COUNCIL AGENDA ITEM
APRIL 1, 2025
PREPARED BY: Tiffany Vitorino, Recreation Manager
SUBJECT: 4th of July Fireworks Show - Award
BACKGROUND/DISCUSSION
The Gustine 4th of July Fireworks Show is a long-standing tradition, with 2025 marking its 115th annual celebration. On March 4, 2025, staff presented different options for the upcoming show to the City Council. As part of this effort, staff researched alternative pyrotechnic vendors but found that most are either fully booked for July 4th or unable to provide manually launched shows within the City's budget constraints. City Council directed staff to proceed with the current vendor for the 2025 show and seek partnerships with community groups to fundraise.
To address budget concerns, particularly the decline in donations and sponsorships over the past few years, staff contacted Jennifer Waite, Customer Service Representative for Pyro Spectaculars. Staff also raised concerns regarding last year's show, specifically the lower-than-expected firework heights, which posed potential public safety issues.
Ms. Waite assured staff that the defective batch of shells used last year has been discontinued and will no longer be in use. Additionally, she confirmed that, as a result of the issues encountered during last year's show, there will be no price increase for the 2025 show. This ensures that the show's length and quality will remain the same at the current cost.
Attached as Exhibit A is the 2025 proposal from Pyro Spectaculars, detailing the scope and specifications of the 2025 show. The total proposed amount for the show is $24,250.00.
FISCAL IMPACT
The total cost of the 2025 fireworks show is estimated at $24,250. To support funding efforts, City staff, community members, and local organizations have volunteered to assist with face-to-face donation collection. The event will primarily be funded through these donations, with any remaining balance subsidized by the Tip Top Community Fund, as has been directed by Council.
RECOMEN DAITON
Staff recommends that the City Council approve the resolution authorizing agreement with Pyro Spectaculars for the 2025 4th of July Fireworks Show and authorize the City Manager to execute necessary documents to proceed with the contract.

ITEM NO. 6
COUNCIL AGENDA ITEM
APRIL 1, 2025
PREPARED BY: Jami Westervelt, Economic and Community Development Director SUBJECT: Pioneer Park Funding Status Discussion
BACKGROUND
The City went through a comprehensive outreach program in 2019 as required by the State of California Department of Parks and Recreation to apply for its Proposition 68 Statewide Park Program. The City submitted two applications. The State notified the City of Gustine in February 2020 that it awarded $1.3 million to the City to fund the complete renovation of Pioneer Park. The City received funding as one of 62 projects funded out of 478 applications for that round of competitive funding.
The approved scope included leveling the site and constructing: a full-court basketball court, a splash pad, a playground with equipment for children of all ages up to 12- years-old, a free-play area, two smaller picnic areas with cover and shared large grill, and updated fence around the entire park.
By the time the City received the contract provision document for review from the State at the end of March 2020, the nation was shutting down due to COVID. The pandemic stopped production of non-essential materials and work-including park projects. When production and construction projects resumed slowly, costs went up significantly. Due to varying economic factors, these costs have only continued to climb and recent inflation has exacerbated the pandemic increases.
The City of Gustine, unlike some larger cities issued the same award, has fewer potential sources to fund cost increases over the original budget. Since accepting the award, City staff has consistently pursued avenues to try and secure the additional funding to cover unavoidable increases. During that time, costs have also continued to only climb.
Staff had indications several times that the additional funds were forthcoming, only to have each funding opportunity end.
Most recently, the pending federal appropriation bill had funds for the City of Gustine to complete this project in full. The appropriation came through the Congressionally Directed Spending process. Changes in administration and developments taking place in Washington DC ended that appropriations bill on March 14, 2025. The nearly $1Million for the City of Gustine for Pioneer Park that was in the bill is not forthcoming. Staff knows of no other potential outside funding sources for the project.
Per the Parks grant, the complete rehabilitation of Pioneer Park must be complete and open to the public no later than March 2028. State Parks already extended the deadline for these projects to the current deadline and representatives have indicated no additional extensions are expected for these funds.
In positive news, State Parks recently relaxed its requirements for the City to substantially alter the project. While Parks representatives previously advised the City would have to
conduct the same significant public outreach efforts done to develop the project, the office recently relayed a more realistic path for the City to eliminate features and substantially change the project from that outlined in the 2019 budget approved.
DISCUSSION
Without additional CDS funding, there are three alternatives the Council could take to implement the State Parks Pioneer Park grant going forward:
1. Attempt to reduce the cost to only the funding amount provided by the State.
The challenge with this path exclusively is that the basic costs to level the existing park and rebuild take a significant amount of the budget on their own. Budgets are being updated to present to Council with analysis in future meetings.
2. Utilize City funds from other sources for the project.
The challenge here is limited funding opportunities. The Council needs to advise its desire to even consider other funds, which may or may not include the City Utility Users Fund, to help fund part of the Pioneer Park project as it sees fit.
3. Attempt to secure other non-City funding sources for the project.
Staff cautions Council this is not likely a realistic option, due to the required project deadline. Staff has devoted significant time seeking alternative funding for this project through various sources since 2020. Inquiries and applications move slowly and staff has found no other viable, potential sources to apply to.
While staff advises that option #3 does not appear feasible, both option # 1 and #2 are - and they are not mutually exclusive. Staff could bring back to Council options that both significantly reduce costs and identify options for funding certain portions from other City funds - if this is something the Council wishes to consider.
The intent of this item is seek direction from Council on the project, given the current situation, so that staff can direct efforts towards the options the Council would like to consider to implement this grant funding.
To significantly alter the project, which is necessary with option one, two or any combination thereof, the State requires the City to conduct public outreach. Once Council has provided direction, staff will develop options for the Council to consider for action at a later meeting and notify the public per State requirements.
