She also advised she spoke with FEMA who relayed that Merced County does participate in the National Flood Insurance Program and if the constituent's residence is outside of City limits, they should be eligible to receive the flood insurance. Council member Marsigli inquired why the City needs to participate if there are no flooding issues within the City limits, to which Interim City Manager Correa advised she was waiting for further information from FEMA.
Council member Marsigli inquired how an annexation would impact residents currently within a flood plain area in the County. Interim City Manager Correa advised if the City were to annex into an area that was County floodplain without participating in the National Flood Insurance program, the City would need to apply to be part of the National Flood Insurance Program, to allow for those residents to be eligible to obtain the insurance. She relayed that she was unsure what would happen to existing property owners that have coverage as County residents.
Council member Marsigli inquired where the floodplain is in the City's sphere of influence, to which Interim City Manager Correa advised it is a small strip along the side of the airport, and that zero structures exist on that portion.
Council member Marsigli revised the question and inquired the sphere of influence outside of the City limits, to which Interim City Manager Correa advised she was unsure how sphere of influence was considered, as opposed to city limits, by FEMA for this process.

COUNCIL AGENDA ITEM
NOVEMBER 7, 2023
PREPARED BY: Jenny Morrison, Finance Director
SUBJECT: Authorize Interim City Manager to Execute a Professional Services Agreement to Complete a Water and Sewer Rate Study
BACKGROUND/DISCUSSION
The City has responsibility for providing water and sewer service for its residents. In order to provide and maintain these services adequately, the City must take steps to ensure that revenues meet current and future expenses for these Enterprises. The City does that by establishing rate schedules based upon current and future factors.
In 2018, the Council adopted a rate schedule that covered a five year period, with the final year beginning July 2023. It is time for the Council to begin the process of considering where rates should be set in July 2024 and beyond.
In order to alter rates, the City must abide by Proposition 218, which states that rates order to determine those costs, the City will need to conduct a Rate Study, per the guidelines of Proposition 218.
The attached contract is with Harris & Associates, it outlines the proposed activities and timeline for the project. It includes a cost cap of $60,000. The timeline calls for beginning the research work needed immediately and for final recommendations to come to the Council in May 2024, with final approval on or before June 1, 2024. It is important to note that there are many steps in this process involving the consultant, City staff and the Council.
PROPOSITION 218 PROCESSES:
As several of the Council members were not on the Council for the last rate study, it seems useful to explain a short bit about the process, as required under Proposition 218.
If the City accepts the basic assumptions and findings of the water and sewer rate studies, the procedure for adopting the proposed rates per Prop 218 include:
• Scheduling a public hearing to consider any proposed rates Mailing a public notice to each property owner and/or customer that describes the proposed changes to rates
• Receiving any written protests from utility customers and/or property owners Administering a vote by the City Council, at the conclusion of the public hearing, to determine whether to adopt new rates
FISCAL IMPACT
The total cost of the contract with Harris & Associates is $60,000, which was allocated in the approved FY 23/24 budget. The cost was allocated as a split between the Water/Sewer/Refuse funds as followed: Water: $24,000, Sewer: $24,000, and Refuse:
$12,000.
RECOMMENDATION
Staff recommends Council authorize the Interim City Manager to execute a professional services agreement not to exceed $60,000, with Harris & Associates to complete a water and sewer rate study as outlined in the scope of work of their proposal (Exhibit A).

CITY OF GUSTINE, CALIFORNIA
FY 2024-2029 WATER AND SEWER RATE UPDATE
SCOPE OF SERVICES
OCTOBER 24, 2023
PURPOSE
The City of Gustine (City) completed a water and sewer rate study in 2019, including five-year financial Harris & Associates (Harris) will utilize the City's previous water and sewer financial/rate models and update with current information, five-year projections, and the proposed schedule of rates.
SCOPE OF WORK
A detailed description of the tasks to be conducted by Harris is described below.
Task 1: Project Management, Review and Coordination
1.1 Project Management. Harris will perform administrative/management procedures for efficient study performance to include internal team coordination, monthly invoicing, and regular communication with City staff regarding study progress and any concerns regarding scope, schedule, or budget. We will perform ongoing QA/QC procedures to ensure that all study components meet client expectations and adhere to all applicable regulatory guidelines and City policies.
1.2 Initial Project Meeting. Harris will facilitate a virtual kick-off meeting with City staff to discuss project scope and objectives, schedule of key milestones, and the initial data request list. Key areas of focus will be discussed including financial policies, capital funding strategies, and sensitivities regarding the level of potential rate increases.
