COUNCIL AGENDA ITEM
NOVEMBER 18, 2025
PREPARED BY: Mario Gouveia, City Engineer
SUBJECT: Adopt the AB 1012 "Timely Use of Funding" Resolution for Congestion Mitigation Air Quality - 2025 Infill Sidewalk Improvements Project
BACKGROUND/DISCUSSION
The Merced County Association of Governments (MCAG) initiated a Call for Projects on August 22, 2025. MCAG is in the process of programming $8 million in future federal funds for the Congestion Mitigation and Air Quality (CMAQ) Program. CMAQ project applications were due by October 24, 2025. City staff developed a list of potential projects that met the funding requirements and applications were submitted to MCAG on October 24, 2025. A Resolution supporting and implementing AB l 012 "Timely Use of Funding" is required to be adopted by the City and a copy of the Resolution provided to MCAG prior to board recommendation for funding.
A summary of the project application is listed below, with the estimated project cost shown.
1. 2025 Infill Sidewalk Improvements
This project consists of the construction of pedestrian facilities along the East side of Linden Avenue between North Avenue and Wallis Avenue and along the west side of Grove Avenue between Wallis Avenue and Meredith Avenue. The project is a "quality of life" project focused on the construction of pedestrian improvements where there are still discontinuities in the City's pedestrian infrastructure.
The total estimated project cost is $818,565.
The above-mentioned project has not been awarded funding and is still being considered by MCAG for project funding.
COMMUNITY OUTREACH
The improvements and their locations were identified in the City's adopted Active Transportation Plan (ATP). This plan was presented to the public for public comment prior to its adoption.
FISCAL IMPACT
No additional fiscal impact to Fiscal Year 2025-2026 budget. All of the federally funded projects require a local match of 11 .47%. The City can commit funds from its Measure V allocation, SB l allocation, or use other available local funds. The City would need to budget for the local match expenditures for any of the funded projects that receive funding.
STRATEGIC PLAN GOALS
This item supports Strategic Plan Goal #2- Community Based Development.
This project will improve walkability to the downtown area, as well as eliminate gaps in the City's pedestrian infrastructure.
RECOMMENDATION
Staff recommends City Council adopt the Resolution, supporting and implementing AB1012 "Timely Use of Funding".

ITEM NO. 7
COUNCIL AGENDA ITEM
NOVEMBER 18, 2025
PREPARED BY: Richard Martin, Fire Chief
SUBJECT: Fire Department Roof Repair Contract Award
STRATEGIC PLAN GOALS: 5. Robust Infrastructure
BACKGROUND
In 2024, the Gustine Fire Department solicited bids for essential repairs to the station's roof. As the facility continues to age, multiple leaks have developed, raising concerns regarding the building's structural integrity, energy efficiency, and overall safety for personnel and equipment. After a careful review and evaluation of all submitted proposals, Continental Roof Solutions was selected as the most qualified contractor based on their pricing, experience, and proven ability to perform similar municipal projects. The same contractor successfully completed the first phase of repairs, addressing a portion of the roof that was in the most critical condition.
ANALYSIS / DISCUSSION
Due to limited funding available during FY 2024-2025, the Gustine Fire Department was only able to complete repairs on approximately half of the roof. The remaining portion of the roof continues to experience leaks and deterioration, necessitating the completion of the project to fully protect the building and its contents.
For FY 2025-2026, the City budgeted sufficient funds to complete the remaining roof work. Attached is an updated estimate from Roof and Solar Solutions, the same contractor that completed the first phase, for an amount of $16,500 to complete the remainder of the repairs. Continuity with the same contractor is advantageous because they are already familiar with the structure, materials, and project specifications, which ensures consistency and efficiency in the completion of the work.
In consulting with the City Attorney, since the cost of the proposed work is less than $75,000, the City is authorized to enter into direct negotiations with the contractor without issuing a formal Request for Proposals (RFP) or engaging in a competitive bidding process. This procurement method is consistent with the California Uniform Public Construction Cost Accounting Act (CUPCCAA), as set forth in Public Contract Code $22032, and incorporated into the City's Municipal Code, Section 2-6-38. This approach provides both flexibility and efficiency in completing the necessary improvements while maintaining compliance with applicable laws and regulations.
COMMUNITY OUTREACH
Outside of this publicly noticed item, there is no community outreach for this project.
FISCAL IMPACT
In the FY 2025-2026 budget, and on the associated capital improvements project list, $25,000 was allocated for this project in the Public Safety Fund (Fund 006).
STRATEGIC PLAN GOALS
Repairing the roof of the Fire Department directly supports Strategic Plan Goal #5 Robust Infrastructure by ensuring the long-term integrity, safety, and functionality of a critical public facility. The fire station serves as an essential operational hub for emergency response, and maintaining its structural soundness is vital to sustaining reliable service delivery.
RECOMMENDATION
Staff recommends that the City Council approve the estimate received from Roof and Solar Solutions and authorize the Interim City Manager to enter into a contract to complete the Fire Station Roof project.

