ITEM NO. 5
COUNCIL AGENDA ITEM
MARCH 19, 2024
PREPARED BY: Soknirorn Than, City Manager
/
Pat Borrelli, Fire Chief
SUBJECT: City Council Approve Memorandum of Understanding with Merced County for the Joint Self-Contained Breathing Apparatus Purchase
BACKGROUND
On January 20, 2023 the City entered into a Memorandum of Understanding (MOU) with Merced County for the purpose of applying for an Assistance to Firefighters Grant (AFG) and managing the funds for purchasing Self-Contained Breathing Apparatus (SCBA) for the County and City of Gustine. The AFG grant is administered through the Federal Emergency Management Agency (FEMA).
The primary objective of this MOU is to establish a purchasing group for the purpose of replacing SCBAs which are at the end of their service life. Forming this group allows for improved interoperability, increased purchasing power and a more thorough evaluation of the units in the market place. More importantly, the long-term benefit will be the support each agency will be able to provide to the partner agency in servicing units and reducing duplication.
The MOU highlighted Merced County obligation to provide the required ten percent matching cost for the equipment to be purchased. Per the MOU, if the grant were awarded, the City is to be allocated eight packs and eight masks.
DISCUSSION
On March 1, 2024, the County notified the City of Gustine along with the Cities of Livingston and Dos Palos that we were successful in receiving the AFG to replace all of the SCBA that are currently on the County's and City's fire engines. To finalize the grant, all parties are required to execute an MOU authorizing the County to purchase the equipment as listed in the grant application. Per the MOU, the City is responsible for following:
• Provide the following assigned liaison(s):
o Project Lead: Primary point of contact responsible for SCBA equipment • Ensure all documents demonstrating programmatic completion are completed in a timely manner, are accurate, and forwarded to the designated Lead Agency contact
• Maintain all SCBA equipment and grant records, files, and supporting documentation in the event of an audit for three years after the official closeout of the grant.
• Ensure that all activities comply with the terms of the host/lead agency, Notice of Funding Opportunity (NOFO), Award, federal regulations, laws, and Executive Orders as applicable
It is worth noting that SCBA are required to be placed on the emergency response vehicles on a "permanent loan" basis for use toward the public good. The County retains the authority to request the return of the SCBA. Once the SCBA has reached its useful life, the City shall replace the SCBA, at its expense, and return the old SCBA back to the County. Any replacement items purchased by the City to replace the SCBA covered by this MOU shall become the property of the City.
FISCAL IMPACT
There is no additional fiscal impact, as the ten percent matching cost will be covered by the County of Merced.
RECOMMENDATION
Staff recommends that City Council approve the resolution authorizing the City Manager to enter into a Memorandum of Understanding with Merced County for the Joint SCBA purchase through the FEMA Assistance to Firefighters Grant.

THIS MEMORANDUM OF UNDERSTANDING ("MOU") is made and entered into by and between Merced County (hereinafter "County"), and City of Gustine (hereinafter "City"), for the purposes set forth below.
WHEREAS, County and City entered into a MOU on January 10, 2023 regarding the application for an Assistance for Firefighters Grant, for the funding and purchase of Self-Contained Breathing Apparatus (SCBA), and
WHEREAS, This grant application was approved by FEMA, and WHEREAS, Self-Contained Breathing Apparatus as agreed to in the previous MOU were purchased by the County, and
WHEREAS, The City desires to place SCBA Equipment on its emergency response vehicles for use by their First Responder personnel; and NOW THEREFORE, IT IS AGREED AS FOLLOWS:

2. The City shall provide for all necessary repair and maintenance of SCBA Equipment, including proper care and storage for proper equipment function. The City assumes all liability for the proper operation of the SCBA Equipment and hereby releases the County for any and all liability that may be associated with its use.
3. The City may place the SCBA Equipment into their emergency response vehicle equipment inventories for use as City deems appropriate, with usual and customary rotation and care of the SCBA Equipment expected.
MOU SCBA Purchase
4. The City shall replace, at its expense, any SCBA that has reached its useful service life or has become unserviceable. City shall notify the County prior to the replacement of any County-tagged SCBA Equipment and County shall issue a property transfer form to the City, signifying the release of interest in the SCBA Equipment. Any replacement items purchased by the City to replace SCBA Equipment covered under this MOU shall become the property of City. SCBA Equipment covered in this MOU will be returned to the County for disposition through its surplus authority.
5. The City shall not transfer or loan any of the SCBA Equipment to facilities outside of the County without the approval of the County. The County shall expedite any such review process to not unnecessarily delay such requests for assistance.
6. The City agrees the SCBA Equipment shall be maintained and used in accordance with reasonable industry practice and standards. Any injury to patients or third parties as a result of the misuse of the equipment which results in a claim or lawsuit for damages shall be assumed fully by City and the County shall be indemnified by City as to all costs and expenses to the fullest extent permitted by law.