1.3 Data Collection/Validation. Harris will prepare an initial data request list identifying the information needed for the study. We will submit this request prior to the initial project meeting to provide an opportunity for discussion of any challenges and potential work-arounds. We will review, analyze, and validate the data for use in formulating the technical analyses, and follow up with City staff for any additional items or clarification.
1.4 Interim City Staff Reviews. Harris will schedule and facilitate up to four (4) virtual meetings with City staff to review preliminary findings, draft scenarios, final draft results for City Council presentation, and final study results for the City Council/Public Hearing.
Task 2: Financial Policies Review
Harris will conduct a financial policy evaluation to determine existing practices that should be maintained and explore alternative practices that might further City goals in funding utility obligations.
This task will begin with a three-year historical review of water/sewer utility financial reports to provide familiarity with recent utility performance and serve as a baseline for policy recommendations and future projections. Financial policies will address financial performance, infrastructure replacement funding from rates, prudent levels of cash reserves, and debt management. We will evaluate the need for each reserve or policy, the basis for minimum reserve targets, and the financial impacts for establishing any new or revised policies. Sensitivity analyses will be performed to assess customer impacts and revenue risk for all policy implications.

Task 3: Capital Funding Strategy
Harris will review the City's current water and sewer capital programs, incorporate annual capital projects and associated costs for the five-year planning period into the financial models, and escalate those costs to the year of anticipated construction based on industry trends for inflation. Based on the prioritized annual five-year CIP, we will design a preliminary capital funding plan for each utility intended to feasibly execute the capital programs. We will evaluate an appropriate combination of resources from grants or other outside sources, cash reserves, connection charges, contributions from rates, and new debt. Depending on the rate impacts of our preliminary capital funding plans, the initial capital prioritization schedules may need to be adjusted to align with feasible project execution and associated rate impacts. We will work closely with City staff to prepare up to three capital funding scenarios for each utility.
Task 4: Financial Plan Development
4.1 Operating Forecast. Harris will review and project rate revenues based on the existing level and structure of water and sewer rates. Growth assumptions for new customers will be based on historical trends and input from City staff. We will review and project other operating revenue from connection fees, interest income, and other miscellaneous income sources. We will forecast operating and maintenance costs over the five-year period. Line-item detail from current operating budgets will form the baseline for this forecast. We will discuss any known or anticipated additional expenses to be incorporated into the forecast, such as impacts of the CIP, additional staffing, maintenance requirements, and any other future impacts that the City is aware of. Economic factors will be applied for cost escalation.
4.2 Revenue Needs Assessment. Harris will integrate total revenue requirements inclusive of financial policies, existing debt service, capital funding impacts, and the operating forecast to develop an annual operating cash flow for each utility over the five-year period. We will then compare projected requirements against projected revenue under existing rates to determine annual rate revenue adjustments needed to recover the total costs for each utility. We will develop a five-year system-wide rate revenue adjustment strategy for each utility that provides level rate impacts to the extent practical.
Indicated percentage rate increases will be applied uniformly to the existing water and sewer rate structure components. Sensitivity analyses will be performed to evaluate the impact of alternative capital funding strategies and other input parameters as appropriate. Representative single-family residential water and sewer bill impacts will be determined and compared against single-family residential bills for up to a selection of five surrounding water/sewer utilities. Up to three rate adjustment strategies will be prepared for the City's consideration.
4.3 Five-Year Schedule of Proposed Rates. Based on the City's selected rate adjustment strategy for each utility, Harris will develop the proposed schedule of water and sewer rates for the five-year period.
Task 5: Draft and Final Reports
5.1 Draft Report. Harris will prepare a draft report summarizing study assumptions, methodologies, and findings of the water/sewer rate study and submit to City staff in Word and pdf format for review and comment. Findings of the draft report will be presented at a City Council meeting (Task 7.1).
5.2 Final Report. Harris will revise the draft report based on City comments and submit a final report in Word and pdf format. Findings of the final report, including the proposed five-year schedule of water and sewer rates, will be presented at a Public Hearing (Task 7.2). An electronic copy of the updated water and sewer financial/rate models will be submitted to the City.
