METHOD OF APPORTIONMENT OF ASSESSMENT

SOUTHPORT LANDSCAPING AND LIGHTING DISTRICT
(Pursuant to the Landscaping and Lighting Act of 1972)
Method of Assessment Spread
The basic objective of the Assessment Spread is to distribute costs in accordance with the benefits received. Costs are to be spread equally to each lot or parcel of land which is benefited from the maintenance services performed by the District. Therefore, each lot or parcel will be assessed an equal share of the net amount to be assessed.

Normally, the assessable costs may be revised upon preparation of the Engineer's Report for each fiscal year for which assessments are to be levied and collected as provided for in the Landscaping and Lighting Act of 1972 (State Streets and Highways Code Section 22500) and Division 15 Part 2 as amended per Proposition 218; however, this assessment district was created utilizing a fixed assessment of $47.10 per assessable unit.
(a) For 2024-2025 Southport has been completed and consists of 84 lots, each of which benefit equally from the improvements maintained by this landscaping and lighting district.

Computing Individual Assessment
The total number of assessable units is 84 RU. The total cost to be assessed for Fiscal Year 2024-2025 is based on a fixed assessment of $47.10 per assessable unit multiplied by 84 units, equaling $3,956.40.

The assessable costs may be revised upon preparation of the Engineer's Report for each fiscal year for which assessments are to be levied and collected as provided for in the Landscaping and Lighting Act of 1972 (State Streets and Highways Code Section 22500) and Division 15 Part 2 as amended per Proposition 218.

Computing Individual Assessment
The total number of assessable parcels is 75. The total cost to be assessed for the 2024-2025 fiscal year is as follows:

ITEM NO. 12

COUNCIL AGENDA ITEM
MAY 7, 2024
PREPARED BY: Jami Westervelt, Economic & Community Development Director SUBJECT: Tentative Parcel Map Application #TM2023-01: Requesting Approval to Subdivide an Existing Lot into Three Parcels at 555 Wallis Avenue (APN 020- 151-022)

BACKGROUND/DISCUSSION
The City received an application requesting the subdivision of a 39,651 square foot (.91 acre) parcel identified as APN 020-151-022 at 555 Wallis, located adjacent to the Northwest corner of Grove Avenue and Wallis Avenue (Exhibit C). The existing parcel dimensions on the plan are 264.1 O' along Wallis Avenue at the south property line, 264. l O' along the north property line, 150.11' along west property line, and 150.16' along east property line.

The application proposes a Tentative Parcel Map to divide one single-family residentiallyzoned developed parcel into three single-family residential zoned parcels. The current single parcel contains four existing single-family residences, one of which is consistent with and being classified as an Accessory Dwelling Unit (ADU), plus one garage, and five accessory buildings. The applicant proposes a Tentative Parcel Map split as follows:

PARCEL NUMBER DWELLING MAIL LOT SIZE AFTER EXISTING DEVELOPMENT

ADDRESSES DEDICATION
Parcel #1 615 Wallis Ave 12,540 SF One single-family
(83.53' X 150.11') residence, one accessory
building (shed)
Parcel #2 605 Wallis Ave, 597 12,600 SF One single-family Wallis Ave (83.92' X 150.13') residence, one (ADU), one garage, one accessory
building (shed)
Parcel #3 555 Wallis Ave 14,511 SF One single-family
(96.64' X 150.16') residence, three
accessory buildings (one
workshop, one shed and
one former utility/water
tower enclosure)
The applicant has indicated to staff the intent is to subdivide to allow for sale of each property individually. The applicant proposes no additional construction.

At its March 27 meeting, the Planning Commission voted to recommend the Council approve the application (Exhibit D). If Council approves the split, each of the three lots individually will have equal rights and responsibilities and owners would have the ability to sell them separately. Additional development on any of those parcels will require a new Uniform Planning application and processing following the established City requirements for any parcel application.

Page 210 of 260 ends

ANALYSIS
City planning has determined that the tentative parcel map request aligns with the provisions outlined in both the Gustine Municipal Code and the Gustine General Plan. The subject property is located within the Single-Family Residential (R-1) zone, which supports the development of single-family detached houses. The proposed subdivision complies with the density allowance for this zone of 2-6 dwelling units per acre. All three parcels meet the 40% maximum lot coverage requirement and the maximum allowable height requirement.