FOR COMPLETION OF FIRE STATION ROOF REPAIRS
WHEREAS, the Gustine Fire Department identified the need for critical roof repairs due to ongoing leaks and structural deterioration; and
WHEREAS, in 2024, the City solicited bids for roof repairs and selected Roof and Solar Solutions as the most qualified contractor based on pricing, experience, and successful completion of similar municipal projects; and WHEREAS, due to limited funding in Fiscal Year 2024--2025, only the most critical portion of the roof was repaired; and
WHEREAS, the City has allocated sufficient funds in the Fiscal Year 2025-2026 Budget to complete the remaining roof work; and
WHEREAS, Roof and Solar Solutions has submitted an updated estimate in the amount of $16,500 to complete the remaining repairs; and WHEREAS, pursuant to the California Uniform Public Construction Cost Accounting Act (CUPCCAA) and the City's Municipal Code Section 2-6-38, the City may directly negotiate with a contractor for public works projects under $75,000 without a formal bidding process; and

SUBJECT: Adopt Resolution Supporting the City of Gustine's Submission of a Candidate Project for the 2025 MCAG Regional Measure V "Call for Projects" for the East Ave, Hunt Road, and Sullivan Road Rehabilitation Project
STRATEGIC PLAN GOALS: 5. Robust Infrastructure
BACKGROUND/DISCUSSION
The Merced County Association of Governments (MCAG) is in the process of updating the Measure V Implementation Plan funding allocations for fiscal years through 2029 /30.
MCAG initiated a Call for Projects on September 3, 2025. Regional Measure V project applications were due by October 3, 2025. City staff developed a project scope for an application that met the criteria for regional Measure V funding consideration and that application was submitted to MCAG on October 3, 2025. A Resolution supporting the submission of the East Ave, Hunt Road, and Sullivan Road Rehabilitation Project (summarized below) is required to be adopted by the City and a copy of the Resolution provided to MCAG.
A summary of the project application is listed below, with the estimated project cost shown.
1. East Ave, Hunt Road, and Sullivan Road Rehabilitation:
This project consists of the rehabilitation of pavement within the East Avenue and Sullivan Road corridors. Improvements would begin at the North end of East Avenue where the roadway intersects with SR-140, then continue South to the Hunt Road intersection. Project improvements would continue South on Hunt Road to the intersection of Sullivan Road where the improvements would head West on Sullivan Road terminating at the bridge near the intersection of SR33/ l 40 and Sullivan Road. The improvements would include non-capacity increasing roadway rehabilitation treatments to the existing roadway. The estimated total project cost is $ 3,600,000.
The above-mentioned project has not been awarded funding and is still being considered by MCAG for project funding.
COMMUNITY OUTREACH
The proposed project has been discussed in open session during previous City Council Meetings. The community has vocalized their support for rehabilitating the pavement within these corridors.
FISCAL IMPACT