Harris & Associates
Task 6: Notice of Public Hearing
Harris will prepare the Notice of Public Hearing in accordance with the requirements of Article XIIID of the California Constitution (Proposition 218) for adoption of new water and sewer rates. We will prepare a drait Notice for review and comment by City staff and legal counsel, incorporate City comments, and submit the final Notice in Word format to the City for distribution. Based on discussion with City staff, the City will prepare the mailing list, print, and mail the Notice to property owners/customers. The City will also receive and tally any protests to the proposed water and sewer rate increases.
Task 7: City Council Meetings/Public Hearing
7.1 City Council Meeting. Harris will prepare materials and attend one virtual City Council meeting to present the findings and recommendations of the draft Water/Sewer Rate Study Report to the City Council, review the schedule of adoption of the proposed five-year schedule of water and sewer rates, and be available to answer questions.
7.2 Public Hearing. Harris will prepare materials, attend the onsite Public Hearing to present the Final Water/Sewer Rate Study Report (including the five-year schedule of proposed water and sewer rates), and be available to answer to questions.
ESTIMATED PROJECT SCHEDULE
An outline of the preliminary schedule is provided below. All major milestones and specific dates for critical milestones will be reviewed and confirmed with City staff during the initial project meeting to make sure this schedule aligns with the City's needs. We will adjust the interim schedule as necessary to meet the critical deadlines.

SUBJECT: Our Lady of Guadalupe Procession
BACKGROUND/DISCUSSION
Our Lady of Miracles Church hosts an annual procession through town known as the Our Lady of Guadalupe Procession. The procession is scheduled to take place on Tuesday, December 12, 2023 from 3:00 pm to 4:00 pm. They are asked for police assistance to ensure the safety of all who participate in the procession.
The route of the procession is as follows: The procession will line up on 2nd Ave between 6'h Street and 5'h Street. It will begin traveling eastbound on 2nd Ave turning right on 5th Street going southbound. It will travel to 5th Ave where it will make a right and travel to West and again turn right going northbound on West Ave. It will then travel to Lucerne where it will turn left going westbound. Once the procession reaches Linden Ave, it will turn left and travel to Our Lady of Miracles Church where it will enter the parking lot which will conclude the procession.
The Gustine Police Department will not post any street closure signs for this event as Police Officers/Police Reserve Officers and Police Volunteers will provide a rolling traffic escort. The volunteers will leap from side street to side street to prevent any motorists from entering the procession.
FISCAL IMPACT
This event will occur on a Tuesday afternoon. All school related activities should have been completed by this time period. The event will use on-duty personnel as well as volunteers. No additional costs are expected.
RECOMMENDATION

PREPARED BY: Gary Ingram, Public Works Director
SUBJECT: Authorize Expenditure for Asphalt Patching on HWY 33 and Alley behind GPS Hall
BACKGROUND/DISCUSSION
As a Public Works Department, we do our very best at patching a road immediately following an excavation for underground utility maintenance. We often times fall short of restoring the area with a perfect patch job. As maintenance workers, our patch work skills need to be further developed in order for the completed patch work to meet our standards. Public Works believes that the community deserves the best quality roads that we can provide given the resources we have. Because our work in the past has not met our standards of quality patching we are interested in hiring an expert paving company to replace the old patches and bring them to an exceptional standard.
Two specific areas have been identified as problematic due to Cal Trans road condition requirements and complaints from the stakeholders residing in the area. The location on HWY 33, between 6th and 7h Street, creates a condition that causes the heavier semi-trucks to rattle and shakes the homes. The patch located in the alleyway adjacent to GPS Hall is sinking and with continued traffic will further deteriorate. Both of these areas were compromised because of water main leaks and repairs. Hensley's Paving quoted $17,919 for both areas, $14,419 for the Highway 33 location and $3,500 for the alleyway.
Public Works requested bids from two contractors, Rocha Backhoe Service and Hensley Paving, a third contractor was unavailable to provide a bid. Public Works reached out to Cal Trans and notified them of our intent to use either Rocha or Hensley and they were satisfied with either contractor. Rocha quoted $14,350.00. Hensley's Paving quoted $17,919.00. Public Works recommends awarding the contract to Hensley's Paving because of the high-quality work they deliver combined with their ability to mobilize quickly before any increment weather. Hensley's will also utilize their own traffic control teams, alleviating the Public Works department from staffing this component.
Hensley's Paving is the same contractor who paved the Schmidt Park walking path.
Hensley's quote includes other areas, which are not currently being sought to repair with this item before Council. Any additional patch repairs will be brought before Council, in accordance of the City's purchasing policy.
