ITEM NO. 8

COUNCIL AGENDA ITEM
JULY 1, 2025
PREPARED BY: Soknirorn Than, City Manager
SUBJECT: Employee Contracts for Economic & Community Development Director, Recreation Manager, and Administrative Services Director, and Contract Amendments for Chief of Police and Public Works Utilities Project Consultant
STRATEGIC PLAN GOALS: 6. Community Services

BACKGROUND
The City engages certain classifications through employment contracts, as opposed to through a collective bargaining agreement. Contracted employees are generally with those classifications that are deemed exempt in accordance with the regulations imposed by the Department of Industrial Relations.

ANALYSIS/DISCUSSION
Employee contracts between the City and its Chief of Police, Economic & Community Development Director, Recreation Manager, Administrative Services Director, and PW Utilities Project Consultant were set to expire on June 30, 2025. As such, staff engaged in the negotiations process with those employees. As a result of those negotiations, staff has developed new three-year contracts for Economic & Community Development Director, Recreation Manager, and Administrative Services Director; and one-year contract amendments to the Chief of Police and PW Utilities Project Consultant. The contracts and amendments are attached to this staff report as exhibits.

COMMUNITY OUTREACH
Not applicable.

FISCAL IMPACT
As negotiations began prior to the FY26 budget adoption, fiscal impacts associated with the contracts and amendments have been accounted for within the adopted FY 25/26 financial budget. Employee salary and additional stipends are allocated across each classification's payroll split.

STRATEGIC PLAN GOALS
This item aligns with Strategic Plan Goal #6 Community Services, objective 2, maintain current level of staff-provided public services.

RECOMMENDATION
Staff recommends City Council adopt a resolution approving the following:

Employment Agreement between City of Gustine and Economic & Community

SUBJECT: National Night Out & Back to School Night Street Closure STRATEGIC PLAN GOALS: 1. Enhanced Community Policing

BACKGROUND
National Night Out is celebrated throughout the U.S. on the first Tuesday in August and was created to enhance the relationship between community members and law enforcement while embracing a true sense of community. The spirit of National Night Out is to get out and get to know your neighbors.

ANALYSIS/DISCUSSION
The Police Department, along with the Recreation Department, is requesting to hold the City's 4 Annual National Night Out event on Tuesday, August 5, 2025. This event will be in conjunction with the Back to School Movie Night event being planned at the Aquatics Center. Organizations will line the sidewalk area along 3 Ave under the solar panels to hand out school supplies. On the other side of the street the Police and Fire Departments will have their vehicles on display for tours and will hand out school supplies and other goodies to share with the community. Event organizers are planning to include one or two food vendors, as well as serve free hot dogs and chips to children attending the event. City staff will ensure that all applicable County health and safety requirements are met. The event will be from 5:00 PM until 7:00 PM. The Aquatics Center will open at 7:00 PM for the Movie Night.

Staff is requesting Council's approval to close 3 Ave between 6 Street and the alley west of the Fire Department to allow patrons to walk safely throughout the event. Staff is asking for the street to be closed from 4:00 PM until 7:30 PM to allow for setup and cleanup. "No Parking" signs will be placed in the appropriate areas for the event.

According to the Gustine Municipal Code Section 5-6-3, mobile kitchen type vendors are only allowed in manufacturing districts, except otherwise by special permission of the City Council during festivals, parades and other public events. If approved, staff will ensure that proper permits and licenses are obtained. The Recreation Department will submit the proper paperwork to Merced County Environmental Health Department to obtain the appropriate health permits for the event and vendors.

COMMUNITY OUTREACH
The event will be advertised on all social media platforms.

Page 61 of 118 ends

STRATEGIC PLAN GOALS
The program offers a great opportunity to interact with our community and truly display a sense of community policing. Across the country, this is considered a flagship event for police agencies to meet directly with community members and discuss solutions to reduce criminal activities in our neighborhoods. This item aligns with Strategic Goal #1, objective 1 increase youth involvement.