The Development Standards Table below and the Notes that follow combine to illustrate how the project further complies with the City's development standards for the R-1 Zone:

Minimum Parcel One Parcel 2 Parcel 3
LOT SIZE 6,000 sq ft 12,540 sq ft 12,600 sq ft 14,511 sq ft LOT WIDTH Minimum 60 85.53 83.92 96.64

SETBACKS
Front 20' 20' 17.8' 1 20'
Side 5' 5' 5' 5'
Rear 10' 10' 10' 7.5' 2
DENSITY 2-6 Dwelling 1 du/.29 acres= 1 du/.29 acres= 1 du/.33 acres= Units Per Acre 3.44 du/acre 3.44 du/acre3 3.03 du/acre
Important Notes on the Development Standards Table:

Parcel 2 Front Setback: The 17.8' setback on the table is based upon the front edge of the porch. City code section 4-30-090 provides an exception that allows porches to project up to 6' into the required front yard setback, meaning that the revised setback minimum for Parcel 2 with its porch is actually 14' and the parcel has 17.8' 2 Parcel 3 Rear Setback: A detached accessory structure less than 10' high is closest to the rear lot line. Section 4-44-030 allows a detached accessory structure with a height of less than 1' to maintain a rear yard setback of not less than 5'. 3 Parcel 2 Density Calculation: Gov. Code 665852.150, CA and Gov. Code, $ 65852.2, subd. (a) ( 1) (CJ-State Accessory Dwelling Unit law- an ADU is an accessory use for the purposes of calculating allowable density under the general plan and zoning and does not count toward the allowable density. The density calculation utilized, therefore, does not include the ADU.

Each new parcel must provide two covered parking stalls, per GMC Sec. 4-36-040.- "Number of parking spaces required." Addressing this requirement calls for the construction of two covered parking spaces on Parcels # l and #3 and new vehicular access to parking stalls in Parcel #3 via a new driveway, driveway apron and curb cut. The covered parking stalls on Parcels # l and #3 will be subject to applicable building permit approval and the new driveway, driveway apron and a new curb cut on Parcel 3 will require an encroachment permit, and will be subject to approval by the City Engineer.

The Planning Commission reviewed the Tentative Parcel Map and passed a resolution (Exhibit D) recommending it to Council for approval with the parking requirements. Council approval would also contain a condition that Parcels # l and #3 meet the required parking requirement in the future. Covered parking and vehicular access to parking (driveway,

Page 211 of 260 ends

driveway apron and curb cut) must be constructed prior to occupancy of a new tenant following the sale of corresponding parcel or prior to the construction of new improvements, whichever comes first.

Since the Planning Commission meeting, the applicant has submitted an Encroachment Permit (Exhibit E) that allows for constructing improvements to meet the parking requirements referenced in the above paragraph.

The City Engineer has reviewed the proposed map and ensured compliance with all applicable engineering and subdivision Map Act components. Attached Exhibit C will be used to identify the specific legal boundaries for the subdivision of the land. As part of the project, the City engineer has required the applicant to dedicate a 10-foot public utility easement along Wallis Avenue. Section 4-68-050 of the Gustine Municipal Code states that the minimum width of easements for public or private utilities shall be determined by the review authority based on the recommendations of the City Engineer for City facilities, and the recommendations of the applicable utility company, for public or private utilities.

Furthermore, the City Engineer has imposed conditions of approval on the tentative map to ensure compliance with the regulations outlined by the City of Gustine Subdivision Ordinance, the Subdivision Map Act, and the California Environmental Quality Act (CEQA).

The conditions upon which approval of the application is based are attached as Exhibit B.

REQUIRED FINDINGS OF APPROVAL/DENIAL
Per GMC Sec. 4-62-060.- Parcel Map Approval, after determining that the Parcel Map is in compliance, the Director forwarded the Parcel Map to the Planning Commission for review and recommendation. The Planning Commission recommended approval by the Council. If the Council approves the Parcel Map, the map shall be transmitted by the City Engineer to the County Recorder for filing in compliance with Map Act Section 66450.