FISCAL IMPACT
After speaking with the Finance Director, and considering these repairs are necessary as a result of water leaks, staff is proposing to pay the $17,919 from the Water Fund's Other Contract Services account (Fund 060).
RECOMMENDATION
Council to approve and authorize the Interim City Manager to enter into a contract with Hensley's Paving, for the amount of $17,919 for the two above-identified asphalt patches.

BUSTINE CITY CALIFO ITEM NO. 10
COUNCIL AGENDA ITEM
NOVEMBER 7, 2023
PREPARED BY: Gary Ingram, Public Works Director
SUBJECT: Authorizing Expenditure for Road Repairs on North Ave. and Fentem Rd.
BACKGROUND/DISCUSSION
Good road conditions are essential for a variety of reasons, as they play a significant role in the safety, efficiency, and overall well-being of a community and its economy.
Here are some, but not all of the key reasons why good road conditions are important:
1. Safety: The primary concern is the safety of all road users, including drivers, passengers, pedestrians, and cyclists. Well-maintained roads with smooth surfaces, clear markings, and appropriate signage reduce the risk of accidents, injuries, and fatalities.
2. Quality of Life: Smooth roads lead to a more pleasant driving experience, which contributes to an improved quality of life for residents. Less time spent in traffic and fewer vehicle repairs lead to less stress and better overall well-being.
3. Community Development: Good road conditions are often associated with an area's development and prosperity. They can encourage businesses to invest in the community and residents to remain or move to the area.
4. Environmental Impact: Well-maintained roads tend to generate less air pollution as vehicles can operate more efficiently. Additionally, proper drainage systems on roads help prevent water pollution and erosion.
This item addresses the needs of road repairs at several locations, two areas located on North Ave. between West Ave. and Laurel Ave. and an area located on the corner of Fentem Rd. and Jensen Rd. These two areas have been in need of repairs for several years with deterioration of the areas continuously worsening. Public Works believes that the community deserves the best quality roads that we can provide given the resources we have. We are interested in hiring an expert contractor to replace the old sections and bring them to an exceptional standard.
Staff believes these areas are compromised due to poor compaction. On North Ave the area has been filled with cold patch several times and the ground continues to subside. The area on Fentem has the same issue where the subsidence stretches from the driveway approach to the center of the roadway.
Staff has collected bids from Rocha Backhoe Service, Inc., Hensley's Paving, and C.C.
Concrete Construction. Hensley's Paving quoted only the North Ave repairs, and set forth parameters limiting their ability to repair the patch. Hensley's quote for $3,500.00 on the North Ave. areas is set at that price because that is the minimum price for them to do any prevailing wage job whether the job costs $3,500.00 or not. CC Concrete Construction returned a quote via text for $12,500 for both areas. Rocha Backhoe Service quotes $11,665 for both areas.
Public Works recommends utilizing Rocha Backhoe Service Inc. for these repairs because of the quality of their work, and historical knowledge this contractor possesses with these specific areas. Rocha will not need to utilize Public Works for any traffic control.
As per Exhibit A, Rocha's quote also includes other areas, which are not currently being sought to repair with this item before Council. Any additional patch repairs will be brought before Council, in accordance of the City's purchasing policy.
FISCAL IMPACT
After speaking with the Finance Director, staff is proposing to utilize Highway Users Tax Account (HUTA) or Gas Tax Street Improvement 2105 Fund (Fund 010) to complete this project. HUTA is only available for specific road-related expenses, staff has confirmed these repairs are within the eligible expenditure categories.
RECOMMENDATION
Council to approve and authorize the Interim City Manager to enter into a contract with Rocha Backhoe Services, for the amount of $11,665 for two above-identified road repairs.

HE CITY CA ITEM NO. 11
COUNCIL AGENDA ITEM
NOVEMBER 7, 2023
PREPARED BY: Gary Ingram, Public Works Director
SUBJECT: Authorize Expenditure for Asphalt Patching on East Ave. and Railroad Ave.
BACKGROUND/DISCUSSION
Good road conditions are essential for a variety of reasons, as they play a significant role in the safety, efficiency, and overall well-being of a community and its economy.
As a Public Works Department we do our very best at patching a road to keep up with overall condition. The department has spent time and money to continuously patch the same area that needs to be removed and replaced. As maintenance workers, we do not have the machines, manpower, or experience to repave a road. Public Works believes that the community deserves the best quality roads that we can provide given the resources we have. We are interested in hiring an expert paving company to replace a 3,500 sq. ft. area at East Ave and Railroad Ave.
