COUNCIL AGENDA ITEM
NOVEMBER 21, 2023
PREPARED BY: Jami Westervelt, Economic and Community Development Director Gina Paolini, Contract Planner, CSG Consultants
SUBJECT: Sixth Cycle Housing Element Information Update on Sites Inventory and Environmental Justice and Safety Elements

BACKGROUND
During a special study session held July 11, 2023, the City Council received an update on the efforts for the City of Gustine related to its participation in the Merced County Multi-Jurisdictional Housing Element (MJHE) as part of the City's required Sixth Cycle Housing Element (HE) submission. The presentation covered the state mandates for submitting the Sixth Cycle, RHNA requirements for that submission and steps required for compliance. The presentation also touched upon the requirement that the City also update its Environmental Justice and Safety Elements in conjunction with the HE work.

Outreach Activities since the July 11 Council Meeting
A number of activities have taken place in the four months since that presentation in order to attempt to garner public input on all the elements under discussion. In addition to MJHE outreach, the City held community workshops August 29, November 3 and November 16. (Please note that this staff report was written prior to the November 16 public workshop was held so that information is not able to be included in this staff report.)
Planning Commission-noticed meetings, including information and draft site inventories, provided members of the public additional opportunities to comment. The Commission meetings took place in September and October.

The City also has developed and posted Community Planning web pages that contain information on the Sixth Cycle HE, MJHE and other developing General Plan elements.

A survey has been developed and distributed starting earlier this month and is still available online both in English and in Spanish.

The schedule allowed for staff to gather and then share with Council the most common questions and concerns expressed by residents to this point in the meeting process.

Consequences of Noncompliance for the Sixth Cycle Housing Element The State has continually tightened housing mandates and planning requirements for local jurisdictions in recent history, under its stated goal to provide more housing inventory statewide and to provide for more affordable housing in the state. Along with increasing mandates, the State has also increased consequences to jurisdictions for non-compliance including potential fines, deeming of a City's General Plan as inadequate or invalid, loss of local control, and loss of eligibility for funding and grant programs. The State has gone as far as to file suit when jurisdictions have attempted to take actions to exempt themselves from Sixth Cycle requirements. No cities have been successful thus far in these legal challenges.

In addition to State-instituted consequences, some jurisdictions are also facing Builder's Remedy applications for projects if they are noncompliant on this cycle of the HE. There are specific parameters for Builder's Remedy projects that, if met, limit the ability of a jurisdiction to stop projects from moving forward based on zoning if the jurisdiction does not have its HE current and certified by the State.

All of these underscore the importance of the City remaining on schedule and moving forward in order to limit potential negative consequences as listed above.

Due to the number of questions received on noncompliance in general and Builder's Remedy specifically, and to ensure that Council has the opportunity to ask all related legal questions, as part of the meeting discussion the City attorney will provide additional legal information and clarification to the Council.

Sites Inventory- RHNA Numbers
The City is working on the Environmental Justice Element and the Safety Element concurrently with the Housing Element, and there are many requirements for all three elements as well as the Housing Element. Overwhelmingly, the Site Inventory has received the most attention by members of the public.

An important component of the State requirements is the Regional Housing Needs Allocation (RHNA) process. HCD determines the statewide housing production goal by income and assigns each region a share. The City must, through its HE and subsequent required zoning changes (if needed), plan for the total number of housing units, by affordability level, as assigned in the RHNA.

It is important to keep in mind that the RHNA numbers require the City to meet inventory availability goals for all income levels. While the City cannot force any developer to build units, the State requires that the City provide zoning appropriate that could accommodate the required units at the mandated density and affordability levels during the planning period (January 2024-January 2032).

While the lower-income unit requirements have received the most comment from the public, the majority of the units required in the City RHNA number-43% of the total units— are intended for above-moderate income individuals. The City of Gustine has the following RHNA unit and affordability requirements for the Sixth Cycle:

Above Moderate: 152
Moderate: 64
Low: 53
Very-Low: 77
Sites Inventory-History of Initial list of 15
The State of California provides mandates on factors that cities of all sizes must consider in their site inventories if they want to gain the required acceptance by the State of their housing elements. Some of these are more straight-forward than others but the selection is in no way random. As the City has enough vacant sites to meet its RHNA allocations, the City began its analysis with the larger list of sites.

