Dear Council Members/Gustine Police Department,
This year will be the 43t Anniversary of the Westside Auto Club Linguica Run. We would like to reserve the Henry Miller Park on Friday 12t (set up) and Saturday July 13(13 is Day of Event) for the Run. We would require access to the park on Friday July 12t for our pre run preparations. We average about 330 cars (from all over California) and we do help bring in a large crowd for the Gustine Fireman's Breakfast! Like I've said in the past its always a win-win situation for everyone in Gustine! Like I've mentioned before there is a lot of History in the Westside Auto Club, The Linguica Run and Gustine all together, it's a tradition that runs 43 years. We thank you for your support in advance. This year we celebrate the 76t Anniversary of the Westside Auto Club, we have been around since 1948! We request to have Second Avenue between West and 6u Street blocked off for the Linguica Run preparations and Club parking. Please leave barricades in those areas as needed. Thank you! (Can you please have the G PD post No Parking signs that weekend as they always to).

If you have any questions or concerns please call Westside Auto Club President Don Gomes at (209)765-1273. Or myself (Club Secretary Johnny Verissimo) at (209)918-0488.

We request that you wave all fees involved in our event for that weekend. The Westside Auto Club 501C3 nonprofit club that donates all money made at our events to local food pantries, scholarships, Saint Jude's Children's Hospital, Toys for Tots, etc.

ITEM NO. 6

COUNCIL AGENDA ITEM
MAY 21, 2024
PREPARED BY: Mario Gouveia, City Engineer
SUBJECT: Resolution of the City Council of the City of Gustine to Convert Real Property into Public Right of Way, for Public Travel and for Construction of Roundabout on SR- 140/33 at Post Mile 5.6, FederalAid Project No. CML-5230(003)

BACKGROUND/DISCUSSION
The proposed roundabout improvements are one element of the "City of Gustine State Route 140 Pedestrian - Bicycle - Motorized Transportation Enhancement Plan" (SR 140 TEP) prepared by RRM Design Group (April 2010) and adopted by the City of Gustine (City). The SR 140 TEP is the result of a comprehensive planning and design effort by community leaders, residents, City staff, Caltrans staff, and planners. It focuses on the development of transportation related enhancements and safety improvements along the State Route 140/33 corridor through the City.

The project consists of constructing a single lane roundabout on State Route 140/33 at the intersection of Fourth Street and Sixth Avenue on SR-140/33. Project also includes the realignment of Railroad Avenue, the construction of a Woonerf between Ash and Railroad, and the rehabilitation of underground utilities within the project limits.

The realignment of the intersection requires that some property presently owned by the City be converted to public Right of Way (ROW) to accommodate the travelling public and to match the new roadway configuration. All roadway realignment improvements and project utility work need to be constructed within the public ROW.

FISCAL IMPACT
This item does not have any fiscal impact to the City.

RECOMMENDATION
Staff recommends that the City Council adopt a resolution converting the real property shown in the attached plats and legal descriptions to public right of way for public travel and for the construction of Roundabout on SR-140/33@ Post Mile 5.6, Federal-Aid Project No. CML-5230(003).

PREPARED BY: Tiffany Vitorino, Recreation Manager
SUBJECT: Food Vendor Attraction and Movie Night

BACKGROUND/DISCUSSION
The Recreation Department is gearing up for an exciting Movie Night to be held on Friday, May 24, 2024. The event will be located near the Aquatics Center in Henry Miller Park, and will be an initiative to celebrate Water Safety Month. We're thrilled to announce that the admission-free Movie Night will be sponsored by CCID. We will be showing the movie "Migration" and CCI D's generous support will allow a free drawing during the event for free youth swim lessons at the Gustine Aquatics Center. Staff will be seeking volunteer hours from lifeguard applicants to join in on the event to allow people to view the new pool surface, which will also promote the upcoming season.

Staff would like to include food vendors at the event as an attraction. Staff is in contact with vendors who have expressed interest in participating. Staff is requesting Council's authorization to allow food vendors at Henry Miller Park during scheduled the event.

Staff have also contacted our local businesses to present this opportunity.

