ITEM NO. 5
COUNCIL AGENDA ITEM
SEPTEMBER 16, 2025
PREPARED BY: Melanie Correa, Administrative Services Director SUBJECT: Establish Utilities Maintenance Worker Classification and Approve Job Description
STRATEGIC PLAN GOALS: 6. Community Services
BACKGROUND/DISCUSSION
During labor group negotiations earlier this year between the City and the Gustine Public Works Association, the City proposed the establishment of a new Public Works job classification entitled Utility Maintenance Worker. The creation of this classification is intended to compartmentalize and expand the organizational structure of the Public Works Department by ensuring that both the utility division and the community services division are staffed with personnel possessing the appropriate specialized skills. This delineation of responsibilities will promote greater operational efficiency, enhance the delivery of municipal services, and support the long-term sustainability and reliability of the City's infrastructure.
The new classification would require the following certifications:
- Valid Class B Driver's License with tanker endorsement within six (6) months of employment, in addition to possessing a valid Class C Driver's License at time of hire.
- California Water Distribution (D1) certification within eighteen (18) months of hire. - Water Treatment Operator (Tl) certification within eighteen ( 18) month of hire.
During labor negotiations it was agreed that once the new classification was established, an internal recruitment would be conducted to fill two Utility Maintenance Worker positions, which in turn would reduce the number of positions within the "Maintenance Worker" classification, updating the approved FY 25-26 City Elected Officials and Staff list as per the attached Exhibit B. Applying for the internal recruitment would be limited to those employees currently within the full time Maintenance Worker classification. The bargaining group also reviewed and accepted the proposed job description presented as Exhibit A.
COMMUNITY OUTREACH
None.
FISCAL IMPACT
There is no fiscal impact associated with approving the job description.
The Utilities Maintenance Worker classification salary range would be set at 6% above the current Maintenance Worker salary range to align with the negotiated certification pay within the Gustine Public Works Association Memorandum of Understanding. A subsequent item on the consent agenda addresses updating the City's Annual Salary Schedule.
STRATEGIC PLAN GOALS
This item aligns with Goal #6 -Community Services, objective 2, maintain current level of staff to ensure public services are consistent.
RECOMMENDATION
Council establish the Utilities Maintenance Worker Classification and approve the job description as proposed.

COUNCIL AGENDA ITEM
SEPTEMBER 16, 2025
PREPARED BY: Melanie Correa, Administrative Services Director SUBJECT: Approved Updated Maintenance Worker Job Description STRATEGIC PLAN GOALS: 6. Community Services
BACKGROUND/DISCUSSION
During labor group negotiations earlier this year between the City and the Gustine Public Works Association, the City proposed to amend the existing Maintenance Worker job description to include a requirement for employees hired in this designation after a certain date to obtain a valid Class B Driver's License designation with tanker endorsement within six (6) months of date of hire and maintain a current OMV medical card. The bargaining group agreed to the proposed job description update.
Previously, this classification did not require employees to hold this license designation, although through the negotiated Memorandum of Understanding (MOU) with the Gustine Public Works Association (GPWA), the City compensates employees in the group with a per-pay period stipend for holding the extra license designation.
A Class B designation is critical to the effective operation of the Public Works Department because several of the vehicles and pieces of equipment necessary for utility, street, and park maintenance-such as the City's dump truck, Vac-Con truck, and Street Sweeper-require a Class B license to operate legally.
Beginning last fiscal year, the City implemented a training schedule to send department employees to a local truck school to obtain the required training to successfully pass the required OMV test to secure the specialized license designation.
The first two department employees sent to training are testing with OMV this month.
The FY26 budget includes funding for the remaining full-time employees to attend training school to ultimately obtain the license designation.
By ensuring that Maintenance Workers hold this designation, the City will increase operational flexibility by enabling a broader pool of staff to safely and legally operate heavy vehicles when needed. This requirement will also reduce scheduling bottlenecks, minimize delays in project completion, and enhance the Department's ability to respond to emergencies. Further, aligning job qualifications with operational needs ensures compliance with state and federal regulations governing the safe operation of commercial vehicles.
The modification, highlighted in red text on the job description attached to this report as Exhibit A, mandates that full-time employees hired on or after July 1, 2025 be required to obtain the license designation within the classification's probationary period (first six (6) months of employment).
COMMUNITY OUTREACH
None.
FISCAL IMPACT
There is no fiscal impact associated with approving the updated job description.
Once bargaining group members obtain the license designation, they will earn an additional $1,950 per year, earned at $75 per-pay period, as per the GPWA MOU.
STRATEGIC PLAN GOALS
This item aligns with Goal #6 -Community Services, objective 2, maintain current level of staff to ensure public services are consistent.