Included as background is a map (Exhibit G) showing the larger list of 29 initial open sites identified as vacant. This list was paired down based upon the fact some sites clearly did not meet the most basic and objective of the State's parameters for rezone consideration. Those being:

1. _ Existing zoning: Sites were removed because the zoning designation was not classified as residential or planned development.

Lot size: Sites removed for not meeting the State minimum (0.5 acres) or exceeding the maximum size (10 acres).

Use: Sites were activated (therefore not considered vacant).

Once sites were excluded for the above three criteria, the City had 15 sites that it could consider for rezone (Exhibit F map). (Note: The map showed 16 Sites because the one Opportunity Site for the HE (Site #1) shows on the Site Inventory Map as well. Only 15 of the sites are in consideration for rezone as the other site is already appropriately zoned.) The City notified all property owners within 300' of the 15 sites and presented that information at the September Planning Commission meeting to garner input from those property owners. It is important to note that staff conducted the analysis that brought the list to 15 prior to comment from the public because public comment could not impact the disqualification either way, as these are prescriptive, objective criteria.

While the City did not expect to have to include the full list of 15 sites to meet its RHNA mandates, the intent of noticing the entire list of 15 was to discuss alternatives and provide an opportunity for community engagement to discuss potential sites.

Moving beyond the 15 sites, the City can consider the additional criteria of "proximity" and "infrastructure" when preparing the Site Inventory but this does not provide for a straight-forward analysis in Gustine.

Proximity to Services
The United States Census Bureau lists the land area in square miles for the City of Gustine as 1.55 square miles. This makes State criteria of "proximity to" less clear cut than in large communities where there may be neighborhoods multiple miles away from any services, schools or parks (three State proximity criteria). At just over a mile and a half, all City locations are generally reasonably close to any of these.

For Gustine, sites may sit slightly closer to a single criterion than other sites but not as close to different criteria-making comparisons often equal. Unless a site sits immediately adjacent to a service, school or park, proximity is relative in Gustine and, for the majority of the sites, not a determining factor. None are unreasonably far from services, schools or parks.

Unlike vacancy, current zoning and a defined size in the first round; proximity considerations did not reasonably allow the City to remove any of the 15 sites from further consideration for rezone.

Access to Infrastructure
Similarly, access to infrastructure, including: ready access to roads, sewer and water mains; did not provide reasonable support for eliminating sites. All 15 sites reasonably met the infrastructure criteria.

Reuse of Sites from 5th Cycle
As a first pass at the list of 15 sites (Exhibit A), the City looked at the sites listed on the state-certified fifth-cycle Housing Element, specifically those listed as high density residential in that cycle. The City has four sites on its list that were listed on the fifth cycle inventory, site numbers: 6, 7. 9 & 10.

This is mentioned in response to questions received on Sites 9 & 10. The fifth cycle HE approved by the State has in one spot that zoning on these sites is "through the year 2024 only" but leaves that reference off in other locations in the document. Both City and County Consultants and City legal counsel advise that the state is highly unlikely to allow these sites to "revert back" to R-l designation based on those words and that the date inclusion does not serve as a sunset to that zoning in any way. City legal counsel has been asked to address this further at the meeting.

It is also important to note that these sites contain both the highest numbers of units overall and the most affordable units in the RHNA of any of the sites on the draft Site Inventory list. Further, the location of both of these sites, one immediately between two schools and the other within very close and safe walking distance to shopping and a park, make the sites amongst the most desirable for these types of projects.

Sites 6, 7, 9 & 10 are high-priority sites for the City to meet its RHNA goals.

Equitable Distribution of Sites-State Directive
The State directs that jurisdictions in their site inventory distribute lower-income RHNA throughout the community and the City has to consider this in its Site Inventory.