COUNCIL AGENDA ITEM
JULY 1, 2025
PREPARED BY: Soknirorn Than, City Manager
SUBJECT: Resolution Approving Contract Amendment with Best, Best & Krieger, and Authorizing City Manager to Execute Amendment STRATEGIC PLAN GOALS: 4. Financial and Budget Stability

BACKGROUND
Since July 7, 2015, the City has entered into an agreement for City Attorney services with Best Best & Krieger LLP (BB&K). At their regular meeting on June 17, 2025, the City Council appointed Olivia Clark as City Attorney.

The role of the City Attorney is to advise and represent the City Council, City Manager and all other City staff in legal matters related to the City. The City Attorney attends all meetings of the City Council and other boards and commissions when needed.

In recent months it has become more common for the City Attorney to attend City Council meeting virtually when appropriate.

ANALYSIS/DISCUSSION
Considering the changes resulting from Council's recent appointment, and those resulting from the City's recent Attorney meeting attendance practice, staff held discussions with BB&K related to the City's contract and monthly retainer fee.

As a result of those discussions, BB&K proposed lowering the City's monthly retainer amount to $7,500 to accommodate the new City Attorney appointment and an updated hour allocation. BB&K further proposed offering the City a credit of $125 for each regular City Council meeting not attended.

COMMUNITY OUTREACH
Not applicable.

FISCAL IMPACT
Strictly based on retainer alone, the City stands to benefit by $1,814 savings per month.

STRATEGIC PLAN GOALS
This item aligns with Strategic Goal #4, objective 4, live within our means.

ITEM NO. 12

COUNCIL AGENDA ITEM
JULY 1, 2025
PREPARED BY: Soknirorn Than, City Manager
SUBJECT: Cancellation of Regular City Council Meeting Scheduled for August 5, 2025 Due to Summer Recess
STRATEGIC PLAN GOALS: 6. Community Services

BACKGROUND
The City Council has been in continuous session since January. During this time, Council members and staff have actively participated in negotiations, deliberations, community engagement, and policy-making efforts critical to the City's governance. The workload and responsibilities inherent in these activities necessitate a period for both staff and Council members to transition into a new fiscal year and implement new programs and policies set under the new budget.

ANALYSIS/DISCUSSION
The purpose of a recess is to allow Council members to spend dedicated time with constituents and address local issues. This recess also provides an opportunity for Council and staff to catch up on administrative tasks and prepare for upcoming sessions.

Specifically, for this Fiscal Year (FY 26), there are significant updates related to financial administration, bargaining group negotiations, and projects. Secondly, staff is also working on closing out Fiscal Year 2025, which involves various account reconciliations, adjustments, and reporting.

The proposed recess is recommended for the first regular Council meeting in August (8/5/2025), selected to minimize disruption to scheduled Council activities while providing time for Council members and staff to focus on community needs.

During this period, City services will continue as normal. Administrative staff will remain available to handle routine inquiries and urgent matters. Precautions will be taken to ensure that any time-sensitive legislative or regulatory actions are addressed appropriately before the recess begins.

COMMUNITY OUTREACH
Not applicable.

FISCAL IMPACT
There is no fiscal impact to this action.

ITEM NO. 13

COUNCIL AGENDA ITEM
JULY 1, 2025
PREPARED BY: Tiffany Vitorino, Recreation Manager
SUBJECT: DISCUSSION AND DIRECTION: Special Event Policy and Procedure STRATEGIC PLAN GOALS: 6. Community Services

BACKGROUND
The City of Gustine is widely recognized for its many annual special community events planned by both the Recreation Department and various community organizations.

Special events are defined as one-time or infrequent gatherings outside normal programs or activities, often sponsored by various organizations or businesses. These events can impact the community by affecting traffic patterns, increasing noise levels, and requiring City resources for coordination and oversight.

ANALYSIS
To ensure proper coordination of City services and compliance with regulatory requirements, the City has historically required event organizers to obtain necessary approvals and permits from various agencies, including Merced County and the California Department of Alcoholic Beverage Control (ABC). Merced County Environmental Health informed City staff that all events within City limits that serve food to the community-excluding private, invitation-only events such as weddings-must go through the Merced County health permit process. As part of this process, event organizers must obtain a letter from the City acknowledging the event. To issue this letter, the City must first confirm that the special event complies with all City, County, and State regulations.

