ITEM NO. 4
COUNCIL AGENDA ITEM
DECEMBER 2, 2025
PREPARED BY: Desirae Porras, Acting Deputy Clerk
SUBJECT: Amend and Approve Administrative Assistant Job Description to Align with SB 1100 Requirements
STRATEGIC PLAN GOALS: 6. Community Services
BACKGROUND/DISCUSSION
On September 28, 2024, Governor Newsom signed SB 1100, a new law that makes it illegal for employers to require a driver's license for positions that do not require driving as normal part of the classification's duties. Many jobs in California have traditionally required a driver's license, but this law aims to prevent unfair discrimination against people who do not possess the license.
Under SB 1100, an employer can only state that a driver's license is required if:
1. Driving is actually part of the job, and
2. An alternative way of getting around (like public transit) would not be practical in terms of time or cost for the employer.
The City conducted a review of its current classification job descriptions, and has discovered that the current job description for Administrative Assistant includes language requiring a driver's license, even though driving is not an essential duty for that position. To comply with SB 1100, the City must update this job description to remove or revise the requirement.
By Council approving and allowing the Administrative Assistant job description to be amended you are ensuring the City remains legally compliant, reduces liability and supports fair and lawful hiring practices.
COMMUNITY OUTREACH
None, aside from this publicly noticed agenda item.
FISCAL IMPACT
There is no fiscal impact in amending the job description.
STRATEGIC PLAN GOALS
This item aligns with Goal #6 -Community Services, objective 2, maintain current level of staff to ensure public services are consistent.
RECOMMENDATION
Staff recommends City Council approved the job description as amended.

DECEMBER 2, 2025
PREPARED BY: Olivia Clark, City Attorney
SUBJECT: City Manager Employment Agreement
STRATEGIC PLAN GOALS: 6. Community Services
BACKGROUND AND DISCUSSION
In late Summer 2025, the then-City Manager gave notice that he would be vacating his position, effective October 2025. Shortly after, the City opened a recruitment for the City Manager position and widely distributed the call for applicants. The City received a number of applications and, after initial review, interviewed a select number of candidates.
The Council deliberated and instructed the City Attorney to make an offer and negotiate with the Council's chosen candidate and current Interim City Manager, Melanie Correa, due to her experience with the City, proven abilities in the role of City Manager, professionalism, and overall compatibility with the City's needs. Staff prepared a contract in accordance-with the Council's instruction and Mrs. Correa accepted.
The contract is not final until the Council approves it. If approved, the contract will be effective January l, 2026. The proposed contract for City Manager is now provided for the Council's review and approval.
FISCAL IMPACT
The City Manager is a budgeted-for position in the City's annual budget.
STRATEGIC PLAN GOALS
Securing a City Manager is relevant and essential to every strategic plan goal and for the effective running of the City.
RECOMMENDATION
Staff recommends that the Council approve the resolution appointing City Manager, approving the proposed contract for City Manager with Melanie Correa, and authorizing Mayor to execute contract on City's behalf.

5. PERFORMANCE EVALUATION
A. Annual performance evaluations are an important way for the City Council and City Manager to ensure effective communications about expectations and performance. 6. TERM
A. The term of this Agreement shall be from January 1, 2026 to January 1, 2029, or until terminated by either Party in accordance with this Agreement, with an optional two-year extension, under the same terms as this Agreement, that may be exercised upon mutual agreement of both Parties. Any such increases or bonuses are subject to the discretion of the Council. Even a satisfactory performance evaluation does not guarantee City Manager any increase in compensation. Any salary increase awarded will be made effective in February.
C. The City Council may also review the City Manager's base salary rate annually for any appropriate positive adjustments during the annual evaluation of the City Manager's performance.

PREPARED BY: Mario B. Gouveia, City Engineer
SUBJECT: A Resolution of the City Council of the City of Gustine Approving the Proposal from LiquiVision for Inspecting and Cleaning the Water Storage Tank and Authorizing the Interim City Manager to Execute an Agreement with LiquiVision in the Amount of $12,292.52 STRATEGIC PLAN GOAL: 5. Robust Infrastructure
BACKGROUND
The City of Gustine owns and operates a 75,000-gallon elevated water storage tank.
Inspection and cleaning of water tanks is regulated by a variety of state and federal entities including the American Water Works Association, the California Water Works Standards, and the Environmental Protection Agency. Water tanks should be inspected at least once every five years. The City's water tank was last inspected over five years ago and is due for an inspection and cleaning. Cleaning will include the interior walls and floor and will be performed by divers. Divers will video the work and record voice communication. All work recorded will be provided to the City with the inspection report.
ANALYSIS/DISCUSSION
City staff researched the availability of companies that provide water storage tanks inspection and cleaning services. The City reached out to LiquiVision as they had performed these services for the City in the past. City staff requested and obtained a proposal from LiquiVision for $12,292.52.
COMMUNITY OUTREACH