RECOMMENDATION
City Council to discuss the Pioneer Park Grant and provide staff direction for follow up.

ITEM NO. 7
COUNCIL AGENDA ITEM
APRIL 1, 2025
PREPARED BY: Ruben Chavez, Chief of Police
SUBJECT: Gustine Municipal Code Section 7-6-10(a)- Illegal Fireworks Fine Structure and Social Host Ordinance Discussion and Direction BACKGROUND/DISCUSSION:
On November 3, 2015 Council waived the second reading and approved an ordinance replacing Title 7, Chapter 6 pertaining to Firework rules and regulations. The updated ordinance reflected Councils stance on a Zero Tolerance Policy for those possessing or using illegal fireworks and established fine limits for violations. The ordinance increased the fine to a maximum of $1,000 per violation.
While many municipalities across California have passed ordinances with similar fine limits, several have passed ordinances where violations and subsequent violations would result in significantly higher fine amounts. The premise of a higher fine structure, especially for repeat offenders, is that it would create a more tailored deterrent effect and discourages recidivism. Below are a few examples of municipalities with higher fine structures.
Municipality 1·+ Violation Fine 2n Violation Fine 3 Violation Fine City of Modesto $2,000 $3,000 $4,000
City of Visalia $2,000 $3,000 $4,000
City of Carson $2,000 $3,000 $5,000
City of Bellflower $2,000 $3,000 $5,000
City of Fontana $2,500 Up To $10,000 Up To $10,000
While these fines are administrative in nature, each violation can additionally result in criminal penalties. Health and Safety Code Section 12700 -- Possession of Dangerous Fireworks can result in a fine between $500 to $1,000 and/or one year in jail. This fine limit is set by statute and cannot be modified.
Gustine's Current Illegal Fireworks Ordinance
GMS Sec. 7-6-8 states:
Any person violating any of the provisions of this Chapter shall be guilty of a misdemeanor and, upon conviction thereon, shall be punishable by a fine of not more than one thousand dollars ($1,000), imprisonment for a term not exceeding six months or both such fine and imprisonment.
GMC Sec. 7-6-10 states:
In addition to any other remedy available at law, any person or entity who possesses, uses, stores, sells and/or displays dangerous fireworks or any person or
entity who possesses, uses, sells and/or displays Safe and Sane Fireworks on or at dates, times or locations other than those permitted by this Chapter are subject to an administrative fine of not more than one thousand dollars ($1,000).
In addition to the fines, several municipalities in California have adopted Resolutions approving a Social Host Ordinance. These cities include Stockton, Pacifica, Suisun City, San Jose, as well as Sacramento County. A Social Host Ordinance allows property owners to be held liable for the use or storage of illegal fireworks on private property.
At their meeting in October 20, 2015 Council meeting, when considering the City's current ordinance, Council directed staff to delete the "Social Host" portion of the ordinance.
City of Stockton Social Host Ordinance:
A social host is defined in proposed subsection 8.92.01 0(L) as anyone either "in charge of property" (including owners, tenants, landlords, and property managers) or anyone in charge of an activity on a property. These social hosts would be responsible for illegal firework activity which occurs on their property or at their events.
City of Pacifica Social Host Ordinance:
In 2017, the Pacifica City Council adopted the Illegal Fireworks Social Host Ordinance in an attempt to curb the rampant use of illegal fireworks in Pacifica. This ordinance was designed to hold responsible those hosting gatherings for any illegal firework activity on property they own or rent. If officers see illegal fireworks being discharged from a property, the person responsible for the property will be subject to a fine, regardless of who discharged the firework. The penalty for a violation of the Illegal Fireworks Social Host Ordinance is $1,000.
Gustine's Current Special Provision:
Sec. 7-6-11. - Enforcement-Special provisions.
(a) A minor and the parent(s) or guardian(s) having custody and control of said minor, are jointly and severally liable to the city for any administrative citation and/ or penalty issued for failure to appear to comply with the provisions of this chapter.
(b) Provided that the violation occurs at real property owned, leased or otherwise resided in by the violator, any administrative citation/fine issued for a violation of this chapter may become a special assessment or a lien against the property of any person who is issued a citation for a violation of the provisions of this chapter. This shall include the property of a minor who is issued a citation and/or the property of the parent(s) or guardian(s) having custody of the minor or private property owner that allows the illegal use or storage on their property.
The procedures set forth in section 3-2-26 shall be followed for the imposition of a special assessment or lien.
(c) Without limiting any other applicable remedies, any nonprofit organization which is granted a fireworks sales stand permit, and which for any reason fails to exercise the permit by the operation of the stand in accordance with the conditions of the permit, shall forfeit the right to a permit for the succeeding year.
Any nonprofit organization may appeal any determination under this subsection in the same manner as a decision related to the issuance of a permit under section 7-6-6.
The City's current special provision requires a host to knowingly allow the illegal use or storage of illegal fireworks on the property to be culpable of this section. While a Social Host ordinance allows enforcement for merely being the host of an activity where illegal fireworks are used or stored regardless of who committed the act(s).
The Gustine Police Department continues to deploy marked and unmarked patrols for those in possession of and/or using illegal fireworks during peak firework seasons. The goal of keeping our community safe is of the highest priority, especially as it pertains to injury and fire. Since this ordinance was incorporated nearly a decade ago, staff desires to bring this topic to the dais for Council's discussion as we have seen an increase in illegal firework activities within the community.
FISCAL IMPACT
There is no fiscal impact resulting from this item, however increased revenue will allow for increased education and outreach in illegal firework prevention.
RECOMMENDATION
Staff recommends the Council hold public comment and discussion to provide staff with direction on next steps.