Also per the Map Act, in order to approve or recommend the approval of a Tentative Map and conditions of approval or to disapprove a Tentative Map, the review authority shall first make specific findings: "The review authority may approve a Tentative Map only after first finding that the proposed subdivision, together with the provisions for its design and improvement, is consistent with the General Plan, and any applicable specific plan, and that none of the findings for denial in Subsection C can be made. The findings shall apply to each proposed parcel as well as the entire subdivision, including any parcel identified as a designated remainder in compliance with Map Act Section 66424.6." These findings help serve as the foundation for either approval or denial of the map. In analyzing the tentative parcel map request, staff believes that the following findings of fact warrant approval of the Tentative Parcel Map.
l. The proposed subdivision including design and improvements is consistent with the General Plan or any applicable specific plan;
The proposed parcel map has proved to be consistent with the General Plan. The subject property is located within the LowDensity Residential General Plan designation, which supports the development of single-family detached houses. The density allowance for this designation ranges from 2-6 dwelling units per acre, a criterion that the proposed parcels satisfy.

6. The discharge of sewage from the proposed subdivision into the community sewer system will not result in violation of existing requirements prescribed by the California Regional Water Quality Control Board;
There are no proposed changes to the sewage system as part of the subdivision. The site is not in an area listed as a Hazardous Waste or Substance Site.

7. A preliminary soils report or geological hazard report has not indicated adverse soil or geological conditions and the subdivider has not failed to provide sufficient information to the satisfaction of the City Engineer or other applicable review authority that the condition can be corrected in the plan for development; or A soils report or geological hazard report was not required to be submitted as part of this application.

8. The proposed subdivision is consistent with all applicable provisions of the Zoning and Subdivision Code, any other applicable provisions of the Municipal Code, and the Subdivision Map Act.

Furthermore, this zone has a minimum lot size requirement of 6,000 square feet, a minimum lot width requirement of 60 feet, and a minimum lot depth

requirement of no less than 1.5 times the width and no more than 3 times the width of the lot. All three proposed parcels exceed the minimum lot size requirement. Furthermore, all three lots boast a width greater than the stipulated 60 foot minimum set forth by the Gustine Municipal Code. Additionally, the depth of each proposed parcel, ranging from 1.55-1.79 times the respective width, fulfills the Gustine Municipal Code's requirements.

Based on review, planning staff has determined that the subdivision is compliant with the provisions stated in the findings of approval.

CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA)
Contract planners have determined that the proposed project is exempt from the provisions of CEQA under Section 15332 Infill Development Project. Staff recommends the Council find the Project categorically exempt from further review under State CEQA Guidelines, Section 15332, In-Fill Development Projects (Class 32).

The entire project is exempt per Section 15332 because the project meets the required conditions for Class 32. The Project is consistent with the applicable General Plan designation and all applicable General Plan policies as well as with applicable zoning designations and regulations. The project occurs within city limits on a project site of less than five acres and is substantially surrounded by urban uses. Specifically, the Project is located at 555 Wallis Avenue, consists of .91 acres, and is surrounded by Public-Institutional zoning to the north and Single-Family Residential to the south, west and east.

The Project site has no value as a habitat for endangered, rare, or threatened species because the majority of the Project site has already been developed and is currently improved with single family residences and accessory structures on the parcels. Therefore, the site is not habitat for endangered, rare, or threatened species.

Approval of the Project would not result in any significant effects relating to traffic, noise, air quality, or water quality. Further, there is no evidence that the Project would result in significant effects relating to air quality or noise. The site can be adequately served by all required utilities and public services; the Project site is currently serviced by all required utilities, including but not limited to electricity, gas, garbage, water, and sewer and therefore would remain adequately serviced.

FISCAL IMPACT
None.

RECOMMENDATION
Council to approve the attached Resolution, which finds the project exempt from the provisions of CEQA, and recommends approval by the Council of the Tentative Parcel Map Application as provided in Exhibit C, subject to Conditions of Approval in Exhibit B.

8. Street Cuts. The Permittee shall use boring and jacking as an alternative to open cut of streets if required by the City Engineer. No street pavement shall be cut unless specifically approved in writing pursuant to an Encroachment Permit.

Trench restoration shall be according to the Gustine Standards, except as modified by additional Special Conditions of Approval or a design by a licensed civil engineer approved by the City Engineer.