This information, along with an initial draft of the Special Event Policy, was first presented to the City Council on February 20, 2024. During this meeting, the Council directed staff to revise the policy to better differentiate between small and large events. Specifically, the Council requested that minor events not be subjected to the same level of requirements as major events and that the application for smaller events be simplified.

Additionally, Council recommended forming an Ad Hoc Committee to assist in refining and further developing the policy.

On March 19, 2024, Council formally established an Ad Hoc Committee comprising of two Council members. City staff invited special event organizers to join the meetings and provide input along the way. The committee was tasked with refining the proposed policy to ensure it met the needs of both the City and event organizers. Over the course of three meetings, the committee reviewed the policy in detail. At the final meeting, event organizers actively participated in suggesting revisions, which were incorporated into this draft policy.

Page 75 of 118 ends

In response to complex nature of various regulatory requirements and the need for a formalized approach to special event approvals, staff has revised a Special Event Policy aimed at streamlining processes, improving coordination, and ensuring compliance with local, county, and state requirements. The policy includes the following key elements:

1. Special Event Application Requirement
•
•
•
•
•
Event organizers must complete a Special Event Application detailing the event's scope, needs, and potential impacts.

The application will facilitate coordination of City services such as street closures, public safety, and other logistical requirements.

Organizers will be asked a series of questions, with relevant sections of the policy referenced to assist them. For example, if alcohol will be available or sold, the application will direct them to the appropriate section of the policy regarding Alcoholic Beverage Control (ABC) permits.

A simplified application process is available for minor events that meet all of the below criteria:
a) There is no Special Event ABC license required
b) There is no street closure or impact to the public right of way c) There is no more than one food vendor
Special Event Permit is not required for the following:
a) Funeral processions
b) Private gathering within a private property that is in compliance with the City Municipal Code.
c) Garage Sales (Separate Permit Required at ww.cityofgustine.com) d) Private/ticketed events inside a permitted use facility

2. Fee Structure for Special Events
•
•
Staff recommends implementing an application fee to help offset the costs of coordinating and managing special events
o $XX for minor events (e.g., indoor open houses, mixers, takeout fundraisers) that have minimal impact on traffic, public right-of-way, and city resources.
o $XX for major events (e.g. large outdoor festivals, parades, car shows) that require street closures, noise considerations, and significant city involvement.

Staffing charges are currently outlined in the City's Regulatory Fee Schedule .

Event organizers will be billed the appropriate cost-recovery amounts. Organizers may request fee waivers in advance; however, staff will track and document all waiver amounts for record-keeping purposes.

3. Other Requirements
Although not every section of the special event policy will apply to every event, staff, in cooperation with the Ad Hoc Committee and stake holders, develops a comprehensive procedure to address all the common topics that came up in the past. These includes:

A. Purpose
B. Definition
C. Event Liaison
D. Application Process
E. General Requirements

Page 76 of 118 ends

F. Insurance Requirements
G. Other Agency Approval
H. Permit Fees
I. Event Advertising
J. Music -- Public Address {Pa) Systems
K. Bounce Houses/Play Structures
L. Sales of Goods & Services
M. Alcoholic Beverages
N. Carnival, Fair or Circus

0. Road Closures
P. Restrooms
Q. Refuse and Dumpsters
R. Site Preparations & Security
S. Misc.

T. Indemnity

COMMUNITY OUTREACH
Should the proposed policy be approved, staff will conduct outreach efforts to inform individuals and organizations that have hosted special events in the City within the last two years.

The City will work closely with event organizers to ensure a smooth transition to the new policy and compliance with all requirements.

FISCAL IMPACT
There is no fiscal impact associated with this item, as it is for discussion and direction.

However, considering adoption of proposed application fees would generate additional revenue for the City's General Fund {Fund 001 ), helping to recover staff time and resources spent coordinating special events. If a fee waiver is requested, it will be presented to the City Council for consideration and approval.

STRATEGIC PLAN GOALS
Special events fall under plan goal Community Service #6, objective 5, actively engaging with the community. Special events provide a positive experience for residents to engage within their community.

RECOMMENDATION
Staff recommends that the City Council hold discussion and provide direction on next steps for the Special Events Policy.