According to the Gustine Municipal Code Section 5-6-3, mobile kitchen type vendors are only allowed in manufacturing districts, except otherwise by special permission of the City Council during festivals, parades and other public events. Staff will ensure that the vendors will have the appropriate city business license and will work closely with Merced County.

FISCAL IMPACT
This event will be funded by CCID's sponsorship donation, along with funding allocated in the FY 23/24 budget in the Swim Pool Fund [Fund 016).

COUNCIL AGENDA ITEM
MAY 21, 2024
PREPARED BY: Soknirorn Than, City Manager
SUBJECT: California Department of Forestry and Fire Protection Grant for Community Forestry Program Resolution

BACKGROUND/DISCUSSION
The City Municipal Code mandates the City's responsibility for maintaining City Trees and requires the development of a Landscaping Master Plan detailing approved street trees and planning methods. However, existing reliance on the City's Improvement Standards and General Plan lacks adequate guidance, leading to challenges in maintaining overgrown existing trees that were planted before standards were adopted. This has resulted in poor tree health in some areas and inconsistencies in others. Additionally, the City lacks an accurate inventory of its trees.

To address these issues and minimize risks to the public, City Council, on 5/7/2024, authorized staff to pursue the California Department of Forestry and Fire Protection Grant for Community Forestry Program to develop an Urban Forest Management Plan (UFMP). This initiative aims to establish a tree inventory, urban forest mapping, UFMP development, integrating policy and ordinance development to enhance the sustainability and accessibility of urban and community forests in the City.

The first step in applying for this grant requires the City Council to adopt the attached resolution. This resolution lists the City commitments to support and carry out the City's obligations if awarded the grant.

FISCAL IMPACT
The total fee for the grant application is $9,900 with an anticipated maximum dollar amount of award per agency of $150,000 to $1,500,000. The fees to apply for the grant would be an impact to the General Fund (Fund 001 ), and Gas Tax Fund (Fund 010). This impact remains unchanged per the presentation to City Council on May 7, 2024.

RECOMMENDATION
Staff recommends that City Council adopt a resolution of the City Council of the City of Gustine authorizing the city manager to pursue the Urban and Community Forestry Program of the California Department of Forestry and Fire Protections.

COUNCIL AGENDA ITEM
MAY 21, 2024
PREPARED BY: Jenny Morrison, Finance Director
SUBJECT: Resolution Approving Deposit into Local Agency Investment Fund (LAIF)

BACKGROUND/DISCUSSION
In August 2017, the City Council approved a contract with Schneider Electric and authorized the City Manager to execute an agreement and application for a project to replace water meters throughout the City of Gustine.

Financing for the project was secured through a 50/50 grant and Clean Water Small Community Loan with the California State Water Board. In June 2022, the City was provided an amendment to the loan contract, providing principal forgiveness on the loan, converting the funds to 100% grant funding.

On February 28, 2023, the City received $2,419,787 reimbursement from the state as full reimbursement for the water meter upgrade project. The monies have remained in the City's general checking account since it was received.

In accordance with the City's investment policy, staff is recommending approval to deposit $2,419,787 into the City's Local Agency Investment Fund (LAIF) account from the general checking account. LAIF is a diversified investment pool administered by the California State Treasurer. Monies invested with LAIF are pooled with State monies in order to earn the maximum rate of return consistent with safe and prudent treasury management. The City may invest a maximum of $20 million pursuant to LAIF policy.

LAIF has an apportionment rate of 4%.

FISCAL IMPACT
Interest accrued from the LAIF account would provide a positive fiscal impact. LAIF interest is accrued on a quarterly basis, as documented in the City's monthly Treasurer Reports.

RECOMMENDATION
Staff recommends Council's approval of a resolution authorizing the transfer of $2,419,787 from the City's general Checking account into the City's LAIF account.

ITEM NO. 10

COUNCIL AGENDA ITEM
MAY 21, 2024
PREPARED BY: Soknirorn Than, City Manager
SUBJECT: Authorize Issuance of Letters of Opposition for SB 1037 and AB 1886

BACKGROUND/DISCUSSION
The League of California Cities, of which the City of Gustine is a member city, has asked for member cities to complete letters to oppose SB 1037 and AB 1886.

