COUNCIL AGENDA ITEM
APRIL 2, 2024
PREPARED BY: Melanie Correa, Administrative Services Director SUBJECT: Consider Resolution Naming and Confirming Signatories on the City's Bank Accounts
BACKGROUND/DISCUSSION
The City's banking accounts require two signatures on accounts payable checks, and one on payroll checks. In the interest of efficient and effective government administration of the City's financial transactions, the Council has traditionally authorized the City Manager and Finance Director as well as the Mayor and Mayor Pro Tern as authorized signers on the City's accounts. It is common practice to have more than one management staff as a signatory on municipal accounts.
With the recent appointment of a permanent City Manager, the City needs to provide the banking institution with updated signatory information. Tri-Counties requires this action be taken by resolution.
Staff recommends Council authorize the following individuals as signatories to the City's bank accounts at Tri-Counties Bank effective immediately: City Manager Soknirorn Than, Finance Director Jenny Morrison, Mayor Pat Nagy, and Mayor Pro Tern Rich Ford, removing any other existing signatories.
FISCAL IMPACT
None.
RECOMMENDATION
City Council approve the attached resolution, naming and confirming signatories on each of the City's bank accounts.

PREPARED BY: Mario Gouveia, City Engineer
SUBJECT: Approve Resolution Directing the Filing of Annual Reports for the City's Assessment Districts
BACKGROUND/DISCUSSION
The attached Resolution is the first step in the yearly process of establishing and levying assessments for assessment districts formed under the Landscaping and Lighting Act of 1972.
In order to meet the timelines required by the Landscaping and Lighting Act of 1972 (herein the "Act") and the Government Code, it is now necessary to initiate proceedings for the annual levy of assessments against all properties in the District(s). By adopting the initial Resolution, the City Council directs the Engineer of Work for the various assessment districts listed in the Resolution to prepare the required Engineer's Report for each of the Assessment Districts.
The City of Gustine has three assessment districts: l . Citywide Lighting and Landscaping Assessment District, 2. Southport Assessment District, and 3. Borrelli Assessment District.
The process will determine the per parcel rate to be charged for lighting and landscaping for the upcoming budget year. Once the analysis has been completed the reports will be brought back for Council review and approval.
FISCAL IMPACT
None at this time.

