protection Plan." Staff will be endeavoring to draft an ordinance that meets the NFIP's requirements, without duplicating components and language already enforceable by state statute.

The resolution before Council with this item declares the City's intent to participate in the NFIP and authorizes the submittal of an application.

FISCAL IMPACT
There is no cost associated with submitting an application to FEMA to participate in the NFIP.

RECOMMENDATION
That the Council adopt a resolution declaring the City's intent to participate in the National Flood Insurance Program and authorize application for participation in the National Flood Insurance Program.

EXHIBIT(S)
A) Resolution 2023-XXXX
B) Application for participation in the National Flood Insurance Program (for reference)
RESOLUTION 2023-XXXX

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GUSTINE DECLARING THE CITY'S

INTENT TO PARTICIPATE IN THE NATIONAL FLOOD INSURANCE PROGRAM AND

AUTHORIZING APPLICATION FOR PARTICIPATION IN THE NATIONAL FLOOD INSURANCE

PROGRAM
WHEREAS, certain areas surrounding the City of Gustine are subject to periodic flooding and flood-related erosion, causing serious damages to properties within these areas; and
WHEREAS, relief is available in the form of federally sponsored flood insurance as authorized by the National Flood Insurance Act of 1968; and WHEREAS, it is the intent of this City Council to require the recognition and evaluation of flood and flood-related erosion hazards in all official actions relating to land use in areas having these hazards; and
WHEREAS, this body has the legal authority to adopt land use and control measures to reduce future flood losses pursuant to Title 7, Chapter 4, Article 1, Section 65800 of the State of California Government Code and Section 4-4-31 of the City of Gustine Municipal Code.

NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Gustine:

Section 1. Assures the Federal Insurance Administration that will enact as necessary and maintain in force in those areas having flood, or flood-related erosion hazards, adequate land use and control measures with effective enforcement provisions consistent with the criteria set forth in Section 60 of the National Flood Insurance Program Regulations; and
Section 2. Vests the City Manager, Director of Public Works or designee, with the responsibility, authority, and means to:
(a) Assist the Administrator, at their request, in their delineation of the limits of the area having special flood, or flood-related erosion hazards. (b) Provide such information as the Administrator may request concerning present uses and occupancy of the floodplain, mudslide (i.e. mudflow), or flood-related erosion areas.