9. Trench Excavation and Restoration. All trenches created in existing pavement shall be neatly saw cut. Trench spoils shall be removed from the job site. Trench Restoration/Backfill shall comply with City Standards. Excavations within the public right-of-way shall be backfilled, compacted, and temporarily paved with cold mix "cut back" type A.C. prior to 4:00 P.M. to allow for vehicular and pedestrian traffic. The use of non-skid trench plates is allowed, provided the Contractor covers all edges of the plates with cold mix material. It shall be the Permittee's and the Contractor's responsibility to maintain on a daily basis, including weekends and holidays, the amount of material necessary to maintain the trench surface flush with the existing street or sidewalk. In addition, the Contractor shall respond to and correct shifting trench plates regardless of the time of day. If Contractor fails to correct sinking backfill material or shifting trench plates in a timely manner, City reserves the right to correct the problem at the expense of the Contractor. All trenches shall be fully restored within thirty (30) days of first street cut.

10. Trench Plating Conditions:
a. Wherever traffic is permitted over or adjacent to trenches and other depressions, Contractor shall furnish and maintain steel plating unless other means of protecting the public and the work are accepted by the City. Plates shall be secured against movement including shifting and rocking by use of adjustable cleats, shims and other devices such as anchor and keys. No gaps between plates and other deficiencies hazardous to bicycles shall be allowed; and the existing pavement shall be protected from damage.
b. Steel plating shall have a non-skid surface.
c. Steel plates used for bridging shall extend not less than 12 inches beyond the edges of the trench. d. Steel plates shall conform to the following minimum thickness:

Trench Width Minimum Plate Thickness
12 inches (300 mm) .5 inches (13 mm)
18 inches (450 mm) .75 inches (19 mm)
24 inches (600 mm) .87 inches (22 mm)
36 inches (900 mm) .98 inches (25 mm)

3.9 feet (1.2 m) 1.5 inches (38 mm)
e. Recessed trench plates shall be used at the following locations: all arterial streets, all collector streets, at trench alignments not parallel with or perpendicular to the direction of traffic and locations determined by City Engineer to be necessary.
f. The Contractor shall prepare for placement of plates over trench by grinding a relief 12 inches wide on each side of the trench by the thickness of the steel plate so that the surface of the steel plate is level with the adjacent pavement surface.

11. Underground Alert: Attention is directed to the possible existence of underground facilities within the area of construction. Prior to project work commencing, permittee is responsible for ascertaining the exact elevations and locations of all existing underground facilities. Permittee is responsible for verifying all PG&E, water, sewer, storm drain, telecommunications, and City facilities are clear or relocated from the area of work prior to construction. ITEM NO. 13

COUNCIL AGENDA ITEM
MAY 7, 2024
PREPARED BY: Jami Westervelt, Economic and Community Development Director SUBJECT: Katakis Vesting Tentative Subdivision Map request for Two-Year Extension

BACKGROUND
On May 17, 2022, the City Council approved the Vesting Tentative Subdivision Map (VTSM) for Mr. Ron Katakis. The subdivision consists of 157 single-family residential lots in the Southeast Gustine Master Plan (SGMP) on two parcels: APN# 063-180-030 and APN# 063-180-029. On February 21, 2023, the City Council approved an amendment to the VTSM for only specific Conditions of Approval. The amendment did not alter the expiration in any way.

The applicant recently requested that the City extend the expiration of the VTSM by two years. Without the request for extension, the VTSM would have expired two years after the 5/17/22 approval date per City code Sec. 4-61-130.

DISCUSSION
City Code defines that an approved VTSM is valid for 24 months following its effective date but allows for an extension of the map with the approval of the Council and in compliance with California Government Code, Section 66452.6. This is a portion of the Subdivision Map Act, which vests in cities and counties the power to regulate and control the design and improvement of subdivisions within their boundaries. Under the Act, the Council has the ability to approve the two-year extension requested.

The applicant has taken steps forward on the project since last appearing before the Council, including: paying all past charges owed to the City for all work related to the original VTSM approval and amendments, signing a Cost Recovery Agreement and paying required deposit amounts related to his most recent submittals.

With completion of the above, the applicant met all the items required in order to proceed beyond the VTSM. Since that time, Mr. Katakis submitted for review Improvement Plans for the subdivision on March 11, 2024 and Final Map on April 25, 2024. The plans are in the review process by the City Engineer.

FISCAL IMPACT
None to the City for the extension.

ITEM NO. 14

COUNCIL AGENDA ITEM
MAY 7, 2024
PREPARED BY: Soknirorn Than, City Manager
SUBJECT: CFD Formation Request and Award of Contract to DTA

BACKGROUND/DISCUSSION
In March, 2018, the City considered and approved a Master Plan for the Southeast Gustine Area. This area was then taken to LAFCO and annexed into the City. In July, 2020, the City Council approved an amendment to this Masterplan to incorporate two revisions to the Masterplan.