RECOMMENDATION
Council approve the updated Maintenance Worker job description as proposed.

ITEM NO. 9
COUNCIL AGENDA ITEM
SEPTEMBER 16, 2025
PREPARED BY: Gary Ingram, Public Works Director
SUBJECT: Purchase of One (1) New Trailer Mounted Falcon 4-Ton Hot Box Combo
STRATEGIC PLAN GOALS: 5. Robust Infrastructure
BACKGROUND
The City of Gustine maintains an extensive network of streets that require regular maintenance to ensure safe and reliable transportation for residents, businesses, and visitors.
Currently, asphalt patch work is performed using a cold mix product, which is less durable and results in temporary repairs. This often leads to recurring potholes, inefficiencies in staff time, and higher long-term costs.
A trailer-mounted asphalt hot box and recycler has been identified as a critical piece of equipment to support long-term road maintenance operations. The purchase was identified as a priority in the 5 Year CIP and was subsequently included in the City's approved Capital Improvement Project (CIP) list with an allocated budget of $80,000.00 for Fiscal Year 2025-2026.
Additionally, a trailer mounted hot box will allow staff to transport and maintain hot asphalt at the required temperature for an extended period, enabling more effective and longer-lasting street repairs. This equipment features a built-in temperaturecontrolled tack-coat storage tank and applicator, hydraulic dump trailer, and mechanical crane for asphalt compactor. In compliance with the Air Resource Board, this unit utilizes propane burner rather than diesel. This equipment is trailer-mounted for easy maneuverability and versatile deployment across the City. This unit is also compatible with cold mix asphalt. This will allow for shorter wait time and deliver a more workable products for repair works.
To obtain bids for this equipment, the City utilizes a cooperative purchasing agreement with Sourcewell. Sourcewell is a national cooperative purchasing organization that establishes competitively solicited contracts on behalf of its members, including local governments. By utilizing Sourcewell contracts, the City can purchase goods and services without conducting its own full-scale competitive bid process, because Sourcewell has already met the statutory requirements for competitive bidding.
ANALYSIS/DISCUSSION
The City of Gustine Public Works Department is requesting authorization to purchase
one (1) new trailer mounted Falcon 4-Ton Hot Box Combo. This equipment will provide the City with the ability to efficiently store and transport hot asphalt for use in road patching and maintenance operations. The Sourcewell price, issued from Haaker Equipment is $62,492.00, plus $6,000.00 for freight, with sales tax of $5,650.59, for a total cost of $74,142.59.
FISCAL IMPACT
The total cost of $74,142.59 will be funded through the approved Capital Improvements budget under the Gas Tax 2106 (Fund 011 ). There is $80,000 budgeted for this purchase.
STRATEGIC PLAN GOALS
This purchase supports the City's Strategic Goal of Robust Infrastructure by improving the quality, safety, and sustainability of the community's roadways.
RECOMMENDATION
Staff recommends that the City Council adopt a resolution authorizing the purchase of one (1) trailer mounted Falcon 4-Ton Hot Box Combo from Haaker Equipment at a total cost of $74,142.59; and authorize the City Manager, or designee, to execute all necessary purchasing documents.

ITEM NO. 10
COUNCIL AGENDA ITEM
SEPTEMBER 16, 2025
PREPARED BY: Ruben Chavez, Chief of Police
SUBJECT: Council to Approve City Manager to Enter into Agreement for Reinstatement of the Animal Services Contract with the County of Merced
STRATEGIC PLAN GOALS 6. Community Services:
BACKGROUND/DISCUSSION
On July 1, 2019, the City of Gustine and County of Merced entered into a 5-year agreement to provide animal services at their shelter in Atwater (Contract #2020103).
The original contract expired June 20, 2024 at which time the City and County approved Amendment 1 for one year with no changes to the agreement.
The Amendment expired June 30, 2025 at which time a new contract was proposed which included additional service charges the City had not yet budgeted. After discussion, the County agreed to reinstate the terms of the original contract until June 30, 2026, giving the City time to work on a long term plan for animal services.
The services provided are mostly for stray animals when the City is unable to locate the owner(s) or when rescue groups are at capacity. Through the City's social media platforms and publications such as City Snippets newsletter, the City has promoted responsible pet ownership. We encourage licensing, vaccination, spaying/neutering, and chipping the pets that reside in the City.
COMMUNITY OUTREACH
None.
FISCAL IMPACT
Historical data reveals that on average, the City utilizes the County's services approximately 15 to 20 times a year. The financial impact to the City varies annually; however, the average service cost to care for one animal add the facility is $85.00 per animal for the first 4 days of housing.
STRATEGIC PLAN GOALS
This contract reinstatement provides a resource to the City when no other options are available to house stray animals from our community, thereby maintaining the quality of life for residents of our community.
