ITEM NO. 5

COUNCIL AGENDA ITEM
*CORPORATED NOW T MARCH 5, 2024
PREPARED BY: Ruben Chavez, Chief of Police
SUBJECT: Consider Waiving the Second Reading and Adoption of an Ordinance adding Chapter 12, Tobacco Retailers, to Title 5 of the Gustine Municipal Code, Regulating Sale of Tobacco Products to Reduce the Illegal Sale of Tobacco to Youth

BACKGROUND/DISCUSSION
At their regular meeting on January 16, 2024, Council introduced and waived the first reading of an ordinance adding Chapter 12 - Tobacco Retailers. During that meeting, prior to taking action, Council provided direction for further amending of the ordinance, which is noted in redline form on the draft ordinance (Exhibit A).

Ordinances are approved in two separate steps, an introduction and an adoption, which occur at separate public meetings according to the law. This item before Council is the second step in the approval process.

Original information from the January 16, 2024 item is included below for background.

The City of Gustine applied for a Tobacco grant in the amount of $294,882 from the California Department of Justice, Division of Operations. On December 31, 2020, The City was notified that we were awarded the grant. At the January 19, 2021 Council meeting, Council accepted the grant by Resolution (Resolution # 2020-2547). One component of the grant's objectives is to develop an Ordinance enhancing the regulation of sales of tobacco products.

At the September 19, 2023 Council meeting, staff presented a draft ordinance for consideration. During that meeting, City Council directed staff to amend portions of the draft ordinance to better encompass the needs of a smaller community. There were additional comments received by the American Cancer Society that were also taken into consideration as staff ventured to update the draft ordinance.

Attached to the report as Exhibit A, is the updated draft ordinance for Council's consideration. Significant modifications include:
- Amended licensing requirement to reference the State of California's requirement that all tobacco operators must obtain a Cigarette and Tobacco Products Retailer's License (5-12-1 (f));
- Removed sections 5-12-4, 5-12-8, 5-12-9, and 5-12-10; - Reduced the distance from 1,000 feet to 500 feet in section 5-12-5a; - Removed subsection (d) in Section 5-12-5;
- Removed subsections (f) and (g) of 5-12-6 (it should be noted that State Law 308 (a) (A) (i) Penal Code is a misdemeanor punished by fine) The updates are shown on Exhibit A in tracked change form for identification. Adoption of this proposed ordinance will ensure the goals and requirements of the grant have been met. As with all ordinances, if introduced and the first reading waived tonight, the City Clerks department will notice the draft ordinance and post its proposed adoption date. The ordinance will return to Council for final adoption at a future meeting.

FISCAL IMPACT
There is no fiscal impact associated with adopting this ordinance.

RECOMMENDATION
Staff recommends Council waive the first reading and introduce an Ordinance adding Chapter 12, Tobacco Retailers, to Title 5 of the Gustine Municipal Code, regulating the sale of tobacco products to reduce the illegal sale of tobacco to youth.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GUSTINE ADDING CHAPTER 12, "TOBACCO RETAILERS," TO TITLE 5 OF THE GUSTINE MUNICIPAL CODE,

REGULATING SALE OF TOBACCO PRODUCTS TO REDUCE THE ILLEGAL SALE OF

TOBACCO TO YOUTH
Section 1. Purpose. In enacting this Chapter, it is the intent of the City Council to encourage responsible tobacco retailing practices and discourage violations of tobacco-related laws, especially those involving the sale or distribution of tobacco and nicotine products to youth. This effort will largely consist of regulating self-service displays of tobacco products, thereby restricting the availability of these products to those persons under the age of 21 years.

Section 2. Authority. The City Council enacts this ordinance under the authority granted to cities by Article XI, Section 7 of the California Constitution.

Section 3. Findings. The City Council finds as follows:
(a) Use of tobacco products is detrimental to human health. (b) A large majority of persons who use tobacco products start that use as minors, and restricting the availability of tobacco products to minors is consequently a goal of the City.
(c) Numerous scientific studies have found that tobacco smoke is a major contributor to indoor air pollution.
(d) Air pollution caused by smoking is an offensive annoyance and irritant.

Smoking results in serious and significant physical discomfort of nonsmokers and constitutes a public nuisance in public places and work places.
(e) Reliable scientific studies, including studies by the Surgeon General of the United States and studies commissioned and assessed by the U.S.

