ITEM NO. 1

CITY COUNCIL AND

PLANNING COMMISSION

JOINT MEETING

AGENDA ITEM
JUNE 26, 2024
PREPARED BY: Jami Westervelt, Economic and Community Development Director SUBJECT: Draft Merced County Multi-Jurisdictional Housing Element - City of Gustine Sixth Cycle Housing Element Update

BACKGROUND
For more than a year, the City has been working on the Merced County MultiJurisdictional Housing Element (MJHE) process, for which all the jurisdictions in Merced County are participating. The Council received its first full update early on in the project in July 2023. Since that time, significant work has occurred, culminating in the release of the full draft of the document for public comment on May 13, 2024.

The City of Gustine undertook a significant effort to involve the public that included holding several public meetings and various outreach efforts to inform the public of the draft release. Additionally, the public comment period provided an additional opportunity for the public to review the entire MJHE, including the City of Gustine specific section. The public comment period closed on Wednesday, June 12, 2024.

The City received comments from 12 individuals. Of those, 10 were the same comment about an error on the exhibits within the draft document. Another was from a housing organization regarding the recommended housing policies. The final comment was from a property owner/ developer regarding zoning code related to higher density housing.

The error commented upon was that in figures (numbering D5-23 through D5-29) in the section on Affirmatively Furthering Fair Housing (AFFH), the sites were not updated to reflect the five parcels on the Site Inventory approved by the Council following the December 19, 2023 meeting. While the sites were updated in other related sections, these figures did not get revised in the AFFH section. While this change could not be made while the public comment period was still open, it has been made since and as shown in Exhibit A.

Due to the size of the MJHE, the document is not attached to this agenda. The full Countywide version, as well as Section D that specifically pertains to the City of Gustine are available online at the City of Gustine website or directly at the website addresses shown below.

City of Gustine Section D:
https://www.cityvofgustine.com/pview.aspx?id=56271&catid=649 Countywide Combined Regional analysis:
https://mercedmjhe.com/project-resources/
At this joint meeting with Council and Planning Commission, they will receive a presentation from the consultants on the MJHE and the comments received. Rincon Consultants has worked with the MCAG and the countywide group since inception of the project and Veronica Tam and Associates specifically focused on Housing Plans/ AFFH sections. Both will attend to participate in a presentation that will both review public comment received and provide an opportunity for both Council members and Commissioners to ask any in-depth questions and provide additional input to the draft.

Following the direction provided at this meeting, the City, along with other jurisdictions in Merced County, will submit the draft review to the State of California for its consideration. The State then has 90 calendar days to return comments on the document.

The State may or may not have substantive comments related to either the countywide analysis or any of the jurisdictions' individual element sections. Regardless, both the Council and Commission will see the document before the final document is submitted for certification. When the document draft ultimately gets approved by the State, the Commission will see the document and recommend an action to Council and the Council then can approve the final document for submission to the State for the required certification.

Concurrent to the review of the draft by the State, staff will begin work on environmental clearances and zoning changes that will need to be approved to implement the Housing Element.

RECOMMENDATION
Staff recommends the Planning Commission and the Council receive public comment, hold discussion, and provide staff with direction to submit this draft MJHE to the State Department of Housing and Community Development.