SB 1037 (Wiener)
The Planning and Zoning Law authorizes the Department of Housing and Community Development (HCD) to notify the office of the Attorney General, that the city, county, or city and county is in violation of state law if the local government has taken action in violation of specified provisions of law. The Planning and Zoning Law also requires that an application for a housing development be subject to a specified streamlined, ministerial approval process if the development satisfies certain objective planning standards. This bill allows the Attorney General to take legal action against a city and seek fines up to $50K a month for violating unspecified state housing laws that require ministerial approval of certain housing projects or for failing to adopt a housing element that substantially complies with the law, even if the jurisdiction is acting in good faith.

Under existing law cities can be subject to significant fines and penalties for violating certain housing laws. However, before fines are imposed, a city has the ability to correct the action. Additionally, enhanced fines are not imposed unless the city fails to follow a court's order or acts in bad faith. Unfortunately, as currently drafted, SB 1037 does not provide an opportunity for cities to correct an honest mistake or address a genuine difference in interpreting the law. Even those jurisdictions acting in good faith could be subject to significant fines and be required to pay the Attorney General for all costs investigating and prosecuting the action, including expert witness fees and attorney's fees.

AB 1886 (Alvarez)
For decades, cities have worked with HCD to draft housing plans that accommodate their fair share of housing at all income levels. These extensive and complex plans can take years to develop, include public involvement and engagement, and environmental review. Cities go to great lengths to ensure that their housing element substantially complies with the law, even if HCD disagrees. Current law acknowledges this fact by allowing cities to "self-certify" their housing element or take the issue to court and have a judge make the final determination of substantial compliance.

AB 1886 encourages "builder's remedy" projects by eliminating City's ability for selfcertification for the purpose of what it means to have a housing element "in substantial compliance with the law." The "builder's remedy" allows a developer to choose any site other than a site that is identified for very low-, low-, Or moderate-income housing, and construct a project that is inconsistent with both the city's general plan and zoning.

Page 52 of 83 ends

AB 1886 facilitates such projects for those cities that have a good faith disagreement based in substantial evidence. At this time, what cities really need is for HCD to provide clear guidance and technical assistance to help them finalize their housing elements and put those plans to work so that much-needed housing construction can occur.

FISCAL IMPACT
There is no fiscal impact associated with this item.

RECOMMENDATION
The recommendation is for City Council to authorize the City Manager, or designee, to execute and submit opposition letters for SB 1037 and AB 1886 to the appropriate recipients.

RE: SB 1037 (Wiener) Planning and zoning: housing element: enforcement Notice of Opposition ( As of April 25, 2024)
Dear Senator Caballero,
The City of Gustine regretfully must oppose measure SB 1037 (Wiener), which would allow the Attorney General to take legal action against a city and seek fines up to $50K a month for failure to adopt a compliant housing element or if the city does not follow state laws that require ministerial approval of certain housing projects.

Under existing law cities can be subject to significant fines and penalties for violating certain housing laws. However, before fines are imposed, a city has the ability to correct the action. Additionally, enhanced fines are not imposed unless the city fails to follow a court's order or acts in bad faith.

Unfortunately, as currently drafted, SB l 037 does not provide an opportunity for cities to correct an honest mistake or address a genuine difference in interpreting the law. Even those jurisdictions acting in good faith could be subject to significant fines and be required to pay the Attorney General for all costs investigating and prosecuting the action, including expert witness fees and attorney's fees.

Instead of creating new fines and penalties, lawmakers and the Department of Housing and Community Development should provide cities with clear guidance and technical assistance to help them finalize their housing elements and put those plans to work so much-needed housing construction can occur.

For these reasons, the City of Gustine must oppose SB 1037. If you have any questions, do not hesitate to contact me at [email protected] 0r 209-854-9403.