Community members have asked at workshops how far apart sites have to be but the State does not provide that information. The Housing Element Site Inventory Guidebook for Government Code Section 65583.2 states that "sites must be identified throughout the community." In clarifying that, the guidebook states the following:
"For purposes of the housing element site inventory, this means that sites identified to accommodate the lower-income need are not concentrated in low-resourcea areas (lack of access to high performing schools, proximity to jobs, location disproportionately exposed to pollution or other health impacts) or areas of segregation and concentrations of poverty. Instead, sites identified to accommodate the lower income RHNA must be distributed throughout the community in a manner that affirmatively furthers fair housing. One resource the jurisdiction could use when completing this analysis is the California Tax Credit Allocation/California Department of Housing and Community Development Opportunity Maps, which can be accessed at
https://www.treasurer.ca.gov/ctcac/opportunity.asp."
The link listed in this section is to opportunity maps. The 2023 Opportunity Map shows resource areas by city quadrant "neighborhoods" as a resource for communities seeking to meet this requirement. The map for Gustine (Exhibit H) shows similar resources throughout the City except for the Northeast quadrant. While staff and consultants do not interpret this as a directive to place the majority of the sites in that neighborhood, ensuring that this neighborhood has received its fair share of low-income sites, along with the other neighborhoods in the City, logically may improve chances of approval of the Site Inventory by the State.

Site Inventory Round 2 Approach: Equitable Distribution and Reducing Impact The planning team, consisting of staff and consultants for both the City and County, have the responsibility to present to decision makers a recommendation that both provides what the team believes represents the best opportunity for approval from the State and that best serves the community as a whole.

While the most common concern expressed by community members thus far has been questioning why the City has to participate and comply with the State mandate, the second most common comment has been the expression that each neighborhood is not the best place to include high density and lower-income housing.

Members of the community identifying themselves as from three of the four neighborhoods of the City have expressed a desire to move higher density and/or lower income from their neighborhoods: Southeast Gustine, Southwest Gustine and Northwest Gustine. Staff cannot say for certain whether representatives from Northeast Gustine attended or have concerns, but the addresses shared at meetings correlate with the other neighborhoods.

It is important to note that the Northeast neighborhood is traditionally underserved and that the State would not allow the City, nor would the planning team recommend, that this neighborhood should receive a higher number of high density and lower-income sites or units in the Site inventory simply because staff have not been able to identify any commentary coming from that neighborhood to this point.

There have not yet been representatives from any one neighborhood asking for high density and/or lower income units to be built in their neighborhood. Property owners from each of the three neighborhoods have stated the following opinions in regard to zoning higher density and/or lower-income in their neighborhoods or near their homes:
• Reduction in property value
• Reduction in quality of life for existing residents
• Increase in crime
• Increase in blight
While the above are not considerations the State weighs or allows the City to consider in order to eliminate sites or a whole neighborhood, the point is that homeowners in all the neighborhoods expressed the same concerns. Eliminating sites in one neighborhood puts a larger burden with more sites needed in other neighborhoods.

With all things being equal, the approach that the planning team has taken in order to come to the draft sites to this point has been to attempt to, as equitably as possible, distribute the RHNA categories that residents have expressed concern about throughout all neighborhoods.

Doing so not only seems most likely acceptable for State review, but also does not show preferential treatment of any one group of residents over another.

As the City does not need to utilize all 15 sites identified as acceptable per the criteria, the planning team created the recommended map for review with the basic principles in mind in order to minimize the impacts as much as possible:
a. Distribute as equitably by neighborhood as possible (with the understanding each of the available sites has limitations to numbers) b. Utilize smaller sites where available
c. Proximity- meaning site immediately next to a service as preferred (only as secondary to principles a. and b. above).

The recommended list of sites and map attached (Exhibits A & B) represent an attempt by the planning team to use the fewest number of new sites available to meet the RHNA numbers within the above principles. The list contains nine sites for rezone. Of the nine parcels identified on the original list, three are proposed for rezone to medium density and six to high density.

The attached chart (Exhibit B) shows the units per acre within the State requirements for each of those designations but also shows a lower "Realistically Allowable Density" for which consultants advise the State accepts. Therefore, medium density sites (State R-3 designation) are realistically expected to contain approximately 11.25 units per acre and high density (State R-4 designation) 15 units per acre.

