COUNCIL AGENDA ITEM
DECEMBER 3, 2024
PREPARED BY: Soknirorn Than, City Manager
SUBJECT: Approve the Purchase of a Tow-Behind Sewer Jet

BACKGROUND/DISCUSSION
The City's Public Works department is responsible for maintaining and ensuring the efficient operation of the sewer system. Currently, the equipment (the Vactor) used for cleaning and maintaining the sewer lines lack the functionality to reach smaller sewer lateral and frequently requires rental equipment or outside contract services such as A Plus Plumbing.

In the last two years, the City has spent over $19,000 in contract services with A Plus Plumbing to jet and unclog various City owned laterals. Unfortunately, these issues continue to plague our department and drain our resources. This is mainly due to the aging infrastructure and the design at the time. Capital replacements or upgrades are not feasible at this time without the assistance of various grants, in order to keep up with the demand, a stop gap measure must be in place.

As a result, staff has identified a trailer-mounted sewer jet to meet the necessities for our operations. The purchase of this equipment offers several benefits:
l. Increased Efficiency: The modern technology of a trailer-mounted sewer jet allows for quicker and more thorough cleaning of sewer lines, reducing the risk of blockages and overflows. This is suitable for smaller lines from 3"-12" in diameter.

2. Cost Savings: Investing in a new sewer jet will decrease the reliability on rental equipment and outside contract services.

3. Improved Safety: The new equipment will enhance the safety of the maintenance crew by providing reliable and effective tools for their tasks. This equipment can be operated with a one-man crew.

4. Flexibility and Mobility: A trailer-mounted unit can be easily transported to various locations within the City, providing flexible and responsive maintenance capabilities. Secondly, this unit does not require a special license classification to transport.

See Exhibit A for the recommended equipment.

FISCAL IMPACT
This equipment purchase has not been budgeted in the CIP; however, there are sufficient funds in the Fiscal Year 2024-2025 budget in the Sewer Fund (Fund 06 l) to accommodate this purchase. Staff is not requesting a budget amendment or additional appropriation at this time.

COUNCIL AGENDA ITEM
DECEMBER 3, 2024
PREPARED BY: Jami Westervelt, Economic and Community Development Director SUBJECT: Adopt Resolution Authorizing SB 1383 Equipment Purchase

BACKGROUND
At the end of 2023, the City applied for a second SB 1383 grant from CalRecycle under the Local Assistance Grant Program (OWR). There has been no match required for these funds to date. The City applied for and received $20,000 in an earlier round of funding (OWR2). For the newest round (OWR4), the City applied for nearly $114,000 but received $75,000-the minimum award amount in OWR4 round.

The OWR grants have provided the City a funding mechanism for items which would otherwise be unfunded state mandates related to solid waste. Although the City has a low-population waiver to portions of SB 1383, there are still portions of the law, and the legislation preceding that the City must adhere to that carry costs to implement.

The City OWR grant budgets thus far have focused on funding the requirements of the legislation that the City has no additional funding sources to cover, including:
• Procurement of organic and recycled-content materials at State-mandated annual levels
• Items needed to move/store the procured material adequately • Collection containers for organic materials
• Conducting required SB 1393 inspections on behalf of the City • Required SB 1383 and grant record keeping and grant reporting Cal Recycle is somewhat unusual in that is has multiple years of grant funding for the same program open simultaneously. Therefore, the City currently has dollars available in both awards. The City must spend OWR2 funds by March 3, 2025 and OWR4 funds by March 31 , 2026.

With the significant reduction from the application amount this round, the City had to provide a revised budget draft for OWR4 within the $75,000 awarded. Staff was able to submit this budget revisions based upon Resolution 2023-2709 approved November 2023 by Council (Exhibit C). CalRecycle required this resolution from jurisdictions to apply.

While staff can submit budget changes to Cal Recycle per the above resolution, the equipment purchase is a significant expense, requiring Council approval and budget appropriation.

DISCUSSION
The Public Works department has identified purchase of a Skid Steer as a priority for assisting with the movement of organic materials that the City is required by the State to purchase. Attached (Exhibit B) are three updated quotes for this equipment. The City could accommodate this purchase through use of a combination of OWR2 and OWR4

The City could accommodate this purchase through use of a combination of OWR2 and OWR4 funds as follows to fund the $52,023.18 purchase from Holt of California (the lowest bid):

OWR 2 Equipment Budget= $ 6,841.30 (Total Line item)
OWR 4 Equipment Budget= $45,181 .88 (leaving $8,818.12 in Line item to re-budget) Staff submitted to CalRecycle the specifications of the equipment and received confirmation in writing from CalRecycle staff that the purchase of the equipment listed qualifies for use of the OWR funds. Therefore, the City may purchase the equipment now with Council approval of the Resolution in Exhibit A attached.

Due to market shifts, Public Works staff took the precaution of asking for updated quotes for the equipment and found the price went down since Cal Recycle approved the City OWR budgets earlier this year. If approved by Council, staff intends to seek reimbursement from the remaining OWR2 grant funds first, since these funds expire earlier.