RE: AB 1886 (Alvarez) Housing Element Law: Substantial Compliance Notice of Opposition ( As of April 1, 2024)
Dear Honorable Juan Alanis,
The City of Gustine regretfully must oppose measure AB 1886 (Alvarez), because it turns its back to a fundamental provision of housing element law: A city may disagree with HCD; explain why its housing element is in substantial compliance with the law; and then adopt that housing element which is thereafter considered "in substantial compliance with housing element law."
For decades, cities have worked with HCD to draft housing plans that accommodate their fair share of housing at all income levels. These extensive and complex plans can take years to develop, including public involvement and engagement, and environmental review. Cities go to great lengths to ensure that their housing element substantially complies with the law, even if HCD disagrees. Current law acknowledges this fact by allowing cities to "self-certify" their housing element or take the issue to court and have a judge make the final determination of substantial compliance.

AB 1886 encourages "builder's remedy" projects by eliminating self-certification for the purpose of what it means to have a housing element "in substantial compliance with the law." The "builder's remedy" allows a developer to choose any site other than a site that is identified for very low-, low-, or moderate-income housing, and construct a project that is inconsistent with both the city's general plan and zoning. AB 1886 facilitates such projects for those cities that have a good faith disagreement based in substantial evidence.

The City of Gustine believes that AB 1886 is counterproductive. What is really needed is for HCD to partner with cities to provide meaningful direction that helps finalize their housing elements and put those plans to work so that much needed housing construction can occur. For these reasons, the City must oppose AB 1886 (Alvarez). If you have any questions, do not hesitate to contact me at [email protected] or 209-854-9 403.

ITEM NO. 11

COUNCIL AGENDA ITEM
MAY 21, 2024
PREPARED BY: Soknirorn Than, City Manager
Sammy Joseph, Acting Chief of Police
SUBJECT: The California Department of Justice Tobacco Grant Program for 2024

BACKGROUND/DISCUSSION
On January 19, 2021, The City of Gustine was successful in receiving $294,882 to fund a School Resource Officer (SRO) to implement four goals:

1. Engage the community to establish an anti-tobacco plan for the City.

2. Create and implement City Tobacco Retailers ordinance with outreach and education.

3. Conduct 6 tobacco-related enforcement operations annually.

4. Prepare GUSD staff to conduct youth education & intervention.

To-date these objectives were met and this grant cycle will be completed this calendar year.

On April 29, 2024, the California Department of Justice released a Request for Proposals for the Tobacco Grant Program for 2024. The Tobacco Grant Program, administered by the Office of the Attorney General, makes these annual funds available to local law enforcement agencies throughout California. Total available funds are $28.5 million.

Since its inception in 2017, the Tobacco Grant Program has distributed approximately $184.7 million in grant funding through a competitive process.

As we have received and met the grant obligation from last cycle, the City of Gustine has a competitive advantage in reapplying for this next grant cycle. The eligible funds for this grant include, but are not limited to:
• Retailer compliance checks
• Enforcement of flavor ban laws/ordinances
• Consumer protection enforcement
• Illegal online sales and marketing, including use of door-to-door delivery services • Retailer training programs
• Public education outreach
• Tobacco retail license inspections
It is also worth noting that this grant cycle will focus and allocate higher scores on two main areas:

1. Tobacco-related enforcement operations and retailer education and enforcement

2. Implement statewide retail flavor ban per the Health and Safety Code§ 104559.5

Page 57 of 83 ends

The summary of the grant program is provided in Exhibit B. As this would be a continuation of our current program and considering the City holds a competitive advantage for this grant application, staff recommends that the City Council authorize the City Manager to pursue this grant through Capital Advocacy Partners (CAP).

The due date for this grant is 6/28/2024.

FISCAL IMPACT
The total fee for the grant application is $12,500. The fees to apply for the grant would be an impact to the General Fund (Fund 001 ). There is no match or cost sharing required.

RECOMMENDATION
Staff recommends that City Council authorize the City Manager to pursue the California DOJ Tobacco Grant through Capital Advocacy Partners (CAP) for a total grant fee of $12,500 and adopt a resolution to increase appropriations to the Fiscal Year 2023-2024 budget in the General Fund (Fund 001) in the amount of $12,500.00

COUNCIL AGENDA ITEM
MAY 21, 2024
PREPARED BY: Soknirorn Than, City Manager
SUBJECT: SB 1 Project List for FY 24-25

BACKGROUND/DISCUSSION
The State of California passed Senate Bill 1 (SB 1) to address basic road maintenance, rehabilitation, and critical safety needs at the state and local level. SB 1 emphasizes the importance of accountability and transparency in the delivery of California's transportation programs. To be eligible for Road Maintenance and Rehabilitation Account (RMRA) funding, cities and counties are required to annually provide basic project reporting to the California Transportation Commission (CTC) for projects anticipated for and funded through the RMRA. The approved maintenance and repair list for 2024-2025 Fiscal Year is currently being scheduled and the project list is attached.