COUNCIL AGENDA ITEM
NOVEMBER 18, 2025
PREPARED BY: Mike Brinkman, Building Official
SUBJECT: Adopt Updated Ordinance relating to the California Code of Regulations Title 24, 2025 Edition of the California Buildings Standards Code.
STRATEGIC PLAN GOALS: 2. Community-Based Development
BACKGROUND
The model codes are updated every three years. This allows the codes to improve and adjust to the newest materials, methods of construction and technological advances in the industry. The California Building Standards Commission adoption of the 2025 code comes after a comprehensive multi-state agency and stakeholder update of the 2022 building codes.
The objective is to produce a practical building code that ensures public safety first and foremost while implementing the most efficient technology available to conserve the state's natural resources and energy use. California's building code is applied to virtually every commercial and residential structure in the state.
ANALYSIS/DISCUSSION
The new 2025 California Building Standards Code contains thirteen parts that incorporate public health, life safety, and general welfare standards used in the design and construction of buildings in California. These parts incorporate the latest national standards in the International Building, Residential and Fire Codes, California Green Building Code, California Energy Code, National Electrical Code, and the Uniform Mechanical and Plumbing Codes.
Along with the usual Energy and Green code updates, below are a few noteworthy updates:
• New Part 7 stand-alone code book for Wildland-Urban Interface (WUI), was Chapter 7 A in the CBC.
• The Energy and Green codes continue to expand Electric Vehicle Charging requirements to install EV charging infrastructure including receptacles and chargers to new multifamily dwellings, single family homes, hotels, and motels. • Electric-Ready Buildings
• The code encourages electric-ready buildings to facilitate future adoption of cleaner electric technologies for cooking and water heating.
Health and Safety Code Section 18941 .5 mandates that the Building Standards contained in the 2025 California Building Standards Code shall be effective 180 days after publication by the California Building Standards Commission. If these codes are not adopted by ordinance, they become effective by default without any amendments. The proposed effective date for the City of Gustine will be January 1, 2026.
COMMUNITY OUTREACH
As part of the adoption process this department has made every effort to notify all the parties affected of the proposed changes.
FISCAL IMPACT
None.
STRATEGIC PLAN GOALS
An important part of Community Development is assurance that building within the City follows the appropriate building codes. Therefore, this action falls under Strategic Goal #2: Community-Based Development.
RECOMMENDATION
It is recommended that the City Council hold a public hearing and waive the first reading of an ordinance amending Title Four, Chapter Four, Article 2, Section 31 to the City of Gustine Municipal Code, and adopting by reference, The California Code of Regulations Title 24, 2025 Edition of the California Building Standards Code.

ITEM NO. 10
COUNCIL AGENDA ITEM
NOVEMBER 18, 2025
PREPARED BY: Ruben Chavez, Chief of Police
Aaron Chandler, Associate Attorney, Best Best & Krieger SUBJECT: Request to Adopt New Parking Violation Fine Schedule Pursuant to 40203.5 eve and Waive the First Reading
STRATEGIC PLAN GOALS: 4. Financial and Budget Stability
BACKGROUND
When a parking violation occurs in the City of Gustine, Gustine Police Officers/Community Service Officers have the discretion to either issue an administrative citation or a parking citation enforcing the California Vehicle Code {CVC). The authorities which regulate vehicle code violations are listed under Vehicle Code Sections 40200 to 40230. The sections are specific to local municipalities to issue and update fine schedules. Keeping up with statutory changes provides an avenue for municipalities to keep fines current with contemporary standards. A review of current state regulations and supporting case law give the City broader discretion to update and enforce vehicle code violations.
ANALYSIS/DISCUSSION
The entire purpose of revising the City's ordinances and resolutions regarding fines, and penalties is to ensure the City of Gustine is implementing best practices and procedures when enforcing their rules and regulations. Increasing fines, fees, and penalties are not only allowed and regulated by statute, it allows the City discretion to determine appropriate amounts for deterrence and punishment as allowed by law.
The City's intent is to ensure the fines, fees, and penalties are commensurate with the level of severity of the offense, the violator's culpability, and the violator's ability to pay the fine, fee, and penalty.
The California Vehicle Code Authority Section for updating the penalty schedule:
40203.5. eve
{a) The schedule of parking penalties for parking violations and late payment penalties shall be established by the governing body of the jurisdiction where the notice of violation is issued. To the extent possible, issuing agencies within the same county shall standardize parking penalties.
{b) Parking penalties under this article shall be collected as civil penalties. (c) () Notwithstanding subdivision {a) the penalty for a violation of Section 22507 .8 or an ordinance or resolution adopted pursuant to Section 22511 .57 shall be not less than two hundred fifty dollars ($250) and not more than one thousand dollars ($1,000).
(2) The issuing agency may suspend the imposition of the penalty in paragraph { l), if the violator, at the time of the offense, possesses but failed to display a valid special identification license plate issued pursuant to Section 5007 or a
distinguishing placard issued pursuant to Section 22511 .55 or 22511 .59. (3) A penalty imposed pursuant to this subdivision may be paid in installments if the issuing agency determines that the violator is unable to pay the entire amount in one payment.
40203.6.
(a) In addition to an assessment levied pursuant to any other law, an additional assessment equal to 10 percent of the penalty established pursuant to Section 40203.5 shall be imposed by the governing body of the jurisdiction where the notice of parking violation is issued for a civil violation of any of the following:
(1) Subdivisions (b), (c), and (d) of Section 4461.
(2) Subdivision (c) of Section 4463.
(3) Section 22507.8.
(4) An ordinance or resolution adopted pursuant to Section 22511.57. (5) Section 22522.
(b) An assessment imposed pursuant to this section shall be deposited with the city or county where the violation occurred.
State Laws also require assessment to fines which are ultimately transferred to the County and State to support specific funds. In short, each parking citation issued results in a total of $12.50 being assessed. The graph below displays the funds and amounts required.
Description of Collection Type Amounts
County - General Fund Pkg Assessment $2.00
County - Courthouse Construction Fund $1.50
County -- Criminal Justice Facilities Construction Fund $1.50 State - Immediate & Critical Needs Construction Fund $3.00 State - Court Facilities Construction Fund $1.50
State - Trial Court Trust Fund $3.00
Total Due for Each Parking Citation Issued $12.50
The effect of the penalty should act as a deterrent from future similar conduct. This will avoid the fine from becoming "the cost of doing business" where the violation remains despite the fine being paid. Although there are increases in fines, fees, and penalties, City staff have discretion to determine appropriate fine amounts for each violation.
The recent approval of the City of Gustine contracting with Data Ticket has increased processing costs. While the parking citation services were previously handled by Duncan Solutions, Inc and administrative citation services handled in-house, the new company will provide a complete wrap-around solution for our processing needs. This will save a tremendous amount of staff time. However, given the work needed, the costs will increase expedientially.
The following graph displays the costs involved with processing parking violation citations only. Not every cost will be included, however those requiring extra attention and the times where collections are required, will further increase costs. There is a minimum charge which if not reached (i.e.- low number of citations needing to be processed), will be invoiced by the vendor.