We are pleased to provide you the following firm quotation and outline of the conditions of our services.
QUOTE SUMMARY:
This quote will follow AIA Format.
Please see the_explaination of our services. You will have the option to choose which service to have completed by initialing the box provided. This quote is vailid for up to 90 days. Retumedsiqned quote are valid for up to 1 year. They are as follows:
1. Base service: Cleaning the reservoir floor and full inspection of reservoir. This is to remove all sediment and/or debris from the floor bottom. Quotes are based on a variety of factors that pertain to the length of time it takes to complete the work. The main consideration is the amount of sediment to be removed. This is based on up to 2" of normal sediment. Our cleaning procedure is accomplished by utilizing our proprietary vacuum cleaner, the "LiquiVac™" (Patented). The LiquiVac" pumps an average of 200 gallons per minute. It has a rotating soft bristle brush that scrubs the floor or wall clean and removes all sediment and without creating turbidity in your tank.
This is the only way to ensure that all biofilm is removed from the interior surfaces without getting any of it mixed into the water column. This system also enables us to clean walls due to the fact that the suction holds the device to the wall and the rotating brush propels it around the reservoir.
No other competitor can provide this level of service. Base Service will also include A comprehensive inspection performed documenting the condition of the entire structure that is also recorded on a USB flash drive. Written documentation with digital pictures, descriptions of the images and any recommendations will be provided to the District on the USB flash drive as well.
See Pg. 2
2. Additional Service #1: Is the cleaning of the reservoir walls. Wall cleaning is highly recommended because a very light accumulation of sediment will still insulate bacteria from disinfectant in the water. Wall cleaning uses same method as floor cleaning and uses water suction in combination with a rapidly rotating brush. No other competitor can provide this level of service.
3. Additional Service #2 Coating repair in steel tanks, we use a two part underwater epoxy. Each rust nodule or area of coating defect is wire brushed to bare metal and epoxy is applied over the area. The epoxy chemically bonds to the steel, displaces water, and remains intact with a greater bond than the original coating. All of our repair, sealing and coating materials meet or exceed NSF 60 & 61 standards.
Crack repair in concrete tanks, we use a two part underwater epoxy or Manus. For large cracks, holes are drilled at a 45 degree angle from the surface into the crack then epoxy or cement is injected into the crack. All of our repair, sealing and coating materials meet or exceed NSF 60 & 61 standards.

2. Base Service is to remove all sediment and/or debris from the floor of the reservoir. Quotes are based on a variety of factors that pertain to the length of time it takes to finish our work. The main consideration is the amount of sediment to be removed. This quote is based on up to 2" of nonnal sediment. Cleaning includes water suction to remove sediment and debris and includes scrubbing of the surface with a rapidly rotating brush. The brush is needed to ensure that any biofilm on the surface is removed. No other competitor can provide this level of service.
3. Base Service includes complete inspection of the reservoir. A final and comprehensive inspection will be performed documenting the condition of the entire structure and recorded on USB flash drive. 6. Additional service #2: Any epoxy or other chemical substance used for repairs or retrofits will comply with and be certified by NSF 60 &61 for use in potable water.
EXCLUSIONS OR ADDITIONAL CHARGES:
1. Quotes for cleaning assume that the sediment is normal material (such as silt, flocculated material, insects, manganese, rust, etc.) found in potable water tanks that is easily removed by our vacuum system. If the sediment is difficult to remove such as large amounts of concrete chips, gravel, sand, rocks, detached coating debris, etc., then our hourly rate of $795 shall apply for each hour (over the first hour) for removing this material. If our divers come into contact with or locate any hazardous materials in or around the tank that may prevent us from completing the job, will result in a full charge of total bill plus an additional fee determined bv severietv.
2. Unless specified in quote detail we clean all submerged horizontal and angled berms or sloped surfaces 35 degrees or less. Surfaces exceeding this angle such as the walls can be cleaned but must be listed separately in the quote detail or estimated by the divers upon inspection. We do not clean surfaces that are out of the water.
3. If any information provided to us is incorrect or if any problems exist that inhibit our ability to complete the job on a timely schedule, then we will notify you of the problem and reserve the right to add on to the quote based on our estimate of the additional time it will take to complete the work. Charges for time delays are $795 per hour. This paragraph only applies to any problems that are your responsibility (i.e. tank not ready (water level too low) rescheduling with less than 2 business days notice, ect.) If the district cancels work on the scheduled day or upon the team's arrival onsite, a full invoice will be issued. In the event our work truck and trailer can not be driven close enough to the reservoir to do the work then we will have to remove our Diver Control System and carry it to the entry point. This is called "Going Remote". Charge for going remote (if required and not addressed in advance) is $795 per hour. (Page 4)

