ITEM NO. 4

COUNCIL AGENDA ITEM
MARCH 4, 2025
PREPARED BY: Ruben Chavez, Chief of Police
Richard Martin, Fire Chief
SUBJECT: Approve Request from Gustine High School for Street Closures and the Use of City Resources for the "Every 15 Minutes Program"

BACKGROUND/DISCUSSION
Staff has received a letter from Gustine High School to request assistance in hosting the popular anti-DUI Program "Every 15 Minutes." This national model program, which last took place at GHS 4 years ago, is geared towards Juniors and Seniors and will take place on March 20-21, 2025. The two-day event is a theatrical DUI related collision and the aftermath of such tragedies where lives are lost. The goal of the program is to challenge students to make mature decisions when drinking and driving. This program takes place on City streets using local resources to ensure a realistic life-like event. The second day takes place in the gym for all the Juniors and Seniors to hear and feel what it is like to be involved in the poor decision making of drinking and driving.

The event, which is being coordinated by Megan Azevedo, involves extensive coordination with Gustine High School students and staff, the California Highway Patrol, the Gustine Police Department, Fire Department and Public Works, Westside Ambulance, Medi-flight, Doctors Hospital, and the Merced County Coroner's Office.

The program begins with a staged collision on North Avenue where the bleachers will be set up. Once it begins, the students will be released from class and brought out to the scene where the drama begins. The morning of the event, a Grim Reaper will accompany a Gustine officer to specific classrooms to read an obituary of a student in that classroom who is removed and becomes the "living dead." Twelve students are selected to be part of the living dead. These students will be the backdrop of the collision scene.

The Gustine High School is requesting the closure and use of North Ave from 5t Street to Sycamore Ave and all side streets within that section to one block south on March 20, 2025 from 8 am to noon. The program also requires no parking signs along North Ave where the Program takes place. Staff will ensure Police and Public Works Personnel are assigned as needed.

FISCAL IMPACT
l. Police staffing will be required to participate in the event. This involves two days of commitment by three officers, with a labor cost estimated at $839.37.

Any costs associated with Cal Fire or the Gustine Volunteer Fire Department have not been included.

Page 36 of 74 ends

2. Total estimated labor costs for Public Works and Police administrative staff is estimated to be $388.25.

Total cost for city staff and services is $1,227.62. The applicant is requesting all fees/costs be waived.

RECOMMENDATION
Staff recommends that Council approve the request for use of City streets, services and waive costs associated to support the Gustine High School Every 15 Minutes program.

Gustine, CA 95322
Dear Honorable Mayor and Members of the City Council:

The Every 15 Minutes Program would like to close city streets for a mock accident.

The Every 15 Minutes program is a two-day program focusing on high school juniors and seniors. It challenges them to think about drinking, driving, personal safety, the responsibility of making mature decisions, and the impact their decisions have on family, friends, their community, and many others. The accident will occur on March 30th at approximately 10:30 am. The location of the mock accident will be at the intersection of West Ave and North Ave, to the side of the football field. Because of the preparation time needed for the event, we would need to close streets from 8 am until noon. The streets that need to be closed will be North Avenue up until Sycamore Ave, North Avenue from 6th, and 5th street, and West Avenue up to 1st street. We will also need No Parking signs on the corner of West and North Avenue down to the front of the high school. The helicopter will land on the Gustine High School football field.

We will receive assistance from the California Highway Patrol, Gustine police, Gustine Fire Department, Westside Ambulance, Doctors Medical Center, and PHI medflight for this program. We formally request that any costs and fees be waived. If you need any further information please contact me at 854-6414 or (209)648-7502. Thank you so much for your cooperation with this program.

Sincerely,
Megan Azevedo

ITEM NO. 6

COUNCIL AGENDA ITEM
MARCH 4, 2025
PREPARED BY: Tiffany Vitorino, Recreation Manager
SUBJECT: 4th of July Fireworks Show - Discussion

BACKGROUND/DISCUSSION
The Gustine 4th of July Fireworks show is a long-standing tradition, with this year marking its 115th annual celebration. Historically, the event was organized by a 4th of July Committee composed of Gustine citizens, that committee dissolved and management transitioned to the Gustine Chamber of Commerce. Over a decade ago, the Chamber requested the City of Gustine assume responsibility for the fireworks show.

At the time of transition, the Chamber informed the City that Pyro Spectaculars by Souza had provided a long-standing special pricing arrangement due to history as a longstanding customer. As a result, neither the Chamber nor the City sought competitive bids from other pyrotechnic companies. For the past several years, the City has continued contracting with Pyro Spectaculars as the show's producer and pyrotechnician.

In the past several years, the cost of the show has increased by $500-$1,000 annually due to inflation and rising equipment costs. To manage these increases, staff has either absorbed the additional cost into other budget line items or shortened the show to remain within budget.

In the 2022-2023 fiscal year, the fireworks fund was subsidized with $9,049.78 from the Tip Top Community Contribution Fund. Last year, due to a shortfall in donations, the City incurred an additional loss of $11,295.97 for the 2024-2025 fiscal year, which was once again subsidized by the Tip Top Community Contribution Fund.

This year, staff reached out to Jennifer Waite, Customer Service Representative for Pyro Spectaculars, to discuss budgetary concerns particularly the decline in donations and sponsorships in the past few years. Staff also addressed concerns regarding last year's show, specifically the lower-than-expected firework heights, which were concerning to public safety.