Once the services are fully implemented, the amount received for each fine will not cover the costs owed to the County, State, and services provided. In short, the costs of doing business will be severely underfunded. The current fine schedule (not comprehensive) for eve violations is listed in graph below. The fines range from $20, $50, $250.

In comparison, the City of Livingston recently updated their bail schedule, also at times referred to as the fine schedule, which allows their agency the ability to recoup the costs of issuing citations. The graph displays some of the more common violations listed on the citation books. In short, the fines range from $28, $197, $238, $490, to $1,105. The bail schedule is consistent with the spirit of 20203.5 (a) eve which standardizes fines in the county.

As required by law, prior to adoption of resolution and for transparency, the City Council will hold a public hearing. The City Council will review staff recommendation for amendments its fine schedules for violations of parking violations. These changes and amendments will assist the City in updating their procedures consistent with applicable federal and state laws.
As mentioned previously, the fines have not increased in approximately 30 years. After review, it is recommended the City Council review the proposed fine increases.
Keeping the fine structure similar to its current form with the slight increases will ensure a fair and simplistic increase.
Pursuant to 40203.5 (a) eve, it is recommended the city adopt a City standardize fine penalties within the County. Based on the County of Merced and City of Livingston's fine penalties, the City should adopt a similar fine structure.
Staff is working with legal to propose revisions to the City's municipal code for council to review and consider at a future meeting, the purpose of this item is to propose increases to the city's vehicle code fines as allowable by statute.
COMMUNITY OUTREACH
The City will notice this agenda item prior to any council discussion to ensure any member of the public desires to provide input prior to or during the City Council Session.
FISCAL IMPACT
The fiscal impact is not precisely known, however the intent it to ensure the City is recouping all associated fees/costs with managing the processing of this legal task.
Dependent on City Councils approval, the budget and sustainability will improve.
STRATEGIC PLAN GOALS
The ability to recoup costs associated with enforcing parking and municipal code violations ensures for budget and financial stability for the agency. The City recently approved a contract for the processing of citations and with the current fine structures.
With the current outdated fine structure, the budget is estimated to be negatively impacted.
RECOMMENDATION
Given it has been 30 years since the municipal code fine schedule was updated, it is recommended council consider approving an increase to the city's current bail schedule pursuant to 20203.5 eve and in the spirit of 20203.5 (a) eve be standardized with the County of Merced bail schedule.