This will leave approximately $8,800 in additional funds in the OWR4 line item for equipment, as shown above. Staff intends to return to CalRecycle at a later date with modifications to the OWR4 budget to re-allocate those funds as necessary to meet City needs. The City first needs definitive clarification on other categories in the OWR4 budget, specifically in regard to consultants and potential City staff time recovery.

Based on experience in OWR2, staff has taken on the oversight and billing of the OWR grants internally to increase efficiency. Inspections of local businesses required by SB 1383 will likely remain a consultant-completed function for at least the timeframe of the OWR4 funding. City staff is currently working to secure a qualified consultant able to work solely on the inspections. The costs related to the significant insurance requirements the City's Risk Management Authority requires of contract consultants limits the ability of some contractors to apply for the work, as the insurance prices them out of the available budget.

Staff is also looking into potentially recovering some staff costs related to administering the grants in-house and is exploring the requirements to claim up to 10% of the grant total for staff administering the OWR4 grant. Actual funding in OWR4 after settling the outstanding question on consultant and the requirements of CalRecycle to claim this staff reimbursement will ultimately dictate whether the City can recover those funds.

FISCAL IMPACT
Utilizing the CalRecycle OWR2 and OWR4 grants as described allows the City to purchase the equipment that the City otherwise has not been able to fund. The Council needs to appropriate the full $75,000 of the OWR4 grant in the current budget year in expenditures and revenue, which will include the current equipment purchase.

RECOMMENDATION
Staff recommends that the Council adopt a resolution to:
1 . Approve the purchase of the Skid Steer equipment from the lowest bidder

2. Amend Fiscal Year 2024-2025 budget by increasing appropriations by $75,000 in the current budget year for expenditures and revenues related to the OWR4 grant.

ITEM NO. 8

COUNCIL AGENDA ITEM
DECEMBER 3, 2024
PREPARED BY: Tiffany Vitorino, Recreation Manager
SUBJECT: Community Contribution Payment Expenditures

BACKGROUND/DISCUSSION
In November 2020, and amended in June 2022 and November 2024, the City entered into an Operating Agreement with Tip Top Farms, a cannabis business located at 377 4th Street in the City of Gustine. The Operating Agreement defines specific terms for the business to operate in the City, including revenue payments that are to be paid from the business to the City. In addition to monthly revenues that are based on the business's gross receipts, Tip Top Farms pays an annual amount that is referred to as a "Community Contribution."
Section 6.0., of the Operating Agreement defines Community Contributions (as it pertains to the Operating Agreement) that are to be paid from the business to the City each fiscal year. The agreed upon amount is $20,000 per fiscal year. The City's fiscal year (FY) runs from July 1 to June 30. The language was recently amended and approved by City Council at their meeting on November 19, 2024.

Section 6.D.:
ii. The Cannabis Business agrees to donate $20,000 to the City per fiscal year, beginning Fiscal Year 2020 unless otherwise reasonably agreed by the City due to timing of State licensing and commencement of business operations. The acceptance and use of the donations shall be subject to City Council approval, with input from the Cannabis Business. Nothing in this Agreement binds the City to acceptance of the donations or use of funds for particular events, nor shall this Agreement in any way operate to restrict or bind the City Council's discretion and legislative authority.

Last year, Council approved to utilize a portion of the funds to purchase eighteen (18) commercial 8' picnic tables totaling $21,956.01 for the Henry Miller Park Rotary Shelter, which is where many of the City and other organization's events take place. Photos of the new tables are shown in Exhibit A. Further direction was to balance the firework fund from fiscal year 2022-2023 that had a deficit of $3,389.26.

Council also authorized for the downtown sound system to be repaired for $5,443.00 and a new microphone be purchased to repair the Al Goman Center sound system for $1,168.00. These expenses left a remaining balance of $8,043.73.

A fund breakdown:

TIP TOP COMMUNITY CONTRIBUTION BREAKDOWN
FY 21/22 & 22/23 Contribution Total $ 40,000.00
Fireworks Fund 2022-2023 Deficit $ (3,389.26)

Fireworks Fund 2022-2023 Deficit $ (3,389.26)

Downtown Sound System $ (5,443.00)
Al Goman New Microphone $ (1,168.00)
Total Expenses $ (31,956.27)
Remaining Balance $ 8,043.73
Following previous discussions, the City Council requested staff continue to provide detailed information on the Fireworks Fund when considering decisions related to the Community Contribution. In response, staff has prepared and attached a comprehensive breakdown (Exhibit B) of the Fireworks fund. This breakdown includes not only the actual revenue and expenses related to the fireworks but also the associated costs and income from park activities and the Miss Gustine accounts.

Each component's revenue and expenses have been categorized by fiscal year, reflecting the timing of the respective events. It is important to note that the majority of expenses may be incurred in one fiscal year, while the related revenue may not be realized until the following fiscal year. For example, the Miss Gustine Pageant held in June 2023 incurred most of its expenses in July 2023, which were recorded in the 2023- 2024 budget. Additionally, the 2024 pageant expenses, held in June 2024, were also recorded in the 2023-2024 budget, leading to a higher apparent expense for that fiscal year. Overall, the average net loss for the Firework Fund (Fund 047) for the last three years is $6782.00 annually. This does not include FY24-25 as the revenue is not expected until June, 2025.