Subsequently, in May 2022, the City Council certified the review of the Southeast Gustine Master Plan EIR and approved the Katakis Vesting Tentative Subdivision Map (VISM). This VSTM provides for the division of the parcels owned by Ron Katakis et. al. totaling 41 .48 ac. into residential lots and a 5 ac. lot for the water well, park, and dualuse storm drain basin. The map provides for 157 residential lots and accompanying public facilities to provide for development, including local streets; utilities and the park/storm drain facility. The lot configuration and overall density are consistent with the General Plan, Master Plan, and PD zone.

To-date, the applicant has submitted the improvement plans and final map for City review. Concurrent with this process and in compliance with the Conditions of Approval, General Condition No. 22, the applicant and City staff have discussed the initiation of forming a new Landscape and Lighting District (L&LD) and/or Community Facilities District (CFD) for the parcels.

In September 2023, Harris and Associates presented the fundamentals of various assessment districts to City Council. Their presentation included Community Facilities Districts (CFD), Benefit Assessment Districts (BAD), and Landscape & Lighting Districts (L&LD). Exhibit A provides a summary of the funding matrix for the different assessment district options. At the time of the presentation, Council did not take action as to which district is preferred.

Based on research with other agencies and our experience with the City's existing L&LDs, staff proposes for council to consider a CFD. A CFD is a special financing district that provides a mechanism for funding specific facilities and services as granted by the Mello-Roos Community Facilities Act of 1982. The Mello-Roos Community Facilities Act was passed by the California Legislature in response to various public funding limitations imposed by Proposition 13.

The Act allows any county, city, special district, school district or joint powers authority to establish a Mello-Roos Community Facilities District (a "CFD") which allows the entity

Page 233 of 260 ends

to levy special taxes for the purpose of financing public improvements and services. The services and improvements that CFDs can finance include streets, sewer systems and other basic infrastructure, police protection, fire protection, ambulance services, schools, parks, libraries, museums and other cultural facilities. By law, the CFO is also entitled to recover expenses needed to form the CFO and administer annual special taxes. The taxes are secured by a continuing lien and are levied annually against property within the District. The tax rate is subject to an annual CPI increase as approved at the time of district formation.

With the increasing need for cost recovery for other services such as police and fire, CFO is a more applicable funding source in comparison to L&LD or BAD. Secondly, CFO allows for expedited future annexations, which will be beneficial when the remaining phases of the Southeast Gustine Development come forward.

At this time, staff does not recommend a bonded CFO as all of the backbone infrastructures will be constructed by the developer and cost recovery will be handled through a.third party agreement between the various property owners of this master plan. Other general benefit infrastructures will be covered under the impact fees program and/or through the non-bonded CFO.

The process to form a CFO is explained in Exhibit B. This process can take anywhere from 4 months up to 12 months. However, the average formation timeframe for new development is much shorter, at 4 to 5 months as typically there are only a few landowners.

Since the City does not have any existing CFD's, staff recommends that council approve a contract with OTA Consulting to assist in the formation process. This will include establishing the CFO policies and goals. OT A will lead the CFO Formation Group along with other members including BBK, Gouveia Engineering, City staff, and the developer team. The Cost proposal for OTA is attached as Exhibit C.

To-date the developer has been made aware of the timeframe and cost associated with the preparation and formation of this CFO. He has signed a Cost Recovery Agreement and has acknowledged and accepted the terms in forming and funding this CFO.

FISCAL IMPACT
There is no fiscal impact to the City as the cost of formation is reimbursable to the City through the Developer. All cost associated with this formation is due and reimbursable to the City prior to the Final Map approval and recordation.

RECOMMENDATION
Staff recommends the City Council to adopt a resolution:
1 . Authorizing the City Manager to execute a professional services agreement with OT A for the amount of $30,000.00 to assist the City in establishing a Community Facilities District.

2. Authorizing the City Manager to initiate the CFO Formation Group for the purpose of forming a CFO for the Katakis VTSM.