ITEM NO. 7
COUNCIL AGENDA ITEM
APRIL 2, 2024
PREPARED BY: Soknirorn Than, City Manager
SUBJECT: DISCUSSION AND DIRECTION: North Avenue Sidewalk Drainage at 820 North Avenue
BACKGROUND/DISCUSSION
The City of Gustine (City) was awarded CMAQ funding to close gaps in the City's pedestrian infrastructure along a portion of North Avenue between West Avenue and Laurel Avenue. The proposed pedestrian facilities for the project consist of constructing ADA curb cut ramps and sidewalk facilities to address closing those gaps. There are also some ancillary facilities that will be constructed as part of the proposed improvements consisting of residential drive approaches with wraparound sidewalks and segments of curb and gutter.
The deadline to expense these funds is June 30, 2025. The project is at 90% design for all the sidewalk, curb ramps and other ancillary facilities. Therefore, staff would like to advertise the construction phase of the project for this summer (2024) to minimize the impact to pedestrian traffic to the High School. The project footprint is far enough away from the SR140/33 Roundabout Project, where there would be minimal conflict, if any, between the two projects.
However, during the design and plan preparation process, staff was made aware of a section of curb and gutter that retains water during storm events located on the southwest corner of West Avenue within the project limits, at 820 North Avenue. During various storm events over the past few years this area has been monitored to identify what was causing the retention of storm water. It was observed that just south of the intersection immediately adjacent to the project improvements are three trees that have raised the curb and gutter with their root structure. The root damage has caused the curb and gutter to lift and causes the corner to retain water until it reaches an elevation that allows the release to the South. The water then makes its way through a number of similar conditions until it reaches a storm drain inlet at the intersection of Lucerne Avenue and West Avenue.
During the December 5, 2023 Council meeting, staff presented two alternatives to City Council and ultimately received direction to construct a new storm drain inlet near the wing of the driveway at 820 North Avenue and connect to the existing drain inlet on the North side of the street. Staff also advised City Council that this option is not without challenges. These challenges are realized during our final design phase:
1. There are existing utilities running along North Avenue. Currently there are two gas lines, a water main and a sewer main running along this road. In order to
connect to the existing Drain Inlet, the pipe would have to be installed well below its normal grade. This will cause a syphon effect in which will require regular maintenance of the facilities. Due to the undeveloped nature of the north side of North Avenue combined with normal fallen leaf debris, this will likely require regular vacuuming and clearing using the City's only Vactor Truck.
2. The addition of the inlet will also require a change in the existing slope on the south side of North Avenue. This will extend the limit of the sidewalk and curb and gutter replacement up to the existing Modesto Ash trees.
3. The drain inlet alternative introduces a new storm drain system, thus is not reimbursable through the CMAQ grant. Therefore, the City will have to amend the budget and use alternative funding for this addition. Considering the depth of the existing utilities, the new storm drain pipe will have to be installed at a depth closer to 6 to 7 feet. This significantly impacts the original estimate. The revised engineer estimate is between $50K to $60K, depending on the PG&E requirements for crossing the two gas transmission lines.
4. In consideration of protecting the trees, staff has enlisted assistance from certified arborists with Ronny's Inc. to review the trees and provide an arborist report. Per the attached report, they have determined that these trees are in poor health and recommend removal of them as soon as possible. Currently, these trees exhibit a history of failures due to age, pests, and fungi. They also exhibit cracking, conks (external indicator that a tree may be rotting inside), cavities, and soft and hardwood decays. All of which has an imminent likelihood of failure. Due to the size of the trees, the fall distance could be between 30 to 40 feet. This would put the adjacent residents as well as our traveling public at risk.
With this new information, Staff would like to re-present the alternatives and seek council direction:
l. Construct a Strom Drain Inlet near the wing of the driveway at 820 North Avenue and connect to the existing drain inlet on the North side of the street.
2. Remove and replace the sections of curb and gutter to the south of the intersection immediately adjacent to the project improvements. This will require the removal of the three trees that caused the damage as well as the replacement of the damaged curb and gutter. This alternative will address the retention of storm water at the new curb ramp but will not correct the retention of storm water further to the south where similar conditions exist. It is worth noting that storm water sheet flow within the gutter pan is the original design of the neighborhood, thus future curb and gutter replacement to re-establish this flow will be required regardless. This is typically done with the road rehabilitation project.
FISCAL IMPACT
The costs for either of the proposed alternatives would not be reimbursed as part of the project CMAQ funding. The City would need to budget for the cost of the selected alternative. The estimated cost for each alternative is:
l . $55,000.00
2. $26,040.00
These estimated costs are based on the work being done as a part of the project. The costs will increase if this work is completed outside of the project.
Currently, there is sufficient funding in the various Gas Tax and future Local Transportation Fund (LTF) to fund option 2.
RECOMMENDATION
Staff recommends Council hold discussion and provide direction on whether or not the City wishes to proceed with either of the proposed remedial alternatives and, if so, which design alternative they would like to proceed forward with as part of the project improvements.

03.25.24 Tree Risk Assessment / Arborist Report
This report consists of an Inspection of trees located in the right-of-way street plant bed within the city limits of Gustine and focuses on tree conservation.
The objective is to offer an expert opinion on the stability of the tree The three Fraxinus Velutina trees, situated on the east side of 820 North Ave, have similar traits.
These features comprise of codominant stems, open cavities, vertical cracks, and fungal conks.
Such signs indicate that a pathogen that causes rot and decay has infiltrated the cambium and heartwood layers.
During the inspection, signs of boring insects and carpenter ants were found. The carpenter ants may cause damage to the sound heartwood, leading to a loss of structural strength.
The canopy cover of all three trees has reduced by 30%.
There are no signs of abiotic or biotic disorders in the root systems. However, the root systems have extended under the street asphalt paving. This can harm the trees and restrict their ability to exchange gases with the atmosphere.
Replacing the curb and gutter or street pavement can cause severe damage to the root system, leading to the tree's failure.
Risks
A high-risk target, which is a residence, is situated within a 30-foot radius of the location of the trees.
Vehicles park under the tree canopies.
Pedestrians walk beneath the canopies of the trees.
Mitigation
Replacement
Removal is necessary due to a history of failures, current conditions, and proximity to targets.
Trees in this location must be replaced with appropriate ones.
Please ensure that trees planted are of an appropriate size to avoid interference with power lines.

Notes, Explanations or descriptions
All three Modesto Ash, have the same characteristics. This would include codominate leaders, open cavities, vertical cracks, fungal conks. This is an indication that a rot/decay inducing pathogen has taken up residence, within the cambium and heartwood layers. Also during the inspection were signs of boring insects and carpenter ants. In my opinion, the ants may extend the damage into sound heart wood and causing loss of structural strength. All three trees have loss 30% of canopy cover. Root systems show no sign of a biotic and biotic disorders. Root systems have extend under the street asphalt paving. This will harm the trees as well, restricting the trees ability to exchange gases with the atmosphere.