Considering that this intersection will be heavily driven on when the traffic detour from the Hwy 33/SR140 Roundabout project is in place in the coming months, the deterioration of this area has come to the forefront as critical in getting repair as soon as possible.
Staff sought proposals to patch the area from Rocha Backhoe Service, and Hensley's Paving (Exhibits A and B). No third contractor was available to provide a bid. As the lowest bidder, Public Works is recommending the City contract with Hensley's Paving to perform the repair. Hensley's is not only the lowest bidder, they are capable of providing their own traffic control teams. The repair will cause a portion of East Ave to close for one working day. It should also be noted that the repair will not extend to the railroad tracks, eliminating the need for any encroachment permits with the railroad- further assisting the ability for this repair to occur prior to the traffic detour implementation.
FISCAL IMPACT
Henley's bid for the project is $40,352.00. After speaking with the Finance Director, staff is proposing to utilize local Measure V funding (Fund 201) to complete this project.
Measure V local funding is only available for specific transportation-related expenses, staff has confirmed these repairs are within the eligible expenditure categories.
RECOMMENDATION
Council to approve and authorize the Interim City Manager to enter into a contract with Hensley's Paving, for the amount of $40,352.00 for the above-identified asphalt patching.

COUNCIL AGENDA ITEM
NOVEMBER 7, 2023
PREPARED By: Jami Westervelt, Economic and Community Development Director SUBJECT: Adopt CalRecycle Resolution for Grant Applications
BACKGROUND/DISCUSSION
The California Department of Resources Recycling and Recovery ("CalRecycle") is the entity responsible for oversight of implementation of SB 1383. The stated intent of SB 1383 was to preserve landill capacity, protect public health and safety, and protect the environment by reducing the amount of materials going to landfills. As part of its responsibilities, CalRecycle also administers various grant programs in furtherance of the goals of the 1383 mandates.
The City of Gustine received approval of a temporary waiver for portions of SB 1383, for no more than five years, but the City still must comply with certain portions of the law.
Therefore, the City remains eligible for funding from CalRecycle related to the mandates of SB 1383 regardless of its waiver.
In 2022, the City applied for and received approval of a grant for $20,000 through the CalRecycle 1383 grant program. The Public Works department will utilize a portion of these funds prior to the end of the calendar year to pay for organic materials the State requires the City purchase. The City will purchase compost with a portion of the grant funding that, without the grant, the City would have to use other funds to purchase. The existing grant does not expire until the latter part of 2024 so Economic Development, Recreation and Public Works staff are working together to revise the original grant budget to best utilize the funds to meet current City needs. Although those previous grants are still open, CalRecycle has opened up the application window for the next year of grants.
The same department staff are working on an application for the new funds.
CalRecycle has published funding estimates showing the City of Gustine as eligible for an estimated $75,000 minimum. Staff is looking at including equipment in the form of a Skid Steer Outfitter in addition to consultant fees, organic material purchase mandates for calendar year 2024 and other items of use to the City. Staff is likely to submit a grant request of more than $75,000 as the City could receive more than the anticipated minimum, depending upon submittals by other jurisdictions. The City would not receive more if it did not initially apply for a higher amount.
If the City receives less funding in its new application than it applies for, staff will submit a budget revision to CalRecycle. The agency could not hold the City to the full scope of the grant while providing fewer dollars.
It is important to understand that CalRecycle allows jurisdictions to modify budget submissions for its grants after award. This also provides for flexibility in unspent funds with change in direction based on changing City staffing, priorities and needs.
At the writing of this staff report, the final budget submission is not finalized but will be completed prior to the grant deadline of November 15. However, CalRecycle requires approval of an authorization grant resolution by the Council prior to the November 15 application deadline.
The attached resolution includes the language required by CalRecycle that can remain active for up to five years. While staff will still bring grant information and inquiries forward to the Council, the resolution allows staff to act quickly to respond to CalRecycle application deadlines, report timelines and requests for payment in the future, without requiring another resolution by the Council. This nimbleness will allow for the City to apply for the maximum amount of funding available both this year and into the future.
FISCAL IMPACT
CalRecycle grants will allow the City to meet needs for which the City would otherwise have to find other funding sources, including for mandated expenses under SB 1383.
RECOMMENDATION
Staff recommends Council adopt the Resolution authorizing submittal of individual grant applications and providing for execution of related grant documents for CalRecycle programs for a maximum period of five years.