ITEM NO. 15

COUNCIL AGENDA ITEM
MAY 7, 2024
PREPARED BY: Soknirorn Than, City Manager
Sammy Joseph, Acting Chief of Police
SUBJECT: The U.S. Department of Justice Promoting Access to Crisis Team (PACT) - Crisis Intervention Teams 2024

BACKGROUND/DISCUSSION
Throughout the years, the Gustine Police Department responded to numerous calls for service where the contacted person was in crisis and required to be evaluated by a mental health clinician. This required the officer to complete the evaluation and necessary paper work and coordinate the individual to be transported to the nearest hospital, usually in Los Banos. There have been times where the officer was required to transport the person themselves for various reasons such as additional charges or being under the influence.

The implementation of Crisis Intervention Teams (CITs) have become more prevalent in larger cities and agencies. The County of Merced has a very robust program under the Department of Behavioral Health and Recovery Services. They have recently implemented mobile response teams mostly the eastern portion of the county. The resources for smaller rural communities are minimal. The Gustine community could benefit from a CIT to provide more front-line resources for those in crisis and to allow limited police resources to respond to other reported criminal activity.

The City of Gustine, through Capital Advocacy Partners, applied for Department of Justice - Community Oriented Policing (COPS) funding in the amount of $335,141.54 to fund a CIT program. The program is referred to as Gustine Police Crisis Intervention Team (GPCIT) and allowed the hiring of one full time Mental Health Clinician to respond to these calls for service.

On October 26, 2022, the City was officially notified that the Gustine Police CIT Grant was approved for funding in the amount of $335, 141 .54. There is no match requirement for this grant. The grant allows the contracting with a known and proven mental health provider, La Familia formerly First Behavioral Health Urgent Care Clinic, which the City of Gustine contracted with for the MAPS Program and currently the CIT clinician program which is due to end September 30, 2024.

Moreover, this grant currently provides crisis intervention training for the entire department as well as dispatchers who field the calls at the dispatch center. In the end, the main goal of this grant is to divert individuals with mental health and/or substance abuse disorders away from justice involvement. To achieve this goal, the objectives have been identified as:

1. Provide trauma-informed services in calls involving individuals experiencing

Page 247 of 260 ends

mental illness, substance use disorders, and homelessness.

2. Improve access to medical, mental health, and wrap around services.

3. Understand/reflect community needs and partner organizations continually.

For FY 25 and beyond, the current CIT program is being replaced with the Promoting Access to Crisis Team (PACT) program. This grant program is now applicable only to law enforcement agencies who are creating or expanding a CIT program. Unfortunately, there is no grant funding available for CIT program continuation.

Secondly, there is only a total 0f $4,000,000.00 in available funding nationwide with an anticipated maximum dollar amount of award per agency of $400,000.00. Thus, only l 0 agencies would be selected from this solicitation.

This limited funding availabilities is especially high risk for Gustine as the cost for application with Capital Advocacy Partners is $11,400.00 with the grant due date of 5/21/2024. For this reason, staff would like to get direction from Council as to whether or not to pursue this grant.

It is also worth noting that CIT services have become an integral part of our City. Since inception (2023), the clinician has responded to 208 cases that required over 231 service hours. Out of the 208-service requests, 185 are case management related services. The CIT is an enormous asset that helps free up sworn personnel to perform other essential duties.

FISCAL IMPACT
The total fee for the grant application is $11,400 with an anticipated maximum dollar amount of award per agency 0f $400,000.00. The fees to apply for the grant would be an impact to the General Fund (Fund 001 ).

RECOMMENDATION
Staff recommends that City Council select one of the following options:

1. Authorize the City Manager to pursue the DOJ Promoting Access to Crisis Team (PACT) grant through Capital Advocacy Partners (CAP) for a total grant fee of $11,400 and adopt a resolution to increase appropriations to the Fiscal Year 2023-2024 budget in the General Fund (Fund 001) in the amount 0f $11,400.00

2. Direct the City Manager not to pursue the DOJ Promoting Access to Crisis Team (PACT) grant and begin the close out process for the existing CIT grant and contract with La Familia

ITEM NO. 16

COUNCIL AGENDA ITEM
MAY 7, 2024
PREPARED BY: Soknirorn Than, City Manager
SUBJECT: California Department of Forestry and Fire Protection Grant for Community Forestry Program

BACKGROUND/DISCUSSION
Per the Municipal Code Chapter 4 section 8-4-1 to 8-4-12, the City is responsible for the maintenance and stewardship of City Trees. Section 8-4-3 requires the development of a Landscaping Master Plan that specifies a list of approved street trees and a uniform method of street tree planning.