Environmental Protection Agency, have shown that breathing sidestream or secondhand smoke is a significant health hazard to non- smokers; particularly to children and teens, elderly people, individuals with cardiovascular disease, and individuals with impaired respiratory function, including asthmatics and those with obstructive airway disease (f) Health hazards induced by exposure to environmental tobacco smoke include lung and other forms of cancer, respiratory infection, decreased respiratory function, decreased exercise tolerance, broncho- constriction and broncho-spasm, and that the most common cause of premature death from environmental tobacco smoke is heart disease. (g) Reliable scientific studies assessed by the U.S. Environmental Protection Agency have found that sidestream and secondhand tobacco smoke is a leading cause of premature death and disability among nonsmokers.
(h) Nonsmokers with allergies, respiratory diseases and those who suffer other ill effects of breathing sidestream or secondhand tobacco smoke may experience a loss of job productivity or may be forced to take periodic sick leave because of adverse reactions to same. (i) Smoking in public places and work places is a major cause of fires and damage to merchandise and equipment as well as costly maintenance and repairs to furniture and fixtures. Studies have shown higher cost to the employer are associated with smoking in the work place due to increases in absenteeism, accidents, costs of medical care, loss of productivity, and cleaning and maintenance requirements. (i) The health care costs produced by smoking-related ailments and diseases constitute a heavy and avoidable financial drain on our community.
(k) The Surgeon General of the U.S. and U.S. Department of Health and Human Services have found that a majority of those Americans who die of tobacco-caused diseases became addicted to nicotine in tobacco products as adolescents before the age of legal consent. (I) The National Institute on Drug Abuse has concluded that the nicotine in tobacco products is a powerful addictive drug and identifies nicotine addiction as the most widespread example of drug dependence in the U.S.
(m) The U.S. Food and Drug Administration conducted laboratory analysis of electronic cigarette samples and found them to contain carcinogens and toxic chemicals to which users and bystanders could potentially be exposed, suggesting that the same health and public nuisance concerns present with conventional cigarettes exist with electronic cigarettes.
(n) The City Council further finds it is within its basic police power to implement and enforce the provisions of this chapter.

NOW, THEREFORE, the City Council of the City of Gustine does hereby ordain as follows:

Section 4. Amendment. A new Chapter 12, entitled "Tobacco Retailers" and containing Sections 5-12-1 through 5-12-310, 5-12-6 and 5-12-7, is added to Title 5 of the Gustine Municipal Code ("GMC") to read in full as follows:- And

COUNCIL AGENDA ITEM
MARCH 5, 2024
PREPARED BY: Administrative Services Director Melanie Correa SUBJECT: Approval of Limited-Term Appointment Agreement for the Position of Acting Police Chief between the City of Gustine and Sammy Joseph effective March 19, 2024

BACKGROUND/DISCUSSION
Beginning at the end of February, 2024 Gustine Police Chief Ruben Chavez will be out of the office for personal time off. In April, Chief Chavez will be out of the office for industrial injury leave that is expected to last upwards of six months. His leave will create an immediate need for leadership in the Chief's capacity in the police department.

To address this need, staff is recommending Council consider approving the limited- term appointment of Sammy Joseph as Acting Police Chief. Staff believes Mr. Joseph's specialized skills in the areas of law enforcement management, along with his time serving the City previously as Lieutenant will lend well towards the continuance of business in vital city services.

Mr. Joseph is currently a CaPERS retiree that is within the initial 180-day wait period established by Government Code section 7522.56. For the Council to appoint a CaPERS retiree to a limited-term position, that appointment must comply with the requirements as codified in Government Code Sections 7522.56 and 21221(g).

Specifically, an appointment under Sections 7522.56 and 21221(g) is permissible if all of the following requirements are met:
(1) The appointment must be to a temporary position;
(2) The appointment is of limited duration;
(3) The appointment is either during an emergency to prevent stoppage of public business or because the retiree has specialized skills needed in performing the work;
(4) The compensation received by the retiree is not more than the maximum monthly base salary paid to other employees performing comparable duties as listed on the City's publicly available pay schedule, reflected as an hourly rate by dividing the monthly base pay by 173.333; (5) The total hours worked by the retiree in a fiscal year, for all CaPERS employers, cannot exceed 960 hours;
(6) The compensation paid to the retiree is limited to the hourly rate:
(7) The retiree cannot have received unemployment insurance payments in the prior 12-month period arising from work performed as a retiree for any public employer; and
(8) For any retirees with a retirement effective date on or after January 1, 2013, the appointment must occur at least 180 days following the date of retirement unless the employer certifies that the appointment is necessary to fill a critically needed position before 180 days have expired and the governing body approves the appointment in a public meeting.

Staff believes the appointment of Mr. Joseph meets all of the foregoing requirements as detailed in the attached Appointment Agreement. Requirement #8, the 180 Day Wait Period Exception, is specifically addressed in the subsequent staff report and proposed resolution.

Staff is proposing an effective date of March 19, 2024, as Mr. Joseph has pre-existing personal obligations preventing him from being able to commence sooner.

RECOMMENDATION
Council review and approve the attached Limited-Term Appointment Agreement with CalPERS Retiree for the position of Acting Police Chief between the City of Gustine and Mr. Sammy Joseph effective March 19, 2024, and authorizing the City Manager to execute the agreement.