RECOMMENDATION
It is recommended the City Council approve the resolution authorizing the City Manager to enter into agreement to reinstate Contract #2020 l 03 between the City and County extending the terms of the agreement through June 30, 2026.

ITEM NO. 11
COUNCIL AGENDA ITEM
SEPTEMBER 16, 2025
PREPARED BY: Soknirorn Than, City Manager
Richard Martin, Fire Chief
SUBJECT: Council Adopt Resolution Approving New Fire Hazard Severity Zone as Required per Government Code Section 51175
STRATEGIC PLAN GOALS: 6. Community Services
BACKGROUND/DISCUSSION
The Fire Hazard Severity Zones (FHSZs) in California are rooted in hard lessons from devastating wildfires. One major catalyst was the 1991 Oakland Hills Firestorm-also known as the Tunnel Fire-that galvanized legislative action. That blaze killed 25 people and consumed more than 3,000 structures in a densely populated area. In response, Assembly Bill 337 (the Bates Bill) was passed in 1992, mandating CAL FIRE to evaluate fire hazards in Local Responsibility Areas (LRAs) and recommend mitigation strategies.
The zone is then split into Local Responsibility Areas (LRAs). These areas include regions such as incorporated cities, urban zones, agricultural lands, and parts of the desert where wildfire protection fall under the jurisdiction of local governments. The designation of Fire Hazard Severity Zones (FHSZs) within LRAs began following Assembly Bill 337 in 1992. This legislation tasked CAL FIRE with evaluating fire hazards and recommending actions to local jurisdictions where various FHSZs are identified, as outlined in Government Code 51175.
To determine FHSZs in LRAs, CAL FIRE extends its State Responsibility Area hazard model to assess risks based on factors like flame and ember intrusion from nearby wildlands and flammable vegetation within urban areas. These evaluations help classify areas into High or Very High hazard zones, guiding local governments in implementing appropriate safety measures. The designation plays a critical role in shaping building regulations and fire prevention strategies tailored to each community's unique risk profile.
Properties in High and Very High FHSZs within LRAs must comply with California's Wildland-Urban Interface (WUI) building codes, specifically CBC Chapter 7 A, which governs the design and construction of new buildings. Local ordinances may also require ignition-resistant materials for remodels. Additionally, Government Code Section 51182 mandates a 100-foot defensible space clearance around structures. Property owners must disclose natural hazards during real estate transactions and are encouraged to follow best practices for home hardening and vegetation management.
For Gustine, a portion of the Gustine Municipal Airport is the only identified area that is considered to be in a moderate FHSZ. This area is currently maintained by the City Public Works Department and has an implementation plan in place for fire prevention.
COMMUNITY OUTREACH
The draft Fire Hazard Severity Zones were published on the City's website and were advertised through our social media accounts for public comment since March, 2025.
To-date no comments has been received. Once adopted, the map will also be incorporated in the updated Safety Element.
FISCAL IMPACT
There is no fiscal impact for this action. Fire prevention actions have been in place and will continue through normal operations.
STRATEGIC PLAN GOALS
This action falls under Strategic Goal No. 6 Objective 1, ensuring accessibility to services while creating strategic plan for disaster response and mitigation.

ITEM NO. 12
COUNCIL AGENDA ITEM
SEPTEMBER 16, 2025
PREPARED BY: Jami Westervelt, Economic & Community Development Director Gary Ingram, Public Works Director
SUBJECT: OWR4 CalRecycle Grant Purchase of Compost Spreader and Budget Amendment
STRATEGIC PLAN GOALS: 5. Robust Infrastructure
BACKGROUND
At the end of 2023, the City applied for and received $75,000 in a second SB 1383 grant from CalRecycle under the Local Assistance Grant Program (OWR). This grant, OWR4, followed its previous OWR2 funding round. The City completed and closed out OWR2 on time and within budget. Only funds remain in OWR4 at this time.
The OWR grants provide the City funding for items that otherwise would be unfunded state mandates related to solid waste. Although the City has a low-population waiver to portions of SB 1383, there are still portions of this law, and the legislation preceding that the City must adhere to that bring unfunded implementation costs.
The City OWR2 grant funded the following:
• Procurement of organic and recycled-content materials at State-mandated annual levels through last federal fiscal year
• Purchase of a skid steer (a portion from OWR2 and a portion from OWR4) • Two collection containers for organic materials (spending final $312 in OWR2) Of the original $75,000 OWR4 grant, the City spent $44,529.59 to pay for a portion of the Skid Steer as approved by Council, leaving $30,470.41 now remaining in the grant.
Staff had initially intended to use a portion of the remainder of the OWR4 funds to meets its annual mandate to purchase organic materials slated to escalate annually.