The work on the project list completed before June 30, 2025 will be reportable to the CTC by October 2024. A detailed project cost sheet will be prepared by staff for the expenditure reporting purposes to the CTC.

At the May 3, 2022 Council meeting staff brought an SB1 Prioritization plan and resolution to Council for approval. During the meeting, council gave direction that they would like to see other projects on the list. Staff met with the City Engineer to discuss other projects that meet SB 1 funding criteria and has updated the list to reflect the current needs.

With the SR 140/33 Roundabout project in construction, there is a major shift in the traffic pattern throughout the City. This has affected City resources in guiding and enforcing various traffic violations throughout the City. At this time, the project is scheduled to be completed by the end of the calendar year. Therefore, staff is proposing to revise the current SB 1 list and push these projects to the summer of 2025 to lessen the traffic impact. Secondly, this allows time to conduct various stakeholder meetings and notify the residents and businesses of these impacts.

The project list remains the same except for an addition of Railroad Avenue. As a major north and south throughfare, this segment of roadway has deteriorated significantly in the last couple of years. Staff is proposing to add this project to the SB 1 list and repair this segment concurrently with the SR 140/33 Roundabout project. This will minimize the duration of impact to nearby residents and businesses.

FISCAL IMPACT
There is no fiscal impact at this time.

ITEM NO. 13

COUNCIL AGENDA ITEM
May 21, 2024
PREPARED BY: Soknirorn Than, City Manager
Gary Ingram, Public Works Director
SUBJECT: Authorize the City Manager to Execute a Purchase Agreement with the City of Merced to Purchase a Street Sweeper

BACKGROUND
Notwithstanding the increased costs, street sweeping serves an important public service, as well as, assists in preserving the City's infrastructure investments. The community relies on effective and thorough sweeping of the streets to preserve their drivability and cleanliness, as well as enhance the City's quality of life. Additionally, the street sweeper provides an equally important function for emergency cleanup, annual catch basin cleaning, and storm water management.

In August 2022, staff prepared an RFP for street sweeping services and received only two responses - Mid Valley Disposal and Ronnie's Inc. As anticipated, the proposals came in very high, in accordance with the requirement to pay sweeper operators at prevailing wage rates. Of the two bids, Mid Valley was the lower at $69,384.00 annually plus $160.00 per hour for emergency call outs and special events. The City also reached out to several neighboring cities, such as Newman, who advised they handle street sweeping in-house.

Staff then requested a Sourcewell Cooperative Purchasing price quote from Municipal Maintenance Equipment to lease/purchase a street sweeper. The quote offered several options for lease-to-own. The least expensive option was a 7-year lease paid annually at a cost of $38,494.91 per year. Due to funding deficiencies, street sweeping in the City has occurred on an as needed basis and is strictly reactionary.

An important consideration when purchasing equipment is annual maintenance and operation costs. Staff researched maintenance costs for a typical sweeper and estimated that the annual cost would be approximately $7,000 - $10,000 annually. This estimated cost is based on operating the sweeper 4-5 hours a week, along with the expense of regular oil changes and replacement of metal sweeper brooms, tires and smaller wear items as needed.

In regards to staffing, we acknowledge that the department is already under staffed, it will be challenging to maintain a regular schedule if they are down staff or have an emergency to attend to. However, staff believes the potential for periodic disruptions in service will be outweighed by the advantages of having the sweeper available for special events, emergency water breaks, resident-initiated complaints, and road cleaning during harvest season. The sweeper will also be very helpful during busy leaf season every fall.