In the same way, there were no expenses for bounce houses for the park activities on July 4, 2024, but the bounce house expenses from the 2023 event are reflected in the 2023-2024 budget as they were paid in July 2023. This also pertains to the donations the community may believe they are donating for the current year however, if donating in July; they are donating towards the following year's fireworks show.

As in the past, staff provided a priority list for the Community Contribution funds. This list is for staff to continue to focus efforts. The list is based on a needs-assessment of the City's rental facilities along with staff's recommendations and priority levels:

High priority
• Henry Miller Gazebo roof repairs - Estimates attached • Peterson Shelter replacement tables - Estimates attached • Henry Miller permanent event garbage cans
• Event Lighting Trailer
• Event Camera Trailer
• Henry Miller (2) electrical event panel replacement and covers • Portable Restroom Trailer
Medium priority
• Henry Miller Park storage and rental garage door replacement • Revitalize Schmidt Park horseshoe tournament area making it a rental facility • Filling prior playground location area by Goman Center • Bleachers or tables for tennis/pickleball court viewing area • Shade area by tennis/pickleball court viewing area
Low priority
• Portable picnic tables
• Shade tents and awnings for events
• Portable stage

Following a thorough needs assessment of the park areas, staff would like to recommend allocating the 2023-2024 funds to address one of two critical improvement projects.
l. Staff propose utilizing the funds for the replacement of the Henry Miller Park Gazebo roof. As detailed in (Exhibit C), we have received two estimates, with Straight Edge Roofing, Inc. being the low bidder at $19,500.

2. Alternatively, Council can consider replacing the tables at the Harry Schmidt Park Peterson Shelter. Exhibit D illustrates the deteriorating condition of the tables, which are beyond repair. The Peterson Shelter hosts numerous community events, such as Kids Fishing Day, ABC Foundation Fishing Day, weddings, and other celebrations. Staff has obtained three bids to replace the 32 tables, in which three of the tables will be ADA, with the lowest bid being Global Industries at $27,812.83 as outlined in (Exhibit E). Since trying to purchase all the tables and the total bids exceed the available Community Fund balance, the Council may choose to purchase only the number of tables that fit within the funding available, and plan the purchase of additional tables at a later date where funding is available.

Alternatively, staff can explore supplementing the cost by increasing the facility rental rates to offset some of the expenses.

FISCAL IMPACT
There is a fund balance of $28,043.73 from the Community Contribution Fund (Fund 042). Currently there is no expenditure appropriate for this account. Staff is suggesting using this fund balance to address one of the above alternative. Council may also elect to use the UUT Fund (Fund 002) for these activities.

RECOMMENDATION
Staff is seeking City Council direction whether to select the following alternative:
l. Replace the Henry Miller Park Gazebo Roof - $19,500.00

2. Purchase of 32 Table for the Peterson Shelter- $27,812.83

3. Use the fund to subsidize the Fire Work Expenses for FY24-$1 l ,295.97.00

4. Other as directed

COUNCIL AGENDA ITEM
DECEMBER 3, 2024
PREPARED BY: Soknirorn Than, City Manager
SUBJECT: Utility Users Tax Expenditure Policy

BACKGROUND/DISCUSSION
On July 3, 1995, City Council adopted ordinance 405 establishing a Utility Users Tax (UUT) and adding chapter nine to title three of the Gustine Municipal Code (since renumbered to Title 9, Chapter 6). This tax rate is set at 2.5% and applies to Cable Television Services, Electricity, Gas, Telephone, and Water.

The purpose of this tax is to provide general municipal revenues, which is to be used for general municipal purposes. Per section, 3-9.010 of the ordinance, the revenue generated by this tax shall be placed in the City's General Fund.

Per the City's adopted budget, this revenue has been placed in a separate fund within the General Fund, the Utility Tax Fund (Fund 002).

Although, per the adopted ordinance, this fund is unrestricted and can be used for general municipal purposes, the City Council directed staff on June 18, 2024 to bring this item back for discussion. On September 17, 2024, staff brought this item forward to City Council for discussion and provided the following options:

1. Revise the ordinance and add the expenditure limitation through adoption of an amended ordinance

2. Adopt an expenditure plan/policy
Ultimately, Council provided direction to keep the current practice, adopting the UUT expenditure plan annually within the budget adoption and keeping the salary and benefit restriction.

For this reason, staff recommends the City Council review and approve the draft UUT Expenditure Policy attached.

FISCAL IMPACT
None at this time. Depending on the funding priorities, staff will analyze the fiscal impact and bring this back to Council for evaluation at the annual budget workshop or as needed.

RECOMMENDATION
Review and approve the UUT Expenditure Policy attached, and approve a resolution adopting the policy.