On its inventory, the City must set "reasonable" targets for affordability level for units— with the State having sole discretion for deciding reasonableness of those assumptions.

The inventory sheet specifies that the medium density sites (R-3) identified will accommodate those in the Moderate and Above-Moderate income levels. The high density (R-4) would be affordable for those in the lower income threshold and likely also occupied by some within the Moderate-Income level.

While higher densities do not have a mandate to correspond with lower income levels, and this is specifically not as true in very large cities and metropolitan markets, higher- density housing being built in a city the current population size of Gustine will more likely be utilized by those in a lower income bracket. At the same time, the medium-density designations may also appeal to seniors and others who may be able to afford lower density properties but prefer not to have the responsibility for maintenance of personal yard areas or larger floorplans.

The Site Inventory list attempts to realistically take all these factors into consideration with the least amount of zoning impacts. The reduction to sites represents an attempt at the fewest impacts overall and an earnest effort to distribute the required RHNA numbers throughout the City as evenly as possible.

The attached sheet (Exhibit B) shows the number of RHNA units in the draft Site Inventory proposed for rezone by type by Neighborhood. The unit impacts in the draft for each neighborhood are listed at the bottom of the sheet by most units to fewest units:

Southeast (most), Southwest, Northwest and Northeast (fewest).

Site Inventory Option A for Northwest Gustine
Each of the sites on the list presented at the October Planning Commission meeting met the minimum requirements the City must follow. On two of the sites, residents brought forward concern that they believed these presented access challenges. These two are labeled Site 4 and Site 5 on the recommended site map (Exhibit A). Consultants have advised that both are accessible by the requirements for site consideration. Parcel maps for these sites are included for information only for the Council (Exhibit D & Exhibit While the sites technically provide the access required, the planning team wishes to provide Council an alternative to consider. Analysis of the site potential numbers shows that removal of Site 4 and Site 5 on the map could be accommodated by placing Site 11 on the inventory instead with the same zoning. This larger site would replace the two smaller ones. The two were initially included instead of the larger in order to keep the sites smaller but the one larger site can accommodate numbers equivalent to the smaller sites combined. This switch also maintains equitable numbers in this neighborhood.

Other Site Changes
The Site Inventory Map-whether original or Option A-represents a proposal that meets the City's RHNA numbers in a reasonable manner. There is no cushion in the numbers to allow for removal of any site without identifying another site acceptable for rezone that can accommodate equal numbers.

To consider potential changes, refer back to Exhibit F that shows which sites meet the rezone criteria and what neighborhood each of those sites fall within.

Meeting other RHNA Numbers without Rezone
It is important to keep in mind that the RHNA numbers require the City to meet inventory availability goals for all income levels. In regard to inventory sites in the higher income brackets, the City must also demonstrate the ability to meet RHNA for that income range.

Less emphasis is placed on meeting the moderate and above moderate-income category, because traditional market-driven development satisfies this income category through the RHNA cycle. However, for the City of Gustine, even single-family home construction has been slow in recent history.

The City can utilize an Opportunity Site listed on the map as Site 1 for single family and not rezone that site. The City may also use R-1 projects currently in the "pipeline" in the Southeast Master Plan Annexation area to meet its required RHNA numbers for higher income levels. Those sites are listed as Opportunity and RHNA Credit Sites on Exhibit C.

When combined, the "pipeline" inventory from the single-family homes listed in the approved City Southeast Master Plan would provide the units to meet the Sixth Cycle RHNA requirements for moderate and above income levels. This is not inconsequential as previously noted because the majority of the units the City needs are for above- moderate income.

Safety and Environmental Justice Elements
As mentioned previously in this report, in addition to the Housing Element, the planning team also is working on the Safety and Environmental Justice elements required by the State at this time as well.

The public has been most interested and concerned about the Site Inventory to date but the City continues to work to collect input on the other two important elements as well. The Council will receive additional information on both of these elements at future Council meetings.

FISCAL IMPACT
None definitive at this time from this action.

RECOMMENDATION
Council receive staff report and public input, and provide comments and direction on the revised proposed sites for new housing locations for the Housing Element, including potential Option A, opportunity sites and sites for potential rezoning.