Page 71 of 83 ends

DISCUSSION
While looking at various options to bring regular street sweeping services back to the City, staff was presented with an opportunity to purchase surplus equipment from the City of Merced. Currently, the City of Merced has a 2014 Autocar Schwarze A900 Monsoon Street Sweeper that will be going to auction. In discussion with City of Merced staff, the City of Merced is willing to execute a direct sale agreement with the City Gustine and place the selling price at $20,000. This price is in line with the average starting bid price for this type of equipment on auction websites that the City of Merced Purchasing Division uses to sell surplus equipment.

Staff has reviewed the maintenance log of this equipment, and verified that it is still in good working condition, and is estimated to allow for an additional three to five years of service.

Currently, Public Works has qualified staff that is properly licensed to operate this equipment at the proper Gross Vehicle Weight Rating (GVWR). However, staff will need to expand commercial driver license training and examination to other staff to account for emergencies and flexibility in work assignment among the department. The cost for this training and certification expansion will be accounted for in the FY24/25 budget.

FISCAL IMPACT
As this is a new program and task for Public Works, staff is proposing to start the sweeping schedule on a bi-weekly basis. This will require approximately 5 days of sweeping per month with an estimated labor cost of $3,600 monthly. The fuel cost would be at $500 monthly. Including the cost of maintenance, this brings our annual cost of operation to approximately $56,200 annually.

In comparison, the cost of the Mid Valley Disposal proposal would be approximately $70,000 (2022 pricing) annually. The lease-to-purchase option has a total estimated annual cost of $81,000 (using existing staff).

The operation cost will be budgeted in the FY24/25 budget and will be presented to Council on 6/4/2024 for consideration.

RECOMMENDATION
Staff recommends that the City Council adopt a resolution authorize the City Manager to execute a Purchase Agreement with the City of Merced for the 2014 Autocar Schwarze A900 Monsoon Street Sweeper, for the amount of $20,000 and increase appropriations to the Fiscal Year 2023-2024 budget in the General Fund (Fund 001) in the amount of $10,000.00, the Gas Tax Fund (Fund 010) in the amount of $5,000, the Sewer Fund [Fund 061) in the amount of $2,500, and the Water Fund [Fund 060) in the amount of $2,500.

ITEM NO. 14

COUNCIL AGENDA ITEM
MAY 21, 2024
PREPARED BY: Soknirorn Than, City Manager
SUBJECT: Authorize the City Manager to Execute a Memorandum of Understanding with the San Andreas Mutual Water Company

BACKGROUND/DISCUSSION
The City has been approached by a private entity, San Andreas Mutual Water Company (SAMWC), seeking a Memorandum of Understanding (MOU) to study the City Waste Water Treatment Facility. The purpose of this study is to generate the volume of usable water within the City of Gustine through water recycling processes at our facility.

The proposed MOU would allow SAM WC access to collect data and conduct a feasibility study at the City's facility. The study is for a conceptual plan to upgrade Gustine's Waste Water Treatment Plant (WWTP) to produce tertiary 'Title 22" recycled water, by providing infrastructure to deliver treated water into an irrigation canal for possible use by downstream agriculture or wildlife refuges in coordination with the respective irrigation districts.

Staff has met with representatives from the Central California Irrigation District (CCID), and the San Joaquin River Exchange Contractors (SJREC) to discuss the possibility of the proposed concept. Both agencies are open to the exploratory works and support this endeavor.

This work is in line with the City's goal and policy on expanding access to clean water and reducing our dependency on groundwater as mandated through the Sustainable Groundwater Management Act (SGMA).

If the feasibility study shows that there are substantial benefits to the City, the conceptual plan can be incorporated into the City Sewer Master Plan, which is being updated. The plan would then be brought to Council for decisions on implementation, permitting, and financing.

No party is obligated to agree to an upgrade of the Treatment Plant or go forward with any project upgrading the WWTP. However, should the parties agree to proceed with the project to upgrade the WWTP to produce tertiary recycled water, the parties do acknowledge that each of the parties is a vital component to that plan and shall work together in a manner to be agreed on at a later date.

FISCAL IMPACT
There is no fiscal impact. The cost of the study will be the responsibility of San Andreas Mutual Water Company.