To-date, the City has relied on the City Improvement Standards and Specifications and the General Plan for landscaping detail. Both of the documents are lacking in guidance as required by the municipal codes above. Secondly, staff has been facing major challenges in maintaining the existing trees that are overgrown and requires significant resources. Some of these trees are beyond their expected life span and were planted prior to adopted standards. This resulted in a mismatch of tree species and has contributed to the poor tree health condition in some areas. Lastly, the City does not have an accurate inventory of City trees and their associated conditions.

To minimize the risk to the public, staff is proposing for City Council to consider developing an Urban Forest Management Plan (UFMP) through the California Department of Forestry and Fire Protection - Community Forestry Program. The grant program objective is to advance the development of sustainable and accessible urban and community forests in California. One of the qualifying grant types under this program is the establishment of a jurisdiction-wide tree inventory, urban forest mapping and analysis, and development of an UFMP that includes policy integration and ordinance development.

An urban forest management plan is a comprehensive document that outlines strategies and guidelines for the management and stewardship of trees and green spaces within the City. It typically includes the following components:
• Inventory and Assessment: An inventory of existing trees and green spaces, including species, size, condition, and location. This assessment helps identify the current state of the urban forest and areas that may need attention. • Goals and Objectives: Clearly defined goals and objectives for managing the urban forest, which may include enhancing biodiversity, improving air and water quality, mitigating climate change impacts, providing recreational opportunities, and enhancing the aesthetic value of the urban landscape. • Management Strategies: Strategies for achieving the goals and objectives set

Page 251 of 260 ends

forth in the plan. This may include recommendations for tree planting, maintenance practices (such as pruning and watering), pest and disease management, and strategies for addressing invasive species. • Community Engagement: Plans for engaging the community in urban forest management and stewardship activities. This may involve educational programs, volunteer opportunities, and partnerships with local organizations and businesses. • Policy Recommendations: Recommendations for policy changes or updates to support urban forest management goals. This may include zoning regulations, tree protection ordinances, and funding mechanisms for tree planting and maintenance.
• Monitoring and Evaluation: Plans for monitoring the effectiveness of management activities and evaluating progress towards goals and objectives.

This may involve tracking changes in tree canopy cover, air quality improvements, community engagement metrics, and other indicators of urban forest health and vitality.
• Emergency Response and Risk Management: Procedures for responding to emergencies such as storms, disease outbreaks, or pest infestations that may threaten the health and safety of the urban forest and the community.

Overall, an UFMP provides a roadmap for sustainable management of trees and green spaces in urban areas, balancing environmental, social, and economic objectives to enhance the quality of life for residents and visitors.

FISCAL IMPACT
The total fee for the grant application is $9,900 with an anticipated maximum dollar amount of award per agency of $150,000 to $1,500,000. The fees to apply for the grant would be an impact to the General Fund (Fund 001), and Gas Tax Fund (Fund 010).

RECOMMENDATION
Staff recommends that City Council receive staff report and select one of the following options:

1. Authorize the City Manager to pursue the Cal FIRE's Urban and Community Forestry Program through Capital Advocacy Partners (CAP) for a total grant fee of $9,900 and adopt a resolution to increase appropriations to the Fiscal Year 2023-2024 budget in the General Fund (Fund 001) in the amount f $2,000.00 and the Gas Tax Fund (Fund 010) in the amount of $7,900.00.

2. Authorize the City Manager to not pursue the Cal FIRE's Urban and Community Forestry Program through CAP.

General Overview
The mission of the CAL FIRE Urban & Community Forestry Program is to advance the development of sustainable and accessible urban and community forests in California.

CAL FIRE envisions urban and community forests that are healthy, extensive, and wellmanaged, providing a wide array of optimal benefits to all Californians. Under the authority of the California Urban Forestry Act of 1978, CAL FIRE's Urban & Community Forestry Program is responsible for leading the effort to advance the development of sustainable urban and community forests in California through technical assistance, grant administration, and resource and partnership development. This is accomplished through expanding and improving the planting and management of trees and associated vegetation in communities throughout California, with a strong emphasis on disadvantaged and low-income communities. CAL FIRE's Urban & Community Forestry Program directly assists these communities with grants and hands-on scientific and technical assistance to achieve more equity in tree canopy distribution.