However, CalRecycle announced in April 2025 a change to procurement targets, reducing the target to for cities with SB 1383 low-population waivers. Staff requested confirmation of the timeframe for the change as part of its annual meeting with the agency recently and on August 27 received an email stating that the City of Gustine annual procurement target through 2030 will remain zero.
ANALYSIS/DISCUSSION
Removal of the organic materials purchasing requirement frees up funding in the OWR4 budget to the extent that the City has enough remaining funds to purchase a compost spreader. CalRecycle has already confirmed in writing the purchase is allowable under OWR4 funds and approved a budget change request submitted by the City and
required by the agency prior to purchase that includes the spreader and containers.
Attached as Exhibit B are specifications and an estimate for the compost spreader. The Public Works Director selected the equipment and obtained the quote from Sourcewell.
Sourcewell is one of the cooperative purchasing organizations the City belongs to that does the work of soliciting multiple bids for purchases, providing the City with the lowest pricing and fulfilling the multiple-source due diligence required.
If Council approves purchase of the compost spreader, the City will have just over $ l 0,000 remaining in funding on this grant. The budget revision approved by CalRecycle reflects the staff recommendation to allocate these funds to purchase of allowable bins. The purchase cannot include trash cans, but can include purchase of the bins for recovery of all types of recyclable and organic materials.
Internally, staff is discussing options to stretch this funding as far as possible and determine the right containers for the right locations. The funds can pay for containers at City-owned facilities, downtown, City parks, etc., as long as they are clearly marked as organics and recyclables and do not include trash receptacles. Prior to purchase, staff will send information on the desired containers to CalRecycle for approval.
The City is in the final year for this grant and final expenditures must be made by March.
Approval of the attached Resolution will provide approval of these items and allow sufficient time to purchase and make the final report on the grant to CalRecycle. The Resolution authorizes the purchases of the compost spreader as well as the allowable containers under the OWR4 grant and within grant amount.
COMMUNITY OUTREACH
None related to this item.
FISCAL IMPACT
Utilizing the remainder of CalRecycle OWR4 grants as described above allows the City to purchase equipment and containers that the City otherwise has not been able to fund. The Council needs to appropriate the remaining $30,470.41 of the OWR4 grant in the current budget year in expenditures and revenue, which will include the equipment and container purchases. This will allow staff to spend all the available funds from CalRecycle with a potentially very small amount of City funding.
STRATEGIC PLAN GOALS
The primary purchase under this item is the compost spreader and it will allow Public Works to more efficiently spread compost that can be important to the maintenance of green spaces and our parks. This action is most akin to Objective 1-implement a preventative maintenance program-under Strategic Goal 5: Robust Infrastructure.
RECOMMENDATION
Staff recommends that the Council adopt a resolution to:
1 . Approve the purchase of the compost spreader equipment through Sourcewell and organics and recyclable material containers in compliance with CalRecycle grant requirements.
2. Amend Fiscal Year 2025-2026 by appropriating an additional $30,770.41 in the current budget year for expenditures and revenues related to the OWR4 grant.

The last EOP was adopted by City Council on February 21, 2017 by Resolution 2017- 2382. Since then, there have been numerous updates to the FEMA guidelines Version
3.0 and the State Emergency Plan best practices.
The updated EOP was developed collaboratively with input from public safety departments, administrative leadership, and regional emergency partners. It incorporates lessons learned from recent incidents and integrates new protocols for continuity of operations, mutual aid coordination, and public communication.
For this comprehensive update, the EOP establishes a scalable emergency management structure and clearly defines roles, responsibilities, and protocols across all phases of emergency operations:
1. Activation & Authority
- May be activated by the Director or Deputy Director of Emergency Services under City Code Title 7, Chapter 4
- Automatically activated under state or federal emergency declarations - Once adopted, becomes an extension of the State and County EOPs
2. Operational Framework
Defines field-level Incident Command and EOC-level coordination Includes continuity of government protocols, disaster service worker roles, and succession planning
Integrates SEMS/NIMS principles, mutual aid coordination, and public-private partnerships
3. Hazard & Capability Assessment
Identifies natural, technological, and human-caused threats
Includes mitigation strategies from the City's Local Hazard Mitigation Plan and General Plan Safety Element
- Assesses current capabilities and outlines resource gaps addressed through Merced County's THIRA
4. Comprehensive Response
Prioritizes access and functional needs
- Includes annexes for sheltering, mass care, public health, and emergency public information
Emphasizes community preparedness, volunteer coordination, and business continuity
5. Training & Maintenance
- Requires annual review and biennial updates
- Supports exercises aligned with Homeland Security Exercise and Evaluation Program (HSEEP)
Establishes documentation, finance, and logistics protocols for cost recovery and resource tracking