ITEM NO. 7
COUNCIL AGENDA ITEM
DECEMBER 2, 2025
PREPARED BY: Jami Westervelt, Economic & Community Development Director SUBJECT: Lease of portion of City-Owned Parcel 020-044-017 STRATEGIC PLAN GOALS: 4. Financial and Budget Stability
BACKGROUND
On November 4, 2025, the Council provided direction to staff to bring back a lease agreement for a portion of City-owned parcel 020-044-017 that Gustine Depot Garage has expressed interest in leasing.
The portion of the parcel for lease is the back portion of the same parcel that houses the Gustine Museum, which is run by the Gustine Historical Society (see Exhibit C).
ANALYSIS/DISCUSSION
The attached agreement (Exhibit B) was constructed through consultation with the City Attorney on terms. The lease calls for the following:
• Five-year initial timeframe
• Annual escalation of monthly lease payment amount
• Potential, but not automatic, annual extensions for up to an additional five years While Depot Garage requested a ten-year initial lease, a shorter term provides nearfuture certainty for Depot but allows the City time to discuss in greater depth other potential uses for the space, which could include use related to the Gustine Museum by the Gustine Historical Society or other City or public benefit uses.
As Depot currently utilizes the space, this lease agreement would require Depot to begin rent payments immediately and still allow the City to hold discussions on best use of the space long term. A five-year timeframe provides the City sufficient time to hold discussions but gives Depot Garage sufficient time to come up with alternatives for its operations, should the City decide to utilize the space in another way in the future.
The City regularly includes escalation amounts in its leases to help recover increases in costs the City faces and this lease includes escalation. This lease mirrors other current City leases with an annual escalation of 5%.
In addition to the rental payment, the lease also seeks to address lapse of payment of rent for the property in recent years. Current cashiering software records going back to 2013 do not show any rent payments back to that time period. In discussions with Depot Garage, they did not dispute this as a reasonable timeframe to establish back rent.
Therefore, while this lease addresses rent payment amounts over the five years, it also
calls for repayment of a significant portion of unpaid rent going back to 2013. The tenant will be required to make two payments monthly: One for the current lease and one as part of a payment plan to recover unpaid rent as agreed upon.
In consideration of the improvements made at the property by Depot, most specifically the paving, the Council may credit some of that work toward the back payment amount. While the work was not approved by the City prior to construction, it does decrease the amount of maintenance on that potion of the property and provide some benefit to the City. The City owns those improvements as part of the property (also addressed in the lease) and the building inspector has inspected them.
The attached draft lease document makes, what staff believes to be, a reasonable allowance for the improvements on the property and reduces the back rent obligation accordingly. The payment plan for back rent calls for full repayment of the back rent within the five-year period of the agreement. It calls for the tenant to pay any remaining back rent upon termination of the lease if this occurs prior to full payment at the end of year five term.
The attached was crafted in consideration of questions and comments at the Nov. 4 Council meeting and in discussions with Depot Garage. If the Council seeks to address recovery differently in any way, or wishes to make any other changes to any portion of the attached lease draft, council members can direct staff at the meeting to incorporate any changes agreeable to the Council into the lease agreement.
COMMUNITY OUTREACH
None applicable.
FISCAL IMPACT
The attached lease provides a dependable income from this portion of this property with few maintenance costs.
STRATEGIC PLAN GOALS
This item falls under Goal #4 of the City Strategic Plan. Specifically, providing an ongoing revenue source.
RECOMMENDATION