Ms. Waite assured staff that the defective batch of shells used last year has been discontinued and will no longer be used. Additionally, she confirmed that due to those issues, there will be no increase for this year's show, meaning the length and quality will remain unchanged at the same cost. Attached as Exhibit A is this year's proposal that gives a description and details of the show. The deadline to sign the agreement with Pyro Spectacular is April 1, 2025.

Currently, the show is manually launched, allowing better timing of larger shells, which enhances the overall visual experience compared to electronically launched displays.

Page 56 of 74 ends

Jennifer also mentioned that Pyro Spectaculars has begun working with drone companies to offer hybrid drone and fireworks shows and inquired whether the City would be interested in exploring this option. This option usually is higher in cost.

Staff has researched other pyrotechnic vendors in the area and has found only a few that may be able to provide a quote. Many are already booked for July 4th or do not offer manually launched shows within the City's budget constraints.

Staff has identified four options for Council to consider:
a. Request for Proposals (RFP) Process - This option would require an estimated 30- day advertisement period, along with additional time for staff review and final consideration by the Council. Given the limited number of companies identified as potential bidders, this option may be challenging to complete in time for the 2025 fireworks show.
b. Adjust Show Length and Budget - In the past, the City has modified the length of the fireworks show to align with budget constraints. Fireworks typically cost approximately $1,500 per minute, with the City's current show lasting around 15 minutes. If desired, the Council may choose to shorten the show's duration to better match available donation funds.
c. Explore Drone/Fireworks Show Combinations - Staff would require a few weeks to further research and evaluate companies that offer drone and fireworks combination shows. According to reports from other cities, incorporating drones would increase the overall cost to the City.
d. Continue with Pyro Spectaculars - The City may opt to proceed with Pyro Spectaculars and accept the quote provided in Exhibit A, maintaining the same show as last year at a cost of $24,250.00.

COUNCIL AGENDA ITEM
MARCH 4, 2025
Jenny Morrison, Finance Director
Mid-Year Budget Review - Fiscal Year 2024-2025
ITEM NO. 7

DISCUSSION
Please find attached a condensed revenue and expenditure report for Fiscal Year 2024-25 for activity through January 31, 2025. Given the revenue received to date and expenses thus far for the fiscal year, staff anticipates finishing the fiscal year within the adopted 2024-25 budget. At this time, staff is not requesting any appropriations during the mid-year. However, we're requesting City Council to approve the adjustments within the accounts as attached (Exhibit B).

REVENUES
The City receives revenue on several different timelines, including monthly, quarterly, semi-annually and annually. During the mid-year budget all revenue has not been collected. However, based on what has been collected the revenues are forecasted to be on track with the adopted budget. There are several revenue accounts that are not at 50% due to the timing of the revenues received. The General Fund (001) is at

51.01 % collected. Enterprise funds (Water (060)/Sewer (061)/Refuse (062)/Storm Drain (059)) are averaging 62%. Some revenue funds are still to be collected, for example, the Swimming Pool Fund (016) is only at 12.11 %. This is mainly due to the budgeted interfund transfer. This transfer will occur at the end of the fiscal year. Based on this, staff is not recommending any mid-year adjustments. However, staff will continue to closely monitor the incoming receivables and will suggest budget amendments if significant variations become likely within this fiscal year.

EXPENSES
The attached report (Exhibit A) shows expenses for General Fund followed by the Enterprise Funds. Overall, the General Fund is on budget. Operational Expenses are on target for mid-year. Capital Improvement Projects (CIP) are also on track with the budget.

TRENDS
In reviewing revenue and expenses there are some items that, while budgeted for this fiscal year, will require review in future budget years:
• Insurance Premium:

For FY25, we have seen a 19% increase in our insurance premium from Central San Joaquin Valley Risk Management Authority. This is our municipal pool insurance that encompasses worker compensation program, liability insurance, property insurance, EAP, ERMA, and overhead. This does not include our group health insurance (PACE). This increase translates to an increase of $83,084.00 to various accounts.

Page 65 of 74 ends

• Park and Facility Rentals:

Expenses for both parks and facilities continue to climb. General fund rental fees are down compared to last year at the same timeframe. Revenue is affected both by the number of individuals and groups that pay to use the building and the amount paid. Council may want to consider whether continued improvements to the facilities will increase rental numbers and revenue. As expenses for park and facility rentals continue to go up, the City would likely need to consider an alternative cost recovery model or whether to continue subsidizing this expenditure.
• Fuel Cost:

We've seen an increase in fuel consumption. Although the crude oil price index has decreased in the last six months, we have consumed more fuel due to higher productivity. As we transition from contract services to in-house programs, we'll continue to see this increase. It is worth noting that the savings in contract services has more than offset the increase.
• Fireworks:

Expenses in the Fireworks Fund continue to grow each fiscal year. Revenues and donations are lessening each fiscal year as well. Council may need to consider alternatives or to continue subsidizing this expenditure.

CONCLUSIONS:

Overall the budget is in good standing both with regard to revenue as well as expenditures. At this time no additional appropriation is needed. Staff will continue to monitor finances as the fiscal years draws to a close and the preparations begin for next year's budget. There are some budget adjustments that are proposed within funds to meet minor increases and realize savings from various activities.

RECOMMENDATION
Staff recommends Council accept and file FY 24-25 Mid-Year Budget Review.