ITEM NO. 6
COUNCIL AGENDA ITEM
MARCH 19, 2024
PREPARED BY: Tiffany Vitorino, Recreation Manager
SUBJECT: Creating a Special Event Policy Ad Hoc committee
BACKGROUND/DISCUSSION
The City of Gustine is widely known for its many special events. A "special event" typically refers to a planned gathering, celebration, or occasion that takes place within a city and is often organized or sponsored by local authorities, organizations, or businesses. These events can vary widely in scope and purpose, ranging from cultural festivals and parades to sporting events, concerts, art exhibitions, conferences, and more. In some cases, these events may affect the public by changing the community's atmosphere, affecting vehicle and pedestrian traffic, increasing noise levels, etc.
Historically, City resources are also impacted by the events that take place within City limits, as each department has various deliverables and coordination efforts.
Recently, staff was also informed by Merced County that the they will be increasing their enforcement on health permits. The County is requiring organizers to obtain a City issued special event acknowledgement letter, in order for the event organizer to acquire their Health Permit to move forward. This process is different from how events were reviewed and approved previously.
In order to streamline the communication efforts between City departments and to consolidate the issuance of acknowledgment letters, staff presented a Special Event Policy on February 20, 2024 to Council. After much discussion, Council directed staff to reevaluate the application document and policy to simplify it for minor events.
Since each event varies significantly in scope, needs and impacts, staff is requesting the Council to establish a Special Event Policy Ad Hoc Committee to provide guidance and act as an advisory body to assist in the development of this policy. The committee is not to be delegated any decision making power and shall be returning to the full Council on its recommendation.
The City's Recreation Manager shall serve as the staff liaison to the committee and would moderate the committee meetings to ensure the framework items are addressed. Staff is proposing the following framework for the Special Event Policy Ad Hoc Committee as they provide guidance on the development of the policy and related materials:
1. Purpose
a. Review and provide guidance on the development of a policy. b. Provide input in the creation of application{s) with enough information to issue an acknowledgment letter to the event organizer for the County's permitting requirements and assist City staff to understand all necessary elements of the event to ensure clear inter-departmental planning efforts.
c. Streamline a process that assists staff in confirming proper permits and paperwork are received by the City, Department of Alcohol Beverage Control, Merced County, and other applicable agencies when appropriate.
d. Determine the definitions of special events, and research and recommend appropriate fees associated with the process for all types of events.
e. Ensure there is sufficient stakeholder input regarding the development of the policy.
2. Role of the Committee
a. Provide input and recommendation to City Council for formal adoption of a policy. In coming to a recommendation, the committee shall consider historical events based off information provided and give input on determining future Special Event procedures, rules and regulations.
3. Members
a. Special Event Ad Hoc Committee should consist of
i. Two (2) members from the City Council
ii. Committee membership shall be for the duration of the Special Events policy development.
4. Meetings
a. Committee meetings will be scheduled by the Recreation Manager, in consideration of the availability of the committee members. The Recreation Manager will be responsible for setting agenda items. b. Because the nature of this Ad Hoc Committee is temporary, and the members are comprised solely of less than a quorum of the legislative body of which they were appointed , Brown Act requirements do not pertain, however the City will endeavor to garner input from local stakeholders.
c. The Special Event Policy Ad Hoc Committee shall extend every effort to meet and provide its recommendation to City Council within one year of its establishment, for a Special Event Policy and Procedure to be formally considered by the City Council prior to July 1, 2025.
5. Benefits:
a. Allow for buy-in from the committee and local stakeholders prior to Council's formal adoption.
b. Allow a focused working group setting to facilitate more productive and inclusive input and meetings.
c. Allow for review of each policy standard as it relates to the City's Municipal Code.
FISCAL IMPACT
There is no fiscal impact to the City.
RECOMMENDATION
Staff requests the City Council to consider the following:
1. Adopt a resolution establishing a Special Event Policy Ad Hoc Committee
2. Appoint two sitting Council members to serve on the Special event Policy Ad Hoc Committee, and approve the committee's framework and initiatives.
